R. 906</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250429">April 29, 2025</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To direct the Federal Communications Commission to publish a list of entities that hold authorizations, licenses, or other grants of authority issued by the Commission and that have certain foreign ownership, and for other purposes.</official-title></form><legis-body id="H1DD35312891B434198278DA295B25B01" style="OLC"><pagebreak></pagebreak><section id="HDBF57EE5A4104FAABD268A37A0FA6C94" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Adversary Communications Transparency Act</short-title></quote>.</text></section><section id="H5D78FA797E4F4643AEE85D6F6DA661E3"><enum>2.</enum><header>List of entities holding FCC authorizations, licenses, or other grants of authority and having certain foreign ownership</header><subsection id="HEA354F2AABA14160BFA30F21077EBB5E" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Commission shall publish on the internet website of the Commission a list of each entity—</text><paragraph id="HA8293DF299D641AF857B7D54B2CE7BB1" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">that holds a license issued by the Commission pursuant to—</text><subparagraph id="HC37E39E8209348CBB124CE6AC074EA70" commented="no"><enum>(A)</enum><text>section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>); or</text></subparagraph><subparagraph id="HCC823859947647F48324BDD0BE99F4FA" commented="no"><enum>(B)</enum><text>the Act of May 27, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/47/34">47 U.S.C. 34 et seq.</external-xref>; commonly known as the <quote>Cable Landing Licensing Act</quote>) and Executive Order 10530 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; relating to the performance of certain functions vested in or subject to the approval of the President); and</text></subparagraph></paragraph><paragraph id="HE6C5630575294A7792BE70D60462A8A6" commented="no"><enum>(2)</enum><text>with respect to which—</text><subparagraph id="H22587AEDEE9D4AD7834E30A0F9240F14" commented="no"><enum>(A)</enum><text>a covered entity holds an equity or voting interest that is required to be reported to the Commission under the ownership rules of the Commission; or</text></subparagraph><subparagraph id="H942EF490FFB044B6AB606FA19D7E9C38" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">an appropriate national security agency has determined that a covered entity exerts control, regardless of whether such covered entity holds an equity or voting interest as described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H632E3BF575C6455AA05281FE3C6765EB"><enum>(b)</enum><header>Rulemaking</header><paragraph id="HCCB2FB6899854C3A80CB95D067B9403D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commission shall issue rules to obtain information to identify each entity—</text><subparagraph id="H866742E3BEE84CFB8962E39932091E57"><enum>(A)</enum><text>that holds any authorization, license, or other grant of authority issued by the Commission (other than a license described in subsection (a)(1)); and</text></subparagraph><subparagraph id="H71DF3E57B3444A769347881545A1938C"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to which a covered entity holds an equity or voting interest that is required to be reported to the Commission under the ownership rules of the Commission.</text></subparagraph></paragraph><paragraph id="H44BD4C2BF0C44B2490821C8D32B22C01"><enum>(2)</enum><header>Placement on list</header><text>Not later than 1 year after the Commission issues the rules required by paragraph (1), the Commission shall place each entity described in such paragraph on the list published under subsection (a).</text></paragraph></subsection><subsection id="H48371768A2F94ADE968BDC428D55A5F1"><enum>(c)</enum><header>Paperwork Reduction Act exemption</header><text>A collection of information conducted or sponsored by the Commission to implement this section does not constitute a collection of information for the purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></subsection><subsection id="HA5955680866E40379602066E004B4A7F"><enum>(d)</enum><header>Annual updates</header><text>The Commission shall, not less frequently than annually, update the list published under subsection (a), including with respect to any entity required to be placed on such list by subsection (b)(2).</text></subsection><subsection id="HF41B1A10DCCA454E83A28E57DF870351"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9549CC7C4347487FA200F2AC0C1C0424"><enum>(1)</enum><header>Appropriate national security agency</header><text display-inline="yes-display-inline">The term <quote>appropriate national security agency</quote> has the meaning given such term in section 9 of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1608">47 U.S.C. 1608</external-xref>). </text></paragraph><paragraph id="H41C3A4FC04DB47FDBFFD8FA93F278024"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text></paragraph><paragraph id="H53D3E0F753504B3EAA916F0B4E8F13A5"><enum>(3)</enum><header>Covered country</header><text display-inline="yes-display-inline">The term <quote>covered country</quote> means a country specified in section 4872(f)(2) of title 10, United States Code.</text></paragraph><paragraph id="H0B1549B7C8F5422BB61B5FEB04BB75E1"><enum>(4)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means—</text><subparagraph id="H8EAED62B6A394A1C911415172ED8F06E"><enum>(A)</enum><text>the government of a covered country;</text></subparagraph><subparagraph id="H12874728B1AF49AE98C8E00C7D10BB11"><enum>(B)</enum><text display-inline="yes-display-inline">an entity organized under the laws of a covered country; and</text></subparagraph><subparagraph id="HCECCB1E25BD84C159FFC1BC83CB932DA"><enum>(C)</enum><text>a subsidiary of an entity described in subparagraph (B), regardless of whether the subsidiary is organized under the laws of a covered country.</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20250428" chamber="House">Passed the House of Representatives April 28, 2025.</attestation-date><attestor display="yes">Kevin F.
