which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize grants to implement school-community partnerships for preventing substance use and misuse among youth.</official-title></form><legis-body id="H3FB187AABC15447593B881EC8368676D" style="OLC"><section section-type="section-one" id="H9127633913764B2880BA6756D4AE80EE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Drugs Out of Schools Act of 2025</short-title></quote>.</text></section><section id="HB587DCD8B0354EF991046C7A8E37E6D5"><enum>2.</enum><header>Grant program</header><subsection id="H7FA2976465AD47CFBE95CB5BEB1DBA59"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H87BA5F7C45744227B97BECAB947EAC3C"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of National Drug Control Policy.</text></paragraph><paragraph id="HAFEC697D15BC468D89D14479D26D04DE"><enum>(2)</enum><header>Drug-Free Communities funded coalition</header><text>The term <term>Drug-Free Communities funded coalition</term> means a recipient of a grant under section 1032 of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1532">21 U.S.C. 1532</external-xref>).</text></paragraph><paragraph id="H8146C2C9ABD448EAA1C5B232241C039E"><enum>(3)</enum><header>Effective drug prevention programs</header><text>The term <term>effective drug prevention programs</term>, with respect to a school-community partnership between a Drug-Free Communities funded coalition and a local school, means strategies, policies, and activities that—</text><subparagraph id="H38475D932A144D7083678CCDB1FA9507"><enum>(A)</enum><text>are tailored to meet the needs of the student population of the school, based on the environment of the school and the community surrounding the school; and</text></subparagraph><subparagraph id="HC250C23A06D9482197B7E61BEAD26724"><enum>(B)</enum><text>prevent and reduce substance use and misuse among local youth.</text></subparagraph></paragraph><paragraph id="H18A7C3B17AB64DAF8751B4C0E1AAFC75"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a coalition (within the meaning of section 1032 of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1532">21 U.S.C. 1532</external-xref>)) that—</text><subparagraph id="HCE5F09AE12354C04A3679C2AA3C60A95"><enum>(A)</enum><text>receives or has received a grant under subchapter I of chapter 2 of title I of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1523">21 U.S.C. 1523 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H6C21F1CB49804538A3A854BDBEAA1DD6"><enum>(B)</enum><text>has a memorandum of understanding in effect with not less than 1 local school to establish a school-community partnership.</text></subparagraph></paragraph><paragraph id="HAFED98075AA740D8B3A315F7C543643B"><enum>(5)</enum><header>Local school</header><text>The term <term>local school</term> means an elementary, middle, or high school located in an area served by an eligible entity.</text></paragraph><paragraph id="H081A3952D18F4BCF8BD38417C68F3A54"><enum>(6)</enum><header>School-community partnership</header><text>The term <term>school-community partnership</term> means a partnership between a Drug-Free Communities funded coalition and not less than 1 local school for the purpose of implementing effective drug prevention programs.</text></paragraph><paragraph id="H5440E3874A704D9D940477FA6627A1F3"><enum>(7)</enum><header>Substance use and misuse</header><text>The term <term>substance use and misuse</term>—</text><subparagraph id="HA9C10CFF9D6F46DFA6676C3254861AD9"><enum>(A)</enum><text>has the meaning given the term in paragraph (9) of section 1023 of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1523">21 U.S.C. 1523</external-xref>); and</text></subparagraph><subparagraph id="H263A839CBE1D4765B6856A588479061E"><enum>(B)</enum><text>includes the use of electronic or other delivery mechanisms to consume a substance described in subparagraph (A), (B), or (C) of that paragraph.</text></subparagraph></paragraph></subsection><subsection id="HEE0B26D910F045348794C7E0369B770A"><enum>(b)</enum><header>Grants authorized</header><paragraph id="H896FA1C92B2040639C2582029B8BF993"><enum>(1)</enum><header>In general</header><subparagraph id="H889ACC1FC6604DBBA03A4C5B672274F8"><enum>(A)</enum><header>Initial grants</header><text>Subject to paragraph (2), the Director may award grants to eligible entities for the purpose of implementing a school-community partnership.</text></subparagraph><subparagraph id="HA259EDDDAFD14336AFB79E8DD23717F1"><enum>(B)</enum><header>Renewal grants</header><text>Subject to paragraph (2), the Director may award to an eligible entity who has received a grant under subparagraph (A) an additional grant for each fiscal year during the 3-fiscal-year period following the fiscal year for which the grant was awarded under subparagraph (A), for the purpose of continuing the school-community partnership.</text></subparagraph></paragraph><paragraph id="HA4F3C562AC284842AE230769F0CE15F2"><enum>(2)</enum><header>Limitations</header><subparagraph id="H06EFBA49ACB74E92878F1DDF1A6913AD"><enum>(A)</enum><header>Amount</header><text>The amount of a grant under this subsection may not exceed $75,000 for a fiscal year.</text></subparagraph><subparagraph id="HD40EDBA0159C4A34BD0DCDF502DF9CC2"><enum>(B)</enum><header>Recipients</header><text>Not more than 1 eligible entity may receive a grant under this subsection to establish a school-community partnership with a particular local school.</text></subparagraph></paragraph></subsection><subsection id="HEEB0DAEAB0EE43378568192F15DC9ADC"><enum>(c)</enum><header>Interagency agreement</header><text>The Director may enter into an interagency agreement with a National Drug Control Program agency, as defined in section 702 of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701</external-xref>), to delegate authority for—</text><paragraph id="H8A3A7CA0D3D6416E8EEDC606A7E897DD"><enum>(1)</enum><text>the execution of grants under this section; and</text></paragraph><paragraph id="HF4F4461F0AC248A2A9A4AF11B41C6074"><enum>(2)</enum><text>other activities necessary to carry out the responsibilities of the Director under this section.</text></paragraph></subsection><subsection id="H3755D9A38A794E8D8A319CEB8FA571F8"><enum>(d)</enum><header>Application</header><paragraph id="H3F744DD484B843A4A4F93189376B6E77"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under this section, in coordination with each local school with which the eligible entity has a school-community partnership, shall submit to the Director an application at such time, in such manner, and accompanied by such information as the Director may require.</text></paragraph><paragraph id="H8B404539FAB848CBB4ED9D2C29168798"><enum>(2)</enum><header>Plan</header><text>The application submitted under paragraph (1) shall include a detailed, comprehensive plan for the school-community partnership to implement effective drug prevention programs.</text></paragraph></subsection><subsection id="HE95A4B228F2C40ACAC7739FB26626803"><enum>(e)</enum><header>Use of funds</header><paragraph id="H28EB53A254A34FAB95047301ABAF13C0"><enum>(1)</enum><header>In general</header><text>An eligible entity receiving a grant under this section shall use funds from the grant—</text><subparagraph id="H8E553CAC645D4F4C85B0AD120A202350"><enum>(A)</enum><text>to implement the plan described in subsection (d)(2); and</text></subparagraph><subparagraph id="HCE5198A16BC347CAB67696943A2706C4"><enum>(B)</enum><text>if necessary, to obtain specialized training and assistance from the organization receiving the grant under section 4(a) of <external-xref legal-doc="public-law" parsable-cite="pl/107/82">Public Law 107–82</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/21/1521">21 U.S.C. 1521</external-xref> note).</text></subparagraph></paragraph><paragraph id="H39464A3B8B204790BB830F3EC8B979AB"><enum>(2)</enum><header>Supplement not supplant</header><text>Grants provided under this section shall be used to supplement, and not supplant, Federal and non-Federal funds that are otherwise available for drug prevention programs in local schools.</text></paragraph></subsection><subsection id="H9D99F3DC8CF6422690C55E97DE6A91EB"><enum>(f)</enum><header>Evaluation</header><text>Section 1032(a)(6) of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1532">21 U.S.C. 1532(a)(6)</external-xref>) shall apply to a grant under this section in the same manner as that section applies to a grant under subchapter I of chapter 2 of subtitle A of title I of that Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1531">21 U.S.C. 1531 et seq.</external-xref>).</text></subsection><subsection id="H6E477B58099C45349281BC0C3861F97C"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="HAEA18E87B376479080B9E9EECCB1EE1F"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to carry out this section $7,000,000 for each of fiscal years 2026 through 2031.</text></paragraph><paragraph id="HBE509449514649FCA910E19950462A1F"><enum>(2)</enum><header>Administrative costs</header><text>Not more than 8 percent of the funds appropriated under paragraph (1) may be used by the Director for administrative expenses associated with the responsibilities of the Director under this section.</text></paragraph></subsection></section></legis-body></bill>
