R. 886</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250131">January 31, 2025</action-date><action-desc><sponsor name-id="R000619">Mr. Rulli</sponsor> (for himself, <cosponsor name-id="G000546">Mr. Graves</cosponsor>, and <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Administrator of the Small Business Administration from garnishing social security benefits with respect to certain named individuals of covered loans who are victims of identity theft, and for other purposes.</official-title></form><legis-body id="H98C74FD8094C445E9EB7D0427A580550" style="OLC"><section id="H0B207502F97E4A7F926633DB7D56F7F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Beat Bad Bureaucrats Act</short-title></quote>.</text></section><section id="HD0BC1883B8EF46FE83B91DDFD6A0EE57"><enum>2.</enum><header>Protection of Social Security benefits from garnishment in certain cases of identity theft</header><subsection id="H0CDB6CCD2E8A46C488EBF0BB50601EE7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 3716(c)(3)(A)(i) of title 31, United States Code, the Administrator may not, with respect to a covered loan, garnish payments made to the named individual of such covered loan under section 202 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402 et seq.</external-xref>) for the purposes of repayment of such covered loan.</text></subsection><subsection id="H1285FFDF104F4FFEA2027E96FA19AC65" commented="no"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply if the Administrator determines that the named individual is not a victim of identity theft.</text></subsection><subsection id="HA6BDB7D9E4F74C6783E2E6B9617FD3EB" commented="no"><enum>(c)</enum><header>Revision of rule</header><text>Not later than 30 days after the date of the enactment of this Act, the Administrator shall revise section 140.11(e)(1) of title 13, Code of Federal Regulations, to add to the list of notice requirements in such section information about how to report identity theft to the Administrator.</text></subsection><subsection id="HEA997935B8C549A3B727956716BE3390"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H3BD08FDB671F48A0A15B51C7E57EF283"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="H68905D5EC20D431CA0DC1BF3B8150AB1"><enum>(2)</enum><header>Covered loan</header><text display-inline="yes-display-inline">The term <quote>covered loan</quote> means—</text><subparagraph id="H0A6E3363BA784323A24BD03A3C8D62F2"><enum>(A)</enum><text>a loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>); or</text></subparagraph><subparagraph id="H8F5DA122FB4B4C07886DA6AAD8F53119"><enum>(B)</enum><text>a loan made under section 7(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) in response to COVID–19 during the covered period (as defined in section 1110(a) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>).</text></subparagraph></paragraph><paragraph id="H010BEAB992FF41F3BF2D09C744CCA8EA"><enum>(3)</enum><header>Named individual</header><text>The term <quote>named individual</quote> means an individual—</text><subparagraph id="H8D36A372DC5548058C5E007D40FF7034"><enum>(A)</enum><text>under whose name a covered loan was fraudulently made; and</text></subparagraph><subparagraph id="H1D43C715CE614C859AF83A79F2FD86DA"><enum>(B)</enum><text>that has notified the Administrator, using the procedure posted on a public website of the Small Business Administration, that such individual is a victim of identity theft with respect to such covered loan.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
