R. 87</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250103">January 3, 2025</action-date><action-desc><sponsor name-id="B001302">Mr. Biggs of Arizona</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to prohibit the Secretary of Health and Human Services from placing any vaccine for COVID–19 on the child and adolescent immunization schedule unless the Secretary has posted on the public website of the Centers for Disease Control and Prevention all clinical data in the possession of the Department of Health and Human Services relating to the safety and efficacy of such vaccine, and for other purposes.</official-title></form><legis-body id="H76AD8E5C28514140A2855F3BDA6B0B82" style="OLC"><section id="H60A0E497544B4B739034629EE28D8307" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Children from the CDC Act</short-title></quote>.</text></section><section id="HB869306835DB494D82152AFCFD0EC7FE"><enum>2.</enum><header>Posting of all clinical data for COVID–19 vaccines before placement on child and adolescent schedule</header><text display-inline="no-display-inline">Part C of subtitle 2 of title XXI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-25">42 U.S.C. 300aa–25 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H3E114F240E0A403196000E8E62CFB89D" display-inline="no-display-inline"><section id="H9755D242362743A6B744E5DD57EF1FBC"><enum>2129.</enum><header>Posting of all clinical data for COVID–19 vaccines before placement on child and adolescent schedule</header><subsection id="HF0B41F155C7D41FCBF41795CB75673B7"><enum>(a)</enum><header>No inclusion of COVID vaccines</header><text display-inline="yes-display-inline">The Secretary, and any official, agency, or office of the Department of Health and Human Services (including the Centers for Disease Control and Prevention and the Advisory Committee of Immunization Practices), shall not include any vaccine for COVID–19 on the child and adolescent immunization schedule unless the Secretary has posted on the public website of the Centers for Disease Control and Prevention all clinical data in the possession of the Department of Health and Human Services (including the Advisory Committee of Immunization Practices) relating to the safety and efficacy (including any adverse effects) of such vaccine. All such data posted under this subsection shall be deidentified to protect all individually identifiable health information, and information with respect to the agency and sponsor personnel of the data involved.</text></subsection><subsection id="H222DBB0019E94C4793C9E6AF9488E249"><enum>(b)</enum><header>Vaccines already on schedule as of enactment</header><paragraph id="H37F41A027EFF4B90A71090E20D244444"><enum>(1)</enum><header>Removal</header><text>Any vaccine for COVID–19 that is included on the child and adolescent immunization schedule as of the date of enactment of this section is hereby deemed to be removed from such schedule.</text></paragraph><paragraph id="H4064A106EF83497DAA04243BD584F98E"><enum>(2)</enum><header>Administrative action</header><text display-inline="yes-display-inline">The Secretary shall take such actions as may be necessary to effectuate the removal of a vaccine from the child and adolescent immunization schedule by operation of paragraph (1).</text></paragraph><paragraph id="H2A1688FAC84B496288C437DB27DB8EF1"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The removal of a vaccine from the child and adolescent immunization schedule by operation of paragraph (1) shall not be construed to affect the authority of the Secretary (or other officials, agencies, or offices) to place such vaccine back on such schedule so long as such placement is in accordance with subsection (a) and other applicable provisions of law.</text></paragraph></subsection><subsection id="H746BE62B63EC490191058C5FDBC7E84C"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>child and adolescent immunization schedule</term> means the child and adolescent immunization schedule of the Advisory Committee of Immunization Practices (or any successor schedule).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
