R. 854</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250131">January 31, 2025</action-date><action-desc><sponsor name-id="D000530">Mr. Deluzio</sponsor> (for himself, <cosponsor name-id="K000389">Mr. Khanna</cosponsor>, <cosponsor name-id="D000399">Mr. Doggett</cosponsor>, <cosponsor name-id="D000631">Ms. Dean of Pennsylvania</cosponsor>, <cosponsor name-id="B001296">Mr. Boyle of Pennsylvania</cosponsor>, <cosponsor name-id="G000553">Mr. Green of Texas</cosponsor>, <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>, <cosponsor name-id="C001131">Mr. Casar</cosponsor>, <cosponsor name-id="L000602">Ms. Lee of Pennsylvania</cosponsor>, <cosponsor name-id="S001215">Ms. Stevens</cosponsor>, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, <cosponsor name-id="E000296">Mr. Evans of Pennsylvania</cosponsor>, <cosponsor name-id="R000579">Mr. Ryan</cosponsor>, and <cosponsor name-id="P000620">Ms. Pettersen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to issue certain regulations to define high-hazard flammable train, and for other purposes.</official-title></form><legis-body id="H02ECDC3F20D54DD9BBEE6EAE8DC06B08" style="OLC"><section id="H5281461D02BA4655BD2511BE6DE7E9AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Decreasing Emergency Railroad Accident Instances Locally Act</short-title></quote> or the <quote><short-title>DERAIL Act</short-title></quote>. </text></section><section id="H123A362E3E1A43029F4F6105DF33467A" section-type="subsequent-section"><enum>2.</enum><header>High-hazard flammable train</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall issue such regulations as are necessary to amend section 171.8 of title 49, Code of Federal Regulations, to modify the definition of <quote>high-hazard flammable train</quote> to mean a single train transporting 1 or more loaded tank cars of a Class 3 flammable liquid or a Class 2 flammable gas and other materials the Secretary determines necessary for safety.</text></section><section id="H686B45EF839F491C9C5412E9F8E2E227"><enum>3.</enum><header>Reporting of material toxic by inhalation</header><subsection id="HC221538CFB2C4E5DAC06B917DD93E510"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/209">Chapter 209</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H03E00526E00845A2B05368B5FEEBB6A9" display-inline="no-display-inline"><section id="H105D199D77FC426DBA831AC5EB1AC693"><enum>20904.</enum><header>Reporting of accidents involving material toxic by inhalation</header><text display-inline="no-display-inline">Not later than 24 hours after any train derailment involving a train carrying material toxic by inhalation, the railroad carrier involved in such derailment shall report to the National Response Center, State officials, local officials, and Tribal governments all material toxic by inhalation on such train. </text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9C609914D139466496C45838F6260F85"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/209">chapter 209</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H77828C45D9574EA2BC3F27D93C4ACB24" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">20904.
