R. 795</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250128">January 28, 2025</action-date><action-desc><sponsor name-id="M001211">Mrs. Miller of Illinois</sponsor> (for herself, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="M001235">Mr. Moore of West Virginia</cosponsor>, <cosponsor name-id="O000175">Mr. Ogles</cosponsor>, <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>, <cosponsor name-id="T000478">Ms. Tenney</cosponsor>, <cosponsor name-id="H001052">Mr. Harris of Maryland</cosponsor>, and <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Department of Health and Human Services from treating pregnancy as an illness for purposes of approving abortion drugs.</official-title></form><legis-body id="H21A6132DD40A42FCB3630055A86B45AD" style="OLC"><section id="HEA15B4FC295A4E40B92EF33392DEB33F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnancy Is Not an Illness Act of 2025</short-title></quote>.</text></section><section id="HD921EDB2C61E45DB862B03E2FB736FB7"><enum>2.</enum><header>Prohibition against treating pregnancy as illness for purposes of approving abortion drugs</header><subsection id="HD810661034B444F680D7381BA14F31C7"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Department of Health and Human Services, including the Food and Drug Administration, shall not treat pregnancy as an illness for purposes of—</text><paragraph id="H66C34CE6334C4A6F9425FCAEE1D312EA"><enum>(1)</enum><text>approving any abortion drug under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>); or</text></paragraph><paragraph id="H3ED42DB94F664F3A920709250929709B"><enum>(2)</enum><text>imposing or maintaining any risk evaluation and mitigation strategy for an abortion drug under section 505–1 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>).</text></paragraph></subsection><subsection id="H8AF84220D1444C3A8024F8558B2D35C2"><enum>(b)</enum><header>Nullification of approvals in effect</header><paragraph id="HA7B303B8FC3A4F9986A9EB2B795AF0C5"><enum>(1)</enum><header>In general</header><text>Any prohibited approval of an abortion drug is hereby nullified.</text></paragraph><paragraph id="H60B9B44FC3A444EC83D5CF14F714C0BD"><enum>(2)</enum><header>Prohibited approval defined</header><text>In this subsection, the term <term>prohibited approval of an abortion drug</term>—</text><subparagraph id="HB7F86595361640FEB84C5BE99910DB25"><enum>(A)</enum><text>means any approval of an abortion drug under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) that relied in whole or in part on the treatment of pregnancy as illness; and</text></subparagraph><subparagraph id="HDC313DA03B624B26B0347906A53FA8E4"><enum>(B)</enum><text>includes the approval of mifepristone in effect under such section 505 on the day before the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
