<legis-type>AN ACT</legis-type> 
<official-title display="yes">To impose sanctions with respect to Chinese producers of synthetic opioids and opioid precursors, to hold Chinese officials accountable for the spread of illicit fentanyl, and for other purposes.</official-title>

<section id="HE3197B753E4F4BB78301760C391B7A20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Chinese Fentanyl Act of 2025</short-title></quote>.</text></section> <section id="HAE330040B40549E5AC10442F072432A3"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Government of the People’s Republic of China should—</text> 
<paragraph id="H924CE746E0DE48C1979E8207F4F669DC"><enum>(1)</enum><text display-inline="yes-display-inline">work with the United States Government to identify a list of unregulated chemicals used to create precursor chemicals that bear increased scrutiny;</text></paragraph> <paragraph id="HAF696442B55E4422B0E1A7489361AEA9"><enum>(2)</enum><text>require the proper labeling of chemical and equipment shipments in accordance with international rules; </text></paragraph> 
<paragraph id="H22827C7C6D2E4176963CC38690E54BF9"><enum>(3)</enum><text>immediately implement <quote>know-your-customer</quote> procedures for chemical shipments; and </text></paragraph> <paragraph id="H86736636DE3444C08139B5783BAD4B37"><enum>(4)</enum><text display-inline="yes-display-inline">direct all relevant departments and agencies, including the National Narcotics Control Commission, the Ministry of Public Security, the General Administration of Customs, and the National Medical Products Administration of the Government of the People’s Republic of China to establish new rules to crack down on precursor trafficking and enforce such rules swiftly.</text></paragraph></section> 
<section id="H237EF884E9CC4BF89A75013899AB1321"><enum>3.</enum><header>Amendments to the Fentanyl Sanctions Act</header> 
<subsection id="HB3E9B2B904B54FD3BA7B81531A6F9726"><enum>(a)</enum><header>Definitions</header><text>Section 7203(5) of the Fentanyl Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/21/2302">21 U.S.C. 2302(5)</external-xref>) is amended—</text> <paragraph id="H87364C7A12FC47CC9CA0897916CC4106"><enum>(1)</enum><text>by striking <quote>The term <quote>foreign opioid trafficker</quote> means any foreign person</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H36D58974C811423EB68686A51DEEEFE0" display-inline="yes-display-inline"><text>The term <quote>foreign opioid trafficker</quote>—</text> <subparagraph id="H01467468B520404C9D1592D5FBBDF24D"><enum>(A)</enum><text display-inline="yes-display-inline">means any foreign person</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8E6E12D5BB1E44DEB2DD3182CB8AECC3"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph> <paragraph id="HF815DAB7D0DF4E43A0C05CFA6FFC92D0"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HDAD52B176CD842C1B7132E137AD7F947" display-inline="no-display-inline"> 
<subparagraph id="HB501C25E0C64442489F2C6B576C9FFB7"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text> <clause id="H796B23CA3C3D411C85017E2627067CE1"><enum>(i)</enum><text>any entity of the People’s Republic of China that the President determines—</text> 
<subclause id="HEC213FC34BCE4DE194CA74EFD6134F6F"><enum>(I)</enum><text>produces, manufactures, distributes, sells, or knowingly finances or transports any goods described in clause (i) or (ii) of paragraph (8)(A); and</text></subclause> <subclause id="HDDDD7CA3B8EB4CC4BF3162834EC9CB13"><enum>(II)</enum><text>fails to take credible steps, including through implementation of appropriate know-your-customer procedures or through cooperation with United States counternarcotics efforts, to detect or prevent opioid trafficking; and</text></subclause></clause> 
<clause id="HFE862DDCE83248F3B432E7906BCB4226"><enum>(ii)</enum><text display-inline="yes-display-inline">any senior official of the Government of the People’s Republic of China or other Chinese political official that—</text> <subclause id="HE9113D37A36F4FB6B287D3CF5BCCF081"><enum>(I)</enum><text>has significant regulatory or law enforcement responsibilities with respect to the activities of an entity described in clause (i); and</text></subclause> 
<subclause id="H57CB1C6ADA9747D28CED2ED62142697B"><enum>(II)</enum><text display-inline="yes-display-inline">aids and abets, including through intentional inaction, opioid trafficking.</text></subclause></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF481A4984E2A4497B94BD47D27D77811"><enum>(b)</enum><header>Identification of foreign opioid traffickers</header><text display-inline="yes-display-inline">Section 7211 of the Fentanyl Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/21/2311">21 U.S.C. 2311</external-xref>) is amended—</text> 
<paragraph id="HC71BB4E80FAF4C63B0C938461ED70388"><enum>(1)</enum><text>in subsection (a)(1)(A), by adding at the end before the semicolon the following: <quote>, including whether the heads of the National Narcotics Control Commission, the Ministry of Public Security, the General Administration of Customs, and the National Medical Products Administration of the Government of the People’s Republic of China are foreign opioid traffickers</quote>; and </text></paragraph> <paragraph id="H9B7D4C12D7E24BC49CE73AC6A477CFDD"><enum>(2)</enum><text>in subsection (c), by striking <quote>5 years</quote> and inserting <quote>10 years</quote>.</text></paragraph></subsection></section> 
<section id="H89B9C568AD2D47CC95DC136BACC6AA1A"><enum>4.</enum><header>Amendments to the International Emergency Economic Powers Act and the Trading with the Enemy Act</header> 
<subsection id="H0548F858C24D4B8AAC36C770C227F0E3"><enum>(a)</enum><header>Periodic evaluation</header><text display-inline="yes-display-inline">Section 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HBBA9C011F4BA46E19713CEBCB50B4692" display-inline="no-display-inline"> <subsection id="H34E0DFE77D9B4386B2B9AD8A32705D8E"><enum>(d)</enum><header>Periodic evaluation</header> <paragraph id="H37B2D959AACB414CAEA2CD27CBC564C8"><enum>(1)</enum><header>In general</header><text>If the authority granted to the President under this section is exercised with respect to a covered national emergency, the President shall transmit to the appropriate congressional committees, not less frequently than annually, a periodic evaluation in writing that—</text> 
<subparagraph id="H4FB4AE270702482CBC068AD4CC71740E"><enum>(A)</enum><text>assesses the effectiveness of the exercise of such authority in resolving the covered national emergency;</text></subparagraph> <subparagraph id="H4B7A9387D94F4540B9B53D6D5F7381A4"><enum>(B)</enum><text>considers the views of public- and private-sector stakeholders; and</text></subparagraph> 
<subparagraph id="H86190E0E214A489B9BC6FBDD49FB44A5"><enum>(C)</enum><text>discusses any potential changes to the exercise of the authority for the purpose of more effectively resolving the covered national emergency.</text></subparagraph></paragraph> <paragraph id="HB32C46458A5E487FAEE9A99F9B8DC646"><enum>(2)</enum><header>Definitions</header><text>In this subsection—</text> 
<subparagraph id="HB4CA3287EF5344A4BDC2C02FAD8704AB"><enum>(A)</enum><text>the term <quote>appropriate congressional committees</quote> means—</text> <clause id="HFDE650736C1C4C9DAD339613FC0F9431"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Financial Services, and the Committee on Oversight and Government Reform of the House of Representatives; and</text></clause> 
<clause id="HF772DB30B5404A51A5F8850929D4DF16"><enum>(ii)</enum><text>the Committee on Homeland Security and Governmental Affairs, the Committee on Foreign Relations, and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></clause></subparagraph> <subparagraph id="HCD32BC44A89D4CC085010C72E35D97E2"><enum>(B)</enum><text>the term <quote>covered national emergency</quote> means a national emergency that—</text> 
<clause id="HE823F728D8204A5FB900043DEF30FDDD"><enum>(i)</enum><text display-inline="yes-display-inline">the President has declared, within the preceding 5-year period, with respect to any national emergency regarding international drug trafficking; and</text></clause> <clause id="HB9D0DBDDF3044207AB6067D7BF48868E"><enum>(ii)</enum><text>has not terminated.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6D7452FE6764467AA98545FC6C11057B"><enum>(b)</enum><header>Consultation and reports</header><text display-inline="yes-display-inline">Section 204 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1703">50 U.S.C. 1703</external-xref>) is amended—</text> <paragraph id="HE42FEF7362AA445AADB04B81896834DC"><enum>(1)</enum><text>by striking <quote>the Congress</quote> each place it appears and inserting <quote>the appropriate congressional committees</quote>; and</text></paragraph> 
<paragraph id="HB325C8B3FE774CDD9058167B4CF3CBC5"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H70FD16528C5B440882B8B8531C8C8E5C" display-inline="no-display-inline"> <subsection id="HAD36EBC4937B4C9AB5E29D640F894030"><enum>(e)</enum><header>Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> has the meaning given that term in section 203(d)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H935AC9390B404112A4EA52681034105B"><enum>(3)</enum><header>Authority to issue regulations</header><text display-inline="yes-display-inline">Section 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1704">50 U.S.C. 1704</external-xref>) is amended—</text> <subparagraph id="H18AADF67F16C45E49D7E76650EDB3D23"><enum>(A)</enum><text>by striking <quote>The President</quote> and inserting <quote>(a) The President</quote>; and</text></subparagraph> 
<subparagraph id="H401E32C858B642E1ABF0743880A718B0"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H24FF49CE37AE48B68CA9D48224571892" display-inline="no-display-inline"> <subsection id="HA632600FB11E41409C481BC87CA91919"><enum>(b)</enum><text display-inline="yes-display-inline">In issuing regulations under subsection (a) pursuant to a covered national emergency (as defined in section 203), the President shall—</text> 
<paragraph id="H6FAD885B025F43FEBDF79ECC4FD944A5"><enum>(1)</enum><text>consider the costs and benefits of available statutory and regulatory alternatives;</text></paragraph> <paragraph id="H099AD2D21BD14B2BB068850B2D5D0C3E"><enum>(2)</enum><text>evaluate the costs and benefits for the purpose of expeditiously resolving the applicable national emergency;</text></paragraph> 
<paragraph id="HD8202CF4BE7C434EBD9D117C3F6AAD84"><enum>(3)</enum><text>establish criteria for the eventual termination of the applicable national emergency; and</text></paragraph> <paragraph id="HCD7F1FFFFD814EFFB1438BF12405CF08"><enum>(4)</enum><text>include in the basis and purpose incorporated in the regulations—</text> 
<subparagraph id="HF511458958014969945B3CBCDA672D8E"><enum>(A)</enum><text>an explanation of how the regulations will resolve the applicable national emergency; and</text></subparagraph> <subparagraph id="H6725D23F5B834738BD2E52A68055ECE4"><enum>(B)</enum><text>a discussion of the costs and benefits.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> </section> 
<section id="H82FBA525AF55404691FB4EE279F775F4"><enum>5.</enum><header>Exception relating to importation of goods</header> 
<subsection id="HE5E4F2BD60FC4131A78C3037F2D2E10A"><enum>(a)</enum><header>In general</header><text>The authorities and requirements to impose sanctions in this Act shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subsection> <subsection id="H5A4B368218DA49D4829A1BA2C841CE61"><enum>(b)</enum><header>Good defined</header><text>In this section, the term <quote>good</quote> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subsection></section>
