R. 727</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250124">January 24, 2025</action-date><action-desc><sponsor name-id="F000472">Mr. Scott Franklin of Florida</sponsor> (for himself, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="S001224">Mr. Self</cosponsor>, <cosponsor name-id="R000395">Mr. Rogers of Kentucky</cosponsor>, <cosponsor name-id="E000071">Mr. Ellzey</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="R000609">Mr. Rutherford</cosponsor>, <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>, and <cosponsor name-id="M001194">Mr. Moolenaar</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title IV of the Public Health Service Act to prohibit sale or transactions relating to human fetal tissue.</official-title></form><legis-body id="HF20A9E3379E341249842595764D134CF" style="OLC"><section id="H38D7E9BA0339484281B9A9C8C3D8D258" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Abortion Industry’s Lucrative Loopholes Act</short-title></quote>.</text></section><section id="H1B5176F2057542258CAB62DC2E53E8E2"><enum>2.</enum><header>Prohibiting sale or transactions relating to human fetal tissue</header><text display-inline="no-display-inline">Section 498B(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289g-2">42 U.S.C. 289g–2(e)</external-xref>) is amended by striking paragraph (3) and inserting the following new paragraph:</text><quoted-block id="H05E681372871474A82B0DF8C6A9129FD" style="OLC"><paragraph id="H91E3C9D6558D4A9296C67C7B5334679F"><enum>(3)</enum><text>The term <term>valuable consideration</term> includes—</text><subparagraph id="HA2B711DEB0694A5C94EA693B8FDD7088"><enum>(A)</enum><text>any payment made or debt incurred;</text></subparagraph><subparagraph id="H57533ED165A04657A7E30B0C9D3D348D"><enum>(B)</enum><text>any gift, honorarium, or recognition of value bestowed;</text></subparagraph><subparagraph id="H6887E927CE8E4A2A8B708058D17ADDC0"><enum>(C)</enum><text>any price, charge, or fee which is waived, forgiven, reduced, or indefinitely delayed;</text></subparagraph><subparagraph id="H070D007E1C354F77A76A4091F5D634AD"><enum>(D)</enum><text>any loan or debt which is canceled or otherwise forgiven;</text></subparagraph><subparagraph id="H73A621E76C694BD7B84B4BBD08BB47E6"><enum>(E)</enum><text>the transfer of any item from one person to another or provision of any service or granting of any opportunity for which a charge is customarily made, without charge or for a reduced charge; and</text></subparagraph><subparagraph id="H6A6E53140668423BA0AB0AF807772A6C"><enum>(F)</enum><text>any payments associated with the transportation, implantation, processing, preservation, quality control, or storage of human fetal tissue.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
