<section id="H0B38302C70E3424B8E5AF12E900DF38E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Justice Screening Tool Act of 2025</short-title></quote>. </text></section> <section id="H206BCD2EB6294E029B0C4A1DB4467F85"><enum>2.</enum><header>Geospatial mapping tool of Environmental Protection Agency to identify disproportionately burdened communities</header> <subsection id="H1BD8FC4E21634EF58B9EA843D3AE6A64"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Administrator of the Environmental Protection Agency shall develop and publish on a publicly available website of the Environmental Protection Agency a geospatial mapping tool to identify disproportionately burdened communities, to be known as the <quote>Environmental Justice Screening Tool</quote>.</text></subsection> 
<subsection id="H2582F4B3EC8540B7BC941D2CDF36423B"><enum>(b)</enum><header>Determination of disproportionate burden thresholds</header> 
<paragraph id="HA6849E3361034AB9A4FF34DB95E2D190"><enum>(1)</enum><header>Thresholds</header><text display-inline="yes-display-inline">In developing the tool under subsection (a), the Administrator shall, for each category of factors described in paragraph (2)—</text> <subparagraph id="HAAC38781794141A2A6180D422CA410C7"><enum>(A)</enum><text>determine a threshold for a census tract to be considered disproportionately burdened with respect to that category; and</text> </subparagraph> 
<subparagraph id="HC7815B822B144B1CBC0DF95BDCABD16B"><enum>(B)</enum><text display-inline="yes-display-inline">ensure the tool identifies as disproportionately burdened with respect to that category any community within a census tract that meets such threshold.</text></subparagraph> </paragraph> <paragraph id="H73278D0102CE4675914606BE272AB14A"><enum>(2)</enum><header>Categories of factors</header><text>The categories of factors described in this paragraph are the following:</text> 
<subparagraph id="HE520D77B46B44DE3A08C2D1925FCE900"><enum>(A)</enum><text>Environmental factors, including the following:</text> <clause id="HF561335CC8824A1F9DEFB511A5012F29"><enum>(i)</enum><text>Air quality.</text></clause> 
<clause id="H0B4DA0B2AB4D48ECB12E01C9F04F3E26"><enum>(ii)</enum><text>Access to safe drinking water.</text></clause> <clause id="HCE7D70F04E8D4F418B32EB90FACFD11D"><enum>(iii)</enum><text>Proximity to any environmental hazard or potential environmental hazard, including—</text> 
<subclause id="H8C09684CD5CC46FC9830C382B7C99364"><enum>(I)</enum><text display-inline="yes-display-inline">a site that is listed on the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>);</text></subclause> <subclause id="H7C96B465A2B04108A19F6EA77D9E0C22"><enum>(II)</enum><text>a brownfield site;</text></subclause> 
<subclause id="HED091225C9C84CDA9A0CE192AEC60566"><enum>(III)</enum><text>a well, pipeline, refinery, or other facility relating to the production, refining, or downstream processing of oil or gas; or</text></subclause> <subclause id="HC4D17167CCBA4C93AB79296D3209C010"><enum>(IV)</enum><text display-inline="yes-display-inline">a municipal solid waste landfill unit.</text></subclause></clause></subparagraph> 
<subparagraph id="H947E64B32A7E4AF09C065DE1BEA72A84"><enum>(B)</enum><text display-inline="yes-display-inline">Climate change factors, including the following:</text> <clause id="HC28DF461C5C64F3A9B5A1ED95CD26C50"><enum>(i)</enum><text display-inline="yes-display-inline">Frequency of natural disasters, including wildfires, hurricanes, earthquakes, tornadoes, landslides, and flooding.</text></clause> 
<clause id="HAFA3CF7FBC14493786E566E2E28676D6"><enum>(ii)</enum><text>Frequency of extreme drought.</text></clause></subparagraph> <subparagraph id="H2E58E1F1F4414FD6B1D8F796AAAB263A"><enum>(C)</enum><text display-inline="yes-display-inline">Human health factors, including the following:</text> 
<clause id="H61C2E2DF40DE4966A3A070BF97F92CF3"><enum>(i)</enum><text display-inline="yes-display-inline">Rate of asthma or chronic obstructive pulmonary disease.</text></clause> <clause id="H74929D604AC048D9B596CD806E1C5A43"><enum>(ii)</enum><text>Rate of diabetes.</text></clause> 
<clause id="HC49F8B82E1F04EDE8E8716869B4AB42D"><enum>(iii)</enum><text>Rate of obesity.</text></clause> <clause id="HE21D539D2350410F97A8E68A5F8E4D71"><enum>(iv)</enum><text>Rate of preterm or low birth weight births.</text></clause> 
<clause id="H5CE6F810DA414725821B35053D219D72"><enum>(v)</enum><text>Rate of maternal mortality. </text></clause></subparagraph> <subparagraph id="HF21767F3C7BC4C208A3B234A63294E49"><enum>(D)</enum><text display-inline="yes-display-inline">Economic factors, including the following:</text> 
<clause id="H2850D7A8206D47218286CBB8BB982AD4"><enum>(i)</enum><text>Poverty rate.</text></clause> <clause id="HBEB0631D1DC24483811AA8DBF9BC8281"><enum>(ii)</enum><text>Unemployment rate.</text></clause> 
<clause id="H8577E4B6003342889B94B917E5F577C5"><enum>(iii)</enum><text>Access to affordable housing.</text></clause> <clause id="HB3C37BFC6E43469084E281C303917187"><enum>(iv)</enum><text>Access to hospitals and other health care facilities.</text></clause></subparagraph> 
<subparagraph id="HED891A08D0FC42EA858377C0FADDEBB7"><enum>(E)</enum><text display-inline="yes-display-inline">Social factors, including the following:</text> <clause id="H6173E88889D640CDB36D0145F45E7B63"><enum>(i)</enum><text display-inline="yes-display-inline">Racial or ethnic demographics.</text></clause> 
<clause id="H9663610AC16F4984B40353738A791AD4"><enum>(ii)</enum><text>Educational attainment.</text></clause> <clause id="HE23AAC4400C045D3AB2AD226167937BD"><enum>(iii)</enum><text>Population density.</text></clause> 
<clause id="HAB5B043B2B2947A4A0A0CCF785CAE9A0"><enum>(iv)</enum><text>Age distribution.</text></clause> <clause id="H05A6D6127EFE49F2AFFB95F6A3682520"><enum>(v)</enum><text>Gender distribution.</text> </clause></subparagraph> 
<subparagraph id="H1F319F8413B5420A8A899AC0FDD2F137"><enum>(F)</enum><text>Any other category of factors the Administrator may prescribe.</text></subparagraph></paragraph> <paragraph id="H0C498548330D490DBF6B9DB5CE6F473A"><enum>(3)</enum><header>Solicitation of feedback and data</header><text display-inline="yes-display-inline">The Administrator shall solicit feedback and data regarding the thresholds under paragraph (1) and the categories of factors described in paragraph (2) from institutions of higher education, nonprofit organizations, community-based organizations, and State, local, and tribal government officials, as determined appropriate by the Administrator.</text></paragraph> </subsection> 
<subsection id="HA0819C73369D4B2C84D6E2F1FEB6045B"><enum>(c)</enum><header>Annual review and report</header><text>Not later than one year after the date on which the Administrator publishes the tool under subsection (a), and annually thereafter, the Administrator shall—</text> <paragraph id="HB1B784C5F2554DA49DA5536969B01C5A"><enum>(1)</enum><text>review the data informing the tool and, as the Administrator determines appropriate, update the tool; and</text></paragraph> 
<paragraph id="HF3AB0EA29F324201913A93F99E93FB05"><enum>(2)</enum><text>submit to the appropriate congressional committees a report on the implementation of this section that contains, at a minimum—</text> <subparagraph id="HEF1EAF39F68343DEB2452E974BECD1BC"><enum>(A)</enum><text>a description of any updates made to the tool; and</text></subparagraph> 
<subparagraph id="HEB9D8A8118FA41998FC51977646E7C40"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of any census tract that, as a result of any such update, became identified as disproportionately burdened under the tool or ceased to be so identified.</text> </subparagraph></paragraph></subsection> <subsection id="HFC61667BB90F477C9F3B6DB9E02B00CC"><enum>(d)</enum><header>Adoption across Federal government</header><text display-inline="yes-display-inline">Beginning not later than one year after the date on which the Administrator publishes the tool under subsection (a), the head of each Federal department or agency shall, to the extent and in the manner determined appropriate by such head, adopt such tool for use in identifying disproportionately burdened communities and prioritizing funding or other resources of the department or agency to the benefit of communities so identified. </text> </subsection> 
<subsection id="HF59F7F7124ED4033BC226A02CA612473"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H658BE2B5763F41C8916736C2E561EDC0"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> 
<subparagraph id="HC700F7541C594C70842B222DFF000775"><enum>(A)</enum><text>the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph> <subparagraph id="H8B2D0A160D914F5283C187039BD8DBBE"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Appropriations and the Committee on Environment and Public Works of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H7E2E9D51352A457E851415A4F1B19B2C"><enum>(2)</enum><header>Brownfield site</header><text>The term <quote>brownfield site</quote> has the meaning given that term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> <paragraph id="H3FC3A28473C643D3BB63CC390A2D309F"><enum>(3)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph>
<paragraph id="HA5193780E0AE4B2EAAC1FC0348F34757"><enum>(4)</enum><header>State</header><text>The term <quote>State</quote> includes each territory or possession of the United States.</text></paragraph></subsection> </section> </legis-body></bill>
