<section id="H264A73A0C9C849DCA78775F290E90348" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conserving Lands and Areas Incompatible with Mining Act of 2025</short-title></quote> or the <quote><short-title>CLAIM Act of 2025</short-title></quote>.</text></section> <section id="H051E5067E6B1441D82505E867F77530F" section-type="subsequent-section"><enum>2.</enum><header>Hardrock mining claim maintenance fee</header> <text display-inline="no-display-inline">Subtitle B of title X of the Omnibus Budget Reconciliation Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/30/28f">30 U.S.C. 28f et seq.</external-xref>) is amended—</text> 
<paragraph id="H1183179B4E6F4D388D3ACD9AFF9D0355"><enum>(1)</enum><text>by striking <quote>Secretary of the Interior</quote> each place it appears and inserting <quote>Secretary</quote>;</text> </paragraph> <paragraph id="H35DF42D6E2494561A1E1EA6394DD35C5"><enum>(2)</enum><text>in section 10101 (<external-xref legal-doc="usc" parsable-cite="usc/30/28f">30 U.S.C. 28f</external-xref>)—</text> 
<subparagraph id="H7C2C794B5D7548FF91AE34E2A6A4D250"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="H92549ED1EC52440B9765184BEC244987"><enum>(i)</enum><text>in paragraph (1)—</text> 
<subclause id="HEDF3C2122935410D9903225003478119"><enum>(I)</enum><text>by striking <quote>of $100</quote> and all that follows through the end and inserting <quote>per claim or site, respectively, in accordance with the following:</quote>; and</text></subclause> <subclause id="H48110514D3D44739A3BB8A7A26811C49"><enum>(II)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA1B9C10B90974C539EBBF2BA78FDF7FC" display-inline="no-display-inline"> 
<subparagraph id="HDB752B5005AC4F33AB07D93FF5A05974" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">For a claim or site the majority of which is located within the boundary of a covered area, $1,100.</text></subparagraph> <subparagraph id="HB0FDD50165124E208883BACA4FA15502"><enum>(B)</enum><text>For a claim or site the majority of which is located between 0 and 10 miles from the boundary of a covered area, $1,000.</text> </subparagraph> 
<subparagraph id="H91F80E24BE6141AA9EB67A166FA2EC8C"><enum>(C)</enum><text display-inline="yes-display-inline">For a claim or site the majority of which is located between 10 and 20 miles from the boundary of a covered area, $700.</text></subparagraph> <subparagraph id="H150A9282198B45899CF351A9C3C8191B"><enum>(D)</enum><text display-inline="yes-display-inline">For a claim or site the majority of which is located between 20 and 30 miles from the boundary of a covered area, $500.</text></subparagraph> 
<subparagraph id="HEA51A5A049C7493481C79810D644F46F"><enum>(E)</enum><text display-inline="yes-display-inline">For a claim or site the majority of which is located more than 30 miles from the boundary of a covered area, $300.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause></clause> <clause id="H73023F680755472EA07615C16311C6D6"><enum>(ii)</enum><text>in paragraph (2), by striking the second sentence; and</text></clause> 
<clause id="HA9B886EC85E24D72AEE11E0FB26E6D2C"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HF7A363B09A19497A8D30DA8E43FC2010" display-inline="no-display-inline"> <paragraph id="H430EAEDEC5754468A5C77F1EBB6218F1" indent="down1"><enum>(3)</enum><header>Fee in lieu of assessment work</header><text display-inline="yes-display-inline">A claim maintenance fee paid in accordance with paragraph (1) or (2) shall be in lieu of the assessment work requirement contained in the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28-28e">30 U.S.C. 28–28e</external-xref>) and the related filing requirements contained in subsections (a) and (c) of section 314 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1744">43 U.S.C. 1744(a)</external-xref> and (c)).</text></paragraph> 
<paragraph id="H76E2968D6CE245A7ACA7C42D146D15C3" indent="down1"><enum>(4)</enum><header>Exemption for small miners</header><text>Paragraphs (1) and (2) and any assessment work required by the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/28">30 U.S.C. 28 et seq.</external-xref>) do not apply with respect to a small miner.</text></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H79AA36C69134487593F5BE692E7ABD12"><enum>(B)</enum><text>by striking subsection (d);</text></subparagraph></paragraph> 
<paragraph id="H6FB29418388C477884E039F44CC3E700"><enum>(3)</enum><text>in section 10105 (<external-xref legal-doc="usc" parsable-cite="usc/30/28j">30 U.S.C. 28j</external-xref>), by amending subsection (c) to read as follows:</text> <quoted-block style="OLC" id="HEE70A202C5EF4D50822FA841476A4F61" display-inline="no-display-inline"> <subsection id="H92C1070DD03A436B831ADF17CF7B6941"><enum>(c)</enum><header>Fee adjustments</header> <paragraph id="HD718EE4E15C64A2486F28104250D19C2"><enum>(1)</enum><header>Inflation</header><text display-inline="yes-display-inline">The Secretary shall, not less than once every 5 years after the date of the enactment of the <short-title>CLAIM Act of 2025</short-title>, adjust each fee paid under this section to reflect changes in the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor, or more frequently if the Secretary determines an adjustment to be reasonable.</text> </paragraph> 
<paragraph id="HCC84CACBDC74439EA569001BE3C3504F"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall provide each claimant notice of any adjustment made under this subsection not later than July 1 of the year in which the adjustment is made.</text></paragraph> <paragraph id="H640117A3FBC447FEA87E9236AF6E2ADA"><enum>(3)</enum><header>Applicability</header><text display-inline="yes-display-inline">A fee adjustment made under this subsection shall begin to apply in the calendar year following the calendar year in which it is made.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H392B1B0D64DB4FCC9EE60E8918CEA376"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HB40D3EBDB6F34172B611BD35174E8DF4" display-inline="no-display-inline"> <section id="HDB0C436967A94638A33A6A3A09F5CB53"><enum>10107.</enum><header>User fees</header> <text display-inline="no-display-inline">The Secretary may establish and collect from each person subject to the requirements of this subtitle such user fees as may be necessary to reimburse the United States for expenses incurred in the administration of such requirements.</text></section> 
<section id="H95DAF584B82F4A50BDB7B5E25B5CB451"><enum>10108.</enum><header>Use of claim maintenance fees</header> 
<subsection id="H8C795C470F5145FB9E6F131965B8A816"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall use amounts paid to the Secretary pursuant to section 10101(a) to administer the mining laws of the United States.</text></subsection> <subsection id="H0E4B4417AC21460EB20C22BD7AD1D24C"><enum>(b)</enum><header>Allocation of excess amounts</header><text display-inline="yes-display-inline">With respect to a given fiscal year, if amounts paid to the Secretary pursuant to section 10101(a) are in excess of the amount required for the Secretary to administer the mining laws of the United States, the Secretary shall allocate such excess amounts in accordance with the following:</text> 
<paragraph id="H648714856E7A40479D4000F88A4CDF5C" commented="no"><enum>(1)</enum><text>40 percent to the program established by the Secretary under section 40704(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1245">30 U.S.C. 1245(a)</external-xref>).</text></paragraph> <paragraph id="H3D65368D444247219818657039EE42AA" commented="no"><enum>(2)</enum><text>20 percent to the Tribal Historic Preservation Program.</text></paragraph> 
<paragraph id="HA55A055199F54743B09C541B35DE6EE1"><enum>(3)</enum><text display-inline="yes-display-inline">20 percent to the States on the basis of the ratio of the number of patented and unpatented mining claims, mill sites, and tunnel sites located pursuant to the mining laws of the United States located within a State to the total number of patented and unpatented mining claims, mill sites, and tunnel sites located pursuant to the mining laws of the United States.</text> </paragraph> <paragraph id="H2F39BA282DBA462C837FB248C0DD1245"><enum>(4)</enum><text display-inline="yes-display-inline">10 percent to the Land and Water Conservation Fund established under section 200302 of title 54, United States Code, which shall be considered income to the Land and Water Conservation Fund for purposes of section 200302 of that title.</text></paragraph> 
<paragraph id="H7395BB5CBB4D46728D9DB2A914692C1F"><enum>(5)</enum><text display-inline="yes-display-inline">10 percent to the National Parks and Public Land Legacy Restoration Fund established by section 200402(a) of title 54, United States Code.</text> </paragraph> </subsection></section> <section id="H63B476DB5F9A40738E83B5A54537D469"><enum>10109.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> 
<paragraph id="H171EA367339F498685A6E40AA29523EF"><enum>(1)</enum><header>Casual use</header><text>The term <term>casual use</term>—</text> <subparagraph id="H3FFA1AF2A2EB43CE8B957D149CC14E94"><enum>(A)</enum><text display-inline="yes-display-inline">means mineral activities that do not ordinarily result in any disturbance of Federal land and resources;</text></subparagraph> 
<subparagraph id="H6E902008480E487086D7DA4C21552E69"><enum>(B)</enum><text>includes collection of geochemical, rock, soil, or mineral specimens using handtools, hand panning, or nonmotorized sluicing; and</text></subparagraph> <subparagraph id="HE8C62592F4284CE49B704D94BE21BF9F"><enum>(C)</enum><text>does not include—</text> 
<clause id="H8EE57EE5017D4E9E8D1BC93CE35FEED9"><enum>(i)</enum><text display-inline="yes-display-inline">the use of mechanized earth-moving equipment, suction dredging, or explosives;</text></clause> <clause id="H26E6203C1A7F4A04949703B29D7F1DB2"><enum>(ii)</enum><text>the use of motor vehicles in areas closed to motor vehicles;</text></clause> 
<clause id="HBC3AE5E7A1E34AF09265717524DA88B5"><enum>(iii)</enum><text>the construction of roads or drill pads; or</text></clause> <clause id="HFC71F1BD059C45CDAFC46066E0D1EB69"><enum>(iv)</enum><text>the use of toxic or hazardous materials.</text></clause></subparagraph></paragraph> 
<paragraph id="H264CC7AD3F4443ED8E654C2ED7EF4925"><enum>(2)</enum><header>Covered area</header><text>The term <term>covered area</term> means a—</text> <subparagraph id="HBD296B3F4C59433DA9EBA2FAAFB89752"><enum>(A)</enum><text>unit of the National Park System; and</text></subparagraph> 
<subparagraph id="H028EA1A88035495FA618F8CA4F7A2E6B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">national monument designated under section 320301 of title 54, United States Code (commonly known as the <quote>Antiquities Act</quote>).</text> </subparagraph> </paragraph> <paragraph id="H7877CB7277364D4BA64F3EE7C9F5A449" commented="no"><enum>(3)</enum><header>Hardrock mineral</header><text display-inline="yes-display-inline">The term <term>hardrock mineral</term>—</text> 
<subparagraph id="H1ABC938762F84D1FB4A03671FA0E95A7" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">means any mineral that is subject to location under the mining laws of the United States and is not subject to disposition under—</text> <clause id="H04030E5E3FC5440F8196AF2E0D233E96" commented="no"><enum>(i)</enum><text>the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>);</text></clause> 
<clause id="HB5E5A4284BEF433E9EFC2F188F3BF60D" commented="no"><enum>(ii)</enum><text>the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>);</text></clause> <clause id="H348FF997083140C6B8932D808E03CC73" commented="no"><enum>(iii)</enum><text>the Act of July 31, 1947, commonly known as the Materials Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/30/601">30 U.S.C. 601 et seq.</external-xref>); or</text></clause> 
<clause id="H399ED8D4654E49C3909C3708E5127780" commented="no"><enum>(iv)</enum><text>the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351 et seq.</external-xref>); and</text></clause></subparagraph> <subparagraph id="HDBEA0EB0919B40549A4D3FA476207BD8" commented="no"><enum>(B)</enum><text>does not include any mineral that is subject to a restriction against alienation imposed by the United States and is—</text> 
<clause id="HE2E9D4CEA9E04000978A71107722AC8F" commented="no"><enum>(i)</enum><text>held in trust by the United States for any Indian or Indian Tribe; or</text></clause> <clause id="HFE4B1BFADEB740668DACD49EB1218BA1" commented="no"><enum>(ii)</enum><text>owned by any Indian or Indian Tribe.</text></clause></subparagraph></paragraph> 
<paragraph id="HD184357E23344A90B93CD35D3B40E72F"><enum>(4)</enum><header>Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> has the meaning given the term in section 2 of the Indian Mineral Development Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/25/2101">25 U.S.C. 2101</external-xref>).</text></paragraph> <paragraph id="HF1A19968DDA1405D83C127606FE5A459"><enum>(5)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 2 of the Indian Mineral Development Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/25/2101">25 U.S.C. 2101</external-xref>).</text></paragraph> 
<paragraph id="H9FA0D3726C184FA4A498D06546FFC997" commented="no"><enum>(6)</enum><header>Mineral activities</header><text display-inline="yes-display-inline">The term <term>mineral activities</term> means any activity carried out on a mining claim, mill site, or tunnel site located pursuant to the mining laws of the United States for, related to, or incidental to, mineral exploration, mining, beneficiation, processing, or reclamation activities for any hardrock mineral.</text></paragraph> <paragraph id="H24E2E649E67E44F293B8EEE6AAF45C0F"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H6BA3FF17A128457FA85506226C6B5B01"><enum>(8)</enum><header>Small miner</header> 
<subparagraph id="H4F8936C3B20E476C9994732273A26D27"><enum>(A)</enum><header>In general</header><text>The term <term>small miner</term> means a person (including all related parties) that—</text> <clause id="H6312DE3DCD4A4B96BF586D18CE28623E"><enum>(i)</enum><text display-inline="yes-display-inline">holds not more than 10 mining claims, mill sites, or tunnel sites, or any combination thereof, on Federal land;</text></clause> 
<clause id="H36254987A4A54CC094799E83A3BD285F"><enum>(ii)</enum><text>holds or operates a mining claim, mill site, or tunnel site with respect to not more than 200 acres of Federal land;</text></clause> <clause id="H0E691298798B4933BDB8A60525104D89"><enum>(iii)</enum><text>certifies to the Secretary in writing that, in the preceding calendar year, the person had an annual gross income from mineral production in an amount less than $50,000; and</text></clause> 
<clause id="H97B07223178A435CA5F7664909EC11CE" commented="no"><enum>(iv)</enum><text>certifies to the Secretary in writing that the person will use each mining claim, mill site, or tunnel site held or operated by the person only for casual use.</text></clause></subparagraph> <subparagraph id="H84765FEC94744697B677E0175DDBE93E" commented="no"><enum>(B)</enum><header>Annual gross income</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(iii), the dollar amount shall be applied, for a person, to the aggregate of all annual gross income from mineral production under each mining claim, mill site, or tunnel site located pursuant to the mining laws of the United States held by or assigned to such person and all related parties.</text></subparagraph> 
<subparagraph id="H85A8FFA76D694AE586274910B5694CCB"><enum>(C)</enum><header>All related parties</header><text display-inline="yes-display-inline">For purposes of subparagraphs (A) and (B), with respect to a person, the term <term>all related parties</term> means—</text> <clause id="H67540FD02E4D43E1804366B48E76A554"><enum>(i)</enum><text>the spouse or qualifying child (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152</external-xref> of the Internal Revenue Code of 1986) of such person;</text></clause> 
<clause id="H63D953538AC948FAB99C4602ED828076" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a person that controls, is controlled by, or is under common control with such person;</text></clause> <clause id="HE7ABBA4CC808411EAA9724891CD864EC"><enum>(iii)</enum><text>a partner of such person; or</text></clause> 
<clause id="HBEA7A1B124444ECC8D0D345740FC0A4A"><enum>(iv)</enum><text>a person that owns at least 10 percent of the voting shares of such person.</text></clause></subparagraph> <subparagraph id="H2E68AD4051BA45CD9C0FFECEE6754FDE"><enum>(D)</enum><header>Control</header><text display-inline="yes-display-inline">For purposes of subparagraph (C), the term <term>control</term> means having the ability, directly or indirectly, to determine (without regard to whether exercised through 1 or more corporate structures) the manner in which an entity conducts mineral activities, through any means, including—</text> 
<clause id="HB8457D8A1A6C452891F25D6C75734D0C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text>an ownership interest;</text></clause> <clause id="HE90C047FAD3D4BB3A9FDDFC0E73C7F77" commented="no"><enum>(ii)</enum><text>the authority to commit the real or financial assets of the entity;</text></clause> 
<clause id="H13B9AAE71E4347FA933E30D30742ABBB" commented="no"><enum>(iii)</enum><text>a position as a director, officer, or partner of the entity; or</text></clause> <clause id="H0E7838AEEA3543FDAB68345509CC8007" commented="no"><enum>(iv)</enum><text>a contractual arrangement.</text> </clause></subparagraph> </paragraph> </section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
