<section id="HFF8D404315B54C7DA128482E70A2CDE8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H15F19A0F6CBA4B8CBE9652043E266CB8"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual who is under the age of 13.</text></paragraph> 
<paragraph id="H1FB53605D1F8456EBD29DFA29C87BA2C"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission. </text></paragraph> <paragraph id="HC266800373ED4F7DA19CE2B57D51B74C" commented="no"><enum>(3)</enum><header>Compulsive usage</header><text>The term <term>compulsive usage</term> means a persistent and repetitive use of a covered platform that substantially limits one or more major life activities of an individual (described in section 3(2) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102(2)</external-xref>)).</text></paragraph> 
<paragraph id="H1E5EE0E3FF2A48459C6D2BAAB2BCAC31" commented="no"><enum>(4)</enum><header>Covered platform</header><text display-inline="yes-display-inline">The term <term>covered platform</term> means a platform that is a website, software, application, or electronic service connected to the internet that—</text> <subparagraph id="H3BE36FD8D7234512BA84A25E8A0A240C"><enum>(A)</enum><text>is publicly available for use by consumers;</text></subparagraph> 
<subparagraph id="HF77619750EC5451596D71A3FE3B96F1A"><enum>(B)</enum><text>enables the creation of a username or user identifier—</text> <clause id="HE2424D454518409A9F5A3FBF64CA061E"><enum>(i)</enum><text display-inline="yes-display-inline">that is searchable on the platform; and</text></clause> 
<clause id="HCF296AA5BC724A279A6306C73AD021F7"><enum>(ii)</enum><text>that can be followed by or is similarly accessible to other users of the platform;</text></clause></subparagraph> <subparagraph id="HB84B6E9E485D4FB19E640798E19CBE79"><enum>(C)</enum><text>as the predominant purpose of the platform, facilitates the sharing and access to user-generated content through text, images, video, audio, or any other interactive medium;</text></subparagraph> 
<subparagraph id="HDC0E91DBBEDD46ECA8697133511B4EFA"><enum>(D)</enum><text>uses a design feature to promote user engagement on the platform; and</text></subparagraph> <subparagraph id="H0A0214BACD9A4FD3B5C8C23781DCCDFA"><enum>(E)</enum><text>uses the personal information of the user to advertise, market, or make content recommendations.</text> </subparagraph> </paragraph> 
<paragraph id="H2EA4F336F09E4FF9BDD692C3FC8DD172" commented="no"><enum>(5)</enum><header>Design feature</header><text>The term <term>design feature</term>—</text> <subparagraph id="H8A9291598F6849AFA7C00257241BFABC"><enum>(A)</enum><text>means any feature or component of a covered platform that encourages or increases the frequency, time spent, or activity of a user on the covered platform; and</text></subparagraph> 
<subparagraph id="H05C49283E4AE442492FFFEFEA66E9F48"><enum>(B)</enum><text>includes any of the following:</text> <clause id="H9AE939BE686E4FE398A28F5F55E1F8DD" commented="no"><enum>(i)</enum><text>Infinite scrolling or auto play.</text></clause> 
<clause id="H2F0871B6F7894622AB34FD6CF28528F2" commented="no"><enum>(ii)</enum><text>Rewards or incentives based on the frequency, time spent, or activity of a user on the covered platform.</text></clause> <clause id="HE7D4CA0073524F8EBFA6CCC6A99DD4DD" commented="no"><enum>(iii)</enum><text>Notifications and push alerts.</text></clause> 
<clause id="H3287566FC0BC4732BCFDE35112FC3F76" commented="no"><enum>(iv)</enum><text>Badges or other visual award symbols based on the frequency, time spent, or activity of a minor on the covered platform.</text></clause> <clause id="HA0D5CD64FCE44710920945EC27A9F90F" commented="no"><enum>(v)</enum><text>Appearance altering filters.</text></clause></subparagraph> </paragraph> 
<paragraph id="HF34B279E79904A9AADC39E2853B90C80" commented="no"><enum>(6)</enum><header>Know; knows</header><text>The term <term>know</term> or <term>knows</term> means to have actual knowledge or to have acted in willful disregard.</text></paragraph> <paragraph id="H01D744F009F24F4E89AC45BCDC2F424C" commented="no"><enum>(7)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who is under the age of 17. </text></paragraph> 
<paragraph id="H20F9E62985CE4726A1F7CA8FC7165A4D" commented="no"><enum>(8)</enum><header>Narcotic drug</header><text>The term <term>narcotic drug</term> has the meaning given that term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph> <paragraph id="H74D85313BFC7442283E19DA5BC329FDB" commented="no"><enum>(9)</enum><header>Parent</header><text>The term <term>parent</term> means the legal guardian of a minor.</text></paragraph> 
<paragraph id="HCFA2A3F179D1447586D41D25EBE01E98" commented="no"><enum>(10)</enum><header>Personal information</header><text>The term <term>personal information</term> has the meaning given that term in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph> <paragraph id="HA3DF06AD611C48BD8B86C106CEDC3A6C"><enum>(11)</enum><header>Physical violence</header><text display-inline="yes-display-inline">The term <term>physical violence</term> has the meaning given the term <term>crime of violence</term> under section 16 of title 18, United States Code.</text> </paragraph> 
<paragraph id="H272DF7DF100749D9B7427949FD88AAE0" commented="no"><enum>(12)</enum><header>Sexual exploitation and abuse</header><text>The term <term>sexual exploitation and abuse</term> means any of the following: </text> <subparagraph id="H677A049FD27B47E2A15FCCB4BF6AC373" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Any offense, including coercion and enticement, as described in section 2422 of title 18, United States Code.</text></subparagraph> 
<subparagraph id="HA5F44E48D32B4443867B51B075FA8580" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Child pornography, as defined in section 2256 of title 18, United States Code.</text></subparagraph> <subparagraph id="H6A38DA5202D14F2994976D7802E6277E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Trafficking for the production of images, as described in section 2251 of title 18, United States Code.</text></subparagraph> 
<subparagraph id="H16007A2E2AD54CD688D0CBF5C3DFB3D9" commented="no"><enum>(D)</enum><text>Any offense described in section 1591 of title 18, United States Code.</text></subparagraph></paragraph> <paragraph id="HEC24C8FCEF4C4660AAA2210869F95EA3" commented="no"><enum>(13)</enum><header>State</header><text>The term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph> 
<paragraph id="H0C1A3918EF5C4B8AA47FB39340CDAF66" commented="no"><enum>(14)</enum><header>User</header><text>The term <term>user</term> means, with respect to a covered platform, an individual who registers an account or creates a profile on the covered platform.</text></paragraph> <paragraph id="HB1C1FA29BAC342DBB3749CB090A47A6B"><enum>(15)</enum><header>Verifiable parental consent</header><text display-inline="yes-display-inline">The term <term>verifiable parental consent</term> has the meaning given that term in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>)).</text></paragraph></section> 
<section id="HAF42B08568494391AB2643E32DD781A2"><enum>3.</enum><header>Preventing harm to minors</header> 
<subsection id="H7CB8FF18FF564ADDA2F203BB9AFB1126"><enum>(a)</enum><header>In general</header><text>A covered platform shall establish, implement, maintain, and enforce reasonable policies, practices, and procedures that address the following harms to minors:</text> <paragraph id="HBC6B96CBACCA42E48F01CC7C335A0549" commented="no"><enum>(1)</enum><text>Threats of physical violence.</text></paragraph> 
<paragraph id="HD433B03E4075423792A5502AAC1B9AD8"><enum>(2)</enum><text>Sexual exploitation and abuse.</text></paragraph> <paragraph id="HFE58E174AC8545CE84014B1DBB620D61"><enum>(3)</enum><text>Distribution, sale, or use of narcotic drugs, tobacco products, cannabis products, gambling, or alcohol.</text></paragraph> 
<paragraph id="H96626B6FCCDB4EA2AEF3231A18E051A8" commented="no"><enum>(4)</enum><text>Any financial harm caused by deceptive practices. </text></paragraph></subsection> <subsection id="H676910A1D895466FA09ADC9AE86CEE67"><enum>(b)</enum><header>Considerations</header><text>The policies, practices, and procedures required under subsection (a) shall be appropriate to each of the following:</text> 
<paragraph id="HE180413D29E94FB987D6B59203BFE203"><enum>(1)</enum><text>The size and complexity of the covered platform.</text></paragraph> <paragraph id="HF58679C72C7348D39012BD2DBA051998"><enum>(2)</enum><text>The technological feasibility of addressing the harms described in subsection (a).</text></paragraph></subsection> 
<subsection id="HECAD9AA048204F0F9F1CC5A1801DD33C"><enum>(c)</enum><header>Rules of construction</header> 
<paragraph id="HBA5FDD585FCB47A58A91B58EBA126FB7"><enum>(1)</enum><header>Search for information and resources permitted</header><text>Nothing in subsection (a) may be construed to require a covered platform to prevent or preclude any minor from—</text> <subparagraph id="H058B1235F95743F1991F34D33904EFE4"><enum>(A)</enum><text>deliberately and independently searching for, or specifically requesting, content; or</text></subparagraph> 
<subparagraph id="H921650C150074C8BA472513C5CE1288E" commented="no"><enum>(B)</enum><text>accessing resources and information regarding the prevention or mitigation of the harms described in subsection (a).</text></subparagraph></paragraph> <paragraph id="HBB8835421C2249A381303511C5ABF14B" commented="no"><enum>(2)</enum><header>First amendment</header><text>Nothing in this section may be construed to allow a government entity to enforce subsection (a) based upon the viewpoint of users expressed by or through any speech, expression, or information protected by the First Amendment to the Constitution of the United States. </text></paragraph></subsection> </section> 
<section id="HC3E91C0765B940CA82BFBF6056CB726E"><enum>4.</enum><header>Safeguards for minors</header> 
<subsection id="H4DB1EC9EA2A6489A96E957B7F8B9C280"><enum>(a)</enum><header>Safeguards for minors</header> 
<paragraph id="H7B2999572C1B445BA7DB690BF7E3EAA6"><enum>(1)</enum><header>Safeguards</header><text>A covered platform shall provide a user or visitor to the covered platform, that the covered platform knows is a minor, with readily accessible and easy-to-use safeguards to, as applicable, do each of the following:</text> <subparagraph id="H3F38731A8A694B1899E53DFD3DE497F8"><enum>(A)</enum><text>Limit the ability of other users or visitors to communicate with the minor.</text></subparagraph> 
<subparagraph id="H2E6E29970D494496B4D382A62F7E1CC0"><enum>(B)</enum><text>Limit by default design features that result in compulsive usage of the covered platform by the minor.</text></subparagraph> </paragraph> <paragraph id="HF12B8123BA61463C9F137805D5453B2E"><enum>(2)</enum><header>Option</header><text>A covered platform shall provide a user that the covered platform knows is a minor with a readily accessible and easy-to-use option to limit the amount of time spent by the minor on the covered platform.</text></paragraph> 
<paragraph id="HD11165F6B7A8456F8B885832AD63B804"><enum>(3)</enum><header>Default safeguard settings for minors</header><text>A covered platform shall provide that, in the case of a user or visitor that the platform knows is a minor, the default setting for any safeguard described under paragraph (1) is the option available on the platform that provides the most protective level of control that is offered by the platform with respect to privacy and safety for that user or visitor.</text></paragraph></subsection> <subsection id="H841ED9423801492AB0A05749174A361D"><enum>(b)</enum><header>Parental tools</header> <paragraph id="H3B273C2036A346B6AECE88DD4885CB9F"><enum>(1)</enum><header>Tools</header><text>A covered platform shall provide readily accessible and easy-to-use parental tools for parents to support a user that the platform knows is a minor with respect to the use of the platform by that user.</text></paragraph> 
<paragraph id="H48D6A5621DF44708AD6953831AF11A65"><enum>(2)</enum><header>Requirements</header><text>The parental tools provided by a covered platform under paragraph (1) include each of the following:</text> <subparagraph id="H52746FFD697B47D29761B8788F341573"><enum>(A)</enum><text display-inline="yes-display-inline">The ability to manage the privacy and account settings of a minor, including any safeguard and option established under subsection (a), in a manner that allows parents to—</text> 
<clause id="H0C263B3A34034D64B55225544F29F88E"><enum>(i)</enum><text>view the privacy and account settings; and</text></clause> <clause id="H1663DC25C4D74B66991FEDF0EBB3BE37"><enum>(ii)</enum><text>in the case of a user that the platform knows is a child, change and control the privacy and account settings.</text></clause></subparagraph> 
<subparagraph id="HA782B460D29E46129A915FBC22AE4698"><enum>(B)</enum><text>The ability to restrict purchases and financial transactions by the minor, if applicable.</text></subparagraph> <subparagraph id="H2469AC9A331F44F7AB7B76928318E751"><enum>(C)</enum><text>The ability to view metrics of total time spent on the covered platform and restrict time spent on the covered platform by the minor.</text></subparagraph></paragraph> 
<paragraph id="H4489A84D591D47749F651EC833B652F7"><enum>(3)</enum><header>Notice to minors</header><text>A covered platform shall provide clear and conspicuous notice to a user when the tools described in this subsection are in effect and what settings or controls have been applied.</text></paragraph> <paragraph id="HADDD705DE00140D7A4F301F49AC809D3"><enum>(4)</enum><header>Default tools for children</header><text display-inline="yes-display-inline">In the case of a user that the platform knows is a child, a covered platform shall enable the tools required under paragraph (1) by default.</text></paragraph> 
<paragraph id="HA2C3785DCCF642219E153A41A147E858"><enum>(5)</enum><header>Application to existing accounts</header><text>If, before the effective date of this subsection, a covered platform provides a parent of a user that the platform knows is a child with notice and the ability to enable the parental tools described under this subsection in a manner that would otherwise comply with this subsection, and the parent opted out of enabling such tools, the covered platform is not required to enable such tools with respect to such user by default on and after the date on which this subsection takes effect.</text></paragraph></subsection> <subsection id="HDF82F70149514BB6A7C2B1BB63B54AEC"><enum>(c)</enum><header>Reporting mechanism</header> <paragraph id="H61BF333270C941AB95B6D871D565B062"><enum>(1)</enum><header>Reporting tools</header><text>A covered platform shall provide each of the following:</text> 
<subparagraph id="HBDBA22DB5AF9491C82A9B70CF130FA06"><enum>(A)</enum><text display-inline="yes-display-inline">A readily accessible and easy-to-use means for a user and visitor to a covered platform to submit a report to the covered platform of any harm to a minor related to use of the covered platform.</text></subparagraph> <subparagraph id="H0E5F66689A0F420ABA46D25F87679CBD"><enum>(B)</enum><text>An electronic point of contact specific to matters involving harms to a minor.</text></subparagraph> 
<subparagraph id="H9D6838CDA01344D8871DAE18BE22DB4D"><enum>(C)</enum><text>Confirmation of the receipt of such report and, within the applicable time period described in paragraph (2), a substantive response to the individual that submitted the report.</text></subparagraph></paragraph> <paragraph id="HBB870129958A4004B58470C010904FD2"><enum>(2)</enum><header>Timing</header><text>A covered platform shall establish an internal process to receive and substantively respond to a report submitted under paragraph (1) in a reasonable and timely manner, but in no case later than—</text> 
<subparagraph id="H8A6C5CECF9A54FAFA123E4CCFF2D5253"><enum>(A)</enum><text>10 days after the date on which the report is received; and</text></subparagraph> <subparagraph id="H101587C021394042A718AD300DE81041"><enum>(B)</enum><text>notwithstanding subparagraph (A), if the report involves an imminent threat to the safety of a minor, as promptly as needed to address the reported threat to safety.</text></subparagraph></paragraph></subsection> 
<subsection id="HE1303F7F78CF40E3A30007C367E5B81A"><enum>(d)</enum><header>Advertising of illegal products</header><text>A covered platform shall not facilitate the advertising of narcotic drugs, cannabis products, tobacco products, gambling, or alcohol to an individual that the covered platform knows is a minor.</text></subsection> <subsection id="HBC739ED853CF4964921AA07EF3AB591B"><enum>(e)</enum><header>Rules of application</header> <paragraph id="H8CDCDDA36D3D42FCBEB37BB60C32CD37"><enum>(1)</enum><header>Accessibility</header><text>With respect to safeguards and parental tools described under subsections (a) and (b), a covered platform shall provide each of the following:</text> 
<subparagraph id="H27FD73E947F34850BD004AF03DFB01C4" commented="no"><enum>(A)</enum><text>Information and control options in a clear and conspicuous manner that takes into consideration the differing ages, capacities, and developmental needs of the minors most likely to access the covered platform and does not encourage minors or parents to weaken or disable safeguards or parental tools.</text></subparagraph> <subparagraph id="HDD3F6EFCB572453794AC4BD8E1C274BD"><enum>(B)</enum><text>Readily accessible and easy-to-use controls to enable or disable safeguards or parental tools, as appropriate.</text></subparagraph> 
<subparagraph id="H94D96F5E26964DECAC9AFF8F0FDFD0F5"><enum>(C)</enum><text>Information and control options in the same language, form, and manner as the covered platform provides the product or service used by minors and their parents.</text></subparagraph></paragraph> <paragraph id="H62B2BBA4FA7744B59BF198F3DE6923F4"><enum>(2)</enum><header>Timing considerations; application of changes to offline devices or accounts</header><text display-inline="yes-display-inline">If the device of a user or user account does not have access to the internet at the time of a change to parental tools, a covered platform shall apply changes the next time the device or user is connected to the internet.</text></paragraph></subsection> 
<subsection id="HA7027E42B97745B39B0AE31B61DB319F"><enum>(f)</enum><header>Rules of construction</header><text>Nothing in this section may be construed to do any of the following:</text> <paragraph id="H00130E864BE146C69CB2A5D909BEA00C"><enum>(1)</enum><text>Prevent a covered platform from taking reasonable measures to—</text> 
<subparagraph id="H743F02AA28E046AEA0EA898A9C2241B2"><enum>(A)</enum><text>block, detect, or prevent the distribution of unlawful, obscene, or other harmful material to minors as described in section 3(a); or</text></subparagraph> <subparagraph id="H7BCEE6A3531E45DBBCB6C10E4B2002FE"><enum>(B)</enum><text>block or filter spam, prevent criminal activity, or protect the security of a platform or service.</text></subparagraph></paragraph> 
<paragraph id="H9A084EB82D2E49C08018D835B38E0B30"><enum>(2)</enum><text>Require the disclosure of the browsing behavior, search history, messages, contact list, or other content or metadata of the communications of a minor.</text></paragraph> <paragraph id="H58507EF4CC4E4A0A95410FD9A50989B1"><enum>(3)</enum><text>Prevent a covered platform from entering into an agreement with a third party, whose primary or exclusive function is to provide the safeguards or parental tools required under subsections (a) and (b) or to assist with meeting the requirements described under subsections (a) and (b).</text></paragraph> 
<paragraph id="H4256370AEE5F4BC6BFD3DF852585993C"><enum>(4)</enum><text display-inline="yes-display-inline">Prevent a parent or user from authorizing a third party described in subparagraph (3) to implement such safeguards or parental tools required under subsections (a) and (b).</text></paragraph></subsection></section> <section id="H7881C2319B2D4610A04D8EAC1C00455F"><enum>5.</enum><header>Disclosure</header> <subsection id="HFBAC7E87B77842B1957C697C7A8C89B1"><enum>(a)</enum><header>Notice</header> <paragraph id="H1DBDCB0D0103442E92B9DEB593F5AA41"><enum>(1)</enum><header>Registration or purchase</header><text>Before any registration or purchase on a covered platform by an individual that the platform knows is a minor, the platform shall provide clear, conspicuous, and easy-to-understand notice on each of the following:</text> 
<subparagraph id="HA35832011AF445FD9104D62316F3CD9E"><enum>(A)</enum><text>The policies and practices of the covered platform with respect to safeguards for minors.</text></subparagraph> <subparagraph id="H63F481F5D0C141B799BEDD7773F058E7"><enum>(B)</enum><text>Information about how to access the safeguards and parental tools required under section 4.</text></subparagraph> </paragraph> 
<paragraph id="HE91D7E02AB454D408356F46DB810C6E7"><enum>(2)</enum><header>Notification</header> 
<subparagraph id="HA3BD73E7A2A445228DCD90F8D666A96B"><enum>(A)</enum><header>Notice and acknowledgment</header><text>In the case of an individual that a covered platform knows is a child, the platform shall provide information about the parental tools and safeguards required under section 4 to a parent of the child and obtain verifiable parental consent.</text></subparagraph> <subparagraph id="H24BAD6C858784DBBACE2DDD27A722F38"><enum>(B)</enum><header>Reasonable effort</header><text>A covered platform shall be deemed to have satisfied the requirement described in subparagraph (A) if the covered platform is in compliance with the requirements of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) to use reasonable efforts (taking into consideration available technology) to provide a parent with the information described in subparagraph (A) and to obtain verifiable parental consent.</text></subparagraph></paragraph> 
<paragraph id="H5F6E038CA7334B6D892894E112DA0B6E"><enum>(3)</enum><header>Consolidated notices</header><text display-inline="yes-display-inline">For purposes of this section, a covered platform may consolidate the process for providing information and obtaining verifiable parental consent or the consent of the minor involved (as applicable) required under this subsection with the obligations of the covered platform to provide relevant notice and obtain verifiable parental consent under the Children’s Online Privacy Protection Act of 1998.</text></paragraph></subsection> <subsection id="H1034E39ADCB14E299312B53A8C1A7ADA" commented="no"><enum>(b)</enum><header>Advertising and marketing information and labels</header><text display-inline="yes-display-inline">A covered platform shall provide clear, conspicuous, and easy-to-understand labels and information, which may be provided through a link to another web page or disclosure, to minors on advertisements regarding the disclosure of endorsements of products, services, or brands made for commercial consideration by other users of the platform.</text></subsection> </section> 
<section id="H8E5175B2232247D5B5E63AE8AB8CEB69"><enum>6.</enum><header>Audit; report</header> 
<subsection id="H3E615E394877435CBD5C4702321BAFAA" commented="no"><enum>(a)</enum><header>Audit required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, a covered platform shall have an independent, third-party auditor conduct an independent, third-party audit of the covered platform.</text> </subsection> <subsection id="HA9E6DA2BC15746B188A7DB07CF6902FF"><enum>(b)</enum><header>Audit specifications</header> <paragraph id="HCB78AB1F670F40FEAEA3AE1526398E49"><enum>(1)</enum><header>Criteria</header><text>In conducting an audit required by subsection (a), an independent, third-party auditor shall do the following:</text> 
<subparagraph id="H32CC570A4ABE4C208BCCFCC5ECB57749"><enum>(A)</enum><text display-inline="yes-display-inline">Consider widely accepted or evidence-based approaches, best practices, frameworks, and methods related to the measures, safeguards for minors, and parental tools required under this Act.</text></subparagraph> <subparagraph id="H6F50B719BCE44F8B97AE9D2CA7CB8580"><enum>(B)</enum><text display-inline="yes-display-inline">Consider widely accepted or evidence-based approaches, best practices, frameworks, and methods related to identifying, preventing, and mitigating the harms to minors listed in section 3(a) of this Act.</text></subparagraph> 
<subparagraph id="H048259BF7C664BABB6DA41DD1596BAFD"><enum>(C)</enum><text display-inline="yes-display-inline">Consult with parents (including parents with relevant experience), public health and mental health nonprofit organizations, health and development organizations, and experts in freedom of expression about methods to identify, prevent, and mitigate such harms.</text></subparagraph> </paragraph> <paragraph id="H26BCE3398A324EE08BEB74B04040E2BD"><enum>(2)</enum><header>Contents</header><text>An audit required by subsection (a) shall include the following:</text> 
<subparagraph id="HFE2799D420AE4C3AB02A1D51E861898E"><enum>(A)</enum><text>An assessment of the extent to which the relevant covered platform is likely to be accessed by minors, including differences between children and teens.</text></subparagraph> <subparagraph id="H4B02A83CE1D14CB2AC420A1E54C8ABCC"><enum>(B)</enum><text>An accounting of the following:</text> 
<clause id="H07293B3549E04006A4ADE376582BB5E0"><enum>(i)</enum><text>The number of users using such covered platform that such covered platform knows to be minors located in the United States.</text></clause> <clause id="HA0102AF316DF4816AE08A16EED92F08C"><enum>(ii)</enum><text display-inline="yes-display-inline">The median and mean amounts of time spent on such covered platform by such users during the year in which such audit is conducted.</text></clause> 
<clause id="H3428B7F679CC4799B01E0B257E714080" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">A description of the policies, practices, and procedures implemented to address the harms described in section 3. </text></clause> <clause id="H2DEA183952004741B8B09339547DB6B4"><enum>(iv)</enum><text display-inline="yes-display-inline">The number of times that the safeguards for minors described in section 4(a) have been exercised during the year in which such audit is conducted.</text></clause> 
<clause id="H64089C5A184F42C29F7D24DAFC5B589C"><enum>(v)</enum><text display-inline="yes-display-inline">The number of times that the parental tools described in section 4(b) have been exercised during the year in which such audit is conducted.</text></clause> <clause id="HCAA37693C33549D0AF57AF6EB2071BAE"><enum>(vi)</enum><text display-inline="yes-display-inline">The number of reports received by such covered platform through the reporting mechanism described in section 4(c) during the year in which such audit is conducted.</text></clause></subparagraph> 
<subparagraph id="H2BA30BD822D640ED87713666AAED72FB"><enum>(C)</enum><text display-inline="yes-display-inline">A description of such safeguards for minors and parental tools that are available to minors and parents on such covered platform.</text></subparagraph> <subparagraph id="H49438E2DB4CC4FF68ADF827ABFA39020"><enum>(D)</enum><text display-inline="yes-display-inline">A description of how such covered platform handles reports received through such reporting mechanism, including the rate of response to such a report and the timeliness and substantiveness of any such response. </text></subparagraph> 
<subparagraph id="HA392F95320394D7094FB4B30D148535A"><enum>(E)</enum><text>A description of whether, how, and for what purpose such covered platform collects or processes categories of personal information of minors. </text></subparagraph> <subparagraph id="HD35ABFA60CEA4B558DAF125DE9A9E5C8" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">If the covered platform has a process used to create, implement, or evaluate the impact of a design feature of the covered platform used by minors, a description of such process. </text></subparagraph></paragraph> 
<paragraph id="HAD100F13854F458284B4DDC29322873F"><enum>(3)</enum><header>Cooperation by covered platform</header><text>A covered platform shall facilitate an audit of the covered platform required by subsection (a) by doing the following:</text> <subparagraph id="HA1F51613760C4E6EB598A31CA90405AC"><enum>(A)</enum><text>Provide or otherwise make available to the independent, third-party auditor that conducts such audit all information and materials in the possession, custody, or control of such covered platform relevant to such audit.</text></subparagraph> 
<subparagraph id="HFA4FEBE88EA14DCC8038886D2DC545A0"><enum>(B)</enum><text>Provide or otherwise make available to such auditor access to all networks, systems, and assets relevant to such audit.</text></subparagraph> <subparagraph id="HE84413A7C0324B6598567B052D5441CF"><enum>(C)</enum><text>Disclose all material facts to such auditor and not misrepresent any material fact.</text></subparagraph></paragraph></subsection> 
<subsection id="H957DC939103541B7813ECEBA197ECFE7"><enum>(c)</enum><header>Report to Commission</header><text>Not later than 30 days after the date on which an audit required by subsection (a) is completed, the relevant covered platform shall submit to the Commission the results of the audit.</text> </subsection> </section> <section id="HAAC67617C8A94A778E4717D7B389503A" section-type="subsequent-section"><enum>7.</enum><header>Enforcement</header> <subsection id="H296ECD3B9E1A4D948BF2A241BF275587"><enum>(a)</enum><header>Enforcement by Commission</header> <paragraph id="HC58A636DD45B4124AB314F5B86D81749"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices. </text></paragraph> 
<paragraph id="HBA93B2096ED64DAEBF5DA18D47F27200"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection> <subsection id="H01D3756DEA3D4669A32B09A02F20D601" commented="no"><enum>(b)</enum><header>Actions by States</header> <paragraph id="H3070D3EFE8794BC28C7B87C6DEB342EE" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State, or an official or agency of a State, has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by an act or practice in violation of this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in an appropriate State court or an appropriate district court of the United States to—</text> 
<subparagraph id="H8ADEC2D6F00C49C9B5484EBB644D1E0B" commented="no"><enum>(A)</enum><text>enjoin such act or practice;</text></subparagraph> <subparagraph id="H1D961F4A9C824E1A80134EB5A87ECAE3" commented="no"><enum>(B)</enum><text>enforce compliance with this Act;</text></subparagraph> 
<subparagraph id="H202C9E0FAF454592A449754DE1E2BB77" commented="no"><enum>(C)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></subparagraph> <subparagraph id="HFF50C1372DE449B48B5770C4BB182F9C" commented="no"><enum>(D)</enum><text>obtain such other legal and equitable relief as the court may consider to be appropriate.</text> </subparagraph></paragraph> 
<paragraph id="HCD33E7CE45FF499D848CEB9BA1D5FAE7" commented="no"><enum>(2)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general, official, or agency of the State involved shall provide to the Commission a written notice of such action and a copy of the complaint for such action. If the attorney general, official, or agency determines that it is not feasible to provide the notice described in this paragraph before the filing of the action, the attorney general, official, or agency shall provide written notice of the action and a copy of the complaint to the Commission immediately upon the filing of the action.</text></paragraph> <paragraph id="H467CF2009842479C93FFD290F5B1E8B0" commented="no"><enum>(3)</enum><header>Authority of Commission</header> <subparagraph id="H9FF1370CED3941C09B6B9C1AC4F21554"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (2) of an action under this subsection, the Commission shall have the right—</text> 
<clause id="HC28E9CCA3D0A4D2EACEC13C652052063" commented="no"><enum>(i)</enum><text>to intervene in the action; and </text></clause> <clause id="H09B53D8ED23742E0BC0646279A2C4E74"><enum>(ii)</enum><text>upon so intervening—</text> 
<subclause id="H6E26A3154C9744A8B0D115E775578E0E"><enum>(I)</enum><text>to be heard on all matters arising therein; and</text></subclause> <subclause id="HF1A048E764154EEF8E21FE0947A1843F" commented="no"><enum>(II)</enum><text>to file petitions for appeal.</text></subclause></clause> </subparagraph> 
<subparagraph id="HC4FA8FEF22B543B4B182549132485ADD" commented="no"><enum>(B)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Commission or the Attorney General of the United States has instituted a civil action for violation of this Act (referred to in this subparagraph as the <quote>Federal action</quote>), no State attorney general, official, or agency may bring an action under this subsection during the pendency of the Federal action against any defendant named in the complaint in the Federal action for any violation of this Act alleged in such complaint.</text></subparagraph> </paragraph> <paragraph id="HB0E3F7D850424D8B9B15283A2EE9A4C5" commented="no"><enum>(4)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this subsection, nothing in this Act shall be construed to prevent an attorney general, official, or agency of a State from exercising the powers conferred on the attorney general, official, or agency by the laws of such State to conduct investigations, administer oaths and affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text> </paragraph> </subsection></section> 
<section id="H974B999A7B074C1C98C4EAEAEDBEF75D"><enum>8.</enum><header>Kids Online Safety Council</header> 
<subsection id="HAB60AB230AF1439DB173714DED7FB0FC"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Commerce shall establish a Kids Online Safety Council (in this section referred to as the <quote>Council</quote>).</text></subsection> <subsection id="H865D5D7AF25847E1A8E1AE9599954A33"><enum>(b)</enum><header>Duties</header><text>The duties of the Council shall be to submit to Congress reports with recommendations and advice on matters related to the safety of minors online, including the following:</text> 
<paragraph id="H5595AA384B12460291BFC4E7B5386029"><enum>(1)</enum><text>An identification of risks, including emerging risks, for minors who engage with covered platforms.</text></paragraph> <paragraph id="H1806022557854AB682464AA124A5BEBC" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">An identification of the benefits for minors who engaged with covered platforms. </text></paragraph> 
<paragraph id="HD871D36E10C74BA387EC5138CC8CE296"><enum>(3)</enum><text>Recommendations with respect to methods for assessing, preventing, and mitigating harms to minors online.</text></paragraph> <paragraph id="HA2748064957F41DA9F8D0B1AAB574ACD"><enum>(4)</enum><text>Recommendations with respect to methods and themes for research regarding harms to minors online.</text></paragraph> 
<paragraph id="H18F807A2497D4700B307A9446C5CA701"><enum>(5)</enum><text>Recommendations with respect to best practices and clear, consensus-based standards for the reports and audits required under this Act, including best practices and standards with respect to methods, criteria, and scope that promote accountability.</text></paragraph></subsection> <subsection id="H97035130357846A1883910EBCE94C1DA"><enum>(c)</enum><header>Participation</header><text>In appointing members under subsection (c), the Secretary shall seek to ensure that the Council includes representatives of the following:</text> 
<paragraph id="H4101FAF32CF644BFB62B9A31AC9E23A9"><enum>(1)</enum><text>Academic experts with specific expertise in the prevention of harms to minors online.</text></paragraph> <paragraph id="HC7C28393BFE44A50BFD6F52F8A8DBC28"><enum>(2)</enum><text>Researchers with specific expertise with respect to social media.</text></paragraph> 
<paragraph id="H7F856A71B0E044D28450B30ADBFD2817"><enum>(3)</enum><text>Parents and minors with demonstrated experience with respect to the safety of minors online.</text></paragraph> <paragraph id="H43465EB446A945E69B0B919AE6E9C95C"><enum>(4)</enum><text>Educators with demonstrated experience with respect to the safety of minors online.</text></paragraph> 
<paragraph id="H4A0052D1DFB248BF9DBE7126EF6A4229"><enum>(5)</enum><text>Covered platforms.</text></paragraph> <paragraph id="HE1CD5618E2BF40278F3820C25297DAFF" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Experts in academia and civil society with specific expertise in constitutional law, privacy, free expression, access to information, and civil liberties.</text></paragraph> 
<paragraph id="H845D23166C294A46A716EA37FD707313"><enum>(7)</enum><text>State attorneys general or designees thereof who work in State or local government.</text> </paragraph></subsection> <subsection id="HED20A07789E246B685D8B1F33CEE0C70"><enum>(d)</enum><header>Timing of appointments</header><text>Each appointment under subsection (c) shall be made not later than the date that is 180 days after the date on which this Act takes effect (as specified in section 14).</text></subsection> 
<subsection id="H82D5640C43DC489693FC88069298CE3B"><enum>(e)</enum><header>Terms; vacancies</header><text>Each member of the Council shall be appointed for the life of the Council and a vacancy in the Council shall be filled in the manner in which the original appointment was made.</text></subsection> <subsection id="H716B21B8AB1A43F29B0F761EA1FA54B6"><enum>(f)</enum><header>Chair; Vice Chair</header><text>The Council, once fully appointed, shall select a Chair and Vice Chair of the Council.</text></subsection> 
<subsection id="H9609354761374BA9943167AD86993D1D"><enum>(g)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which this Act takes effect (as specified in section 14), the Council shall submit to Congress a final report that includes the following:</text> <paragraph id="H8C55C5DDFADC4C3F9E131F7CF4646C47"><enum>(1)</enum><text>A detailed statement of the findings and conclusions of the Council with respect to the recommendations and advice described in subsection (b).</text></paragraph> 
<paragraph id="H44DFB719F8A84EDC92841F01E75D646A"><enum>(2)</enum><text>The dissenting opinions of any member of the Council who does not support the findings and conclusions described in paragraph (1).</text></paragraph> <paragraph id="HD2DC480F5B3B4190BDE325CBD06DE779"><enum>(3)</enum><text>Any recommendations for legislative or administrative actions to address the online safety of minors.</text></paragraph></subsection> 
<subsection id="HF9A38B00D5DB4CA0B70DA722FC6E13AC"><enum>(h)</enum><header>Termination</header><text>The Council shall terminate on the date that is 30 days after the date on which the Council submits the final report of the Council under subsection (h).</text></subsection> <subsection id="H026A799FE8524B29961D6F933EF2E84E"><enum>(i)</enum><header>Nonapplicability of FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, does not apply to the Council.</text> </subsection></section> 
<section id="H04B3863271F7465C89D5F5781CA6D811"><enum>9.</enum><header>Rules of construction</header> 
<subsection id="H29E6F94EDFC54D7BB25D4DB13BE3F238"><enum>(a)</enum><header>Relationship to other laws</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to—</text> <paragraph id="H404E891932FA45EF80723FEBC72F251F"><enum>(1)</enum><text>limit or impair the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) or any rule or regulation promulgated under such Act;</text></paragraph> 
<paragraph id="H0A4D1B6CEC35437DBF849FD26AA9D1E7"><enum>(2)</enum><text>authorize any action in conflict with section 18(h) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(h)</external-xref>); or</text></paragraph> <paragraph id="H22B7D52C1D4346AD86446F1298835632"><enum>(3)</enum><text>expand, limit the scope of, or alter the meaning of section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>).</text></paragraph></subsection> 
<subsection id="HF60ECB467ECD4C57B629BCD186114F1B"><enum>(b)</enum><header>Compliance</header><text>Nothing in this Act may be construed to restrict the ability of a covered platform to—</text> <paragraph id="HAED531B61DC549E8BB7EB46F0EEA2CA1"><enum>(1)</enum><text>cooperate with a law enforcement agency regarding activity that the covered platform reasonably and in good faith believes may violate a Federal, State, or local law, rule, or regulation;</text></paragraph> 
<paragraph id="HD0608228A5084889810F8276B2F3F7F6"><enum>(2)</enum><text>comply with a lawful civil, criminal, or regulatory inquiry, subpoena, or summons from a Federal, State, local, or other government authority;</text></paragraph> <paragraph id="HA06EDD807D1C4563BE869FF949D6B5BC"><enum>(3)</enum><text>investigate, establish, exercise, respond to, or defend against a legal claim;</text></paragraph> 
<paragraph id="H7F5B94C639A440F18503A50B22391BE0"><enum>(4)</enum><text>prevent, detect, or respond to security incidents, identity theft, fraud, harassment, or any other malicious, deceptive, or illegal activity; or</text></paragraph> <paragraph id="HB2865A546316406B8253BFAB1998E986"><enum>(5)</enum><text>investigate or report an individual or entity responsible for an activity described in paragraph (4).</text></paragraph></subsection> 
<subsection id="H4307477B1DEA4C05B06CA9C0EECCF866" commented="no"><enum>(c)</enum><header>Protections for privacy</header><text>Nothing in this Act may be construed to require the affirmative collection of any personal information with respect to the age of users that a covered platform is not already collecting in the normal course of business.</text></subsection> </section> <section id="H0621D02745FC42BC9A75611B3FD16588"><enum>10.</enum><header>Relationship to State laws</header><text display-inline="no-display-inline">No State or political subdivision of a State may prescribe, maintain, or enforce any law, rule, regulation, requirement, standard, or other provision having the force and effect of law, if such law, rule, regulation, requirement, standard, or other provision relates to the provisions of this Act. </text></section> 
<section id="HE2BD8E811EE943EB98CAC8CE3F1F27B0"><enum>11.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided in this Act, this Act shall take effect on the date that is 18 months after the date of the enactment of this Act.</text> </section> <section id="H91BFA655BB03442BB35143803E8728C8"><enum>12.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of this Act to any person or circumstance is held invalid, the remaining provisions of this Act and the application of this Act to other persons or circumstances shall not be affected.</text> </section>
