<subsection id="H9EC3B487F9D5414CA0FEEF183CB0E940"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Children and Teens’ Online Privacy Protection Act</short-title></quote>.</text></subsection> <subsection id="H74D0162152364D3A89E4D498F3ECD6B9"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for this Act is as follows:</text>

<section id="HE743C64B3D9F4D99BD12245B47C9017A"><enum>2.</enum><header>Amendments to Children’s Online Privacy Protection Act of 1998</header> 
<subsection id="HD4DCF4AD69F2403F91FB4CEB748D9E1C"><enum>(a)</enum><header>Definitions</header><text>Section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) is amended—</text> <paragraph id="H7213836FF8844B3D97D46311814BC03B"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HC5A523E194084997BA14EDB3DECCC190"> 
<paragraph id="H17DA4B856B554ECC97EB0423A4E63C20"><enum>(2)</enum><header>Operator</header><text>The term <term>operator</term>—</text> <subparagraph id="HD005FE40F52D4D7ABA39530ACB3E7962"><enum>(A)</enum><text>means any person—</text> 
<clause id="H0306168F7E514FD8BD9C304114EB1B48"><enum>(i)</enum><text>who, for commercial purposes, operates or provides a website, an online service, an online application, or a mobile application; and</text></clause> <clause id="H05D22BE7B2BC480C849A98267BE76A43"><enum>(ii)</enum><text>who—</text> 
<subclause id="H85D5D91FCB634D27959F20AA02237C64"><enum>(I)</enum><text>collects or maintains, either directly or through a service provider, personal information of users of the website, service, or application;</text></subclause> <subclause id="HD4B7ECAE18C64CDCA2BF706A19C1E453"><enum>(II)</enum><text>allows another person to collect personal information directly from users of the website, service, or application (in which case, the operator is deemed to have collected the information); or</text></subclause> 
<subclause id="H7E1DD7BAED134F258FA0627C4F865571"><enum>(III)</enum><text>allows users of the website, service, or application to publicly disclose personal information (in which case, the operator is deemed to have collected the information); and</text></subclause></clause></subparagraph> <subparagraph id="H83E8CA8828824211932AA103431E072F"><enum>(B)</enum><text>does not include any organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7D25837DD44744E1AE92AFE79DA9594D"><enum>(2)</enum><text>in paragraph (4)—</text> <subparagraph id="H22FA4A3FA24F4B4398C7346455A99BCF"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H38B36FE2E25B4EF29549FDB9692F0A0D"> 
<subparagraph id="HB84C5F6704DB466FB55B8E4EFA7C0837"><enum>(A)</enum><text>the release of personal information collected from a child or teen by an operator for any purpose, except if the personal information is provided to a person other than an operator who—</text> <clause id="H98024B73CA934BEE82AD357F91D13D31"><enum>(i)</enum><text>provides support for the internal operations of the website, online service, online application, or mobile application of the operator, excluding any activity relating to individual-specific advertising provided to children or teens; and</text></clause> 
<clause id="HDAF8F05FB3124C469E5AE21BBA925E28"><enum>(ii)</enum><text>does not disclose or use the personal information for any other purpose; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HF5DBDA7EDEF64588B29F7134477C6C68"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="HE085DAD634B14EFDB9321B4E37BC1ADD"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i)—</text> <subclause id="HDDF91585D85342EFA825C5B53B4265B5"><enum>(I)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></subclause> 
<subclause id="H1430AA73FE7A4AC68619F6638A6DCDEE"><enum>(II)</enum><text>by striking <quote>website or online service</quote> and inserting <quote>website, online service, online application, or mobile application</quote>; and</text></subclause> <subclause id="H6E1F469F0B35409C84EF7613188DEC24" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by striking <quote>actual knowledge</quote> and inserting <quote>knowledge</quote>; and</text></subclause></clause> 
<clause id="HEA29AD9273A1432AB60D94F78466ECE2"><enum>(ii)</enum><text>in clause (i), by striking <quote>a website</quote> and inserting <quote>such a website, service, or application</quote>;</text> </clause></subparagraph></paragraph> <paragraph id="H2EFEA89C214A4077AA648CB328FE6633"><enum>(3)</enum><text>by amending paragraph (8) to read as follows:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H1C242C1BDD0645569D7549E8FC491C9B"><enum>(8)</enum><header>Personal information</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEA07C9D639064179970D69F58530E7B6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>personal information</term> means individually identifiable information about an individual collected online, including—</text> <clause commented="no" display-inline="no-display-inline" id="HD1199B4C925C4302933BC2ABA956D2E6"><enum>(i)</enum><text>a first and last name;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HD310DAD5C8C54F008F300F8D8A9AF27D"><enum>(ii)</enum><text>a home or other physical address, including a street name and a name of a city or town;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HFE973F3488A744DF8F0254ED0AB95DC4"><enum>(iii)</enum><text>an e-mail address;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HFAAB69A17CF64E3F85A7CB0D8E8BA49F"><enum>(iv)</enum><text>a telephone number;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H983E4D1CFC674001A9BFA45449D5E5AF"><enum>(v)</enum><text>a Social Security number;</text></clause> 
<clause id="H790A1B23851341C3B7002D6570B6517F"><enum>(vi)</enum><text>a persistent identifier that can be used to recognize a specific child or teen over time and across different websites, online services, online applications, or mobile applications, that—</text> <subclause id="H9A330C53CAD84025A096976FE8117DB0"><enum>(I)</enum><text>includes—</text> 
<item id="H9ECDB64A2ABE4D4899450815523815C7"><enum>(aa)</enum><text>a customer number held in a cookie;</text></item> <item id="H45CF3F52358D4AA9849A253F51B74F53"><enum>(bb)</enum><text>an Internet Protocol (IP) address;</text></item> 
<item id="HB7317D8B97D5420C9F00B213914CB438"><enum>(cc)</enum><text>a processor or device serial number; and</text></item> <item id="H9F8A226DB7BC4C0180691741926E31DC"><enum>(dd)</enum><text>a unique device identifier; and</text></item></subclause> 
<subclause id="H69BE36F5BD724187A6432018F3A1E336"><enum>(II)</enum><text>excludes an identifier that is used by an operator solely for providing support for the internal operations of a website, online service, online application, or mobile application of the operator;</text></subclause></clause> <clause id="HC76692FD597F453CB9DC371EBCFF3F50"><enum>(vii)</enum><text>a photograph, video, or audio file that contains the image or voice of a child or teen; </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H8DBDFD9C8C20463C872A548F4B784BC6"><enum>(viii)</enum><text display-inline="yes-display-inline">geolocation information;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HBA8A7D257CCA44B38F07F699431E18C1"><enum>(ix)</enum><text>information generated from the measurement or technological processing of the biological, physical, or physiological characteristics of an individual, including—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HCD639259526449AC923314EDA4CC6325"><enum>(I)</enum><text display-inline="yes-display-inline">fingerprints;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HF637218CA265436AB9E038E78C7F3E23"><enum>(II)</enum><text display-inline="yes-display-inline">voice prints;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H5ECC1BF5E8854C6C9C6CFF210D09AC36"><enum>(III)</enum><text>iris or retina imagery scans;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H5CF7F799B3BB43DEA857E1A66A33976D"><enum>(IV)</enum><text>facial templates;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HAFDE24FF0FFB49838732DCFE1FB72C12"><enum>(V)</enum><text>deoxyribonucleic acid (DNA) information; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H0548E4A7D5E14FDDA3B697029FEAF2D5"><enum>(VI)</enum><text>gait;</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H00D03F12D6D44C99BBAB016E01474F52"><enum>(x)</enum><text>information linked or reasonably linkable to a child or teen or a parent of a child or teen (including any unique identifier) that an operator collects online from the child or teen and combines with an identifier described in this subparagraph; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HBC068B61DA4945799AA69B55AC823071"><enum>(xi)</enum><text>any other identifier that the Commission determines permits the physical or online contacting of an individual.</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFBE4DA5C15C24FA7B90A8B319851E5E4"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>personal information</term> does not include an audio file that contains the voice of a child or teen if the operator—</text> <clause commented="no" display-inline="no-display-inline" id="H2E212D05BD4F48F4BB0A9BDA646BB753"><enum>(i)</enum><text display-inline="yes-display-inline">does not request information via voice that would otherwise be considered personal information under this paragraph;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB9C56D997FB54C7BBE1191EC99BE3761"><enum>(ii)</enum><text display-inline="yes-display-inline">provides clear notice in the privacy policy of a website, online service, online application, or mobile application of the operator regarding—</text> <subclause id="HDEA615B17C314742BD10F716BE297AC8" commented="no"><enum>(I)</enum><text>the collection and use of such an audio file; and</text></subclause> 
<subclause id="H6D29BC2A5FB942C2B03B2189A2A354EB" commented="no"><enum>(II)</enum><text>the deletion policy relating to such an audio file;</text> </subclause></clause> <clause commented="no" display-inline="no-display-inline" id="HC9DF6DE364AD4BB096285E7ED71567D6"><enum>(iii)</enum><text display-inline="yes-display-inline">only uses the voice contained in the audio file as a replacement for written words to perform a task or otherwise engage with such website, service, or application, including by conducting a search or fulfilling a verbal instruction or request;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HBB33AB6709954F799462A242EC3B9156"><enum>(iv)</enum><text display-inline="yes-display-inline">only maintains the audio file during the period necessary to complete the relevant task or engagement;</text></clause> <clause id="H331B26B706454765A6816728CCC51366"><enum>(v)</enum><text>does not make any other use of the audio file during such period; and</text></clause> 
<clause id="H9A5220CDCA2A4D71AF96F225C5B5C6E3" commented="no"><enum>(vi)</enum><text>deletes the audio file at the end of such period.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H37B1D15F1F344D919BCBDE2332887E96"><enum>(C)</enum><header>Support for the internal operations of a website, online service, online application, or mobile application</header> <clause commented="no" display-inline="no-display-inline" id="H1CE4830266164CECA26F62CBB60B5516"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(vi)(II), the term <term>support for the internal operations of a website, online service, online application, or mobile application</term> means the activities necessary to such website, service, or application to—</text> 
<subclause id="H254A2FBC60D14C25B58252E3C182EA94"><enum>(I)</enum><text>maintain or analyze functioning;</text></subclause> <subclause id="H54A2F43080E84D0DABAA705AA5D06825"><enum>(II)</enum><text>perform network communications;</text></subclause> 
<subclause id="H537C960842234BF3B21DE9879CD737A9" commented="no"><enum>(III)</enum><text>authenticate users;</text></subclause> <subclause id="HE31B5229A3B04186BF33DED81F864802"><enum>(IV)</enum><text>personalize content;</text></subclause> 
<subclause id="H309A5010BBDD4A2487E627EB53A030A4"><enum>(V)</enum><text display-inline="yes-display-inline">serve contextual advertising to users (if any persistent identifier is only used as necessary for technical purposes to serve the contextual advertisement or cap the frequency of contextual advertising);</text></subclause> <subclause id="H03068FC401F24D2486B9BD64ED9F551D"><enum>(VI)</enum><text>protect—</text> 
<item id="HC78B827C4B194826B5E38C26FBFD5837"><enum>(aa)</enum><text>the integrity of the website, service, or application; or</text></item> <item id="H298CB2EC235247B19CA1231F1506DECD"><enum>(bb)</enum><text>the personal information or security of users;</text></item></subclause> 
<subclause id="H799A50ADAFA14FEF82C970C942901A99"><enum>(VII)</enum><text>ensure compliance with Federal or State law; and</text></subclause> <subclause id="HEB438D0670064FD3AC844A950ABBF2A4"><enum>(VIII)</enum><text>fulfill a request of a child or teen under subparagraph (A), (B), or (C) of section 1303(b)(2).</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H8FE638C3386249AD83723616875906DF"><enum>(ii)</enum><header>Condition</header><text>Except as permitted under clause (i), information collected through the activities described in clause (i) may not be used or disclosed to contact an individual (including through individual-specific advertising provided to children or teens), to amass a profile on an individual, in connection with processes that encourage or prompt use of a website or online service, or for any other purpose.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HE6FE6D8E7B65488E82E9324CD16F79AA"><enum>(4)</enum><text>by amending paragraph (9) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HC748C6B1080C4CB8BB16D2E66E79FF5C"> 
<paragraph id="HEFFAEFBF583A4A3E887ED77C09D678AF"><enum>(9)</enum><header>Verifiable consent</header><text display-inline="yes-display-inline">The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology) by an operator, including a request for authorization for future collection, use, and disclosure of personal information, to ensure that a parent of a child (in the case of a child) or a teen (in the case of a teen)—</text> <subparagraph id="H651A33BDB6C341DCB596A378AE9A739C"><enum>(A)</enum><text display-inline="yes-display-inline">receives direct notice of the collection, use, and disclosure practices of the operator with respect to personal information; and</text></subparagraph> 
<subparagraph id="H33C4811580FE48ACA179B2DD0DA57C34"><enum>(B)</enum><text>before the personal information of the child or teen is collected, freely and unambiguously authorizes—</text> <clause id="HD1353125CC374038BEA1585FF3BC50DA"><enum>(i)</enum><text>the collection, use, and disclosure, as applicable, of the personal information; and</text></clause> 
<clause id="HE67AA18BA2F24CA6BA1D947CE350631A"><enum>(ii)</enum><text>any subsequent use of the personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H5A9B12D2618F40E0B56ED00DAEFFFDC7"><enum>(5)</enum><text>in paragraph (10)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC9CDB242063943D985ACBCEE6967BE4A"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text style="OLC" level="paragraph">Website or online service directed to children</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Website, online service, online application, or mobile application directed to children</header-in-text></quote>;</text></subparagraph> <subparagraph id="H9165A984EFA8445183641CB43E0F93D9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>website or online service directed to children</quote> each place it appears and inserting <quote>website, online service, online application, or mobile application directed to children</quote>;</text></subparagraph> 
<subparagraph id="HBE55EAE4636B42F6883BEAB1115EF4A5"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>commercial website or online service</quote> each place it appears and inserting <quote>website, online service, online application, or mobile application</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEF97EE748B7346BCA46A3BF2AC15A629"><enum>(D)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H3C3C13E8F83C48BCB8F6ECB38319676F"> 
<subparagraph id="HE79AFCEB42264173AF08FA3BA27F8113" commented="no"><enum>(C)</enum><header>Rule of construction</header><text>In considering whether a website, online service, online application, or mobile application, or a portion thereof, is directed to children, the Commission shall apply a totality of circumstances test considering competent and reliable evidence regarding the intended audience of the website, service, or application.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HAE50EA87194E4D9B9297200B2D40DB87"><enum>(6)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HFD11B3587C34494E81105FEABEBEBE9B"> 
<paragraph id="H4DD0F15CEE18434DB6D376AB23D2E649" commented="no"><enum>(13)</enum><header>Online application</header><text>The term <term>online application</term> means an internet-connected software program.</text> </paragraph> <paragraph id="H20B3519FD2DA41E4B50894BD846F804C" commented="no"><enum>(14)</enum><header>Mobile application</header><text>The term <term>mobile application</term> means a software program that runs on the operating system of—</text> 
<subparagraph id="HC23FEB7A630B44469A65F7190F139FDC" commented="no"><enum>(A)</enum><text>a cellular telephone;</text></subparagraph> <subparagraph id="H387C25AFAECC433CB0179E5969F73159" commented="no"><enum>(B)</enum><text>a tablet computer; or</text></subparagraph> 
<subparagraph id="H28E7D97C77EB4451B7F99263219E9180" commented="no"><enum>(C)</enum><text>a similar portable computing device that transmits data over a wireless connection.</text></subparagraph></paragraph> <paragraph id="HC0BD2ABB04C44FBA86AB652586520F98" commented="no"><enum>(15)</enum><header>Geolocation information</header><text>The term <term>geolocation information</term> means information sufficient to identify a street name and name of a city or town.</text></paragraph> 
<paragraph id="HCFCD785A4B2F4EA2AE9277EAF41BBD69" commented="no"><enum>(16)</enum><header>Teen</header><text>The term <term>teen</term> means an individual over the age of 12 and under the age of 17.</text></paragraph> <paragraph id="H7E07B1819609412AB23C0AFA4C04E938"><enum>(17)</enum><header>High-impact social media company</header><text display-inline="yes-display-inline">The term <quote>high-impact social media company</quote> means a website, online service, online application, or mobile application of an operator that—</text> 
<subparagraph id="HB6B37C7047FC4A69BDCA1AFF108E34ED"><enum>(A)</enum><text display-inline="yes-display-inline">generates $3,000,000,000 or more in annual revenue, including any revenue generated by any affiliate of such operator;</text></subparagraph> <subparagraph id="H3A64223F9C8548B0AEC2EC245C809412"><enum>(B)</enum><text>has 300,000,000 or more monthly active users for not fewer than 3 of the preceding 12 months on the website, online service, online application, or mobile application of such operator; and</text></subparagraph> 
<subparagraph id="H8854B618D1764C8A973EAE3F39391DCE"><enum>(C)</enum><text>constitutes an online product or service that is primarily used by users to access or share user-generated content.</text> </subparagraph></paragraph> <paragraph id="H827882D3C19847E795C79CB4D9639FC7"><enum>(18)</enum><header>Knowledge</header><text>The term <term>knowledge</term> means—</text> 
<subparagraph id="HCB3D2CD547B8497184CB2B69087D724E"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a high-impact social media company, the operator has actual knowledge, or willfully disregarded information that would lead a reasonable and prudent person to determine, that a user is a child or teen; and</text></subparagraph> <subparagraph id="H126A5D66EFF34C88BE67EA803B5026B8"><enum>(B)</enum><text>with respect to an operator that does not meet the requirements of subparagraph (A), actual knowledge.</text> </subparagraph></paragraph> 
<paragraph id="H103D06F27A4B43B99047914A5CC1C40F" commented="no"><enum>(19)</enum><header>Individual-specific advertising to children or teens</header> 
<subparagraph id="HD1E2E3BD570B40D1A6DE5967E76F0B18" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>individual-specific advertising to children or teens</term> means advertising or any other effort to market a product or service that is directed to a child or teen based on—</text> <clause id="H1AE565721BB54E40B1A707EDDD1FE76A" commented="no"><enum>(i)</enum><text>personal information of—</text> 
<subclause id="H866BA5C178EA479D82570325D14054EA" commented="no"><enum>(I)</enum><text>the child or teen; or</text></subclause> <subclause id="H62EE6798C23C445796863596846D375E" commented="no"><enum>(II)</enum><text>a group of children or teens who are similar in sex, age, household income level, race, or ethnicity to the child or teen to whom the product or service is marketed; or</text></subclause></clause> 
<clause id="HDCC377FFFD2640EA9E938036969BC0FF" commented="no"><enum>(ii)</enum><text>profiling of such child or teen or group of children or teens.</text></clause> </subparagraph> <subparagraph id="H0FD12416DF614E248ADC4F1C57242B1F" commented="no"><enum>(B)</enum><header>Exclusions</header><text>The term <term>individual-specific advertising to children or teens</term> does not include—</text> 
<clause id="H505F4443E98C4F338B1BB068DB95D02E" commented="no"><enum>(i)</enum><text>advertising or marketing to an individual or to a device of an individual in response to a request by the individual for information or feedback, such as a search query by a child or teen;</text></clause> <clause id="HA51DE6C6673F41BDB6479BD3B352C414" commented="no"><enum>(ii)</enum><text>contextual advertising, including if an advertisement is displayed based on the content of the website, online service, online application, or mobile application on which the advertisement appears and does not vary based on personal information of an individual who views the advertisement;</text></clause> 
<clause id="HC3A289D8EC774ADBB45B609720EC98B3" commented="no"><enum>(iii)</enum><text>processing personal information solely for measuring or reporting advertising or content performance, reach, or frequency, including through independent measurement; or</text></clause> <clause id="H44229F34717C42298E67E4AB0788A225"><enum>(iv)</enum><text display-inline="yes-display-inline">advertising or marketing directed to a device used by both adult and child or teen members of a household, if such advertising or marketing is directed only to services accessible through an adult user profile.</text></clause></subparagraph> 
<subparagraph id="H415F13A1305C48E58C4503DE0714BB8E" commented="no"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) may be construed to prohibit an operator with knowledge that a user is a child or teen from delivering advertising or marketing that is age-appropriate and intended for a child or teen audience, if the operator does not use any personal information other than whether the user is a child or teen.</text></subparagraph></paragraph> <paragraph id="H275CEB31E4234EBB9675192D52B4381D" commented="no"><enum>(20)</enum><header>Educational agency or institution</header><text display-inline="yes-display-inline">The term ‘educational agency or institution’ means—</text> 
<subparagraph id="H926AFEB6F497445489C6F329511F1A96" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a State educational agency or a local educational agency (as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)); and</text></subparagraph> <subparagraph id="H12D5C298C1734F8CB49BEB9C0359A4C8" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">an elementary school or secondary school (as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)).</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0B135470647044C6B0EF4461BCF3CEBD"><enum>(b)</enum><header>Online collection, use, disclosure, and deletion of personal information of children and teens</header><text>Section 1303 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text> <paragraph id="HFC5B8A459DB84096B38C9C2859A7CF17"><enum>(1)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="section" style="OLC">Online collection, use, disclosure, and deletion of personal information of children and teens.</header-in-text></quote>;</text></paragraph> 
<paragraph id="H7AF331F49C374F1EB5AC197EDBFD3DB8"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="HB91A3C766E1B432197131A54A9904B92"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>

<paragraph id="H39C30A6A9BC54210A43D4463FCC3FF0E"><enum>(1)</enum><header>In general</header><text>It is unlawful for an operator of a website, online service, online application, or mobile application directed to children or for any operator of a website, online service, online application, or mobile application with knowledge that a user of such website, service, or application is a child or teen—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE502FB8238EF40AFAC3F1062873D5B0F"><enum>(A)</enum><text display-inline="yes-display-inline">to collect personal information from a child or teen in a manner that violates the regulations promulgated under subsection (b);</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9672A63334884AB1938E3926A6F602F8"><enum>(B)</enum><text display-inline="yes-display-inline">to collect, use, disclose to third parties, or maintain personal information of a child or teen for the purpose of providing individual-specific advertising to children or teens (or to allow another person to collect, use, disclose, or maintain such information for such purpose);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HECF27F61BF8944B6B68C67D04AC7D6FE"><enum>(C)</enum><text display-inline="yes-display-inline">to collect personal information of a child or teen, except if the collection of the personal information is—</text> 
<clause id="HF902CDEA02044B98AE0F2379B9CE665B"><enum>(i)</enum><text>consistent with the context of a particular transaction or service or the relationship of the child or teen with the operator, including any collection necessary to fulfill a transaction or provide a product or service requested by the child or teen; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H192B571CC97B4B50B461B7241221F60C"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized or required by Federal or State law;</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H359BC08C958148CB88E70141F9DF6A57"><enum>(D)</enum><text display-inline="yes-display-inline">to retain the personal information of a child or teen for longer than is reasonably necessary to fulfill a transaction or provide a service requested by the child or teen, except as authorized or required by Federal or State law; or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HCE4FA5E0F6644076A6A5FBD3A3072F3C"><enum>(E)</enum><text display-inline="yes-display-inline">with respect to the personal information of a child or teen—</text> 
<clause id="HC9764B68D5EB421CB2784744CD27930A"><enum>(i)</enum><text display-inline="yes-display-inline">to store such information in a covered nation (as defined in section 4872(f) of title 10, United States Code), unless notice of such storage is provided to the parent of such child or to such teen, as the case may be;</text></clause> <clause id="H5903668E78CE4F458C83191B1500FD4F"><enum>(ii)</enum><text display-inline="yes-display-inline">to transfer such information to such a nation, unless notice of such transfer is provided to the parent of such child or to such teen, as the case may be; or</text></clause> 
<clause id="H26C53018AB50455FB404BB755C682E54"><enum>(iii)</enum><text display-inline="yes-display-inline">to provide such a nation with access to such information, unless notice of such access is provided to the parent of such child or to such teen, as the case may be.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HB252F54BECED41D2A7BA302A0B891677"><enum>(B)</enum><text>in paragraph (2)—</text>

<clause id="H155D574AE3C24B91B7360DEE1F44D215"><enum>(i)</enum><text>a description of the specific types of personal information collected from the teen by the operator, the method by which the operator obtains the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information;</text></clause> <clause id="HF2BE491ED618455A8712964C0BAD0DD3"><enum>(ii)</enum><text>the opportunity at any time to delete personal information collected from the teen or content or information submitted by the teen to a website, online service, online application, or mobile application of the operator;</text></clause> 
<clause id="H604C4B19B92946A6B56CAC56F29E51AA"><enum>(iii)</enum><text>the ability to refuse to permit the operator any further use or maintenance, in retrievable form or online collection, of personal information of the teen;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H0416245F31E2444C99E7859BA51A7AD5"><enum>(iv)</enum><text display-inline="yes-display-inline">the opportunity to challenge the accuracy of the personal information and, if the teen or parent establishes the inaccuracy of the personal information, to have such inaccurate personal information corrected; and</text></clause> 
<clause id="HA66ED96F55264621827094570176606E"><enum>(v)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of law, a means that is reasonable under the circumstances for the teen or parent to obtain any personal information collected from the teen, if such information is available to the operator at the time the teen or parent makes the request;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause> <clause commented="no" id="HF4C0ED57008742B494E80029F10A7EFA"><enum>(v)</enum><text>in subparagraph (D), as so redesignated—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H2309BB4132A44DD5BF9DD3225F9F3267"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>a child’s participation</quote> and inserting <quote>the participation of a child or teen</quote>; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HA7A356CE30904189B3212A85D57589B8"><enum>(II)</enum><text>by inserting <quote>or teen</quote> after <quote>the child</quote>; and</text></subclause></clause>

<item id="H2E18639EB2D446D1959C460F7AAE986E"><enum>(aa)</enum><text>by inserting <quote>or teen, as applicable,</quote> after <quote>parent</quote> each place the term appears; and</text></item> <item id="HE8956B549E4243CC8715F4BD3FCC09DF"><enum>(bb)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote>; and</text></item></subclause></clause> 
<clause id="HF6E50E01080D49C48FCAF770929BC747"><enum>(vi)</enum><text>in subparagraph (E)—</text> <subclause id="HE71B03F0399F4535B265CB6C5E4C81F5"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>website or online service</quote> and insert <quote>website, service, or application</quote>; and</text></subclause> 
<subclause id="H4990EF891DC0439380FA68176C108A49"><enum>(II)</enum><text>in clause (i), by striking <quote>its website</quote> and inserting <quote>the website, service, or application</quote>;</text> </subclause></clause></subparagraph> <subparagraph id="H1400D8E4D7B4428E945F71B965ECF40B"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (4) and inserting after paragraph (2) the following new paragraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HB6463041FCAD4A16A21135480A4246C9"> 
<paragraph id="HE8ADEFE642284D398D9AE7704919EEAC" commented="no"><enum>(3)</enum><header>Application to operators acting under agreements with educational agencies or institutions</header><text>The regulations promulgated under this subsection may provide that verifiable consent under paragraph (1)(A)(ii) is not required for an operator that acts under a written agreement with an educational agency or institution that requires—</text> <subparagraph id="HDC99B0DDEE7E419EB7FEB44863664378" commented="no"><enum>(A)</enum><text>the operator to—</text> 
<clause id="H7B57273D6FB146D5915C64FDAB864B5A" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">limit the collection, use, and disclosure by the operator of the personal information of a child or teen who is a student served by the educational agency or institution to solely educational purposes and for no other commercial purposes;</text></clause> <clause id="HAEDCB3C803704BB9A96D2FBDB02ADAA8" commented="no"><enum>(ii)</enum><text>provide notice to the educational agency or institution regarding the specific types of personal information the operator collects from such a child or teen, the method by which the operator obtains the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information;</text></clause> 
<clause id="HBAB5EBE7CC934C4EA4AAA746740184BE" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">provide to the educational agency or institution a link regarding the disclosure practices of the operator described in subsection (b)(1)(A)(i); and</text></clause> <clause id="H3E0169FBE286496890C90A9545ADB32A" commented="no"><enum>(iv)</enum><text>upon request by the educational agency or institution—</text> 
<subclause id="HE9AF08EFADBB436791B3F9166AB160E8"><enum>(I)</enum><text>provide the educational agency or institution with a means to review the personal information collected from such a child or teen;</text></subclause> <subclause id="H90EF74BD7E994D72AC6E35F9A5158482"><enum>(II)</enum><text>prevent any further use, maintenance, or collection of personal information of such a child or teen; and</text></subclause> 
<subclause id="HDF90CA48410B4DED835ECE776E905F01"><enum>(III)</enum><text>delete personal information collected from such a child or teen or content or information submitted by such a child or teen to the website, online service, online application, or mobile application of the operator;</text></subclause></clause></subparagraph> <subparagraph id="H9D696D9E32D5489989D5A0EB024095F0" commented="no"><enum>(B)</enum><text>a representative of the educational agency or institution to provide—</text> 
<clause id="H0EB19FF7A69C4D608B688F8813EDB255"><enum>(i)</enum><text>the name of the representative;</text></clause> <clause id="HD2B11B176C5342168C9B1FFF2CCF47B8"><enum>(ii)</enum><text>the title of the representative at the educational agency or institution; and</text></clause> 
<clause id="HF5359B84C08149E9B794A090F094B639"><enum>(iii)</enum><text display-inline="yes-display-inline">an acknowledgment that the representative has authority to permit the collection, use, and disclosure of personal information of children or teens who are students served by the educational agency or institution on behalf of the educational agency or institution; and</text></clause></subparagraph> <subparagraph id="H7FDB2E72882040AC9F3D72BB47B8B46C" commented="no"><enum>(C)</enum><text>the educational agency or institution to—</text> 
<clause id="HA295A241878F4E6C936A5C68C51883B8" commented="no"><enum>(i)</enum><text>provide on a publicly available website of the educational agency or institution a notice that—</text> <subclause id="H97623F1702B1437A8D50FBC0A9A7A26A"><enum>(I)</enum><text>identifies the operator with which the educational agency or institution has entered into a written agreement under this paragraph; and</text></subclause> 
<subclause id="H0D8C550064FE46A6935AE311C025F8C7"><enum>(II)</enum><text>includes the link described in subparagraph (A)(iii);</text></subclause></clause> <clause id="H7F9F862416EC4899AB609396260730D3" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">upon request, provide the notice described in subparagraph (A)(ii) to a parent (in the case of a child who is a student served by the educational agency or institution) or a parent or teen (in the case of a teen who is a student served by the educational agency or institution); and</text></clause> 
<clause id="H21D4D433CDE047B4B51423800C6E6C3E" commented="no"><enum>(iii)</enum><text>upon the request of a parent (in the case of such a child) or a parent or teen (in the case of such a teen), request the operator provide a means to review the personal information of such child or teen and provide such parent or teen a means to review the personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF03A90635B934AFEA583EC5334AEBE82"><enum>(D)</enum><text display-inline="yes-display-inline">by amending paragraph (4), as so redesignated, to read as follows:</text> 
<quoted-block id="HCA90A02795BA48E79CD796585786B417" style="OLC" act-name=""> 
<paragraph id="HBB176B807EF9403796CAA07D53E4C2BC"><enum>(4)</enum><header>Termination of service</header><text>The regulations promulgated under this subsection shall permit an operator to terminate service provided to a child for whom a parent has refused or a teen who has refused (under the regulations promulgated under paragraphs (1)(B)(ii) and (1)(C)(ii), respectively) to permit the operator any further use or maintenance, in retrievable form or online collection, of personal information of the child or teen.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFA94044C62C74458A129708EF58FDD06"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H916AB49A79A74210A08FA2E9BA576369"> 
<paragraph id="H25983DB73E964A578F697DEDA404C8C2" commented="no"><enum>(5)</enum><header>Continuation of service</header><text>The regulations promulgated under this subsection shall prohibit an operator from discontinuing service provided to a child or teen on the basis of a request by a parent of the child or by the teen (under the regulations promulgated under paragraphs (1)(B)(ii) and (1)(C)(ii), respectively) to delete personal information collected from the child or teen, to the extent that the operator is capable of providing such service without such information.</text></paragraph> <paragraph id="HF16077E23E414B6B9FCACA7172B151DA"><enum>(6)</enum><header>Rule of construction</header><text>A request to delete or correct personal information of a child or teen (under the regulations promulgated under paragraphs (1)(B) or (1)(C), respectively) may not be construed—</text> 
<subparagraph id="H0373900369B84C8F876C948402B80DA1"><enum>(A)</enum><text>to limit the authority of a law enforcement agency to obtain any content or information from an operator pursuant to a lawfully executed warrant or an order of a court of competent jurisdiction;</text></subparagraph> <subparagraph id="HBBC093AE4B0944C4A6B665BE19AB110C"><enum>(B)</enum><text>to require an operator to delete or correct information that—</text> 
<clause id="H2D3A5515B8554217807D422EC8E84616"><enum>(i)</enum><text display-inline="yes-display-inline">the operator is required to maintain under any other provision of Federal or State law; or</text></clause> <clause id="HC372208C95A040928C3DF728CEE0B9E8"><enum>(ii)</enum><text>was submitted to the website, online service, online application, or mobile application of the operator by any person other than the user who has requested that the content or information be deleted or corrected, including content or information submitted by the user that was republished or resubmitted by another person; or</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H052324634E7A41369E4BDFF81EE16EE8"><enum>(C)</enum><text display-inline="yes-display-inline">to prohibit an operator from—</text> <clause commented="no" display-inline="no-display-inline" id="HF72D35D7C1834CA88CAC566188708CE3"><enum>(i)</enum><text display-inline="yes-display-inline">retaining a record of the request for deletion or correction and the information necessary to comply with a request made under the regulations promulgated under paragraphs (1)(B) or (1)(C);</text></clause> 
<clause id="H8E7154F55FA64EC8B2154D1CC8EFE4D7"><enum>(ii)</enum><text>preventing, detecting, protecting against, or responding to security incidents, identity theft, or fraud, or reporting a person responsible for any such action;</text></clause> <clause id="HCC5D393EB16B4204A75336CE4448E155"><enum>(iii)</enum><text>protecting the integrity or security of a website, online service, online application, or mobile application of the operator; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H15942C510E5945D29EFF1D785EAADC18"><enum>(iv)</enum><text display-inline="yes-display-inline">ensuring that the personal information of the child or teen remains deleted.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H958E1F95D6C1427F800D7F5C85C39510"><enum>(7)</enum><header>Common verifiable consent mechanism</header> <subparagraph commented="no" display-inline="no-display-inline" id="HEB53BA5CA5424ED3A03F61F08115645D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header> <clause commented="no" display-inline="no-display-inline" id="HB119F2B2C4F54E68A90FF873C36C9F64"><enum>(i)</enum><header display-inline="yes-display-inline">Feasibility of mechanism</header><text display-inline="yes-display-inline">The Commission, with notice and public comment, shall assess the feasibility of allowing an operator to use a common verifiable consent mechanism that meets the requirements of this title. </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H8357F7FA796047268DD117110775FA7C"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">The feasibility assessment required by clause (i) shall consider whether a single operator could use a common verifiable consent mechanism to obtain verifiable consent from a parent of a child or from a teen on behalf of multiple, listed operators that provide a joint or related service.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H04F5F6F4B86B45AA8DD24F1196EBCA23"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report detailing the results of the feasibility assessment required by subparagraph (A)(i).</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC1AAB92D4EA64A2D81738B3417ABD8CA"><enum>(C)</enum><header>Regulations</header><text display-inline="yes-display-inline">If the Commission determines in the feasibility assessment required by subparagraph (A)(i) that the use of a common verifiable consent mechanism is feasible and meets the requirements of this title, the Commission shall promulgate regulations to permit the use of such a common verifiable consent mechanism in accordance with such determination. </text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HFA55EDA96A664405A65B3BC65D9456C9"><enum>(4)</enum><text>in subsection (c), by striking <quote>a regulation prescribed under subsection (a)</quote> and inserting <quote>subsection (a)(1) or a regulation promulgated under subsection (b)</quote>; and</text></paragraph> 
<paragraph id="H3EC6EDD28D324C268435D11A90B4D8AD"><enum>(5)</enum><text>by amending subsection (d) to read as follows:</text> <quoted-block style="OLC" id="H3446B96CC60A46BFB270ED72C4CDA017" display-inline="no-display-inline"> <subsection id="H7B9AB48940A44FC39A665067559E8906"><enum>(d)</enum><header>Preemption</header><text display-inline="yes-display-inline">No State, or political subdivision of a State, may maintain, enforce, prescribe, or continue in effect any law, rule, regulation, requirement, standard, or other provision having the force and effect of law that relates to the provisions of this Act. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD13753B7B7DD41C2952DA9838433975D"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text> <paragraph id="H54BFBBFF51034363A03F7C48531D2E29"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and teens</quote> after <quote>children</quote>; and</text></paragraph> 
<paragraph id="H56668066016E4A1EB66148622A81AE07"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H0FDC33898CEA4254BCA265AFC295FB20"> <subsection id="H71299655DE9249029B5864529C783A77"><enum>(d)</enum><header>Publication</header> <paragraph id="H22018EBAEED44BB3A7AAB35397C136CE"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Commission shall publish on the website of the Commission any report or documentation required under this title to be submitted to the Commission.</text></paragraph> 
<paragraph id="H4B95AF777F5A4E888B30411955083882"> <enum>(2)</enum> <header>Restrictions on publication</header> <text>Notwithstanding the publication requirement described in paragraph (1), the restrictions described in sections 6(f) and 21 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(f)</external-xref>; 57b–2) applicable to the disclosure of information obtained by the Commission shall apply in the same manner to any publication under paragraph (1).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4431ED642B1B4F0DAD5A201A1D3EA3D0" commented="no"><enum>(d)</enum><header>Actions by States</header><text>Section 1305 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6504">15 U.S.C. 6504</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H627FADF4B17E4DB28733B18EBDADFEA8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC174D88A75D14223952D37E53E0FAA1B"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>section 1303(a)(1) or</quote> before <quote>any regulation</quote>; and</text></subparagraph>

<subsection commented="no" display-inline="no-display-inline" id="H4ECD999AE729437093C4FFAAC042CC35"><enum>(e)</enum><header display-inline="yes-display-inline">Administration and applicability of Act</header><text>Section 1306 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6505">15 U.S.C. 6505</external-xref>) is amended—</text> <paragraph id="HAB510619F92D45BCA0362D34D10DDCB7"><enum>(1)</enum><text>in subsection (d)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2B653021084A4195BCD5CBA6CCC975D7"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>a rule of the Commission under section 1303</quote> and inserting <quote>section 1303(a)(1) or a regulation promulgated under section 1303(b)</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA3BAB0A806DB4E2FAD706B955F608186"><enum>(B)</enum><text>by striking <quote>such rule</quote> and inserting <quote>such section or such regulation</quote>; and</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7B9DDEFBD95F4B14967F73ABFDA6119A"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H71A9D7070FC14226BAB78C8EE9D78F95"> <subsection id="H977B3061B40A4CAB91552FB1CFCCCE4F"><enum>(f)</enum><header>Additional requirement</header><text>Any regulation promulgated under this title shall include a description and analysis of the impact of proposed and final rules on small entities per the Regulatory Flexibility Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H8C12BF6B311341E4B594077F02A53D22"><enum>3.</enum><header>Reports</header> 
<subsection id="HE1D1DF92960A4FF9B67754EA965E9AAA"><enum>(a)</enum><header>Oversight report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report detailing the processes of high-impact social media companies to ensure that, for such companies that are websites, online services, online applications, or mobile applications directed to children, such websites, services, or applications operate in accordance with this Act, including the amendments made by this Act and the regulations promulgated under this Act.</text></subsection> <subsection id="H99EFC9DB83514E26A0294B1B243D13A8"><enum>(b)</enum><header>Enforcement report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that details the following:</text> 
<paragraph id="HA83C5171A7D6446480CCD4292FB23615"><enum>(1)</enum><text>The number of actions brought by the Commission during the reporting year to enforce the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) (referred to in this subsection as the <term>Act</term>) and the outcome of each such action.</text></paragraph> <paragraph id="HAA6E7220E4BB411CA4493B912C60CBAC"><enum>(2)</enum><text>The number of investigations or inquiries into potential violations of the Act during the reporting year.</text></paragraph> 
<paragraph id="HCBA6DB0A51AB4A70B8966DCE178C9DBF"><enum>(3)</enum><text>The number of open investigations or inquiries into potential violations of the Act as of the date on which the report is submitted.</text></paragraph> <paragraph id="HEB7CEC0C0BF0412085CD5BF045586FD8"><enum>(4)</enum><text>The number and nature of complaints received by the Commission relating to an allegation of a violation of the Act during the reporting year.</text></paragraph> </subsection></section> 
<section id="H8316E3B4BA4846E8AE417596D5CBB1C0" commented="no"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of this Act to any person or circumstance is held invalid, the remaining provisions of this Act and the application of this Act to other persons or circumstances shall not be affected.</text> </section> </legis-body> </bill>
