<section id="H4E1D17B3189C40AA8D69F9F431382763" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting a Safe Internet for Minors Act</short-title></quote>.</text></section> <section id="HC34B39C08AF645E7BBBFC46FD51FA31C"><enum>2.</enum><header>Online safety for minors</header> <subsection id="H0B4A1BFB39B2494C94F862531C83315C"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Subtitle A of the Protecting Children in the 21st Century Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6551">15 U.S.C. 6551 et seq.</external-xref>) is amended by striking sections 211 through 214 and 216 and inserting the following:</text> 
<quoted-block style="OLC" id="H034826E5ECB54E5C99BED9276B1E6E41" display-inline="no-display-inline"> 
<section id="H0403D4F11FAD4250A9D424EA9A4F2998"><enum>211.</enum><header>Public awareness and educational campaign</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this section, the Commission, in partnership with the heads of other relevant agencies, State and local governments, nonprofit organizations, schools, industry, law enforcement, medical professionals, and other appropriate entities, shall carry out a program throughout the United States to promote the safe use of the internet by minors, that includes the following:</text> <paragraph id="H69ED7B3F140D462A95A5939A66F23758"><enum>(1)</enum><text>The identification, promotion, and encouragement of best practices for educators, online platforms, minors, and parents and guardians to protect minors online.</text></paragraph> 
<paragraph id="H2CD4AA84694B491DB701287AED9C8BB1"><enum>(2)</enum><text>The establishment and implementation of an outreach and education campaign throughout the United States that promotes online safety for minors.</text></paragraph> <paragraph id="H177F5A1D3E83496ABF21004136A38906"><enum>(3)</enum><text display-inline="yes-display-inline">The facilitation of access to, and the exchange of, information regarding online safety for minors to promote up-to-date knowledge regarding harms and risks negatively impacting or benefits positively impacting minors online.</text></paragraph> 
<paragraph id="HF03E5C3E579F47B3B84F72FCC35D4A77"><enum>(4)</enum><text>The facilitation of access to publicly accessible online safety education and public awareness efforts by other relevant agencies, State and local governments, nonprofit organizations, schools, industry, and other appropriate entities.</text></paragraph></section> <section id="HC4D61D3FF15A4C95AB4622D4E801E67F"><enum>212.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter for 10 years, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes the activities carried out under section 211.</text></section> 
<section id="H64B7657BB41C4BF1923BD5A3AAF079ED"><enum>213.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="HC8F7F7466A0044C39E9FCB1B0792B7C4" commented="no"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code.</text> </paragraph> 
<paragraph id="HBD800CE3DED845D989C6C3B1F7964AF3"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph> <paragraph id="HEC47C1141BB34E38888AB70F293E03FA"><enum>(3)</enum><header>Minor</header><text>The term <term>minor</term> means an individual under the age of 17.</text></paragraph> 
<paragraph id="H3C6E8E7DD15C45D59E8F8A855C6E00DF" commented="no"><enum>(4)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</text></paragraph> <paragraph id="HFE1B3F95A8424F478DA476A7321A46ED"><enum>(5)</enum><header>Online safety</header><text display-inline="yes-display-inline">The term <term>online safety</term> includes issues regarding the use of the internet in a manner that promotes safe online activity for minors through the following:</text> 
<subparagraph id="HBFC206A7FB2E4657A47C36938D6994EA" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Protecting minors from cybercrimes, access to narcotics, tobacco products, gambling, alcohol, and other adult content.</text></subparagraph> <subparagraph id="HF07A27BDB7EF4866B454247220EA07A4"><enum>(B)</enum><text>Preventing compulsive behavior online and other adverse impacts on the physical and mental health of minors.</text></subparagraph> 
<subparagraph id="HAF67338B14F64D15878C89D1D21B8827"><enum>(C)</enum><text display-inline="yes-display-inline">Facilitating the effective use of safeguards, parental controls, and other tools to empower parents, guardians, and minors to protect minors online.</text></subparagraph></paragraph> <paragraph id="H70BFFD64DB2E491695B418617E5FDE66" commented="no"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBC91F72D18F442428856828328A96BF5"><enum>(b)</enum><header>Technical and conforming amendments</header><text display-inline="yes-display-inline">The table of contents for subtitle A of the Protecting Children in the 21st Century Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6551">15 U.S.C. 6551 et seq.</external-xref>) is amended—</text> <paragraph id="HBD1BC94343B942E994C5A591FBADF3CB"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the items related to sections 211 through 214 and 216; and</text></paragraph> 
<paragraph id="HB7CABEE54F7B462FABBEA45954FCE921"><enum>(2)</enum><text>inserting before section 215 the following:</text> <quoted-block style="OLC" id="HC1C0359B6C12440FB824A7A72E031652" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 211.
