<section id="H0CADEB2B0E774B4186CDCAC90E5A9A50" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Algorithm Accountability Act</short-title></quote>.</text></section> <section id="H51CA5583D0FB4CEE803B8A0F5EE0DABF"><enum>2.</enum><header>Limitation of liability protection for certain social media platforms</header> <subsection commented="no" display-inline="no-display-inline" id="H6577993F3F6541F2850E2209C869052A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text>
<paragraph id="H2E9327DDA65D496CB3A2B20738DFEC32"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph> <paragraph id="H4D390521767D4B0488A4B6D911CC347B"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>

<subsection id="HAED542735ABE468A885215822D20D22C"><enum>(f)</enum><header>Algorithmic product design accountability</header>
<paragraph id="HA95D35C53DE145B9BCABCD1D78304082"><enum>(1)</enum><header>Duty of care in algorithmic design</header>
<subparagraph id="H35B7367159A749A1AEFC0DB2B6628058"><enum>(A)</enum><header>In general</header><text>A provider of a social media platform shall exercise reasonable care in the design, training, testing, deployment, operation, and maintenance of a recommendation-based algorithm on the social media platform to prevent bodily injury or death described in subparagraph (B) that a reasonable and prudent person would agree was—</text> <clause commented="no" display-inline="no-display-inline" id="H4551597921824FA89FF9DEB6F64C356A"><enum>(i)</enum><text display-inline="yes-display-inline">reasonably foreseeable by the provider; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HB70917881B624020AF86F941BD66784C"><enum>(ii)</enum><text display-inline="yes-display-inline">attributable, in whole or in part, to the design characteristics or performance of the recommendation-based algorithm.</text></clause></subparagraph> <subparagraph id="HAADE0EC649BA4CAE89F1DF6212B65239"><enum>(B)</enum><header>Covered bodily injury or death</header><text>Bodily injury or death described in this subparagraph, with respect to a social media platform, is bodily injury to or the death of a user of the social media platform, or bodily injury or death inflicted by a user of the social media platform upon another person, that arises from the operation of the recommendation-based algorithm.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H31EA04B61E69423995A2A3817472C0E6"><enum>(C)</enum><header>Exception</header>
<clause commented="no" display-inline="no-display-inline" id="HA3DE77304FE744EC842CCD8B00CAD4E6"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Subparagraph (A) shall not apply to the ranking, ordering, promotion, recommendation, amplification, or similar curation of content that is effectuated—</text> <subclause id="H2EF49A1B44AE4306A95069ECAD84C45B"><enum>(I)</enum><text>by sorting information chronologically or reverse chronologically; or</text></subclause>
<subclause id="HCD5C15E3B253431BA89323F2B353C40E"><enum>(II)</enum><text>to respond to an individual search for content on the social media platform initiated by a user.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H608E0BE71DFA4B83ACF50967C49F67C3"><enum>(ii)</enum><header>Exception limited to initial search</header><text>Nothing in clause (i)(II) shall be construed to limit the applicability of subparagraph (A) to a provider of a social media platform, with respect to the activities of a recommendation-based algorithm, after a user of the social media platform navigates beyond the initially populated search results.</text></clause></subparagraph>
<subparagraph id="HBECA1A85E7E6487DA645CCF4CB9A1E45"><enum>(D)</enum><header>First Amendment protections</header><text>Nothing in subparagraph (A) shall be construed to authorize the Commission to enforce that subparagraph based on the viewpoint of a user of a social media platform or of an information content provider expressed by or through any speech, expression, or information protected by the First Amendment to the Constitution of the United States.</text></subparagraph></paragraph> <paragraph id="HE028D46910E348299034DE742B2A56B4"><enum>(2)</enum><header>Enforcement</header> <subparagraph commented="no" display-inline="no-display-inline" id="H30FE9F78AB2C444E8E8E92397F990ACD"><enum>(A)</enum><header display-inline="yes-display-inline">Loss of liability protection</header><text>Subsection (c)(1) shall not apply to a provider of a social media platform that violates paragraph (1)(A) of this subsection. </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H94EB3EE8FA914083835D1B4C04D19270"><enum>(B)</enum><header display-inline="yes-display-inline">Private right of action</header><text>If a person suffers bodily injury or death as the result of a violation of paragraph (1)(A) by the provider of a social media platform, and the bodily injury or death meets the requirements under clauses (i) and (ii) of that paragraph and paragraph (1)(B), the person or, in the case of a minor or disabled person who suffers a bodily injury or any person who dies, the legal representative of such a person, may bring a civil action in a district court of the United States of competent jurisdiction against the provider for compensatory and punitive damages.</text></subparagraph></paragraph> <paragraph id="H17D6732E5A684596BBCCDE4A4126AB52"><enum>(3)</enum><header>Invalidity of predispute agreements and waivers</header> <subparagraph commented="no" display-inline="no-display-inline" id="H510ECA53B02A44A5BE0F48E936E3B735"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>No predispute arbitration agreement or predispute joint-action waiver (as those terms are defined in section 401 of title 9, United States Code) shall be valid or enforceable with respect to a dispute arising under this subsection.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3F3A2E2D79934E7883BEA63FDC8921E2"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">Any determination as to the scope or manner of applicability of subparagraph (A) shall be made by a court, rather than an arbitrator, without regard to whether an agreement described in that subparagraph purports to delegate such determination to an arbitrator.</text></subparagraph></paragraph> <paragraph id="HE0691DBE7AD04CCF93D4C0CD3A44BB53"><enum>(4)</enum><header>Relationship to other laws</header><text display-inline="yes-display-inline">Nothing in this subsection or any regulation promulgated thereunder shall be construed to prohibit or otherwise affect the enforcement of any Federal law or regulation or State law or regulation that is at least as protective of users of social media platforms as this subsection and the regulations promulgated thereunder.</text></paragraph>
<paragraph id="H36EFCAB6E6454D5F82E77B34ABAF0A90" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this subsection or the application of such provision to any person or circumstance is held to be unconstitutional, the remainder of this subsection and the application of the provision to any other person or circumstance shall not be affected.</text></paragraph> <paragraph id="HBAD0FF8A7CE24DAB8150E34DDA931A21"><enum>(6)</enum><header>Definitions </header><text>In this subsection:</text>
<subparagraph id="H5DEBBC43E0AD437591E6F3A6EE13AD31"><enum>(A)</enum><header>Recommendation-based algorithm</header><text>The term <term>recommendation-based algorithm</term> means, with respect to a user of a social media platform, a fully or partially automated system used to rank, order, promote, recommend, amplify, or similarly curate content, including other users, hashtags, or posts, based on the personal data of the user, including the preferences, interests, behavior, or characteristics of the user.</text></subparagraph> <subparagraph id="HA2449D4C1AEB497FA7B6A392935B91B3"><enum>(B)</enum><header>Social media platform</header><text>The term <term>social media platform</term>—</text>
<clause commented="no" display-inline="no-display-inline" id="H3D86C45F337D42D8A3ABD239DED2C68A"><enum>(i)</enum><text display-inline="yes-display-inline">means a for-profit interactive computer service that—</text> <subclause id="HA9CB4A9340B7499A82CD0AFCF45E8449"><enum>(I)</enum><text>permits a user to establish an account or create a profile for the purpose of allowing the user to create, share, or view content through the account or profile; and</text></subclause>
<subclause id="HEF55242CF08146CC8A8E00114995C637"><enum>(II)</enum><text>primarily serves as a service through which a user described in subclause (I) interacts with content; and</text></subclause></clause> <clause id="H6708BDB83A814971B3F975E5ACB6A69E"><enum>(ii)</enum><text>does not include an interactive computer service—</text>
<subclause id="H3D426A3E7BB24048B53EA4D0EC8A84B5"><enum>(I)</enum><text>that serves fewer than 1,000,000 registered users;</text></subclause> <subclause id="H4E2E68F6BF544317BC168E6C91D400B0"><enum>(II)</enum><text>that is—</text>
<item commented="no" display-inline="no-display-inline" id="H18A13574203C41F9BF2AA489F46EE07A"><enum>(aa)</enum><text display-inline="yes-display-inline">an email program;</text></item> <item commented="no" display-inline="no-display-inline" id="H39CB1DA19C394EC0A7E5383C443DBD62"><enum>(bb)</enum><text display-inline="yes-display-inline">an email distribution list;</text></item>
<item commented="no" display-inline="no-display-inline" id="H63422B90CE174E09A8135A7A7598A64D"><enum>(cc)</enum><text display-inline="yes-display-inline">a wireless messaging service; or </text></item> <item commented="no" display-inline="no-display-inline" id="HFA3F9A732025450BA2781F00D8738976"><enum>(dd)</enum><text display-inline="yes-display-inline">an online messaging service, the predominant or exclusive function of which is direct messaging, meaning messages are transmitted from the sender to a recipient and not posted within the interactive computer service or publicly;</text></item></subclause>
<subclause id="H0CEAD09CE7E748F39EAF68950E8C1A42"><enum>(III)</enum><text>that is a private platform or messaging service used by an entity solely to communicate with others employed by or affiliated with the entity;</text></subclause> <subclause id="HA1566A60F7D94EE294B3A15A2598810D"><enum>(IV)</enum><text>that is a teleconferencing or video conferencing service that allows reception and transmission of audio or video signals for real-time communication, provided that the real-time communication is initiated by using a unique link or identifier to facilitate access; or</text></subclause>
<subclause id="HBD2AE801D5254E5A9E5F784D69BDFA12"><enum>(V)</enum><text>that is an internet-based platform whose primary purpose is—</text> <item id="H63D0ED7B55D8401E98A4072671BE536A"><enum>(aa)</enum><text>to allow users to post product reviews, business reviews, or travel information and reviews;</text></item>
<item id="H5B480D71E7614A6F9EFCF93FF2253720"><enum>(bb)</enum><text>internet commerce, which may include providing a comment section;</text></item> <item id="H0E9C6FE9B5DB48D18CF44F7C0CA7B29E"><enum>(cc)</enum><text>to allow users to stream music, audiobooks, or podcasts; or</text></item>
<item id="HD71E0E697AB14BE98E73BA4949917612"><enum>(dd)</enum><text>news or sports coverage.</text></item></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6AD15EDBA74441BE9D46CBAD38150ECE"><enum>(b)</enum><header>Technical and conforming amendments</header> <paragraph id="HAA52557357E54A7FB4BCED54EB507DB2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Trademark Act of 1946</header><text>Section 45 of the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 5, 1946 (commonly known as the <quote>Trademark Act of 1946</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>), is amended, in the definition relating to the term <term>Internet</term>, by striking <quote>section 230(f)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)(1)</external-xref>)</quote> and inserting <quote>section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>)</quote>.</text></paragraph>
<paragraph id="HA36B845D52534598BA92EC405E2D7117"><enum>(2)</enum><header>Title 18, United States Code</header><text>Section 2421A of title 18, United States Code, is amended—</text> <subparagraph id="H47947E4A537248988BD9927AEB1BCFB3"><enum>(A)</enum><text>in subsection (a), by striking <quote>(as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>))</quote> and inserting <quote>(as that term is defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>))</quote>; and</text></subparagraph>
<subparagraph id="HB40F4484207E4499B59DF090161B1F2A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in subsection (b), by striking <quote>(as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>))</quote> and inserting <quote>(as that term is defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>)</quote>.</text></subparagraph></paragraph> <paragraph id="HAFD090B3D61B4B449563A0D4522F252D"><enum>(3)</enum><header>Webb-Kenyon Act</header><text>Section 3(b)(1) of the Act entitled <quote>An Act divesting intoxicating liquors of their interstate character in certain cases</quote>, approved March 1, 1913 (commonly known as the <quote>Webb-Kenyon Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/27/122b">27 U.S.C. 122b(b)(1)</external-xref>), is amended by striking <quote>(as defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)</quote> and inserting <quote>(as defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>))</quote>.</text></paragraph>
<paragraph commented="no" id="H03157406C01F4E9999DF49B35CCAFD7D"><enum>(4)</enum><header>Title 31, United States Code</header><text>Section 5362(6) of title 31, United States Code, is amended by striking <quote>section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)</quote> and inserting <quote>section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>)</quote>.</text></paragraph></subsection></section> </legis-body></bill>
