which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Environmental Protection Agency to authorize manufacturers of certain vehicles to suspend engine derate or shutdown functions in prolonged cold weather conditions, and for other purposes.</official-title></form><legis-body id="H80BCD715D3EA4FD4A9B02FE5075790FC" style="OLC"><section id="H3689B6D75872473DA15ACB04FAC178D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cold Weather Diesel Reliability Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H63B944C3B0FC4FD7953E614D9B438F05"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="H19A5125354414798B8FD83E5EA669747"><enum>(1)</enum><text display-inline="yes-display-inline">diesel vehicles are vital for critical transportation and emergency services in cold weather regions;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H29F65947264E4BA5A47589402C39D989"><enum>(2)</enum><text>in rural regions with prolonged freezing conditions, diesel exhaust fluid storage, supply, and system functionality are frequently unreliable and logistically impractical on a year-round basis;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6092D718761A468A960E24FB50A53C58"><enum>(3)</enum><text>automatic engine shutdowns and power reductions due to emissions control malfunctions in extreme cold pose serious, life-threatening risks; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1147B3A0C2E94F73871C0F2A30605DE4"><enum>(4)</enum><text>emissions safeguards under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) were never intended to jeopardize human safety or impede critical mobility.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HC726882E2F5C41E68F5B06279938B5B2"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H02D8189B775E49EEAFD8AA77EDFEA955"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H7D465B8DD501403D8CD4C219BF95C839" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Covered manufacturer</header><text>The term <term>covered manufacturer</term> means the manufacturer (as defined in section 216 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7550">42 U.S.C. 7550</external-xref>)) of a covered vehicle or an engine of a covered vehicle.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H939F508BA8A149C1874E9575E3572328"><enum>(3)</enum><header>Covered vehicle</header><text>The term <term>covered vehicle</term> means an on-highway diesel vehicle or nonroad diesel equipment.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HFC29CFD651194E518B24E6591331196F"><enum>4.</enum><header>Diesel engine emissions relief in cold weather regions</header><subsection commented="no" display-inline="no-display-inline" id="H579DBBF2E9FC439C89EE784A040C8B97"><enum>(a)</enum><header display-inline="yes-display-inline">Cold weather sensor mitigation measures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall revise any applicable regulation under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) that applies to covered vehicles or engines used in covered vehicles to authorize covered manufacturers to suspend inducement-related engine derate or shutdown functions that are triggered by emissions control system faults when ambient temperatures are at or below zero degrees Centigrade and to specify that no party other than a covered manufacturer shall suspend those inducement-related derate or shutdown functions, subject to the conditions that—</text><paragraph id="H5658120A2865475CB341B7703B65EA1E"><enum>(1)</enum><text>the engine returns to normal emission control operation, including inducement enforcement, once ambient temperatures rise above zero degrees Centigrade; and</text></paragraph><paragraph id="HA5438707133641C3A39E4CE3C659B0C4"><enum>(2)</enum><text>continued maximum engine performance when ambient temperatures are at or below zero degrees Centigrade is necessary to prevent occupational danger, equipment failure, or loss of essential transportation functionality in remote areas with limited roadside support or emergency communications access.</text></paragraph></subsection><subsection id="HC537E47B8EDF4B3AA97FFDA1CF3492FC"><enum>(b)</enum><header>Relief to regions with prolonged freezing conditions</header><paragraph commented="no" display-inline="no-display-inline" id="H93F9E33955AD4A29B881F49F6F46BF57"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall revise any applicable regulation under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) to grant a year-round exemption from diesel exhaust fluid system requirements any covered vehicle that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD055EFE0113B4EF0AEAF75CF2E8FD90F"><enum>(A)</enum><text display-inline="yes-display-inline">is primarily operated north of 59 degrees north latitude, as demonstrated by documentation of commercial operation, domicile location, or maintenance and dispatch records; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H27099F32697F4747A8C2B0AD278EEBA8"><enum>(B)</enum><text>encounters operational or logistical conditions characterized by prolonged ambient temperatures that—</text><clause commented="no" display-inline="no-display-inline" id="H8FDAC06986AD4034B9B53BD39F15829F"><enum>(i)</enum><text display-inline="yes-display-inline">are below the freezing point of diesel exhaust fluid; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HAE5B425166CD4832A5D239B5A6657FDC"><enum>(ii)</enum><text>otherwise make the use of the diesel exhaust fluid system impractical.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2539F5524036419C8F79B7C574D11378"><enum>(2)</enum><header>Scope of relief</header><text>In carrying out paragraph (1), the Administrator shall grant to a covered vehicle described in subparagraph (A) or (B) of that paragraph an exemption from any requirement to include an engine derate or shutdown function that is triggered by the absence, degradation, malfunction, or fault of a diesel exhaust fluid system, including any associated sensors or electronic control modules.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H539C69483F8C4BFFBFF9FE0F0310387B"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act waives compliance with any emissions standard under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) outside of—</text><paragraph commented="no" display-inline="no-display-inline" id="H8581F8A5B9AE47A18A7933AD51377A25"><enum>(1)</enum><text display-inline="yes-display-inline">the temporary cold-weather operational mode authorized under section 4(a); and</text></paragraph><paragraph id="H90DC5717853B4FD298E7DC54C915809E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the exemption from diesel exhaust fluid system requirements under section 4(b).</text></paragraph></section></legis-body></bill>
