 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Everyone Access Long Term Healthcare Act of 2025</short-title></quote> or the <quote><short-title>HEALTH Act of 2025</short-title></quote>.</text></section><section id="H3B09F62C4FD947A9809F2FD37D1F3164"><enum>2.</enum><header>Deduction for qualified charity care</header><subsection id="H6A9790A7A54446E780A48A5CE8890A9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part VII of subchapter B of chapter 1 of subtitle A of the Internal Revenue Code of 1986 is amended by redesignating section 226 as section 227 and inserting after section 225 the following new section:</text><quoted-block style="OLC" id="HB01EEF430E4549BBAA26091F8ED63DF8" display-inline="no-display-inline"><section id="H722CAE1E09944EB885F086B62DA0C964"><enum>226.</enum><header>Qualified charity care</header><subsection id="H60796DE1A632476184B71387A50AE498"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a physician (as defined in section 1861(r) of the Social Security Act), there shall be allowed as a deduction for the taxable year an amount equal to the unreimbursed Medicare-based value of qualified charity care furnished by such taxpayer during such year.</text></subsection><subsection id="H4EC81E6BE2F84325B1FCAC1AFCCF49AE"> <enum>(b)</enum> <header>Unreimbursed medicare-Based value</header> <text display-inline="yes-display-inline">For purposes of this section, the term ‘unreimbursed Medicare-based value’ means, with respect to qualified charity care, the amount payable for such care under the physician fee schedule established under section 1848 of the Social Security Act.</text>
 </subsection><subsection id="HA75D76858D7D43328A4A386951605CEC"><enum>(c)</enum><header>Qualified charity care</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="H395CF1855A20496D9E94716FD9D42CFB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>qualified charity care</quote> means physicians’ services that are furnished—</text><subparagraph id="H29B9BA5B065946189C1A3C90DCE1BC0E"><enum>(A)</enum><text>without reimbursement or the expectation of reimbursement, and</text></subparagraph><subparagraph id="HFE320698BA254B85AA6511BE054D0552"><enum>(B)</enum><text>to an individual enrolled—</text><clause id="H6114E031EEA4499ABD84AA4322BD0BA5"><enum>(i)</enum><text>under a State plan under title XIX of the Social Security Act (or a waiver of such plan), or</text></clause><clause id="H83884B00F5614C89966EE013FBDCB36B"><enum>(ii)</enum><text>under a State child health plan under title XXI of the Social Security Act (or a waiver of such plan).</text></clause></subparagraph></paragraph><paragraph id="H17510DAA9F38424C9D40CF3BC66C2157"><enum>(2)</enum><header>Exclusion</header><text>The term ‘qualified charity care’ does not include—</text><subparagraph id="H556A552914C940679997D8124105CAA9"><enum>(A)</enum><text>services for which funding is prohibited under sections 506 and 507 of title V of division D of the Further Consolidated Appropriations Act, 2024,</text></subparagraph><subparagraph id="HCCFB523715F248BE950F34BA0EED5CE7"><enum>(B)</enum><text>sex reassignment surgeries furnished for the purpose of the gender alteration of a transgender individual, or</text></subparagraph><subparagraph id="HE5148FABC44C4D248B9758F884D5E3A3"><enum>(C)</enum><text>hormone treatments furnished for the purpose of the gender alteration of a transgender individual.</text></subparagraph></paragraph></subsection><subsection id="HE4939A426A72459E8854C5BF8D1C8DA8"><enum>(d)</enum><header>Physicians’ services</header><text>For purposes of this section, the term ‘physicians’ services’ has the meaning given such term by section 1861(q) of the Social Security Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDC0269EFA1E54D2A8950E9F0C36A9F45"> <enum>(b)</enum> <header>Deduction allowed to non-Itemizers</header> <text>Section 63(b) of such Code is amended—</text>

          <enum>(1)</enum>
 <text>in paragraph (6), by striking <quote>and</quote>,</text> </paragraph> <paragraph id="HF76D033B13D644AE873C917DA202B02A"> <enum>(2)</enum> <text>in paragraph (7), by striking the period and inserting <quote>, and</quote>, and</text>
        </paragraph>

          <enum>(3)</enum>
 <text>by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H12BB79E61C0A49D594423157664881CE" display-inline="no-display-inline"> <paragraph id="H056267F263274D0B8E57D59C40136036"> <enum>(8)</enum> <text display-inline="yes-display-inline">the deduction provided in section 227.</text>

 </subsection><subsection id="H58C06BF83446427B830668FA109A1240"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part VII of subchapter B of chapter 1 is amended by redesignating the item relating to section 226 as relating to section 227 and by inserting after the item relating to section 223 the following new item:</text><quoted-block style="OLC" id="H17D2D536081943D9AF16C96C570F40E1" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry idref="H722CAE1E09944EB885F086B62DA0C964" level="section">Sec. 226. Qualified charity care.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H485615DF14524E12B8F5A9EF3931648A"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to qualified charity care (as defined in section 199B(c) of such Code) furnished after December 31, 2025.</text></subsection></section><section id="HC7261C06FE35475CA070F410B873C417" section-type="subsequent-section"><enum>3.</enum><header>Limitation on liability for physicians furnishing qualified charity care</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 224 (<external-xref legal-doc="usc" parsable-cite="usc/42/233">42 U.S.C. 233</external-xref>) the following:</text><quoted-block style="OLC" id="HAA04F72160D14162B73587E754838794" display-inline="no-display-inline"><section id="H6274EDF02F5C408AAF15A975FCC7B667"><enum>224A.</enum><header>Limitation on liability for physicians furnishing qualified charity care</header><subsection id="HA3C8F600B73649D99FE17CC99D5C592E"><enum>(a)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">A physician or attending medical personnel shall not be liable under Federal or State law in any civil action for any harm caused by an act or omission of such physician or attending medical personnel, if such act or omission—</text><paragraph id="H3FCF3B19BEFE428E9467B03AC9AFD28B"><enum>(1)</enum><text display-inline="yes-display-inline">occurred in the course of furnishing qualified charity care (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/199B">section 199B</external-xref> of the Internal Revenue Code of 1986); and</text></paragraph><paragraph id="H599D0ECA4F8D4104A14BA8F2CE06EBE8"><enum>(2)</enum><text>was not intentional, knowing, reckless, or grossly negligent.</text></paragraph></subsection><subsection id="HE4DE4A5F413449B5897E2D67ACA87425"><enum>(b)</enum><header>Preemption</header><text display-inline="yes-display-inline">This section preempts the laws of a State or any political subdivision of a State to the extent that such laws are inconsistent with this section, unless such laws provide greater protection from liability for a defendant.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
