<section id="HAB4149DC49A14BA6948A106D9AC9C88D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Resources for our Schools Act</short-title></quote> or the <quote><short-title>SROS Act</short-title></quote>.</text></section> <section id="H5966F542F1EF448CBC74E88279636BE6"><enum>2.</enum><header>Exclusion from gross income of retirement income received by school resource officers</header> <subsection commented="no" display-inline="no-display-inline" id="HE35DC4242F1E4E4FA90311823DDE9136"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986, as amended by section 70435(a) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended by inserting after section 139L the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="HC8CDEE7FE81C4D8C8E9B0D2E79CBC2B4"><enum>139M.</enum><header>Retirement income received by school resource officers</header>
<subsection commented="no" display-inline="no-display-inline" id="H49068B094E9B4FF9BD8E8F4190F5BF00"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to subsection (e), in the case of an individual described in subsection (b) who is employed as a school resource officer during a taxable year, with respect to any period in such taxable year in which such individual is so employed, gross income shall not include any retirement income received by such individual during such period.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8F3C60C14F3F41E68D09D292E6F958BE"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">An individual is described in this subsection if such individual—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H627C416F67DA4DEA849D4FE3AF751677"><enum>(1)</enum><text display-inline="yes-display-inline">has retired from employment as—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H11C6A47B2DD247799350FBDBBA149E2F"><enum>(A)</enum><text display-inline="yes-display-inline">a member of the Armed Forces of the United States, or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDAA30B36EBB94A539B2EF2475D1A7A7C"><enum>(B)</enum><text display-inline="yes-display-inline">a law enforcement officer (as defined in section 2503 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10533">34 U.S.C. 10533</external-xref>)),</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H3A487524267A4D00B1CEA809647EC67F"><enum>(2)</enum><text display-inline="yes-display-inline">is employed as a school resource officer after having successfully cleared any background check required for such employment, and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDD2A8AAD322E4BC092570E42A03AAE0E"><enum>(3)</enum><text>is in compliance with all applicable requirements of the peace officer standards and training agency of the State in which such individual is employed as a school resource officer.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H0C751216A1C94BEA93B1809C87D40D5E"><enum>(c)</enum><header>Retirement income</header><text>For purposes of this section, the term <term>retirement income</term> means any otherwise includible income, distribution, or payment received by an individual from any pension, annuity, retirement income account, defined contribution plan, or defined benefit plan which is associated with employment described in subsection (b)(1).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H556923D5BBD14BD3AB7A504F3994A1FC"><enum>(d)</enum><header display-inline="yes-display-inline">Other definitions</header><text>In this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="HEE5D65FB575942B8B26049607497682B"><enum>(1)</enum><header display-inline="yes-display-inline">Peace officer standards and training agency</header><text>The term <term>peace officer standards and training agency</term> means an agency of a State with the statutory authority under State law to set standards for the hiring, training, ethical conduct, and retention of the law enforcement officers of the State through certification, licensing, or other similar qualification process.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H71FF1FBD0ED64D6A88DC85C574E0E4BF"><enum>(2)</enum><header display-inline="yes-display-inline">School resource officer</header><text display-inline="yes-display-inline">The term <term>school resource officer</term> has the same meaning given such term under section 1709 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10389">34 U.S.C. 10389</external-xref>).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8971A378480F458B82DBA0307D31C6FC"><enum>(e)</enum><header>Lifetime exemption</header><text display-inline="yes-display-inline">In the case of an individual described in subsection (b) who has been employed as a school resource officer for a period of not less than 10 years, in addition to any period described in subsection (a), gross income shall not include any retirement income received by such individual during any period after such employment has ended.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H25929A46B5794C809A28DD7AF8F5E61B"><enum>(f)</enum><header>Regulations and guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Secretary shall prescribe such regulations or other guidance as may be necessary to carry out the purposes of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="HDCE8C0B69B9E42CA9954DA178F9D6177"><enum>(b)</enum><header>Information reporting</header> <paragraph commented="no" display-inline="no-display-inline" id="H864EAFCAACAA4490AEB428172B3CA58A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart A of part III of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/61">chapter 61</external-xref> of the Internal Revenue Code of 1986, as amended by section 70421(d) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended by inserting after section 6039L the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="H17B1F60DF3EB4F378A766D720582753D"><enum>6039M.</enum><header>Information with respect to school resource officers</header><text display-inline="no-display-inline">The head of any law enforcement agency employing an individual described in section 139M(b) shall provide the Secretary with notice (in such manner as the Secretary may prescribe) regarding—</text> <paragraph commented="no" display-inline="no-display-inline" id="HAE3EBC0A7C98410DAAE8D14C5CDEB360"><enum>(1)</enum><text display-inline="yes-display-inline">the initial date that such individual began employment as a school resource officer, and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1958BAC35646440AAA6BEAD2946160CF"><enum>(2)</enum><text display-inline="yes-display-inline">the date on which the employment of such individual as a school resource officer has ended.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" id="HC07EA56B1AA44169AFF91199CB21A8E4"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 6724(d)(1) of such Code is amended by striking <quote>and</quote> at the end of subparagraph (C), by striking the period at the end of subparagraph (D) and inserting <quote>, and</quote>, and by inserting after subparagraph (D) the following new subparagraph:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H321D5AC323F6421CB355B8140CB9173D"><enum>(E)</enum><text display-inline="yes-display-inline">any notice required to be filed under section 6039M.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H885B3A2206AF48668BC715A12C61F93F"><enum>(c)</enum><header>Clerical amendments</header> <paragraph commented="no" display-inline="no-display-inline" id="H576118F68EF44C01B8C8643254A5A07B"><enum>(1)</enum><text display-inline="yes-display-inline">The table of sections for part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986, as amended by section 70435(b) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended by inserting after the item relating to section 139L the following new item:</text>

<paragraph id="H7345FFACA0024D4C8B80B70D9CE20383"><enum>(2)</enum><text>The table of sections for subpart A of part III of subchapter A of chapter 61 of such Code, as amended by section 70421(d) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended by inserting after the item relating to section 6039L the following new item:</text> <quoted-block style="OLC" id="HE97E11FAFBC24975A441BAE7853E2E88"> <toc> <toc-entry level="section" idref="H17B1F60DF3EB4F378A766D720582753D">Sec. 6039M. Information with respect to school resource officers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H9154FCB7692B4AA3B7E6F13358F7B502"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of enactment of this Act.</text></subsection></section>
