<section id="H0AFD958C3F704ABABD8D242946E062A1" section-type="section-one"><enum>1.</enum><header>Making certain exclusions from participation in Federal health care programs related to fraud mandatory</header> 
<subsection id="HCEAA549D790B4A42B90C295AB28A47D5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1128 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7">42 U.S.C. 1320a–7</external-xref>) is amended—</text> <paragraph id="HE65ADA8E1B684A1F9011BA8B0BFA46FA"><enum>(1)</enum><text>in subsection (a), by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" id="HDDA85BD783DB4159875D0B507AA769B1" display-inline="no-display-inline"> 
<paragraph id="H18D56B75BDE04E748FDE046C9415543B"> <enum>(5)</enum> <header>Conviction relating to fraud</header> <text display-inline="yes-display-inline">Any individual or entity that has been convicted for an offense which occurred on or after the date that is 1 year after the date of the enactment of this paragraph, under Federal or State law—</text> <subparagraph id="HEAFCAD5B365941BEBC9F4B7B0BADD41F"> <enum>(A)</enum> <text>of a criminal offense consisting of a misdemeanor relating to fraud, theft, embezzlement, breach of fiduciary responsibility, or other financial misconduct—</text> 
<clause id="H9DDE417003A647EB97EA4E1679D281AA"> <enum>(i)</enum> <text>in connection with the delivery of a health care item or service, or</text> </clause> <clause id="H7058558BD76E4021BFB4B190470127E4"> <enum>(ii)</enum> <text>with respect to any act or omission in a health care program (other than those specifically described in paragraph (1)) operated by or financed in whole or in part by any Federal, State, or local government agency; or</text> </clause> </subparagraph> 
<subparagraph id="HAA11F24831FC49119EDE1A3A89BFDB9A"> <enum>(B)</enum> <text>of a criminal offense relating to fraud, theft, embezzlement, breach of fiduciary responsibility, or other financial misconduct with respect to any act or omission in a program (other than a health care program) operated by or financed in whole or in part by any Federal, State, or local government agency.</text></subparagraph></paragraph> <paragraph id="HB9BA16F7B2FE4449AC69AA04D6991D46"> <enum>(6)</enum> <header>Fraud, kickbacks, and other prohibited activities</header> <text>Any individual or entity that the Secretary determines has committed an act which is described in section 1128A, 1128B, or 1129 on or after the date that is 1 year after the date of the enactment of this paragraph.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB2CB253609E044A4B8D6AF3FF2338630"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H7655753DC841408C83CAD2ECA771C572"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and before the date that is 1 year after the date of the enactment of subsection (a)(5)</quote> before <quote>, under Federal or State law</quote>; and</text></subparagraph> 
<subparagraph id="H879001A4908F40DBA5EC6066B646772B"><enum>(B)</enum><text>in paragraph (7), by inserting <quote>before the date that is 1 year after the date of the enactment of subsection (a)(6)</quote> before the period at the end; and</text></subparagraph></paragraph> <paragraph id="H83910B3123A14C1E9D2065A4A680FBE5"><enum>(3)</enum><text>in subsection (f)(2), by inserting <quote>(a)(6) or</quote> after <quote>subsection</quote> each place it appears.</text></paragraph></subsection> 
<subsection id="HC45D8710D45C4A269FBDB77F7E36799C"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1128D(a)(1)(A)(ii) of the Social Security Act (42 U.S.C. 1320a–7d(a)(1)(A)(ii)) is amended by striking <quote>section 1128(b)(7)</quote> and inserting <quote>subsection (a)(6) or (b)(7) of section 1128</quote>.</text></subsection></section> </legis-body></bill>
