which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to reauthorize the pilot program for alternative water source projects, and for other purposes.</official-title></form><legis-body id="HF0757153C48944FF903F315291F8792F" style="OLC"><section id="HD288167844A842928E3270C4C5329478" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Infrastructure Modernization Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HA76A3C8171E54B308D416B0AF0E13614"><enum>2.</enum><header>Intelligent water infrastructure technology</header><text display-inline="no-display-inline">Section 220 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H830C1ECD35F946ABB1CFB48B1B76CE43"><enum>(1)</enum><text>in subsection (b), by adding at the end the following:</text><quoted-block id="H7915C6FC1AFB4F15B09B21CEAA31401D" style="OLC" act-name=""><paragraph id="H8F080629DE5541B5B981BDCE233586FE"><enum>(3)</enum><header>Intelligent water infrastructure technology</header><text>The term <term>intelligent water infrastructure technology</term> means—</text><subparagraph id="H77E7359ECFF349D7939D626AA2F6C889"><enum>(A)</enum><text>intelligent wastewater treatment and collection systems and stormwater management operations, including technologies that rely on—</text><clause id="H320E36A64EE34C9C806F0911B540E41C"><enum>(i)</enum><text>the use of real-time monitoring, management, analytics, and data collection tools, embedded intelligence, and predictive maintenance capabilities that improve the energy efficiency, cost efficiency, reliability, and resiliency of wastewater treatment and collection systems;</text></clause><clause id="H0B45AC83A8B946BC8FB7D42299A095CC"><enum>(ii)</enum><text>real-time remote sensors that provide continuous monitoring of water quality to support optimization; and</text></clause><clause id="H04D1D52796804508B3DE72EEF5E5A4D4"><enum>(iii)</enum><text>the use of artificial intelligence and other intelligent optimization tools that—</text><subclause id="H1479618DD0E44939B6310BEA3E4894AB"><enum>(I)</enum><text>reduce operational costs, including operational costs relating to energy consumption and chemical treatment; and</text></subclause><subclause id="HC2AF4CF1D2854A61A642CAA57C6016D3"><enum>(II)</enum><text>improve decisionmaking;</text></subclause></clause></subparagraph><subparagraph id="HFA6393C39E3D4581886774CC885C509E"><enum>(B)</enum><text>innovative and alternative combined sewer and stormwater control projects, including groundwater banking, that rely on real-time data acquisition to support predictive aquifer recharge through water reuse and stormwater management capabilities;</text></subparagraph><subparagraph id="H769CC39C264B4D14B67A64C4A2EAB057"><enum>(C)</enum><text>advanced digital design and construction management tools, including advanced digital technologies;</text></subparagraph><subparagraph id="HB66C8DB59BE543A8B4FD46DFBAED947A"><enum>(D)</enum><text>technology that can identify or reduce water losses in a nondestructive or nondisruptive manner, including through analytical software, flow and pressure monitoring, or acoustic data collection;</text></subparagraph><subparagraph id="H68A5967CF594433CB17F40987449D286"><enum>(E)</enum><text>predictive and diagnostic tools for informed decisionmaking;</text></subparagraph><subparagraph id="HAD0EF715059A4C48AFDFFF95CAECAC9C"><enum>(F)</enum><text>technology that can provide comprehensive data on pipe integrity to identify the presence of leaks or gas pockets;</text></subparagraph><subparagraph id="HC975A679AF014A5B83EFB2852781DFD0" commented="no"><enum>(G)</enum><text>technology that can provide information on the extent of leaks or gas pockets, with an emphasis on detecting weakness of, vulnerability of, or damage to pipe barrels, pipe joints, or other pipe features;</text></subparagraph><subparagraph id="HA6FC22F8E4244170A4D72CD9EF68328C"><enum>(H)</enum><text>real-time remote sensing technologies, including the use of advanced data management and analytics, that detect and alert owners and operators to wastewater and water supply treatment facilities operations, including leakages, and pipe bursts on a real-time basis, including persistent sensor networks capable of measuring—</text><clause id="H452EAA092B8B49E3825BDBDF3798D412"><enum>(i)</enum><text>acoustic signals;</text></clause><clause id="H276134F1C0E649568F202CA1E2BCED8D"><enum>(ii)</enum><text>pressure transient;</text></clause><clause id="H40ECE10908304D35835C91C61961AE26"><enum>(iii)</enum><text>water quality; or</text></clause><clause id="H3DC13136E60843B79323DC71FE9AD4E3"><enum>(iv)</enum><text>water flow;</text></clause></subparagraph><subparagraph id="HDDC6EF9D8F214288859AA8167DE8464A"><enum>(I)</enum><text>advanced metering infrastructure, including meter data analytics and ratepayer technology—</text><clause id="HC258177EE7154C3FBC0666D11221C7BE"><enum>(i)</enum><text>to improve end-user conservation; and</text></clause><clause id="HC0B77A09F323462FAC2EB325B53F1EED"><enum>(ii)</enum><text>in support of disadvantaged communities;</text></clause></subparagraph><subparagraph id="H7092FBA7A98B4BA0AC902FF95226AC0A"><enum>(J)</enum><text>resilient water supply projects that may provide real-time monitoring of weather patterns and weather-related impacts on water quality and flood protection reservoirs and dams that enhance operations, including—</text><clause id="H04476CF8ACF346949342DB6653EC542B"><enum>(i)</enum><text>improved water supply reliability and management;</text></clause><clause id="HA93DE66FC4B041989958D4EC4D5655AF"><enum>(ii)</enum><text>protection of natural resources, including fisheries; and</text></clause><clause id="H3D64E85A6E1944B183DDFFB0812B92A8"><enum>(iii)</enum><text>temperature control;</text></clause></subparagraph><subparagraph id="H234B57132E964BB18CF731B5679D21D4"><enum>(K)</enum><text>innovative and alternative water supply projects, including groundwater banking, that rely on real-time data acquisition to support predictive aquifer recharge through water reuse and stormwater management capabilities;</text></subparagraph><subparagraph id="H1833C6AFB6F14B2D8DD9EFBA010AAB6F"><enum>(L)</enum><text>artificial intelligence and other intelligent optimization tools that—</text><clause id="HF1ECA8FE55434644921FE0246B5F59DB"><enum>(i)</enum><text>reduce operational costs, including costs relating to energy consumption and chemical treatment of wastewater and stormwater; and</text></clause><clause id="HFF1BBF9E15CD47BEA0B6250018468E9D"><enum>(ii)</enum><text>improve decisionmaking; and</text></clause></subparagraph><subparagraph id="HD972FF30905346699A7D04D2F7F47A14"><enum>(M)</enum><text>advanced digital design and construction management technologies and tools relating to water treatment systems and distribution networks the development of advanced digital models.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HE14B760897A844AAA23AC2A74B3F9B2F"><enum>(2)</enum><text>by striking subsection (f) and inserting the following:</text><quoted-block id="H76499CB3CDD54497B0175745379F79BF" style="OLC" act-name=""><subsection id="HF3E631F1F52245408CFECDB86F8785EA"><enum>(f)</enum><header>Uses of grants</header><paragraph commented="no" display-inline="no-display-inline" id="H4F27682E510A4DEBAFE1E58AE8ACD9D8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Amounts from grants received under this section may be used for engineering, design, construction, and final testing of alternative water source projects designed to meet critical water supply needs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC547CC2F58E48A6BD589665E212BFA9"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Amounts from grants received under this section may not be used for planning, feasibility studies, operation, or maintenance.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD670EC415F304F6180C6A3F4448D4E64"><enum>(3)</enum><header>Intelligent water infrastructure technologies</header><subparagraph commented="no" display-inline="no-display-inline" id="H40492F24678145398E8BB51A8ECB5D68"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts from grants received under this section may be used for engineering, design, construction, implementation, training, and operations relating to the adoption and use of intelligent water infrastructure technology.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0F417C346F04D9799DE547937FCF50E"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">For purposes of paragraph (2), any costs with respect to intelligent water infrastructure technology shall not be considered operation or maintenance costs.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12CAF33E5B014C2594519C06ADB88A00"><enum>(3)</enum><text>by striking subsection (h) and inserting the following:</text><quoted-block id="HCCC69CC849674F1DA3F0169825D3E14D" style="OLC" act-name=""><subsection id="HA2C5FB117647426F99A83CC4E340F813"><enum>(h)</enum><header>Reports</header><paragraph commented="no" display-inline="no-display-inline" id="HC20B17EC294A4145AB3E0E7001445200"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Water Infrastructure Modernization Act of 2025</short-title>, and not less frequently than annually thereafter, the Administrator shall submit to Congress a report that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H60A224D0EF3B4BC8A529CE467F9ABF93"><enum>(A)</enum><text display-inline="yes-display-inline">describes—</text><clause commented="no" display-inline="no-display-inline" id="HB4608935041A429BB4CE0B0F523F214F"><enum>(i)</enum><text display-inline="yes-display-inline">the projects awarded grants for the purposes described in subsection (f)(3); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H36D4D94840A143D2B5985768B903AC4A"><enum>(ii)</enum><text display-inline="yes-display-inline">the improvements in the resiliency that resulted from grants awarded under this section; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BD47D092C6844BE9CF956E4B71B0E9C"><enum>(B)</enum><text display-inline="yes-display-inline">includes any recommendations of the Administrator to improve the ability of grants under this section to achieve the uses described in subsection (f).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B10F9A824C54AFDB4BC4D546F696B66"><enum>(2)</enum><header>Initial report</header><text display-inline="yes-display-inline">In the initial report required under paragraph (1), the Administrator shall include a description of the implementation of this section, including a description of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEBE7DBA0C43844EBB404AB36FBD33270"><enum>(A)</enum><text display-inline="yes-display-inline">the projects for which a grant was sought under this section for the purposes described in subsection (f)(3) that were denied; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB877F4EBB29C400D9D771270213B5D4A"><enum>(B)</enum><text display-inline="yes-display-inline">for each of the projects described in subparagraph (A), the reasons for which the grant was denied.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3BEB223D97F46FB86440A0559087DF8"><enum>(4)</enum><text>in subsection (i)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5CFF10F2BD7E43ED93D9DB5A3FB301FB"><enum>(A)</enum><text>by striking <quote>$25,000,000</quote> and inserting <quote>$50,000,000</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H76CE13E611FA41B28058D89718F85E68"><enum>(B)</enum><text>by striking <quote>2026</quote> and inserting <quote>2028</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
