<section section-type="section-one" id="H9A578F0953A44AD8AFB086E4544D4CE5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Headwaters Protection Act of 2025</short-title></quote>.</text></section> <section id="HE15CC04B7E3B43F0B00C574C29D51925"><enum>2.</enum><header>Water Source Protection Program reauthorization and improvements</header><text display-inline="no-display-inline">Section 303 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6542">16 U.S.C. 6542</external-xref>) is amended—</text>
<paragraph id="H3A9FBA779E5A49F0A9A17D836B259255"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H76F9526C91B14721B63003BB265D6CD1"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="H735D7A65E5BB4B2FBC331BA13AB6E83E"><enum>(i)</enum><text>by redesignating subparagraphs (G) and (H) as subparagraphs (K) and (L), respectively; and</text></clause> <clause id="H5D31A23637B94623B556C30CF619F2DC"><enum>(ii)</enum><text>by inserting after subparagraph (F) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HDBDB92C62DBC4484BCFD7B8B87A9A03F">
<subparagraph id="HD06064BF3954429E8F198BF21AE0DC67"><enum>(G)</enum><text>an acequia association;</text></subparagraph> <subparagraph id="H85ADA1537518489AB1D9D8F0CB1382E0"><enum>(H)</enum><text>a local, regional, or other public entity that manages stormwater or wastewater resources or other related water infrastructure;</text></subparagraph>
<subparagraph id="H3524D7ED26134E019B359395C47CB66C"><enum>(I)</enum><text>a land-grant mercedes;</text></subparagraph> <subparagraph id="H6DE6AFE1E0414F53AC66AF9565376A6E"><enum>(J)</enum><text>a local, regional, or other private entity that has water delivery authority;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H91471241F76042A3A9FDF5968255FB85"><enum>(B)</enum><text>by redesignating paragraphs (1) through (7) as paragraphs (2) through (8), respectively; and</text></subparagraph> <subparagraph id="HA86C90CD45E74AC2B81A0AEA13D3FD1A"><enum>(C)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text>

<paragraph id="H3AF013386CE340CCA249C835E3A1C81C"><enum>(1)</enum><header>Adjacent land</header><text>The term <term>adjacent land</term> means non-Federal land, including State, local, and private land, that is adjacent to, and within the same watershed as, National Forest System land on which a watershed protection and restoration project is carried out under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H5473254FE0214D07A3FBF46C69E128B0"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="H50F109103AD247C882EFFF42E4067DC4"><enum>(A)</enum><text>by inserting <quote>and adjacent land</quote> before the period at the end;</text></subparagraph> <subparagraph id="H074A1DD2D3EF46829F382E8D375A1D0D"><enum>(B)</enum><text>by striking <quote>The Secretary shall</quote> and inserting the following:</text>

<paragraph id="H12C770397DF3497ABD0B5B1E802BD15A"><enum>(1)</enum><header>In general</header><text>The Secretary shall</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H1AB1F9D29868442B9CA2316742478FBB"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H1B04510EE6FF4EA2B3D87D12620EE550">
<paragraph id="HE2749381E8384E6486EBD84FC970F1AB"><enum>(2)</enum><header>Requirements</header><text>A watershed protection and restoration project under the Program shall—</text> <subparagraph id="H4412600229464793B88993F42D4D63CE"><enum>(A)</enum><text>protect and restore watershed health, water supply and quality, a municipal or agricultural water supply system, and water-related infrastructure;</text></subparagraph>
<subparagraph id="H3A15AF7BBF0F4EF0B949B811DA37FF05"><enum>(B)</enum><text>protect and restore forest health from insect infestation and disease or wildfire; or</text></subparagraph> <subparagraph id="H0C038638DE0D4859824F9BF7C5A724C4"><enum>(C)</enum><text>advance any combination of the purposes described in subparagraphs (A) and (B).</text></subparagraph></paragraph>
<paragraph id="H49D999AC020B4C8B8178A606EFAAC26D"><enum>(3)</enum><header>Priorities</header><text>In selecting watershed protection and restoration projects under the Program, the Secretary shall give priority to projects that would—</text> <subparagraph id="HF85ADE2AA0834DAB800413C629774C5E"><enum>(A)</enum><text>provide risk management benefits associated with drought, wildfire, post-wildfire conditions, extreme weather, or flooding, including minimizing risks to watershed health, water supply and quality, and water-related infrastructure, including municipal and agricultural water supply systems; </text></subparagraph>
<subparagraph id="H7F52F83554B94FB390EA63F7BED44B4C"><enum>(B)</enum><text>be designed to support aquatic restoration and conservation efforts that complement existing or planned forest restoration or wildfire risk reduction efforts;</text></subparagraph> <subparagraph id="H7D6A5FDA0FCC41D2865C97B0FACB4712"><enum>(C)</enum><text>include—</text>
<clause id="HE6D86D5EEBB44CA086EC73CD2C553FC3"><enum>(i)</enum><text>partners with demonstrated capacity and success in designing and implementing ecological restoration projects, wildfire risk reduction efforts, or post-wildfire restoration projects; or</text></clause> <clause id="HBA5DFF2340284FB68D7EE36E2BA0F88F"><enum>(ii)</enum><text>in the case of disadvantaged communities that have historically lacked access to adequate resources, partners with a strong likelihood of success in designing and implementing a watershed protection and restoration project; and</text></clause></subparagraph>
<subparagraph id="HA043CACE0EE8447BADFBD18E502D014E"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H69BB994754E94F9DB208AC78A04280CC"><enum>(i)</enum><text>include a contribution of funds or in-kind support from non-Federal partners in an amount greater than the amount required under subsection (g)(2);</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC9ED4B0EA5194C319E019F6E0A0BC8B5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">provide quantifiable benefits to water supply or quality and include the use of nature-based solutions, such as restoring wetland and riparian ecosystems;</text></clause>
<clause id="H8C325EA7E4934725BED15EA0DA5DC678" indent="up1"><enum>(iii)</enum><text>be designed to improve—</text> <subclause id="H4A915B6419E54BFAAE304584C1EB0F3C"><enum>(I)</enum><text>resilience to climate change; or </text></subclause>
<subclause id="H99AC972980724B8D85EC653F0085A37A"><enum>(II)</enum><text>watershed and fire resilience; or</text></subclause></clause> <clause id="H30585634BA0F4992967D6434AF25D924" indent="up1"><enum>(iv)</enum><text>include such other characteristics as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCF760C8D3D754C52A461102893F7D13A"><enum>(4)</enum><header>Conditions for projects on adjacent land</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HB0590206B930430FB55D69E6DA8CDF25"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No project or activity may be carried out under this section on adjacent land unless the owner of the adjacent land provides express support for, and is a willing and engaged partner in, carrying out that project or activity.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H538B7F399C9F4351B71C161FF9E7C112"><enum>(B)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this section authorizes any change in—</text>
<clause commented="no" display-inline="no-display-inline" id="H0602DFA0C0A94F5B8EBB0965DDB062B3"><enum>(i)</enum><text display-inline="yes-display-inline">the ownership of adjacent land on which a project or activity is carried out under this section; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HA5117B21FD604C19B594854A02464205"><enum>(ii)</enum><text display-inline="yes-display-inline">the management of adjacent land on which a project or activity is carried out under this section, except during the carrying out of that project or activity.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H869C8D0D0BB84C67B01216C1BC192CE1"><enum>(3)</enum><text>in subsection (c)—</text> <subparagraph id="H35A4F72FAB094D68AB410DDF4F3042B2"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause commented="no" display-inline="no-display-inline" id="H0B1A177664494EFA8E5B7A552FED8A38"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>and adjacent land</quote> after <quote>watersheds</quote>;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H1B02F57E94E44BD690232C77C6B4B480"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H00C5A82A73A0419BB1D1C0679E40CF64"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>with end water users</quote> and inserting the following: “with—</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HEBA2B11B485F43F2AA9E64FF39284D61"> <subparagraph id="HF80CE2ED13AD4731BF5C118790D0A9F3"><enum>(A)</enum><text>end water users</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause commented="no" display-inline="no-display-inline" id="H01A5A02438AE41BC9CEBFFE4755458B8"><enum>(iv)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H5935DF0A4F5C4D739CFB2874F7828FA0"> <subparagraph id="H9717764C84854417B06DDCE50A253882"><enum>(B)</enum><text>end waters users to protect and restore the condition of National Forest watersheds and adjacent land that provide water for the benefit of another end water user.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4BDD0B16837242709C6FB6044BD13C06"><enum>(B)</enum><text>in paragraph (2)—</text> <clause commented="no" display-inline="no-display-inline" id="H22EC0AC9E7D841B1BEB61884A2C01D61"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>or</quote> after the semicolon;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HD43A0A709AAF47A0858A0810B4F04DBB"><enum>(ii)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H5208ED34C7C54337899A6C3AAA71EEA0"><enum>(iii)</enum><text>by inserting after subparagraph (C) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H4D9AD9B47D4940B1BBA61B85927D2EBE">
<subparagraph commented="no" display-inline="no-display-inline" id="HA85F1B7F08DE48A0B290F0EA5CA622DB"><enum>(D)</enum><text>a good neighbor agreement entered into under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>); or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H547310F546AB4D97A1100BD7A4D49625"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H72850FC3A6614EC2AD8B75590F82FE80">
<paragraph id="H2139CC606BCC47F992EE49707C0DBB2B"><enum>(3)</enum><header>Leadership by non-Federal partners</header><text>The Secretary shall facilitate a leadership role for non-Federal partners in carrying out assessments, planning, project design, and project implementation under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HB8906AA2548943629DF7C7357F607661"><enum>(4)</enum><text>in subsection (d)—</text>
<subparagraph id="H23287F8C9476470F8CC581C7EC3FACF2"><enum>(A)</enum><text>in paragraph (2), by striking <quote>shall be conducted</quote> and inserting the following: “shall be—</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HC478347853324E65A0C03C47D41FC5FF"> <subparagraph id="H42EF6049C57E4CB2B24824DFCB912567"><enum>(A)</enum><text>designed to protect and restore ecological integrity (as defined in section 219.19 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this subparagraph));</text></subparagraph>
<subparagraph id="H8F509172E7264A89BD4383B82FE0A0DB"><enum>(B)</enum><text>based on the best available scientific information; and</text></subparagraph> <subparagraph id="H27D7F339BE8D4F1F8A951E86C8F18596"><enum>(C)</enum><text>conducted</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HF0EFDFD107454CE4B64932BCC8C68CB3"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB7A3AE320BA740DD8B6E4AED203D764C"> <paragraph id="HF4CC72F42A5945B881F5797F71C8BC3F"><enum>(4)</enum><header>Reducing redundancy</header><text>An existing watershed plan, such as a watershed protection and restoration action plan developed under section 304(a)(3), or other applicable watershed planning documents may be used as the basis for a water source management plan under this subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HC3AF5E57D7D94B1BBC5F62F0DDC67205"><enum>(5)</enum><text>in subsection (e)(1), by striking <quote>purpose of—</quote> in the matter preceding subparagraph (A) and all that follows through the period at the end of subparagraph (C) and inserting <quote>purpose of advancing any of the purposes described in subsection (b)(2).</quote>; and</text></paragraph> <paragraph id="H0BEA5CDFE6024AF3B849B5A35C87115C"><enum>(6)</enum><text>in subsection (g)—</text>
<subparagraph id="H7E2510D2671942329888C2C35E582DA9"><enum>(A)</enum><text>in paragraph (2)—</text> <clause id="H17A8973B582546F18A3F71B0AB060DE0"><enum>(i)</enum><text>by striking <quote>at least equal to</quote> and inserting <quote>not less than 20 percent of</quote>; </text></clause>
<clause id="HD9DBFAFA8CF743D28132414299718C02"><enum>(ii)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD6A780E2559148E8BCA35A2FCA536C0C"> <subparagraph id="H62687D22810447FB8E483C3D5956E02C"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H5066FDD841AE47C787AE35C005EC38F2"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HBF760AB6CCBA49E2998274D8679917C4"> <subparagraph id="HA6A0356F7FD94248B9D291BFDC3797D0"><enum>(B)</enum><header>Waiver</header><text>The Secretary may waive the requirement under subparagraph (A) in the discretion of the Secretary.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="HD04DE2572B3D44A7B9FF181F7AD2C579"><enum>(B)</enum><text>in paragraph (4)—</text> <clause commented="no" display-inline="no-display-inline" id="H3D97C6DDE3E246D986EF486C76C56757"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>$10,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$30,000,000 for each of fiscal years 2025 through 2033</quote>; and</text></clause>
<clause id="H393D350821FF449A8FEB67341ACFE3B9"><enum>(ii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7851EC2A265641FB8326E094A4E0902B"> <subparagraph id="H43871855C6B64A7B9519E4A25CE05E72"><enum>(D)</enum><header>Set-aside for partner participation in planning and capacity</header><text>Of the amounts made available under subparagraph (B) to carry out this section for each fiscal year, the Secretary shall use not less than 10 percent for non-Federal partner technical assistance participation and capacity-building efforts in developing or implementing a water source management plan under subsection (d).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section>
<section id="H93E6DEFEBFE64F62BDBB3D3FAD944F07"><enum>3.</enum><header>Watershed condition framework improvements</header><text display-inline="no-display-inline">Section 304 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6543">16 U.S.C. 6543</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H17BB508972E14F68980EB90E51538E03"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="H26F53DB658FF4C1DA6010ED9639D3D96"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H4C7A11C80EF5457F91081B6804355849"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H04153DFCB93445B493DC827122DE54B9"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2C7707A89EB1420991D385D67AE04646"> <paragraph id="HC7336B86B2C24642A3E6E3AE5CAFF3A0"><enum>(7)</enum><text>that ensures that management activities and authorizations do not result in long-term degradation of watershed health or lower the classification under paragraph (1) of any watershed in a National Forest.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H24A2CC90EF9C4E078E670D822AA7B3FC"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HEB554B1267E54768BF14918339CFF4C0"> <subsection commented="no" display-inline="no-display-inline" id="H0F065F413AF74644A7527C5ED30D075C"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2025 through 2029.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="HDB86A71DA9C3413C8CA02992D0AEA2BE"><enum>4.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act shall be construed—</text> <paragraph commented="no" display-inline="no-display-inline" id="H69F3DD547B67419DA672835787F8241E"><enum>(1)</enum><text display-inline="yes-display-inline">to supersede or in any manner affect or conflict with State water law, Federal water law, interstate compacts, or treaty obligations; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H256CF74D2E0E4326AA89FA75E93467E6"><enum>(2)</enum><text>to authorize any acquisition of land by the Federal Government or any exertion of Federal control over non-Federal land.</text></paragraph></section> </legis-body></bill>
