Short title

This Act may be cited as the Ensuring the Necessary Destruction of Illicit Chinese Tobacco Act or the END Illicit Chinese Tobacco Act.

Destruction of adulterated, misbranded, or counterfeit tobacco products offered for import

(a)

In general

Section 801(a) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 381(a)) is amended— (1)in the fourth sentence, by striking or counterfeit device and inserting , counterfeit device, or counterfeit tobacco product (as defined in section 900); and (2)by striking drug or device each place it appears in the seventh, eighth, ninth, and tenth sentences and inserting drug, device, or tobacco product. (b)

Applicability

The amendments made by subsection (a) shall apply beginning on the date of enactment of this Act.
