R. 5926</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20251107">November 7, 2025</action-date><action-desc><sponsor name-id="A000375">Mr. Arrington</sponsor> (for himself, <cosponsor name-id="C001063">Mr. Cuellar</cosponsor>, <cosponsor name-id="M001205">Mrs. Miller of West Virginia</cosponsor>, <cosponsor name-id="M001224">Mr. Moran</cosponsor>, <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor>, <cosponsor name-id="B001314">Mr. Bean of Florida</cosponsor>, and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the United States Trade Representative to request a dispute resolution panel with Mexico under the USMCA, initiate an investigation under the Trade Act of 1974, or require, during the first joint review of the USMCA, that Mexico comply with certain obligations under the USMCA with respect to certain actions taken by Mexico that favor its state-owned electrical utility and state-owned petroleum company.</official-title></form><legis-body id="H383984BF515042B5AE0E5E053408C12A" style="OLC"><section id="HE346D40D31594019B3315354FC6330F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mexican Energy Trade Enforcement Act</short-title></quote>.</text></section><section id="HA324C81869D14840B01B31A865C1E898"><enum>2.</enum><header>Requirement to take certain actions to require Mexico to comply with its obligations under the USMCA</header><subsection id="HC7D3DD42B2904F4E91E1BD6330AFE9F3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To protect United States commerce abroad, and with respect to the covered actions, the United States Trade Representative shall—</text><paragraph id="H9F7ACEFAD3DF429089DFF82CB3CB37F7"><enum>(1)</enum><text>request the establishment of a dispute resolution panel with Mexico under article 31.6 of the USMCA; or</text></paragraph><paragraph id="H33C47697CEB149379266D024EFCE9118" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">require, during the first joint review of the USMCA, that Mexico provide non-discriminatory access for United States energy companies consistent with the obligations of Mexico under the USMCA, including under chapters 2 (Market Access), 14 (Investments), and 22 (State-Owned Enterprises) of the USMCA.</text></paragraph></subsection><subsection id="H614022B98D994AF8AC6A2A6C82778503"><enum>(b)</enum><header>Report</header><text>Not later than 90 days after the date of the enactment of this Act, the United States Trade Representative shall submit a report to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate detailing action taken under subsection (a).</text></subsection><subsection id="H58A538DF9C9C4784BA7766BFA4CC4BDB"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H6812FF51C9684F2A9DD04FA61DECB8FD"><enum>(1)</enum><header>Covered actions</header><text>The term <term>covered actions</term> means the actions taken by Mexico that formed the basis for the request for dispute settlement consultations with Mexico under the USMCA, circulated by the United States Trade Representative on July 20, 2022, and which favor its State-owned electrical utility company, Comisión Federal de Electricidad, and State-owned petroleum company, Petróleos Mexicanos, and negatively impact United States companies operating in Mexico and United States energy export to Mexico.</text></paragraph><paragraph id="HA30830FB155A44C6A13CE58CC969528B"><enum>(2)</enum><header>USMCA</header><text display-inline="yes-display-inline">The term <term>USMCA</term> has the meaning given such term in section 3(9) of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4502">19 U.S.C. 4502(9)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
