<section id="H9A50AAF680E14271A4170E82BA4C9B5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thalidomide Survivors Compensation Act of 2025</short-title></quote>.</text></section> <section id="H2318AFEB1F314673A7B3390AE931C01E"><enum>2.</enum><header>Findings; purpose</header> <subsection id="HEF1C672B7E404E40B8B709CC6F577542"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text> 
<paragraph id="H3D6FDA3953AE45E684AC23CCD30B94AC"><enum>(1)</enum><text display-inline="yes-display-inline">Thalidomide caused an estimated more than 10,000 birth defects and deaths worldwide during the 1950s and 1960s.</text></paragraph> <paragraph id="HC4769108F034474C9FA4619D8B259EB5"><enum>(2)</enum><text>Thalidomide exposure in utero is known to cause limb deformities and internal organ malformations.</text></paragraph> 
<paragraph id="H263D9E1CC03D4CA1AEE36F773E194F91"><enum>(3)</enum><text>Although not formally approved in the United States, approximately 5 million thalidomide samples were distributed by over 1,200 physicians through informal clinical trials.</text></paragraph> <paragraph id="H832E45E700934F3BAC9B8F687C5B849E"><enum>(4)</enum><text>The number of U.S. individuals affected remains undocumented, but research estimates approximately 100 thalidomide survivors are still living in the United States.</text></paragraph> 
<paragraph id="H45B44380646B4093BC4E9CBC3BC2FAB2"><enum>(5)</enum><text>U.S. thalidomide survivors have faced decades of unreimbursed medical costs, limited accessibility accommodations, and lack of formal diagnosis recognition.</text></paragraph> <paragraph id="H939C6B0BCD184DC98FF4BE4F829EDE7A"><enum>(6)</enum><text>46 countries currently provide compensation or medical assistance to thalidomide survivors, including direct payments, pensions, and adaptive living support.</text></paragraph> </subsection> 
<subsection id="H7CAC64153DC04C439EC3735DD7D3D47E"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to allow our thalidomide survivors the ability to live the remainder of their lives with independence and dignity.</text></subsection></section> <section id="H0E55E6A562AF4B919F7185AC5C85C175"><enum>3.</enum><header>Thalidomide Survivors Compensation Program</header> <subsection id="H647615DDF1944FC9818984861818A7F0"><enum>(a)</enum><header>Establishment of Program</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall establish a program to be known as the Thalidomide Survivors Compensation Program (in this section referred to as the <quote>Program</quote>) for the purpose of providing compensation to individuals injured by exposure to thalidomide.</text></subsection> 
<subsection id="H643754E0CF1C49CE8A5D6FA2608696C7"><enum>(b)</enum><header>Petitions</header><text>Subject to subsection (c), to receive compensation under the Program, an individual shall submit to the Secretary a petition at such time, in such manner, and containing such information as the Secretary may require, which shall include documentation from a physician or other health professional showing that—</text> <paragraph id="H346AB331F1C042FEA0E1C28141E2D890"><enum>(1)</enum><text display-inline="yes-display-inline">the individual was exposed to thalidomide; and</text></paragraph> 
<paragraph id="HB13A94C4E9D84638822AFFE6448B8529"><enum>(2)</enum><text display-inline="yes-display-inline">the individual suffered injury as a result of such exposure.</text></paragraph></subsection> <subsection id="H04013433F3774EAEB843225A292D61CB"><enum>(c)</enum><header>Limitations</header> <paragraph id="H3E57EE2571944079925EC987DC6B186A"><enum>(1)</enum><header>Deadline for petitions</header><text>No petition may be submitted under the Program after May 31, 2034.</text></paragraph> 
<paragraph id="H09BF389C0EB8453EA31EDFE00BFDDE86"><enum>(2)</enum><header>1 petition per individual</header><text>No individual may submit more than 1 petition under the Program.</text></paragraph> <paragraph id="HB6DC77582332440694AE50DD9A34A028"><enum>(3)</enum><header>Exclusive to American citizens, permanent residents</header><text>No petition may be submitted under the Program by an individual who—</text> 
<subparagraph id="H60D3CD6105CB42238142CD85CAE71E6A"><enum>(A)</enum><text>is not an American citizen or permanent resident at the time of such submission; or</text></subparagraph> <subparagraph id="HD6F557B87A0445D5BBC24197C19A6BC3"><enum>(B)</enum><text>was not an American citizen or permanent resident at the time of the individual’s exposure to thalidomide on which the petition is based.</text> </subparagraph></paragraph></subsection> 
<subsection id="HFE69C868A8B24ACBB9DE78DA5C045E43"><enum>(d)</enum><header>Compensation</header> 
<paragraph id="HC12E8E6821D645828BA6BA8A51EE19E2"><enum>(1)</enum><header>In general</header><text>For any petition for which the expert panel described in paragraph (2) determines that the individual was exposed to thalidomide and suffered injury as a result of such exposure, the Secretary shall pay the individual $150,000.</text></paragraph> <paragraph id="H7A196E281DEC4216A89E2E37E0F64C02"><enum>(2)</enum><header>Expert panel</header><text>The expert panel described in this paragraph is a panel of legal, medical, and thalidomide experts and survivors, to be appointed by the Secretary for the purpose of reviewing petitions under the Program.</text></paragraph></subsection> 
<subsection id="H7AB8F80B054742E4996D68C6AADD47E5" commented="no">
        <enum>(e)</enum>
        <header>Treatment of payments received for means-Tested welfare programs</header>
 <text display-inline="yes-display-inline">Compensation provided under this section to an individual may not be considered for the purpose of calculating such individual’s income or assets under any means-tested welfare program.</text>
      </subsection> 
<subsection id="HAD4B0FB3689F424399BFA36189FE9827"><enum>(f)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated to the Secretary, for each of fiscal years 2028 through 2034, such sums as the Secretary certifies are necessary to carry out this section for each such fiscal year.</text></subsection></section> <section id="H0FCC7524EBE449C99C9003200002929F"><enum>4.</enum><header>Annual review of Program</header> <subsection id="H07B975B0DF59494E895F9104FD9B2C6E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the establishment of the Thalidomide Survivors Compensation Program under section 3, and annually thereafter, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall conduct a comprehensive review of all compensation provided under the Program.</text> </subsection> 
<subsection id="H6BE01AFE4E584607BE3EBDEB40E20C11"><enum>(b)</enum><header>Congressional reports</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of each review under subsection (a), the Secretary shall make publicly available and submit to Congress a report, which shall include—</text> <paragraph id="HD2976762B18D411488680768274DA410"><enum>(1)</enum><text>an evaluation of whether the objectives of this Act are being met;</text></paragraph> 
<paragraph id="H03DC0CC92B254080AC240C28C990C3CC"><enum>(2)</enum><text>recommendations for modifications, improvements, support, compensation, or expansions to better serve thalidomide survivors in the United States;</text></paragraph> <paragraph id="HA04587B5CD6D42D299D4891C525BD8E7"><enum>(3)</enum><text>a detailed accounting of funds appropriated and expended pursuant to this Act;</text></paragraph> 
<paragraph id="HD12609A67EDE42E496FC4ED006CFDFF4"><enum>(4)</enum><text>the number of individuals receiving compensation under this Act;</text></paragraph> <paragraph id="H75DF1565B93C4F8C9443BBFF668DAB36"><enum>(5)</enum><text>an evaluation of the adequacy of the compensation under the Thalidomide Survivors Compensation Program to meet the medical and other needs of thalidomide survivors;</text></paragraph> 
<paragraph id="HF6091DC474B94E10B3722897A1E7F96A"><enum>(6)</enum><text>any recommendations for adjustments to amounts appropriated to carry out this Act; and</text></paragraph> <paragraph id="HD81947E14C394C5EB4C19937CFC251B8"><enum>(7)</enum><text>a summary of the feedback and satisfaction of individuals receiving compensation under this Act.</text> </paragraph></subsection> </section> 
<section id="H5C4725D598BF40A2A1EBBC981B210B91"><enum>5.</enum><header>Additional compensation</header> 
<subsection id="H89E8A9CA6B44442AB4897E8B83405FAC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations following an annual review under section 4, the Secretary of Health and Human Services may pay to individuals who received compensation under the Thalidomide Survivors Compensation Program established under section 3 such additional compensation, as the Secretary determines appropriate, to meet the ongoing medical or other needs of such individuals.</text></subsection> <subsection id="HD0B4A5146B8B4189AA5E74C1FA3D3083" commented="no"> <enum>(b)</enum> <header>Treatment of payments received for means-Tested welfare programs</header> <text display-inline="yes-display-inline">Compensation provided under this section to an individual may not be considered for the purpose of calculating such individual’s income or assets under any means-tested welfare program.</text>
      </subsection></section> 
<section id="HA354389C143D4108800AE3B14D5E3915"><enum>6.</enum><header>Compensation under Thalidomide Survivors Compensation Program excludable from income tax</header> 
<subsection id="H8A2476F433E547678044442E6791CCCA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 139L the following new section:</text> <quoted-block style="OLC" id="H244234482A90489FBA46E42216648F0E" display-inline="no-display-inline"> <section id="HDDEDE13F9DC14BF68B3EF53CD3C851AC"><enum>139M.</enum><header>Compensation under the Thalidomide Survivors Compensation Program</header><text display-inline="no-display-inline">Gross income shall not include compensation received by an individual under the <short-title>Thalidomide Survivors Compensation Act of 2025</short-title>.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3E620DE749844AB7A79774073CCC5044"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 139L the following new item:</text> <quoted-block style="OLC" id="HDBCFB598459A4A759439AA173B79280A" display-inline="no-display-inline"> <toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H244234482A90489FBA46E42216648F0E" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="HDDEDE13F9DC14BF68B3EF53CD3C851AC" level="section">Sec. 139M. Compensation under the Thalidomide Survivors Compensation Program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD4D62B43173B4232B7C53CCD6034E0A1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts received after the date of enactment of this Act, in taxable years ending after such date.</text></subsection></section> 
<section id="H8D2ECF259D814E6FA7DB53929F907412" section-type="subsequent-section"><enum>7.</enum><header>Definition of means-tested welfare program</header> 
<subsection id="H7532711D7258439AA4574F75458F16C2">
        <enum>(a)</enum>
        <header>Means-Tested welfare program</header>
 <text display-inline="yes-display-inline">In this Act, the term <term>means-tested welfare program</term>—</text>
        <paragraph id="HF16926DC847C4FC2A6747D397831F99E">
          <enum>(1)</enum>
 <text display-inline="yes-display-inline">means any Federal program that is designed to specifically provide assistance or benefits exclusively to low-income Americans; and</text>
        </paragraph>
        <paragraph id="H288CF8AB3F754797A556FC11FF2FDDF7">
          <enum>(2)</enum>
 <text>includes community and economic development programs targeted to low-income communities or populations.</text>
        </paragraph>
      </subsection> 
<subsection id="H4FAC661AD8A04288B42FA3173FAD534A"><enum>(b)</enum><header>Programs included</header><text display-inline="yes-display-inline">For purposes of subsection (a), the following Federal programs shall be considered means-tested welfare programs:</text> <paragraph id="H5F9711A7483941C691F97B2ACB487BEA"><enum>(1)</enum><header>Cash and general assistance</header> <subparagraph id="H9F3FB88FA2414C1C93477293342BAA5D"><enum>(A)</enum><text>The Supplemental Security Income program under title XVI of the Social Security Act.</text></subparagraph> 
<subparagraph id="H0BA035ECF17049DEADC3C87609438F60"><enum>(B)</enum><text>The earned income tax credit determined under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph> <subparagraph id="H13C660675DC64A258FA8DC885435E972"><enum>(C)</enum><text>The refundable portion of the child tax credit determined under <external-xref legal-doc="usc" parsable-cite="usc/26/24">section 24</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph> 
<subparagraph id="H064853797D6949E687C9D02976B4F90E"><enum>(D)</enum><text>The program of block grants to States for temporary assistance for needy families under part A of title IV of the Social Security Act.</text></subparagraph> <subparagraph id="H5DB1FCECA69146D6A08374EF67E1869D"><enum>(E)</enum><text>The foster care and adoption assistance program under part E of title IV of the Social Security Act.</text></subparagraph> 
<subparagraph id="H71A4787D6A284E7097B827DA041FB45A"><enum>(F)</enum><text>General Assistance to Indians.</text></subparagraph> <subparagraph id="HEF19BAFAEEF749AD9A7B67FAA4BF07C0"><enum>(G)</enum><text>The programs operated under the Assets for Independence Act.</text></subparagraph></paragraph>

<subparagraph id="H006A1F5697BF4A47B19B0007FBD10D2B"><enum>(A)</enum><text display-inline="yes-display-inline">The Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>).</text></subparagraph> <subparagraph id="HC466BB16A6A34734A47C59B941339474"><enum>(B)</enum><text>The Medicaid program under title XIX of the Social Security Act.</text></subparagraph>

<subparagraph id="H840A7823D7444FB6827EEA2FCEC7A6C8" indent="up1" commented="no"><enum>(C)</enum><text>For purposes of this paragraph, the term <term>refundable portion</term> means the portion of the credit which is paid to an individual in excess of the amount of Federal income tax owed by the individual.</text></subparagraph></paragraph> <paragraph id="HF055FADA54F7445DBC7FBC3B4D14B16F" commented="no"><enum>(2)</enum><text>For purposes of subsection (a), only the costs of the free and reduced price segments of the school lunch and school breakfast programs shall be considered means-tested welfare programs.</text> </paragraph></subsection> 
<subsection id="H80B7747B4AC04922A4493C4A4F250E99" commented="no"><enum>(d)</enum><header>Exclusion of certain State and local expenditures</header><text>For purposes of subsection (a), expenditures by State and local governments of funds that are—</text> <paragraph id="H4EDBF363EA084191A0DD6CEB78B89AFC" commented="no"><enum>(1)</enum><text>obtained by the State and local government from taxes, fees, or other sources of revenue established by the State or local government; and</text></paragraph>
