<section id="H6679A55007924B0D8155CD670FA0D8D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No CDLs for Illegals Act</short-title></quote>.</text></section> <section id="H089412A234EC4E2D912B5D4B9A38BFF7" section-type="subsequent-section"><enum>2.</enum><header>Commercial driver’s license requirements</header> <subsection id="H8C5D4E6EB3C046168F751C64ADA77752"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 31308 of title 49, United States Code, is amended—</text> 
<paragraph id="H2A360288063C4F56BC90CDCC2B26CE05"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="HD0F4CB5FACFB4D55BA0EE5E633AE80B2"><enum>(A)</enum><text>in subparagraph (A) by striking <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="HA86AEC804C3044BE91A3B26F9094EFE8"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" id="H6C85218E93ED48458E65164CA2E13DA2" display-inline="no-display-inline"> <subparagraph id="HF5FC78FCC1EC4575B00AEBEC41442D46"><enum>(C)</enum><text display-inline="yes-display-inline">present valid documentation proving citizenship status, lawful permanent resident status, or a valid work authorization; and </text></subparagraph> 
<subparagraph id="H142659690D654F4C83BF659C272AC523"><enum>(D)</enum><text>present valid documentation of domicile in the State in which the commercial driver’s license is issued; </text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H7CA61E6C7D69415DB46F2421C0922552"><enum>(2)</enum><text>in paragraph (3) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H7539D11AF06B45FE8E71536611D80784"><enum>(3)</enum><text>in paragraph (4)(E) by striking the period and inserting a semicolon; and</text></paragraph> <paragraph id="H2CE2DB94D51549ADBEABE118CB8311EA"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block style="USC" id="H96DC63BE260C4918A05CB47CE3263F35" display-inline="no-display-inline"> 
<paragraph id="HB9E07CB56DA44462A3B15EA924643736"><enum>(5)</enum><text display-inline="yes-display-inline">prohibit a State from issuing a commercial driver’s license to an individual who is not domiciled in such State; and </text></paragraph> <paragraph id="H42E9F15DC7B34A80A3E381F6EE2A789C"><enum>(6)</enum><text>require States to use the SAVE system for any non-citizen applicant for a commercial driver’s license and deny any applicant if the SAVE system does not confirm lawful presence of such applicant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3C84BD23DC0845A5988263EE9E6CBE3E"><enum>(b)</enum><header>Penalties</header> 
<paragraph id="H5D855E02977A4B9383A292E3E623B587"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HF2D7C7754BF345E58BD3120885047F0C"> <section id="H9A0F660D89734FB0B0217B8D6A40BF15"><enum>155.</enum><header>Suspension of funds for licensing unauthorized commercial drivers</header> <subsection id="H2D1A9DED29534D50931C9FB4C740BA05"><enum>(a)</enum><header>Suspension</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Transportation shall suspend a State’s apportionment of funds under section 104(b) if the Secretary determines that the State has issued commercial driver’s licenses in contravention of section 31308(6) of title 49.</text></subsection> 
<subsection id="H2F0A630E41094017A367C7507BBC64C2"><enum>(b)</enum><header>Determination</header> 
<paragraph id="H734CD7BEC7244FA4B4151990A2C98723"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall, on an annual basis, review the commercial driver’s licensing policies and practices of each State to determine compliance with this section.</text></paragraph> <paragraph id="H700DB2B232534484A9263CF2933BE411"><enum>(2)</enum><header>Information</header><text>The Secretary may request any information necessary from a State to make such a determination.</text></paragraph></subsection> 
<subsection id="HDFC76B007D26432B9228C0595EE9E957"><enum>(c)</enum><header>Reinstatement</header><text>Funds suspended under subsection (a) shall be reinstated to a State when the Secretary certifies that the State has taken all necessary measures to comply with section 31308(6) of title 49.</text></subsection> <subsection id="H3EF7E180D5B14466AB42432F30E92B94"><enum>(d)</enum><header>Applicability</header><text>This section shall apply to any State that receives funds under section 104(b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA8C77473548E4A39ADCFBB9FE44A13BF" display-inline="no-display-inline"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/154">section 154</external-xref> the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H66B8EA2813A34FBE8B0A5717CEC01397"> <toc regeneration="no-regeneration"> <toc-entry level="section">155. Suspension of funds for licensing unauthorized commercial drivers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HA00AD2C8D6D940139AE61A4DF407AE13"><enum>(3)</enum><header>Rulemaking</header><text>The Secretary of Transportation shall issue such regulations as are necessary to set fines for trucking companies that knowingly employ drivers that do not hold a valid commercial driver’s license that complies with section 31308 of title 49, United States Code.</text></paragraph></subsection></section>
