<section id="H57AAF69E88A94771BF562299D4B128B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Requiring Ethical and Accurate Labeling of Lab-grown Meats Act</short-title></quote> or the <quote><short-title>REAL Meats Act</short-title></quote>.</text></section> <section id="H99CC77812BCE4CFA83F85677B9927994"><enum>2.</enum><header>Amendment to the Federal Food, Drug, and Cosmetic Act regarding fake meat</header><text display-inline="no-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HB37CF261C58B42B491F85506DB7A627F"><enum>(z)</enum> 
<paragraph id="H6F2491F05BA74CE6B3927231049CC2A7" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">If it is a cell-cultured product or an analogue product and its label does not bear immediately before the name of the product a qualifying term or disclaimer that clearly communicates to a consumer the contents and nature of the product, such as the terms <quote>cell-cultured</quote>, <quote>lab-grown</quote>, <quote>analogue</quote>, <quote>meatless</quote>, <quote>plant-based</quote>, <quote>made from plants</quote>, or other similar terms.</text></paragraph> <paragraph id="HA94502A07A7542DE851D77E474DED9D4" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If it is a cell-cultured product or an analogue product that uses in the product name the term <quote>chicken</quote>, <quote>turkey</quote>, <quote>beef</quote>, or <quote>pork</quote> or that of another species or kind of animal processed for food subject to the Federal Meat Inspection Act or the Poultry Products Inspection Act, and its label does not bear immediately before the name of the product the term <quote>cell-cultured</quote>, <quote>lab-grown</quote>, <quote>analogue</quote>, or <quote>imitation</quote>.</text></paragraph> 
<paragraph id="H673742C7682E43FD9FC4156DA4891C2C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this paragraph:</text> <subparagraph id="H2B3873D4A8604934AA716082393B0897"><enum>(A)</enum><text display-inline="yes-display-inline">The term ‘analogue product’ means any food product derived by combining processed plants, insects, or fungus with additives to approximate the texture, flavor, appearance, or other aesthetic qualities or the chemical characteristics of any specific type of meat, meat food product, poultry, or poultry product and that does not contain meat or poultry at levels that would trigger inspection under the Federal Meat Inspection Act and Poultry Products Inspection Act.</text></subparagraph> 
<subparagraph id="HCD477A60F7534FB8BD12486400112722"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>cell-cultured product</quote> means food product derived by harvesting animal cells and artificially replicating those cells in a growth medium in a laboratory to produce tissue.</text></subparagraph> <subparagraph id="H6BFCEF074E9B42AAB4CD29C7C514073C"><enum>(C)</enum><text display-inline="yes-display-inline">The term ‘meat’ has the meaning given the term in section 301.2 of title 9, Code of Federal Regulations (or successor regulations).</text></subparagraph> 
<subparagraph id="H6E760A7EBBB3457294A032AE135DE630"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>meat food product</quote> has the meaning given the term in section 1(j) of the Federal Meat Inspection Act.</text></subparagraph> <subparagraph id="H4D6BE75984C14000ACD5E5F4B42EB67B"><enum>(E)</enum><text display-inline="yes-display-inline">The term <quote>poultry</quote> and <quote>poultry product</quote> have the meanings given the terms in section 4 of the Poultry Products Inspection Act, except that such terms do not include a product that is exempted from the definition of poultry product under section 381.15 of title 9 Code of Federal Regulations (or successor regulations).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
