<section id="H996FDD86E4B843889E03E5D7B3B6E01D" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Shutdown Salary Suspension Act</short-title></quote>.</text> </section> 
<section id="HA9F6AC31937546E5859BEB3301DA3CB0" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting paying salaries of Members of Congress during Government shutdowns</header> 
<subsection id="H8FBF598EA4114914852F4BF0E4A018E5"><enum>(a)</enum><header>Rule for One Hundred Nineteenth Congress</header> 
<paragraph id="H2B113C7876D349DFB6280041D519DAAD"><enum>(1)</enum><header>Holding salaries in escrow</header><text display-inline="yes-display-inline">If on any day during a pay period occurring during the One Hundred Nineteenth Congress a Government shutdown is in effect, the payroll administrator of each House of Congress shall—</text> <subparagraph id="H1C1507117A3743C191D37E7C607718AF"><enum>(A)</enum><text display-inline="yes-display-inline">deposit in an escrow account and exclude from the payments otherwise required to be made with respect to that pay period for the compensation of each Member of Congress who serves in that House of Congress an amount equal to the product of—</text> 
<clause id="H6C22B5A365804AEAAF9BD68E117EC190"><enum>(i)</enum><text>the daily rate of pay of the Member under section 601(a) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501</external-xref>); and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H4DE3E3E932454AC180FE0A4C47371CEE"><enum>(ii)</enum><text>the number of 24-hour periods during the pay period during which the Government shutdown is in effect; and</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HBD17106A3A7A41BD8D30C498EA191273"><enum>(B)</enum><text>release amounts deposited in an escrow account under subparagraph (A) to such Member of Congress only upon the expiration of the period described in <internal-xref idref="HC0A439988E624394B5B5176936F537F7" legis-path="2.(a)(2)">paragraph (2)</internal-xref>.</text> </subparagraph></paragraph> <paragraph id="HC0A439988E624394B5B5176936F537F7"><enum>(2)</enum><header>Period described</header><text>The period described in this paragraph is the period that—</text> 
<subparagraph id="H9F9AF4ACE0E740D1A331045686B129EC"><enum>(A)</enum><text>begins on the first day on which the applicable Government shutdown is in effect; and</text> </subparagraph> <subparagraph id="H79C614183C344B79B3DB4E8A9FCA3E42"><enum>(B)</enum><text>ends on the earlier of—</text> 
<clause id="H12657020CFD649D59BDE8FF17313A495"><enum>(i)</enum><text>the date on which the applicable Government shutdown is no longer in effect; or</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HF4B89A1EBCB54C92B9B28A4423D3E63D"><enum>(ii)</enum><text>the last day of the One Hundred Nineteenth Congress.</text> </clause></subparagraph></paragraph> 
<paragraph id="H1B3AC9084C414BD08D71EAAA29FABF75"><enum>(3)</enum><header>Withholding and remittance of amounts from payments held in escrow</header><text>The payroll administrator of each House of Congress shall provide for the same withholding and remittance with respect to a payment deposited in an escrow account under <internal-xref idref="H2B113C7876D349DFB6280041D519DAAD" legis-path="2.(a)(1)">paragraph (1)</internal-xref> that would apply to the payment if the payment were not subject to <internal-xref idref="H2B113C7876D349DFB6280041D519DAAD" legis-path="2.(a)(1)">paragraph (1)</internal-xref>.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEFC465C603254EF6A5C8123C8DD36D45"><enum>(4)</enum><header>Release of amounts at end of the Congress</header><text>In order to ensure that this subsection is carried out in a manner that shall not vary the compensation of Senators or Representatives in violation of the twenty-seventh amendment to the Constitution of the United States, the payroll administrator of a House of Congress shall release for payment to Members of that House of Congress any amounts remaining in any escrow account under this section on the last day of the One Hundred Nineteenth Congress.</text> </paragraph></subsection> 
<subsection id="H29C168F47CBF4987BD9775260B173F6D"><enum>(b)</enum><header>Subsequent Congresses</header> 
<paragraph id="HB16289D475534F60B654D2B6C5848620"><enum>(1)</enum><header>Holding salaries in escrow</header><text>On and after the first day of the One Hundred Twentieth Congress, if on any day during a pay period a Government shutdown is in effect, the payroll administrator of each House of Congress shall—</text> <subparagraph id="HD03B7966F82742E9B7A1FBC9ABE385A9"><enum>(A)</enum><text display-inline="yes-display-inline">deposit in an escrow account and exclude from the payments otherwise required to be made with respect to that pay period for the compensation of each Member of Congress who serves in that House of Congress an amount equal to the product of—</text> 
<clause id="HAA5E5256CD1642398DE3425270ECF46D"><enum>(i)</enum><text>the daily rate of pay of the Member under section 601(a) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501</external-xref>); and</text> </clause> <clause id="H0015598F4B8B46AD8F3F0E68F9378D2A"><enum>(ii)</enum><text>the number of 24-hour periods during the pay period during which the Government shutdown is in effect; and</text></clause></subparagraph> 
<subparagraph id="HA40E011CE19C43EF9993C913E81A19EE"><enum>(B)</enum><text display-inline="yes-display-inline">release amounts deposited in an escrow account under subparagraph (A) to such Member of Congress only upon the expiration of the period described in <internal-xref idref="HC0A439988E624394B5B5176936F537F7" legis-path="2.(a)(2)">paragraph (2).</internal-xref></text> </subparagraph> </paragraph> <paragraph id="HEA611C74F73347799DA2C8902E14D9E1" display-inline="no-display-inline"><enum>(2)</enum><header>Period described</header><text>The period described in this paragraph is the period that—</text> 
<subparagraph id="H964BACFDAFFB4A4B94E66ABED5BE385F"><enum>(A)</enum><text>begins on the first day on which the applicable Government shutdown is in effect; and</text> </subparagraph> <subparagraph id="HE98392B59D3A4169B166EFAF43BEBA5E"><enum>(B)</enum><text>ends on the earlier of—</text> 
<clause id="H9E6E5FBEB8DF4F4693CF47116A21EFBC"><enum>(i)</enum><text>the date on which the applicable Government shutdown is no longer in effect; or</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HB355201822544CCBBBB98B7798D3BF0D"><enum>(ii)</enum><text>the last day of the Congress during which the period began under subparagraph (A).</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="HF6184848C3A54680B5FB8866E94010CB"><enum>(c)</enum><header>Role of Secretary of the Treasury</header><text>The Secretary of the Treasury shall provide the payroll administrator of each House of Congress with such assistance as may be necessary to enable the payroll administrator to carry out this Act.</text> </subsection> <subsection id="H085AD22D2A304F268B9D5A2C30F5D44A"><enum>(d)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H5C53091D4932489787EA49AABB08962A"><enum>(1)</enum><text>the term <term>Member of Congress</term> means an individual serving in a position covered under subparagraph (A), (B), or (C) of section 601(a)(1) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501(1)</external-xref>); and</text> </paragraph> <paragraph id="HD3D8753281F54212B4F86997E59FBCA2"><enum>(2)</enum><text>the term <term>payroll administrator</term>, with respect to a House of Congress, means—</text> 
<subparagraph id="HF26D1A02B97645DF8E91BA9BEF0F1F8E"><enum>(A)</enum><text>in the case of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this Act; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE9D9D46D04EA481ABD5226C8972B6C1F"><enum>(B)</enum><text>in the case of the Senate, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this Act.</text> </subparagraph></paragraph></subsection></section> 
<section id="H02E1AC0AE0EC4A4B8A683CFEA616998F"><enum>3.</enum><header>Prohibiting paying salaries of President and Vice President during Government shutdowns</header> 
<subsection id="HF534B2EDFF774BEEAA5B2C85EEE7E324"><enum>(a)</enum><header>Holding salaries in escrow</header><text display-inline="yes-display-inline">If on any day during a pay period occurring during the term of office of the President or Vice President a Government shutdown is in effect, the Director of the Office of Personnel Management shall—</text> <paragraph id="H2258361EBA124BA3AB2F3EC8AEEDC567"><enum>(1)</enum><text display-inline="yes-display-inline">deposit in an escrow account and exclude from the payments otherwise required to be made with respect to that pay period for the compensation of the President and the Vice President an amount equal to the product of—</text> 
<subparagraph id="HED0BE532509448D0B3B0E6F41CC8775E"><enum>(A)</enum><text>the daily rate of pay of the President or Vice President (as the case may be) under applicable law; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF8158BEFA55B4FE5903BD7859E348F97"><enum>(B)</enum><text>the number of 24-hour periods during the pay period during which the Government shutdown is in effect; and</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBABFE9A739344B32B2C3DE5F5E96E16B"><enum>(2)</enum><text>release amounts deposited in an escrow account under <internal-xref idref="H2258361EBA124BA3AB2F3EC8AEEDC567" legis-path="3.(a)(1)">paragraph (1)</internal-xref> to the President and the Vice President only upon the expiration of the period described in <internal-xref idref="H3B664CBE9205408FBB1A3B23D363A912" legis-path="3.(b)">subsection (b)</internal-xref>.</text> </paragraph></subsection> <subsection id="H3B664CBE9205408FBB1A3B23D363A912"><enum>(b)</enum><header>Period described</header><text>The period described in this subsection is the period that—</text> 
<paragraph id="H6BF608C709B8405A85C328D4F5FB08BD"><enum>(1)</enum><text>begins on the first day on which the applicable Government shutdown is in effect; and</text> </paragraph> <paragraph id="HCC33B512C32A4BBCBBFE1C70C9F41F9B"><enum>(2)</enum><text>ends on the earlier of—</text> 
<subparagraph id="HDCA7D18B020545A0BDBDCE54E1A58467"><enum>(A)</enum><text>the date on which the applicable Government shutdown is no longer in effect; or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0ACD5B0B312C4B80B05E838577515955"><enum>(B)</enum><text>the last day of the term of office of the President and Vice President during which the period begins.</text> </subparagraph></paragraph></subsection> 
<subsection id="H8DDB87C9CC94456690A6DD6CDA3B05DF"><enum>(c)</enum><header>Withholding and remittance of amounts from payments held in escrow</header><text>The Director of the Office of Personnel Management shall provide for the same withholding and remittance with respect to a payment deposited in an escrow account under <internal-xref idref="HF534B2EDFF774BEEAA5B2C85EEE7E324" legis-path="3.(a)">subsection (a)</internal-xref> that would apply to the payment if the payment were not subject to <internal-xref idref="HF534B2EDFF774BEEAA5B2C85EEE7E324" legis-path="3.(a)">subsection (a)</internal-xref>.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H52919519B3024A88B2FDC7FE962849DD"><enum>(d)</enum><header>Release of amounts at end of term</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall release for payment to the President and Vice President any amounts remaining in the escrow account under this section on the last day of the term of office of the President and Vice President during which the period described in <internal-xref idref="H3B664CBE9205408FBB1A3B23D363A912" legis-path="3.(b)">subsection (b)</internal-xref> begins.</text></subsection></section> 
<section id="H11BFCE043DF24F00BB1DF9D7FA5293EC"><enum>4.</enum><header>Determination of Government shutdown</header><text display-inline="no-display-inline">For purposes of this Act, a Government shutdown shall be considered to be in effect if there is a lapse in appropriations for any Federal agency or department as a result of a failure to enact a regular appropriations bill or continuing resolution.</text> </section> </legis-body></bill>
