which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require U.S. Immigration and Customs Enforcement to take into custody certain aliens who have been charged in the United States with a crime that resulted in the death or serious bodily injury of another person, and for other purposes.</official-title></form><legis-body id="H6F1E0A6EFBE24CC9A608E9D5BA874838" style="OLC"><section id="H5F6E953FCFD441BC82E3D77301A85AFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Sarah’s Law</short-title></quote>.</text></section><section id="H9564FCAA32F046A0B3F807BED462102C"><enum>2.</enum><header>Mandatory detention of certain aliens charged with a crime resulting in death or serious bodily injury</header><text display-inline="no-display-inline">Section 236(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)</external-xref>) is amended—</text><paragraph id="HD4A0F972FA5B4B7788282A1E7C9BCAC7"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HDE8B971F59A4404B9DE654003BDF6115"><enum>(A)</enum><text>in subparagraph (C)—</text><clause id="H6B0361D524604C24B963245349781792"><enum>(i)</enum><text>by striking <quote>sentence</quote> and inserting <quote>sentenced</quote>; and</text></clause><clause id="HD6F3E0DA2E814834AE654DE5BBEB9A2C"><enum>(ii)</enum><text>by striking <quote>or</quote>;</text></clause></subparagraph><subparagraph id="H75B5E2724F634775BF197008F685C0EF"><enum>(B)</enum><text>in subparagraph (D), by striking the comma at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H65D27DF48BDD4128BA512980817B136E"><enum>(C)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block id="HB311EF71C1CE496B832167114E112CFF" style="OLC"><subparagraph id="HFF220E81125C4DDBA8867FFA212CA906"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H1F1B3FD6FA33492B98AD7AF2EFFD6051"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H0254089D4B6B4B0EA88115BB0A37C0CC"><enum>(I)</enum><text display-inline="yes-display-inline">is inadmissible under paragraph (6)(A), (6)(C), or (7) of section 212(a), </text></subclause><subclause id="H7E66FEA6F11C45208C6C36669AF568B7" indent="up2"><enum>(II)</enum><text display-inline="yes-display-inline">is deportable under section 237(a)(1)(B) as an alien whose nonimmigrant visa (or other documentation authorizing admission into the United States as a nonimmigrant) has been revoked under section 221(i), or</text></subclause><subclause id="H2D386D7615F54F379DFDC9F8EEB6D735" indent="up2"><enum>(III)</enum><text>is deportable under section 237(a)(1)(C)(i), and </text></subclause></clause><clause id="HD2E01728BF3E49369E3BDD183A42E071" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is charged with, is arrested for, is convicted of, admits having committed, or admits committing acts which constitute the essential elements of any offense that resulted in the death or serious bodily injury (as defined in section 1365(h)(3) of title 18, United States Code) of another person,</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8DF632701A9E4D5996E5395E4DE7F348"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H2481BB795B5D4F8A860E147A6C583577" style="OLC"><paragraph id="H9F088CCDEABD4C4CB6C17D49CEBF16D2"><enum>(3)</enum><header>Notification requirement</header><text>Upon encountering or gaining knowledge of an alien described in paragraph (1), the Secretary of Homeland Security shall—</text><subparagraph id="H63CD9041A3CE4291B948F077536ACC21"><enum>(A)</enum><text>obtain information from law enforcement agencies and from other available sources regarding the identity of any victims of the crimes for which such alien was charged, arrested, or convicted; and</text></subparagraph><subparagraph id="H84A8E8D7631E40548B0076B51E8179F4"><enum>(B)</enum><text>provide the victim or, if the victim is deceased, a parent, guardian, spouse, or closest living relative of such victim, with information, on a timely and ongoing basis, including—</text><clause id="HFCB2757D89894F539BA034765F4B6659"><enum>(i)</enum><text>the alien’s full name, aliases, date of birth, and country of nationality;</text></clause><clause id="HF4EC7D45DDC84E0596B2B7F486790E2A"><enum>(ii)</enum><text>the alien’s immigration status and criminal history;</text></clause><clause id="HA11BC1695B35406DA0A89B24F8CDB6F8"><enum>(iii)</enum><text>the alien’s custody status and any changes related to the alien’s custody; and</text></clause><clause id="H7DB6A5A5DB9D4609A71874743B72CEAD"><enum>(iv)</enum><text>a description of any efforts by the United States Government to remove the alien from the United States.</text></clause></subparagraph></paragraph><paragraph id="HEA8DCA039C6F429183DCA86EB63FDB64"><enum>(4)</enum><header>Detainer</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall issue a detainer for an alien described in paragraph (1)(E) and, if the alien is not otherwise detained by Federal, State, or local officials, shall effectively and expeditiously take custody of the alien.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4B274AE1980B45B48D247BF7E90A8B76"><enum>3.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, may be construed to limit the rights of crime victims under any other provision of law, including section 3771 of title 18, United States Code.</text></section></legis-body></bill>
