<section id="HF8F43A90D4A042D1813648668020C447" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Fire Academy Reimbursement for Emergency Service Course Unavailability and Expenses Act</short-title></quote> or the <quote><short-title>National Fire Academy RESCUE Act</short-title></quote>.</text></section> 
<section id="H335BED6E06B0449099638E565E66FC16" commented="no"><enum>2.</enum><header>Reimbursement of certain expenses during a lapse in appropriations for the National Academy for Fire Prevention and Control</header> 
<subsection id="HFD4C250E2E264823A5A3CD5E057985D3" commented="no"><enum>(a)</enum><header>Reimbursement of certain expenses</header><text display-inline="yes-display-inline">Section 7 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2206">15 U.S.C. 2206</external-xref>) is amended—</text> <paragraph id="H3B7DC7A839884D62A8EC55A221290D73" commented="no"><enum>(1)</enum><text>by redesignating subsection (n) as subsection (o); and</text></paragraph> 
<paragraph id="HC7E2C46EB02A4EC3B894669D621D1F30" commented="no"><enum>(2)</enum><text>by inserting after subsection (m) the following new subsection:</text> <quoted-block style="OLC" id="HFB5DAFAF38A34591934216978B0E0DE0" display-inline="no-display-inline"> <subsection id="H54363312D4AC4CFAA3144CE6E73B181B" commented="no"><enum>(n)</enum><header>Reimbursement of certain expenses</header> <paragraph id="HCD1F89EEF7E247E9ABCF627A0225F13B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a covered course or activity that is cancelled during a period in which there is a lapse in appropriations, or as a result of such a lapse, for the Federal Emergency Management Agency, the Administrator of FEMA, subject to paragraph (2), shall reimburse a fire department for any covered expense related to such covered course or activity not later than 90 days after the later of—</text> 
<subparagraph id="HD1D665D2AF9043D9BC4E00ECA6C33D50"><enum>(A)</enum><text display-inline="yes-display-inline">the date such period ends, if applicable; or</text></subparagraph> <subparagraph id="HE2BB62662FCD410BA17394A59C983CBB"><enum>(B)</enum><text>the date the Administrator of FEMA receives an itemization under paragraph (3) from such fire department relating to such covered course or activity.</text> </subparagraph></paragraph> 
<paragraph id="H7A6C4EC446D54DBD83B1F0787DF738A3" commented="no"><enum>(2)</enum><header>Good cause</header><text>A reimbursement under paragraph (1) shall not apply with respect to a covered course or activity that is cancelled if such covered course or activity is cancelled for good cause.</text> </paragraph> <paragraph id="H1572969D6EDA4EDD90DA07EA3D0AD44B" commented="no"><enum>(3)</enum><header>Itemization of expenses</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which a lapse in appropriations for the Federal Emergency Management Agency ends, the fire chief or other appropriate head of a fire department affected by a covered course or activity that is cancelled during any such period, or as a result of any such lapse, may submit to the Administrator of FEMA an application for reimbursement that includes an itemization of each covered expense incurred by such fire department.</text></paragraph> 
<paragraph id="HE42BC920A9A14D35ABFCE16A0B2BA240" commented="no"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H7D2DA6A64DDE48398F28691276D3AB23" commented="no"><enum>(A)</enum><header>Backfill expense</header><text display-inline="yes-display-inline">The term <quote>backfill expense</quote> means an expense incurred for the following:</text> 
<clause id="HF64C2A5FBC4E4111B80A0BDDD1990202" commented="no"><enum>(i)</enum><text>Staffing adjustments.</text></clause> <clause id="H2078979615134B65A8DBAC782471EDA4" commented="no"><enum>(ii)</enum><text>Overtime compensation.</text></clause></subparagraph> 
<subparagraph id="H15C7E95CA6CC4296B4FB9B1289A9570F" commented="no"><enum>(B)</enum><header>Covered course or activity</header><text display-inline="yes-display-inline">The term <quote>covered course or activity</quote> means—</text> <clause id="H06DF846C626446A4881FE35C1EF007C6"><enum>(i)</enum><text>a course or program that is offered by the Academy—</text> 
<subclause id="HFDD8206E27AA4D1587841EA85F9D2787" commented="no"><enum>(I)</enum><text>in-person and on-campus;</text></subclause> <subclause id="H477FE93984AF4E97888B75E85615EFAA" commented="no"><enum>(II)</enum><text>in-person and off-campus; or</text></subclause> 
<subclause id="HBE2F49170C38451CA9F958F829408B80"><enum>(III)</enum><text display-inline="yes-display-inline">through synchronous or asynchronous virtual instruction; or</text></subclause></clause> <clause id="HFE8D1EE47C4A41BB896B895AC0E98281"><enum>(ii)</enum><text display-inline="yes-display-inline">a conference or symposium that is offered by the Academy in-person and on-campus.</text></clause></subparagraph> 
<subparagraph id="H4C5B41F72E86495A8B09C2BDA5BECFAF" commented="no"><enum>(C)</enum><header>Covered expense</header><text display-inline="yes-display-inline">The term <quote>covered expense</quote> means any expense that a fire department incurred for the planned participation of the personnel of such fire department in a covered course or activity, including the following:</text> <clause id="HE2AE94A26329404B9872EFD3F4E4E092" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">Any travel expense.</text></clause> 
<clause id="H69BA9FF542CF426ABBA350B048A96EFC" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">Any backfill expense.</text></clause></subparagraph> <subparagraph id="H5F2174B6AB134AC88ABE938D4D491112" commented="no"><enum>(D)</enum><header>Good cause</header><text>The term <quote>good cause</quote> includes the following:</text> 
<clause id="HFF08495D56804712A77939024A0B8054" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">The closure of a facility of the Academy for any reason other than a lapse in appropriations.</text></clause> <clause id="H9868EE312B894C1B91B8EFFCF2998B7B" commented="no"><enum>(ii)</enum><text>The illness or unavailability of an instructor of the Academy.</text></clause> 
<clause id="HCAFC6F3761A94784AD445DC0FEECEFD0" commented="no"><enum>(iii)</enum><text>A national emergency that impedes access to a facility of the Academy by a student or faculty member of the Academy.</text></clause></subparagraph> </paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
