which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 36, United States Code, to require the Hostage and Wrongful Detainee flag to be displayed on key historical dates, and for other purposes.</official-title></form><legis-body id="H799661F37C3741348A0084CC7D4C45F1"><section id="H9BE5056910574146960E4E84AC7C83A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Remembering American Hostages Act of 2025</short-title></quote>.</text></section><section id="H5823347B4C9D448B98818C66F2AA24F4"><enum>2.</enum><header>Hostage and wrongful detainee flag</header><text display-inline="no-display-inline">Section 904(b) of title 36, United States Code, is amended—</text><paragraph id="HE7A4209245E9495E9340117208917E90"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H3A983D9308854E79A204B32BB0D6E02B"><enum>(A)</enum><text>by redesignating subparagraph (D) as subparagraph (E); </text></subparagraph><subparagraph id="H802C49670D074C2D9BDEB506B3D06262"><enum>(B)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block id="H5F89B70085684772879708A5FD4DCFDF" style="OLC"><subparagraph id="H46C459A0491C4EE7BB96E4BB77120A68"><enum>(D)</enum><text>Key dates in hostage and wrongful detention history, including—</text><clause id="HB422468E442C495E9DEC188BDA9FC8E9"><enum>(i)</enum><text>November 4 and January 20, key dates of the Iranian hostage crisis; </text></clause><clause id="H2261983FEDEC4DB3A3FFEFBEFA4F4E35"><enum>(ii)</enum><text>August 19, the date of the death of James Foley.''; and</text></clause><clause id="H2E2C19C95EDE467DA20600B48C902E03"><enum>(iii)</enum><text>October 7, the date of Hamas’ unprovoked attack where more than 240 were taken hostage, including 12 Americans; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC7436F7D11AC4EA7BC7E42471B0BB374"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H77E1E6DC9FE646309EBCA5D69493EC9E" style="OLC"><subparagraph id="H4FA3C67F269B4865972FD6C971633956"><enum>(F)</enum><text>With respect to the locations described in subparagraphs (D) through (G) of paragraph (3), any day on which the United States Flag is displayed.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB48ED58E355446FBAA95820052D4C5E1"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="HAAD714C253984147896660C39995339B"><enum>(A)</enum><text>in subparagraph (C)—</text><clause id="H2CE72A920D5B4765BCAE210A1F3F88D6"><enum>(i)</enum><text>in clause (i) by striking <quote>and</quote> at the end;</text></clause><clause id="HD5F8DA555C09454988834596F14E09BD"><enum>(ii)</enum><text>in clause (ii) by striking the period at the end and inserting a semicolon; and</text></clause><clause id="H97A5ADA2A0AC4FD18CEE3C69042E91EF"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block id="H369BF666794F452A939481E482C44AEC" style="OLC"><clause id="H909D0B058E37449DBF3DD6E40017B7E2"><enum>(iii)</enum><text>the Attorney General;</text></clause><clause id="H886DCEFE8EBC4E689D31DA0802FA5BDD"><enum>(iv)</enum><text>the Secretary of Education;</text></clause><clause id="HC0A8A87B2D3D494AB178918171B394A0"><enum>(v)</enum><text>the Secretary of Transportation; and</text></clause><clause id="H4F1E5D7DB57D4B07ADB37B506BDEF45E"><enum>(vi)</enum><text>the Secretary of Commerce.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H9CD38132C572428683F3DEEE32E1C9B6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HE1D064A44E7D4FB4B149793EDEDCF1E1" style="OLC"><subparagraph id="HD38D88628E9548C0BE6FFF38E3C205F1"><enum>(D)</enum><text>The buildings containing any office of the Department of State offices in the United States.</text></subparagraph><subparagraph id="HB4C7ABADC53F44C2A43A3C1112FCBA00"><enum>(E)</enum><text>Each embassy and consulate of the United States.</text></subparagraph><subparagraph id="HC709511F41454362A8F6CF211D4E6FC4"><enum>(F)</enum><text>The buildings containing any office of the Department of Justice in the United States, unless otherwise specified by the Attorney General.</text></subparagraph><subparagraph id="H11F4D8EBF2314CC594FF8B2BA683B1B4"><enum>(G)</enum><text>Each place in the United States at which an individual can initiate, renew, or otherwise obtain a passport of the United States, in a location visible to such individuals.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H207B619440804F4DB6F5466745ACD52D"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Federal Government should strongly encourage local and State governments and airports across the United States, in coordination with the Administrator of the Federal Aviation Administration, to fly the Hostage and Wrongful Detainee flag on days as specified in section 904 of title 36, United States Code, including distributing an Executive order for direction to raise and fly such flag on specified days in honor of a hostage returning to the United States, or whenever a hostage is recognized as passing away in captivity.</text></section></legis-body></bill>
