<section id="H7387899BF91E4BBAB81058A6AC2912BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Newborn Formula Access for a Nutritious Tomorrow Act of 2025</short-title></quote> or the <quote><short-title>INFANT Act of 2025</short-title></quote>.</text></section> <section id="HE7BC8BEBA8924CB793A4F2A4C1649FDB" section-type="subsequent-section"><enum>2.</enum><header>WIC infant formula contracting</header><text display-inline="no-display-inline">Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text> 
<paragraph id="H180652D321544CD9BE4BCEE27EB14D3B"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="HAA685D22A72044A187DC8E4C8CEA8C3F"><enum>(A)</enum><text>by amending paragraph (17) to read as follows:</text>

<paragraph id="H0BE63A8AFFC74DA6B05D5040E76BEE3D"><enum>(17)</enum><header>Competitive bidding</header> 
<subparagraph id="H84697C858E56444B95F80655FC7666BD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>competitive bidding</term> means a procurement process under which the Secretary or a State agency selects 2 manufacturers offering the lowest price, as determined by the submission of sealed bids, for a product for which bids are sought for use in the program authorized by this section.</text></subparagraph> <subparagraph id="H6D35252CFB104C3DB2E539801C544163"><enum>(B)</enum><header>Designation</header><text>Of the manufacturers described in subparagraph (A), 1 such manufacturer may be designated as the primary manufacturer and 1 such manufacturer may be designated as the secondary manufacturer.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H4DC565A596094AC7BB43BC147B0E4FC6" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (22)—</text> <clause id="HBEEF1648F0D64719A98FA34146E0CAFD"><enum>(i)</enum><text>by striking <quote>primary</quote> in the heading and each place it appears and inserting <quote>manufacturer</quote>;</text></clause> 
<clause id="H5B4C56CC9FCA4BE3BAFC9CEDEC865E5E"><enum>(ii)</enum><text>by striking <quote>specific</quote>; and</text></clause> <clause id="H2086A612A21F433CAED616C9C3DBC0E3"><enum>(iii)</enum><text>by striking <quote>a contract is awarded</quote> and inserting <quote>contracts are awarded</quote>; and</text></clause></subparagraph></paragraph> 
<paragraph id="H090E3C82329748F38E7AF900885F4EF0"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (h)(8)(A)—</text> <subparagraph id="HDBAF8892E2C741ACA50E5A5187C3C21A"><enum>(A)</enum><text>in clause (ii)(I), by striking <quote>primary</quote> and inserting <quote>manufacturer</quote>; and</text></subparagraph> 
<subparagraph id="HA0C9F1914A5A43E589EB8820C7376AC9"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (v)—</text> <clause id="H643CE61724A34863851EC053709D12B0"><enum>(i)</enum><text>by striking <quote>first</quote> in the heading and each place it appears; and</text></clause> 
<clause id="HDD5BD3FC4DB14B6AADE30BC2FEF61680"><enum>(ii)</enum><text>by striking <quote>primary</quote> in each place it appears and inserting <quote>manufacturer</quote>.</text></clause></subparagraph></paragraph></section> </legis-body></bill>
