which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/77">chapter 77</external-xref> of title 5, United States Code, to ensure timely rulings by the Merit Systems Protection Board on appeals by Federal employees and applicants for employment.</official-title></form><legis-body id="H05A19935970B4E67A7D057D367487229" style="OLC"><section id="HD93A5C52DDCB4F8D80A9AC20F53FE5E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access to Swift and Timely Justice Act</short-title></quote> or the <quote><short-title>FAST Justice Act</short-title></quote>.</text></section><section id="H2502D3D618B0473EA2EC0052A550E45E"><enum>2.</enum><header>Timeliness of MSPB appeals</header><subsection commented="no" display-inline="no-display-inline" id="HA5197EF610204B869C49B34820BC4DDD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7701 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HA506F9EB37644143BAE4500B3ED255CE"><enum>(1)</enum><text>by redesignating subsection (k) as subsection (l); and</text></paragraph><paragraph id="H5D81B87C1FFE460D89B485BE6F9FA70E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting after subsection (j) the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H1394130551EF4142815001736C91A329"><subsection id="HAB23E7B775AE46059BE4AF7221C7251C"><enum>(k)</enum><header>Untimely action by MSPB</header><paragraph id="HC1C5424A3FE74B499F2341FD2A38E9CA"><enum>(1)</enum><header>In general</header><text>On and after the date that is 120 days after the date on which an employee or applicant for employment files an appeal under this section, other than an appeal of a case that is subject to section 7702, if the Merit Systems Protection Board has not taken an action with respect to the appeal that is subject to judicial review, the employee or applicant shall be entitled to file a civil action with respect to the personnel action that is the subject of the appeal.</text></paragraph><paragraph id="H2CC42E6C53BE46AC84F6044E64ADC27A"><enum>(2)</enum><header>Filing</header><subparagraph commented="no" display-inline="no-display-inline" id="HB9FEBC55147C4CA290BA2B106807C905"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>An employee or applicant may bring a civil action under paragraph (1) in a district court of the United States for— </text><clause commented="no" display-inline="no-display-inline" id="HC4D62A4AC5D64CF4AED4288C46856FBA"><enum>(i)</enum><text display-inline="yes-display-inline">any judicial district in which a personnel action that is a subject of the civil action is alleged to have occurred; or </text></clause><clause commented="no" display-inline="no-display-inline" id="HB213A73403FC4792AD938AC05D911AD4"><enum>(ii)</enum><text display-inline="yes-display-inline">the judicial district in which the employee or applicant would have been employed, but for a personnel action that is a subject of the civil action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCA9298E1084D43AF800B2DF316E93C1B"><enum>(B)</enum><header>Where principal office is located</header><text display-inline="yes-display-inline">If the respondent for a civil action under paragraph (1) is not subject to personal jurisdiction in any judicial district described in subparagraph (A), the civil action may be brought in a district court of the United States for the judicial district in which the principal office of the respondent is located.</text></subparagraph></paragraph><paragraph id="H56401845F2A84F37B62EB3D2294F52BA"><enum>(3)</enum><header>Standards for judicial review</header><text>In a civil action under paragraph (1), the court—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4F8664C80BA6430099FC6EE3B61FF378"><enum>(A)</enum><text display-inline="yes-display-inline">shall apply the standard of review under section 7703(c) only with respect to an order or decision of the Merit Systems Protection Board; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC53A519280C9415EB3FF71A37194E6A8"><enum>(B)</enum><text display-inline="yes-display-inline">in making any other determination, shall apply the same standard of review that would have applied to the review of the personnel action at issue by the Merit Systems Protection Board. </text></subparagraph></paragraph><paragraph id="HB79802737A9C4DEDA697679060BCFD62"><enum>(4)</enum><header>Appeal of district court determination</header><text>An appeal from an order or decision of the district court in a civil action under paragraph (1) shall, in accordance with section 1291 of title 28, be filed with the court of appeals of the United States for the judicial district in which the district court is located.</text></paragraph><paragraph id="HE385D7DC119D42C18039176B788A33FD"><enum>(5)</enum><header>Stay</header><text>If an employee or applicant for employment brings a civil action in accordance with paragraph (1) with respect to a personnel action, the Merit Systems Protection Board— </text><subparagraph commented="no" display-inline="no-display-inline" id="HFDA6CD497730429ABCC6380BD72E8096"><enum>(A)</enum><text display-inline="yes-display-inline">shall stay the appeal relating to the personnel action upon the filing of the civil action; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H88A9D48B3C8A4BC3A0B9179B2E926EFA"><enum>(B)</enum><text display-inline="yes-display-inline">if the civil action is dismissed for lack of jurisdiction, shall resume processing the appeal.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5C4D6E0103AD41E495673FFD535256DF"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in the amendments made by subsection (a) shall be construed to limit the ability of an employee or applicant for employment to obtain judicial review of an order or decision of the Merit Systems Protection Board in accordance with section 7703 of title 5, United States Code.</text></subsection></section></legis-body></bill>
