R. 571</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250121">January 21, 2025</action-date><action-desc><sponsor name-id="G000568">Mr. Griffith</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to means-test certain child’s insurance benefits.</official-title></form><legis-body id="H2BD1CCCBA8774125B5ECA5351AA7C0F4" style="OLC"><section id="HDE157DBB24AE466A801AF82BE649817F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>____ Act</short-title></quote>.</text></section><section id="HBC084C673F9641538D79D2C81C5D6E53"><enum>2.</enum><header>Means-testing child’s insurance benefits</header><subsection id="HD445783DA9BB47F2B7E34843F6E1FC53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(d)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/407">42 U.S.C. 407(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HEC59F8C5E6394C74A1B178AC573103AC" display-inline="no-display-inline"><subparagraph id="HF9D192F58DB340978B74F8CDA3586137" commented="no"><enum>(E)</enum><text>No child aged 18 years or older shall be considered a <quote>full-time elementary or secondary school student</quote> for any month of a taxable year if being so considered would entitle such child to a benefit under this subsection on the basis of the wages and self-employment income of an individual who—</text><clause id="H8FA34701136040B8AD67FB7844902DF6" commented="no"><enum>(i)</enum><text>is entitled to old-age or disability insurance benefits,</text></clause><clause id="HEEE10B31D32E4C37BFFBD7B52358F279" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">is 67 years of age or older, and</text></clause><clause id="HA4D57CB4092E467FB7163B0C1F8B8442" commented="no"><enum>(iii)</enum><text>has more than $125,000 of earnings for such taxable year as computed under section 203(f)(5)(A).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0103A0B57C5F47C8B10A3BE503F2EBF1"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this Act shall apply to with respect to benefits paid for any month beginning after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
