<section id="HCF3B4E8FC10048169B1A57A12CEC74F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Non-Domiciled CDL Integrity Act</short-title></quote>.</text></section> <section id="HA747879676154DCFAF65E47B8AB716A0" section-type="subsequent-section"><enum>2.</enum><header>Issuance of non-domiciled commercial driver’s licenses</header><text display-inline="no-display-inline">Subparagraphs (A) and (B) of section 31311(12) are amended to read as follows:</text> 
<quoted-block style="USC" id="HAB4837B701414136AC677645D4D9F3D7" display-inline="no-display-inline"> 
<subparagraph id="H0049398D69C0409894F332E652E35C26"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the State may issue a commercial driver’s license only to an individual who operates or will operate a commercial motor vehicle and is domiciled in the State or in a State that does not issue commercial driver’s licenses.</text></subparagraph> <subparagraph id="HAA758F4F7CF048E69DEFF6F4C37D424A"><enum>(B)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the Secretary, the State may issue a commercial driver’s license to an individual who operates or will operate a commercial motor vehicle and is domiciled in a foreign jurisdiction, if—</text> 
<clause id="HF2286B9D524F4FEBBB0197A3248D2F1C"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to applicants domiciled in a foreign jurisdiction other than the jurisdictions specified in clause (ii)—</text> <subclause id="H945E42FBBD8A431F8B5854ACCDBEF752"><enum>(I)</enum><text>the individual has lawful immigration status in the United States;</text></subclause> 
<subclause id="H3573EAF3E6D54E5DB6F700697D95B385"><enum>(II)</enum><text>the individual possesses a visa determined by the Secretary to be directly connected to a legitimate, employment-based reason to hold a commercial driver’s license;</text></subclause> <subclause id="H2A4DA08BA07F4CB18A7F5D131974E0C3"><enum>(III)</enum><text>the State confirms the applicant’s lawful immigration status before issuing, transferring, renewing, or upgrading a license issued under this paragraph;</text></subclause> 
<subclause id="H4F47690F1D3B4268BEA93E10FB8F06D2"><enum>(IV)</enum><text>the State issues a license under this paragraph for a time period of up to 1 year or until the expiration of the applicant’s authorized stay in the United States, whichever is shorter; and</text></subclause> <subclause id="HE46BAADB95D04439AE9C5FCF27E94524"><enum>(V)</enum><text>the State retains records related to the issuance of a license under this paragraph for not less than 2 years or for a period of time as otherwise prescribed by the Secretary and, within 48 hours of a request, provides such records to the Secretary; and</text></subclause></clause> 
<clause id="H9FC36E2B6C124376B303E2DF57F17C24"><enum>(ii)</enum><text>with respect to applicants domiciled in Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, or the Commonwealth of the Northern Mariana Islands—</text> <subclause id="H2784851193D245FD81CAB85973378D3A"><enum>(I)</enum><text>the individual presents acceptable proof of United States citizenship or lawful permanent resident status;</text></subclause> 
<subclause id="H0B74F3BE662E4C4BA667A8A574296003"><enum>(II)</enum><text>the State confirms the applicant’s United States citizenship or lawful permanent resident status before issuing, transferring, renewing, or upgrading a license issued under this paragraph; and</text></subclause> <subclause id="H05CCAC9FA41D4CB2AA6AA5B9E4678D18"><enum>(III)</enum><text>the State retains records related to the issuance of a license under this paragraph for not less than 2 years or for a period of a time as otherwise prescribed by the Secretary and, within 48 hours of a request, provides such records to the Secretary.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
