<section id="H791F90D13AF34C58939B0E0C69849B71" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cost-of-Living Fairness Act</short-title></quote>.</text></section> 
<section id="HCD0656C0900345C2B0285BCBE04D688A"><enum>2.</enum><header>Income determination with respect to payments for insurance policies</header> 
<subsection id="H0AA06A3B6D29439FA32FAD833F6B7B0C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a payment made by an individual for a covered insurance policy that provides a specified benefit to the individual or a member of the household of the individual shall be deducted from the income and resources of the individual in determining the eligibility of the individual, or any member of the household of the individual, for benefits or assistance (or the amount or extent of benefits or assistance) under any Federal program or under any State or local program financed in whole or in part with Federal funds.</text></subsection> <subsection id="H124474ADFAE144B196A29E2FDF551A51"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0C98C69BF3BB463BB935F711613BED31"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>covered insurance policy</quote> means any of the following:</text> <subparagraph id="HAF82F48FDAAB44FAB7B27DBED53A71A9"><enum>(A)</enum><text>An insurance policy provided by an insurer for a passenger motor vehicle registered under applicable State law to—</text> 
<clause id="H583CFCB0E9E343D6A2C01707EB55682E"><enum>(i)</enum><text>the individual who pays for the policy; or</text></clause> <clause id="H2F276AC7D3DB4EC793C75601D939E481"><enum>(ii)</enum><text>a member of the household of such individual.</text></clause></subparagraph> 
<subparagraph id="HD9679AC7FD024E65AFB92BCB672851E0"><enum>(B)</enum><text>An insurance policy or product under applicable State law that insures, guarantees, or indemnifies against liability, loss of life, loss of health, or loss through damage to, or destruction of, property, which is available to the individual who pays for the policy or product or a member of the household of such individual based on the status of the individual or member as a homeowner or a renter.</text></subparagraph> <subparagraph id="H7D718DEB9F0F4FFFB827B24908A2DAC2"><enum>(C)</enum><text>A flood insurance policy for the principal residence of an individual that is—</text> 
<clause id="H54B3AC4F49CE4475B66E866E00748909"><enum>(i)</enum><text>issued under the National Flood Insurance Act of 1968;</text></clause> <clause id="HF6470D90AEB849F395284F4CD8B2D40F"><enum>(ii)</enum><text>a policy for private flood insurance, as such term is defined in section 102(b) of the Flood Disaster Protection Act of 1973; or</text></clause> 
<clause id="H2ABBBE80E417446CB8CEF027A0D25590"><enum>(iii)</enum><text>designed to supplement either of the types of policies described in clause (i) or (ii).</text> </clause></subparagraph></paragraph> <paragraph id="H872D0ECEAF8F456FA370A7B010CA18F0"><enum>(2)</enum><text>The terms <quote>insurer</quote>, <quote>passenger motor vehicle</quote>, and <quote>State</quote> have the meanings given the terms, respectively, in section 32101 of title 49, United States Code.</text></paragraph> </subsection></section>
