<section id="HF7F0199E51644C22951777D589354845" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Childhood Genital Mutilation Prevention Act</short-title></quote>.</text></section> <section id="HF7D1711990E44E29BED68BA9D81FEFDC" commented="no"><enum>2.</enum><header>Prohibiting gender-related medical treatment for minors</header> <subsection id="HF342190ACE114C7BADED0017FBC6F816" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/116">section 116</external-xref> the following new section:</text>

<section id="H5B67EBF35B4D46178B8F3791A735D765" commented="no"><enum>116A.</enum><header>Gender-related medical treatment furnished to minors.</header>
<subsection id="H47DDA7B0FC454BA3AAAD3912310B4769" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="HE2229FCA7E6044879ECEE11E800BB110" legis-path="116A.(c)">subsection (c)</internal-xref>, whoever, in a circumstance described in <internal-xref idref="H23D7052626A044F28CA3EA0BF888E8FE" legis-path="116A.(b)">subsection (b)</internal-xref>, knowingly performs or attempts to perform a gender-related medical treatment on a minor, shall be fined under this title, imprisoned not more than 10 years, or both.</text></subsection> <subsection id="H23D7052626A044F28CA3EA0BF888E8FE" commented="no"><enum>(b)</enum><header>Circumstances described</header><text display-inline="yes-display-inline">For the purposes of subsection (a), the circumstances described in this subsection are that—</text>
<paragraph id="H9EDDE2C5474845ED934F9323BD6C8446" commented="no"><enum>(1)</enum><text>the offender or victim traveled in interstate or foreign commerce, or traveled using a means, channel, facility, or instrumentality of interstate or foreign commerce, in furtherance of or in connection with the conduct described in subsection (a);</text></paragraph> <paragraph id="HCF5C857C294A4A93B47FA18056F5BF37" commented="no"><enum>(2)</enum><text>the offender used a means, channel, facility, or instrumentality of interstate or foreign commerce in furtherance of or in connection with the conduct described in subsection (a);</text></paragraph>
<paragraph id="H6E293C8F784846E7B7E1D90FAD2EEF1B" commented="no"><enum>(3)</enum><text>any payment of any kind was made, directly or indirectly, in furtherance of or in connection with the conduct described in subsection (a) using any means, channel, facility, or instrumentality of interstate or foreign commerce or in or affecting interstate or foreign commerce;</text></paragraph> <paragraph id="H639ACA42C58A45A9BF4A570B40E046F0" commented="no"><enum>(4)</enum><text>the offender transmitted in interstate or foreign commerce any communication relating to or in furtherance of the conduct described in subsection (a) using any means, channel, facility, or instrumentality of interstate or foreign commerce or in or affecting interstate or foreign commerce by any means or in manner, including by computer, mail, wire, or electromagnetic transmission;</text></paragraph>
<paragraph id="H00D42990A81D4C098015601154CA62B0" commented="no"><enum>(5)</enum><text>any instrument, item, substance, or other object that has traveled in interstate or foreign commerce was used to perform the conduct described in subsection (a);</text></paragraph> <paragraph id="H8DF5CC340D1B45A9A1DCCA5D39A478AF" commented="no"><enum>(6)</enum><text>the conduct described in subsection (a) occurred within the special maritime and territorial jurisdiction of the United States, or any territory or possession of the United States; or</text></paragraph>
<paragraph id="HA364C7582E454A669EC16A77CA02BC77" commented="no"><enum>(7)</enum><text>the conduct described in subsection (a) otherwise occurred in or affected interstate or foreign commerce.</text></paragraph></subsection> <subsection id="HE2229FCA7E6044879ECEE11E800BB110" commented="no"><enum>(c)</enum><header>Exceptions</header> <paragraph id="HE39217A82E97479995A65EDA0BACB02C" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who provides gender-related medical treatment to a minor shall not be considered to have violated the prohibition in subsection (a) if such medical treatment is provided to such minor for purposes of treating—</text>
<subparagraph id="H8E80E1D6AEEB4D25AB6B1EABB7308B28" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a disorder of sex development, diagnosed by a physician after such physician has determined through genetic or biochemical testing that such minor does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action;</text></subparagraph> <subparagraph id="HE6958B71D6114ED7B220CF266A3A6DE4" commented="no"><enum>(B)</enum><text>irresolvably ambiguous biological sex characteristics of such minor, including the presence of—</text>
<clause id="H6E343BA3F62E4F9992F5B4D751CC837F" commented="no"><enum>(i)</enum><text>46 XX chromosomes with virilization;</text></clause> <clause id="H87C135B9B43C4589B5BD829A7241C534" commented="no"><enum>(ii)</enum><text>46 XY chromosomes with undervirilization; or</text></clause>
<clause id="HB72E757F8A2843B394FA1D7AAE7697A6" commented="no"><enum>(iii)</enum><text>both ovarian and testicular tissue; or</text></clause></subparagraph> <subparagraph id="HC70E226CBBE541D693EDEAC73F282FF3" commented="no"><enum>(C)</enum><text>an infection, injury, disease, or disorder caused or exacerbated by gender-related medical treatment that was furnished to such minor.</text></subparagraph></paragraph>
<paragraph id="H417D6BD1AAD64E559AC5873D0C018F34" commented="no"><enum>(2)</enum><header>Exception for minors</header><text display-inline="yes-display-inline">A minor who seeks gender-related medical treatment, or on whom gender-related medical treatment was performed, shall not be considered to have violated the prohibition in subsection (a).</text></paragraph></subsection> <subsection id="HA363C81C165D4D108F2ABFCDC8371FF3" commented="no"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HFBB90D1E9663481884B1CBDA9B4BDF45" commented="no"><enum>(1)</enum><header>Gender-related medical treatment</header><text>The term <term>gender-related medical treatment</term> means—</text> <subparagraph id="HB8D929547DB941D3BA17A51E37856FC4" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a female individual, medical treatments provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not female, including—</text>
<clause id="H155BA2F797D248208519E3E060C284D9" commented="no"><enum>(i)</enum><text>surgical procedures, including—</text> <subclause id="H6CA09A3955BB4F91AD15AB3A88A31A42" commented="no"><enum>(I)</enum><text>vaginectomy;</text></subclause>
<subclause id="H926792CB2A3C492DBAB5CC87E46FC134" commented="no"><enum>(II)</enum><text>hysterectomy;</text></subclause> <subclause id="H154DD53E5A954EBC89EB50CEFBA74DF0" commented="no"><enum>(III)</enum><text>oophorectomy;</text></subclause>
<subclause id="HD06B2F673B1C4ACC842D057EC125B3A2" commented="no"><enum>(IV)</enum><text>reconstruction of the urethra;</text></subclause> <subclause id="HB93815D6E6E94F73B136A2B8AF7B8BBE" commented="no"><enum>(V)</enum><text>metoidioplasty;</text></subclause>
<subclause id="H3E8F565DB9D347FD8A32C655C885A9E9" commented="no"><enum>(VI)</enum><text>phalloplasty;</text></subclause> <subclause id="H80340A95E7F24735BBEE5617377CBFC5"><enum>(VII)</enum><text display-inline="yes-display-inline">salpingo-oophorectomy;</text></subclause>
<subclause id="HDF64293595934A60BCA0D84BC5491B0E" commented="no"><enum>(VIII)</enum><text>scrotoplasty;</text></subclause> <subclause id="HACF6C821D9C14078B45F8CF6D0A2762D" commented="no"><enum>(IX)</enum><text>implantation of erection or testicular protheses;</text></subclause>
<subclause id="HFB91F407DD07403D9DE2EC59CC2BDCD7" commented="no"><enum>(X)</enum><text>subcutaneous mastectomy;</text></subclause> <subclause id="H22A4C32AC2944F5F8F09F4025F8D44FB" commented="no"><enum>(XI)</enum><text>vocal cord surgery;</text></subclause>
<subclause id="H05292903CEA14049A50C40B757E249F9" commented="no"><enum>(XII)</enum><text>pectoral implants; and</text></subclause> <subclause id="H2B16CA8C55DD4B399C2A4055E0B31BA8"><enum>(XIII)</enum><text display-inline="yes-display-inline">penile transplantation;</text></subclause></clause>
<clause id="H8B3D6DDDE2C641E0B9B8E25757FC6E4E" commented="no"><enum>(ii)</enum><text>exogenous doses of testosterone or other androgens; and</text></clause> <clause id="H8CA7727E065D4B36AAA7D06FBB809624" commented="no"><enum>(iii)</enum><text>puberty blockers, including—</text>
<subclause id="H774AA315E6A34F05BB64B01B2F3BFF75" commented="no"><enum>(I)</enum><text>GnRH agonists; and</text></subclause> <subclause id="H83D6013417AA4DCFA48E2B1F3DB99826" commented="no"><enum>(II)</enum><text>synthetic drugs that suppress the production of estrogen and progesterone or delay or suppress pubertal development in female individuals; and</text></subclause></clause></subparagraph>
<subparagraph id="H13A1403235ED43B599777768A4158F3F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a male individual, medical treatments provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not male, including—</text> <clause id="H6B3893D27B5F41B4982F4497B10AB0AD" commented="no"><enum>(i)</enum><text>surgical procedures, including—</text>
<subclause id="H1BFC062A91BA40F291E6B3538570D31B" commented="no"><enum>(I)</enum><text>penectomy;</text></subclause> <subclause id="HE9EE8E92BDCF4B4098FE585C6603AF3E" commented="no"><enum>(II)</enum><text>orchiectomy;</text></subclause>
<subclause id="HBBF7F545F2734968B70DECA5424D8626" commented="no"><enum>(III)</enum><text>vaginoplasty;</text></subclause> <subclause id="HBD91B36FED9F42E9B4112D8C8F7ECECA" commented="no"><enum>(IV)</enum><text>clitoroplasty;</text></subclause>
<subclause id="H0FDA4C510A4B416DA71DB28BB34DDF7B" commented="no"><enum>(V)</enum><text>vulvoplasty;</text></subclause> <subclause id="H0849C1F705314707A82F327FBA54BF88" commented="no"><enum>(VI)</enum><text>augmentation mammoplasty;</text></subclause>
<subclause id="H3D9EE9B2945940798045AEBDF537059D" commented="no"><enum>(VII)</enum><text>facial feminization surgery;</text></subclause> <subclause id="HF1ABF919FE62491384B2B45ADB9212EC" commented="no"><enum>(VIII)</enum><text>vocal cord surgery;</text></subclause>
<subclause id="H5C025B6933FF4D9C8B3D46D4F3627CCD" commented="no"><enum>(IX)</enum><text display-inline="yes-display-inline">chondrolaryngoplasty;</text></subclause> <subclause id="H89B954C387AE46F3BF8210C0525B2C4E" commented="no"><enum>(X)</enum><text>gluteal augmentation; and</text></subclause>
<subclause id="HE89C007A52C7494598F3934CA3C47A29"><enum>(XI)</enum><text display-inline="yes-display-inline">uterine transplantation;</text></subclause></clause> <clause id="HFA7AFC8AE56E4425A00FDB7C53382F71" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">exogenous doses of estrogen; and</text></clause>
<clause id="HA90580FA7CDB4E7FA08B3FBC7408F846" commented="no"><enum>(iii)</enum><text>puberty blockers, including—</text> <subclause id="HA2D148E527A94D6AB4EAE31656D0A7E4" commented="no"><enum>(I)</enum><text>GnRH agonists; and</text></subclause>
<subclause id="H004473DFA9A8426EBB43A6D93C7CC56C" commented="no"><enum>(II)</enum><text>synthetic drugs that suppress the production of testosterone or delay or suppress pubertal development in male individuals.</text></subclause></clause></subparagraph></paragraph> <paragraph id="HA8A6C968F9794B6096C0149C397D46D2" commented="no"><enum>(2)</enum><header>Female</header><text display-inline="yes-display-inline">The term <term>female</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></paragraph>
<paragraph id="H0560B04C5FB34309875AB92D283E1420" commented="no"><enum>(3)</enum><header>Gender</header><text display-inline="yes-display-inline">The term <term>gender</term>—</text> <subparagraph id="H564DB46703FE41B38DF9AB8E0A09008B"><enum>(A)</enum><text>means—</text>
<clause id="H649B7B5BC4D145F9B6F5D4F3B6AD9771"><enum>(i)</enum><text display-inline="yes-display-inline">males, females, or the natural differences between males and females, unless such term is otherwise specified or used alone, rather than with or as an adjective modifying other words; and</text></clause> <clause id="HF854F99E48AC4E3C8F1D8B8900A6B417"><enum>(ii)</enum><text display-inline="yes-display-inline">a synonym for sex; and</text></clause></subparagraph>
<subparagraph id="H6B32E0A4CBFD490F93ABAB23F6B3A27E"><enum>(B)</enum><text display-inline="yes-display-inline">does not mean gender identity, experienced gender, gender expression, or gender roles.</text></subparagraph></paragraph> <paragraph id="H86A06A6683B64279BAA8610AA0D2C244" commented="no"><enum>(4)</enum><header>Male</header><text display-inline="yes-display-inline">The term <term>male</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text></paragraph>
<paragraph id="H54600EF50D714839BD48B123D3141451" commented="no"><enum>(5)</enum><header>Minor</header><text>The term <term>minor</term> means an individual under 18 years of age.</text></paragraph> <paragraph id="H7C8254E277E34A3CA19C9025E9290EA8" commented="no"><enum>(6)</enum><header>Sex</header><text display-inline="yes-display-inline">The term <term>sex</term> means the biological determination as to whether an individual is male or female.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HBC32F89E11FA413E80EA19CE2C5E6AC0" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by inserting after the item relating to section 116 the following new item:</text> <quoted-block style="USC" id="HBADAB483CFB043C1BD781EF2A4340508" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">116A. Gender-related medical treatment for minors.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H72C5CE5695E242B194ECC9D6E1F37F84"><enum>3.</enum><header>Prohibiting payment and participation under Medicare with respect to gender-related medical treatment for minors</header> <subsection id="HE15679AC615F4CF8ADCE084749257710"><enum>(a)</enum><header>Excluding from coverage gender-Related medical treatment for minors</header><text>Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)</external-xref>) is amended—</text>
<paragraph id="H57E3CF2006714D88BED761C6DD385682"><enum>(1)</enum><text>in paragraph (24), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="H8AB68D0A3BF64B279B9DB65EE483B42C"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph>
<paragraph id="HFB034AF17D8645B186C8AF6020FEBF70"><enum>(3)</enum><text>by inserting after paragraph (25) the following new paragraph:</text> <quoted-block style="OLC" id="HD03DB8CB9BC74D93A08FC768350114A2" display-inline="no-display-inline"> <paragraph id="H1FA2AC12A6D54A97B0F72C4C578B2747"><enum>(26)</enum><text display-inline="yes-display-inline">beginning on the date that is 90 days after the date of the enactment of the Childhood Genital Mutilation Prevention Act, which constitute gender-related medical treatment for minors described in section 116A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, and are not provided for the purposes described in subsection (c)(1) of such section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H7B3955DACBFE4CDBA8A4CEB7A723C4EF"><enum>(b)</enum><header>Excluding from participation providers furnishing gender-Related medical treatment for minors</header><text>Section 1866 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H3C011F0125F245E39C4C4E8CF686B47A" display-inline="no-display-inline"> <subsection id="H5A68B22BFB844993B07CC6FC25385C5C"><enum>(l)</enum><header>Exclusion of providers furnishing gender-Related medical treatment for minors</header><text display-inline="yes-display-inline">Beginning on the date that is 90 days after the date of the enactment of the Childhood Genital Mutilation Prevention Act, with respect to a provider of services or supplier that, on or after the date that is 90 days after such date of enactment, furnishes gender-related medical treatment for minors, as described in section 116A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code to any individual (other than such a treatment that is furnished for the purposes described in subsection (c)(1) of such section), regardless of whether such individual is entitled to benefits under part A or enrolled under part B—</text>
<paragraph id="H5158359D5F864C7783B0CEC1EDF8606F"><enum>(1)</enum><text>if such provider of services or supplier is enrolled in the program under this title, the Secretary shall terminate such enrollment; and</text></paragraph> <paragraph id="H552C589A33D8471EB26F9A46D1A7293A"><enum>(2)</enum><text>the Secretary may not enroll such provider of services or supplier as a new provider of services or supplier in the program under this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H035C86402ED643E2AD1302B0A92923B7" commented="no"><enum>4.</enum><header>Prohibition on Federal funding for gender-related medical treatment for minors</header><text display-inline="no-display-inline">No funds authorized or appropriated by Federal law, and none of the funds in any trust fund to which funds are authorized or appropriated by Federal law, shall be obligated or expended for any gender-related medical treatment furnished to a minor (as such terms are used for purposes of section 116A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code) or for any health benefits coverage that includes coverage for gender-related medical treatment furnished to a minor.</text></section> </legis-body></bill>
