<enum>I</enum> <section id="H4CE865E92E77427396176C8AB2207A55" section-type="section-one"><enum>101.</enum><header>Tuition-free community college grant and support program</header> <subsection id="H7051C19CC68744CAA8893B1BC2306053"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a program to provide grants to each State that submits a complete application under subsection (b) to—</text> <paragraph id="H82A5E0C6C67A436789462113DA5C56A9"><enum>(1)</enum><text>facilitate tuition-free community college for eligible students;</text></paragraph> <paragraph id="H560C27C5B2C84BBE914C1A30CCEB8E50"><enum>(2)</enum><text>award subgrants to eligible institutions for the improvement of the capacity of institutions to provide supportive services; and</text></paragraph> <paragraph id="H5ADEAEDA2CD541ACAC64599C02946275"><enum>(3)</enum><text>award subgrants to eligible institutions for the provision of direct grants to student to address non-tuition costs to meet the growing demand from employers for workers with postsecondary credentials.</text></paragraph></subsection> <subsection id="HC3D6FC58719E4017BCD4B7781FCC2491"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, a State shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including a State plan describing the following:</text> <paragraph id="H9684262EC54D43A5BC18EF949A72024D"><enum>(1)</enum><header>Interagency committee</header> <subparagraph id="H588527DF4A85463DA307AD9377381B56"><enum>(A)</enum><header>In general</header><text>A plan to formalize an interagency committee within such State to—</text> <clause id="HFE2B92CAAC00410DB2C3660863B2B17E"><enum>(i)</enum><text>evaluate gaps and opportunities in the State workforce, higher education, childcare, and human services systems; and</text></clause> <clause id="HD466E9BF2E2446FDA000ADA561851E74"><enum>(ii)</enum><text>maximize Federal and State resources to support pathway development that increases economic mobility and recognized postsecondary credential attainment.</text></clause></subparagraph> <subparagraph id="H2B0603CA879B4C719FFB70EC6163CD36"><enum>(B)</enum><header>Membership</header><text>An assurance that such committee shall consist of members from the following entities:</text> <clause id="H59E59AE357F5410592E527A2CE1E64CB"><enum>(i)</enum><text>State unemployment insurance agency.</text></clause> <clause id="HEE260A67EF924321B40D04B698652A46"><enum>(ii)</enum><text>Office of the State higher education executive officer and public college boards.</text></clause> <clause id="H72A79994F2F64FDF82BF445503BC2A89"><enum>(iii)</enum><text>State community college system.</text></clause> <clause id="HF12CB11EB256463D8140F442B3ED8E1C"><enum>(iv)</enum><text>State departments of health and human services.</text></clause> <clause id="H32E3CD0383C94B0A80013C6AB1563D67"><enum>(v)</enum><text>State departments of economic development.</text></clause> <clause id="HB60595E34986481BB12C1609190D8AF3"><enum>(vi)</enum><text>Workforce development agencies.</text></clause> <clause id="H72FFC98AD31F4919AD56B729EF3AAD4F"><enum>(vii)</enum><text>State or local housing authorities.</text></clause> <clause id="HC03772F3829546F985211F1A3C2F317B"><enum>(viii)</enum><text>Students enrolled in community colleges in the State.</text></clause> <clause id="HB421E20D8E4946ABA716C38AF91FBABB"><enum>(ix)</enum><text>Other relevant State agencies as determined by the State.</text></clause></subparagraph></paragraph> <paragraph id="H1FBE854A73E042A0B163B59BD8CE85DA"><enum>(2)</enum><header>Education alignment</header><text>A plan to—</text> <subparagraph id="H9AC72724CCCB41339631C7498275D2D1"><enum>(A)</enum><text>with respect to eligible individuals without a secondary school diploma or its recognized equivalent, facilitate the completion of such diploma or recognized equivalent at a community college;</text></subparagraph> <subparagraph id="H1F108B27B5344F30B4C3853FD742C4B6"><enum>(B)</enum><text>ensure that credits received for Advanced Placement or International Baccalaureate classes are applied to an equivalent community college course; and</text></subparagraph> <subparagraph id="HB02538EF38D747C18AF860A3709E581F"><enum>(C)</enum><text>otherwise align the requirements between secondary schools and community colleges in order to increase the accessibility of community college for eligible individuals.</text></subparagraph></paragraph> <paragraph id="HB1CB1738F7A846B6AF1DA9603FF424B3"><enum>(3)</enum><header>Development</header><text>A plan to—</text> <subparagraph id="H4993E8751F3841308C716BB3D11F9EFA" commented="no"><enum>(A)</enum><text>improve career pathway development, with special attention to career pathways related to in-demand industry sectors or occupations identified under paragraph (14);</text></subparagraph> <subparagraph id="H4E87FC9152C548F0A3122618ABF3BEA4"><enum>(B)</enum><text>increase economic mobility of State residents; and</text></subparagraph> <subparagraph id="H8CF863FE185E45B6A783FCB22858E90F"><enum>(C)</enum><text>provide access to affordable postsecondary education for State residents through a network of coordinated State and Federal support systems designed and implemented by State agencies in partnership with public institutions of higher education and public higher education systems.</text></subparagraph></paragraph> <paragraph id="H9D2150D158D84C8F962C34D419C8DE4F"><enum>(4)</enum><header>Credential attainment</header><text>A plan to prioritize secondary and recognized postsecondary credential attainment through—</text> <subparagraph id="HEACF7295E202424CB933A3D3CAA4CD7C"><enum>(A)</enum><text>integrated education and training models;</text></subparagraph> <subparagraph id="H339BBD7ABD724DCA8F73F20D6AB66AFF"><enum>(B)</enum><text>dual enrollment programs; and</text></subparagraph> <subparagraph id="HC8B57F2B128F445FBF981A6130C22A7A"><enum>(C)</enum><text>an increased number of navigators.</text></subparagraph></paragraph> <paragraph id="HF6DFC2E609F54C199DEFC9D4CBA728BE" commented="no"><enum>(5)</enum><header>Priority</header><text>A plan to prioritize assistance to individuals—</text> <subparagraph id="HA8915092B8C04F02A046ED778F3564C5" commented="no"><enum>(A)</enum><text>with a barrier to employment;</text></subparagraph> <subparagraph id="HEA5988583D6F4D5A967A0D876613A139" commented="no"><enum>(B)</enum><text>with incomes below 200 percent of the poverty level; or</text></subparagraph> <subparagraph id="H03D18E234AE24150B9A2E32387AB86F2" commented="no"><enum>(C)</enum><text>without a recognized postsecondary credential.</text></subparagraph></paragraph> <paragraph id="H060D4CBE37784107907165E63D8379F4"><enum>(6)</enum><header>Public resources</header><text>A plan to maximize public resources to support the attainment of a recognized postsecondary credential, including with respect to—</text> <subparagraph id="HEB071BEEFF02404FBD20B7295BDC596B"><enum>(A)</enum><text>transportation;</text></subparagraph> <subparagraph id="HE8916004078E4258BB692351E63D0F36"><enum>(B)</enum><text>on-campus or off-campus housing;</text></subparagraph> <subparagraph id="HA290B9ACB4AC4FACA00E34FAF990CA49"><enum>(C)</enum><text>childcare;</text></subparagraph> <subparagraph id="HD4C9DF639307459181FB28E2F06734F4"><enum>(D)</enum><text>food assistance; and</text></subparagraph> <subparagraph id="HC24D7C90616C4845AE55985CF855FAE2"><enum>(E)</enum><text>other support programs.</text></subparagraph></paragraph> <paragraph id="HFC302774E60D40A78968DE7DF691EF3D"><enum>(7)</enum><header>Outreach</header><text>A plan to reach eligible individuals without a recognized postsecondary credential, including with respect to individuals who—</text> <subparagraph id="H65CA11D5DB3A4678BEF9B558E3FC3320"><enum>(A)</enum><text>live in high-poverty areas;</text></subparagraph> <subparagraph id="H8DD8C43C484743DAB17CE570523BA382"><enum>(B)</enum><text>are first-generation students;</text></subparagraph> <subparagraph id="H4B6564E191D841A1BFB636D07019026E"><enum>(C)</enum><text>are low-income students; and</text></subparagraph> <subparagraph id="HACA1B2502E1948529B9B5E316D0463DB"><enum>(D)</enum><text>identify as belonging to other underrepresented student groups.</text></subparagraph></paragraph> <paragraph id="H5AA3FC9D43434ECDA940B871363B30DB"><enum>(8)</enum><header>Recognized postsecondary credential enrollment, persistence, retention and completion</header><text>A plan to increase enrollment, persistence, retention, and credential completion by—</text> <subparagraph id="H30F50D3FC56449B2B3B13A3638EFE1E5"><enum>(A)</enum><text display-inline="yes-display-inline">developing new, or expanding existing, degree and credential programs based on the needs of in-demand industry sectors or occupations identified under paragraph (14);</text></subparagraph> <subparagraph id="H27E57D5D0610414786EF966B94C5246A"><enum>(B)</enum><text>increasing the number of career counselors and navigators;</text></subparagraph> <subparagraph id="H6D2DD65D2202470CB744E50DC4E54BB9" commented="no"><enum>(C)</enum><text>ensuring that eligible students enrolled in community colleges—</text> <clause id="HF5950546F53844DF93CB830B6F2CD3E2" commented="no"><enum>(i)</enum><text>are not charged tuition or fees; and</text></clause> <clause id="HD641171935A8402CAC885BECFFEDA4E0" commented="no"><enum>(ii)</enum><text>are not required to apply Federal, State, or private financial assistance (including scholarships) to pay for the cost of tuition or fees; and</text></clause> </subparagraph> <subparagraph id="H5135EBA5ED444BD0A1A816EDE23AE9F1" commented="no"><enum>(D)</enum><text>ensuring that the eligibility of an eligible student enrolled in community college for a Federal Pell Grant under subpart 1 of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>) or other financial assistance is not affected by funds provided under this Act or private scholarship awards unless the total amount of such student’s Federal Pell Grant, other financial assistance, and private scholarships exceeds the student’s annual cost of attendance.</text></subparagraph></paragraph> <paragraph id="H2835B7F774FD4BF2A2497C6614A854D3"><enum>(9)</enum><header>Cost analyses</header><text>Cost analyses for—</text> <subparagraph id="H6DACAC5E5FD74F759850CFD1E77E7493"><enum>(A)</enum><text>providing tuition-free community and technical college pathways to individuals who have not attained—</text> <clause id="H5E28B2977E5540A5A4CE478F4B5751B6"><enum>(i)</enum><text>a secondary school diploma or its recognized equivalent; or</text></clause> <clause id="HE09266B9B1554A0985000045EC6784AE"><enum>(ii)</enum><text>a recognized postsecondary credential, up to and including a bachelor’s degree; and</text></clause></subparagraph> <subparagraph id="H23718D9DE6B84D02954C3EF8217E039E"><enum>(B)</enum><text>expanding institutional capacity to meet an increased demand for recognized postsecondary credentials by expanding supportive services, including with respect to hiring additional—</text> <clause id="H337A034B5EAC4431A165F074CE4E8A07"><enum>(i)</enum><text>career counselors;</text></clause> <clause id="H6256DCFE77D449908A6DE54DA943EC33"><enum>(ii)</enum><text>navigators; and</text></clause> <clause id="H5A3C47CF18474A359E32E549B3615A54"><enum>(iii)</enum><text>other support staff.</text></clause></subparagraph></paragraph> <paragraph id="H93156BA080DB447FA02713384247897C"><enum>(10)</enum><header>Data collection</header> <subparagraph id="H8CABACEE309C4E6292C123D4F7215280"><enum>(A)</enum><header>In general</header><text>A plan for data collection efforts to measure program outcomes and evaluate program success, including by leveraging existing administrative data to track any change in participation in recognized postsecondary credential programs at community colleges.</text></subparagraph> <subparagraph id="H61C148D8DF524AB48DC94B9D7DD25010" commented="no"><enum>(B)</enum><header>Content</header><text>An assurance that the State that awards subgrants under this title will collect the following data:</text> <clause id="HA67E00430B8F4C7787E0D9F786A30F64" commented="no"><enum>(i)</enum><text>With respect to each public institution of higher education—</text> <subclause id="HDDF59632151C4999840EEA33842DF47C" commented="no"><enum>(I)</enum><text>the number and percentage of students receiving emergency aid; and</text></subclause> <subclause id="HDA70F9D6546E48FEBF2BF7CDC9D56239" commented="no"><enum>(II)</enum><text>the average grant amount for each student.</text></subclause></clause> <clause id="H9B49B2C500B34104820EDA871A0A8D98" commented="no"><enum>(ii)</enum><text>With respect to each semester or quarter at a public institution of higher education—</text> <subclause id="H18AE5BCDDF564D7DA649076740186196" commented="no"><enum>(I)</enum><text>rate of retention; and</text></subclause> <subclause id="H62FA2EF96532422795EDEB54693F33EB" commented="no"><enum>(II)</enum><text>rate of completion of a recognized secondary credential.</text></subclause></clause> <clause id="H39EFA2ED95CE4D8E9E237FB5DF69BC1D" commented="no"><enum>(iii)</enum><text>The grade point averages of students receiving emergency aid subgrants.</text></clause> <clause id="H09F1AF3DB308458A947C2B4E84FF071A" commented="no"><enum>(iv)</enum><text>Other data reported by the State.</text></clause> <clause id="H9545D5B507C24E3AB2B79B020DA8E757" commented="no"><enum>(v)</enum><text>Other data required by the Secretary.</text></clause></subparagraph></paragraph> <paragraph id="H37A9C9842FE64B3AB7F3B386682B99E0"><enum>(11)</enum><header>Data sharing</header><text>A State shall—</text> <subparagraph id="HF72B612E1899456BA45630DC15CBC8BE"><enum>(A)</enum><text>provide an interagency data-sharing agreement that facilitates statewide data collection efforts between—</text> <clause id="HD8B3F2380BD14F579BBC88ECD1B9B708"><enum>(i)</enum><text>State agencies that oversee the dispersal of State and Federal benefits;</text></clause> <clause id="H2756D8EBA07D4ADD9D849EF63030D20C"><enum>(ii)</enum><text>the State educational agency;</text></clause> <clause id="H9C0D5F6E76144087ABC2B488E1A01B93"><enum>(iii)</enum><text>the State higher education system;</text></clause> <clause id="HCF0946A0477542BDAFC71BFED889D39D" commented="no"><enum>(iv)</enum><text>the State board; and</text></clause> <clause id="H7405CB1FB05747C48A7F846B01A8F216"><enum>(v)</enum><text>other agencies determined by the Secretary to be necessary; and</text></clause></subparagraph> <subparagraph id="HA73FD4135CE9402A8E8260F756751362"><enum>(B)</enum><text>detail how such agreement will promote cross-agency collaboration and improve recognized postsecondary credential completion.</text></subparagraph></paragraph> <paragraph id="HE50A72AED5344FBAB56F0A3C6038F25D"><enum>(12)</enum><header>Transfer agreements</header><text display-inline="yes-display-inline">A description of—</text> <subparagraph id="HDEE32C6A67F6410395344B5076B263B4" display-inline="no-display-inline"><enum>(A)</enum><text>transfer agreements between 2-year and 4-year public institutions of higher education in such State; and</text></subparagraph> <subparagraph id="H1A0E6578F5C942DDA26F7F5AC0D15902"><enum>(B)</enum><text>the ways in which the State will expand the number of transfer agreements, including with respect to the facilitation and improvement of credit transfers between institutions.</text></subparagraph></paragraph> <paragraph id="H8DEB7B640ADD49C6B2E9D710899CAD07"><enum>(13)</enum><header>Sustaining funds</header><text>The State shall describe—</text> <subparagraph id="H0CF7206B33754BF4A27F32C696467629"><enum>(A)</enum><text>the ways in which such State will sustain a tuition-free community college model; and</text></subparagraph> <subparagraph id="H37D6D27350924779B45216B6E1757A46"><enum>(B)</enum><text>the amount of Federal assistance needed to sustain the model described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H01A91E1B1AFF4FC29F485D2C96C5885E" display-inline="no-display-inline"><enum>(14)</enum><header>In-demand industry sectors or occupations</header><text>A plan to—</text> <subparagraph id="H2167A4D3388B4B109AD9221E9B91D545"><enum>(A)</enum><text>identify in-demand industry sectors or occupations in such State; and</text></subparagraph> <subparagraph id="H7B36C5381AAC4ADF9219B71FC38B322F"><enum>(B)</enum><text>develop and provide access to pathways to credential and degree programs for jobs in such industries, giving priority to credential and degree programs that correspond to high-quality jobs in consultation with—</text> <clause id="H9996B48586974B61A7B2E60F5F32082D"><enum>(i)</enum><text>the State board;</text></clause> <clause id="H2255B4719273448EA4BB15916EA34CDE"><enum>(ii)</enum><text>the State health and human services agency;</text></clause> <clause id="HD6B57909F1114BD698478A3C3AC57867"><enum>(iii)</enum><text>the State board of higher education; and</text></clause> <clause id="HC5A1217485BC4E9683B6B08DD6B7D41A"><enum>(iv)</enum><text>business industry groups within the State.</text></clause></subparagraph></paragraph> <paragraph id="HC090B10E1C5D45F0BCF929A10BC85610"><enum>(15)</enum><header>Federal programs</header> <subparagraph id="H018C5C0662DA4F1ABB4A3EEA0CA16696"><enum>(A)</enum><header>In general</header><text>A description of how the State will use amounts under covered programs, to the extent otherwise permitted by law, to reduce eligibility and participation requirement barriers in such programs in order to—</text> <clause id="H255207E766D340AD94C6A05B963A1DE6"><enum>(i)</enum><text>treat the pursuit of a recognized postsecondary credential as meeting any compliance, work participation, and core activity requirements for each such program; and</text></clause> <clause id="HE42668BCCBA846C5804466FF41EC68AE"><enum>(ii)</enum><text>increase access to and completion of recognized postsecondary credential programs.</text></clause></subparagraph> <subparagraph id="H07E64C87AB1240968995391050946ACF"><enum>(B)</enum><header>Covered programs defined</header><text>In this paragraph, the term <term>covered programs</term> means—</text> <clause id="HFC1B15C9740945B790CB1C35B72A837C"><enum>(i)</enum><text>the temporary assistance for needy families program under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref>);</text></clause> <clause id="H36DBDEFDF05846D1A48F7BF907CCA2DB"><enum>(ii)</enum><text>the Supplemental Nutrition Assistance Program Employment and Training Program under section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>);</text></clause> <clause id="H90C30F45079244AA970A163B16AD119A"><enum>(iii)</enum><text>the Child Care Development Fund under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>); and</text></clause> <clause id="H9B42363863EB42D787C33EBFF066177D"><enum>(iv)</enum><text>housing assistance programs carried out by the Secretary of Housing and Urban Development.</text></clause></subparagraph></paragraph></subsection> <subsection id="H92ED0FC0956D4AC9A91EF669BB5330E4"><enum>(c)</enum><header>Grant amounts</header><text>The Secretary shall determine grant amounts under subsection (a) with respect to each State based on the following:</text> <paragraph id="HC86D1FA6395D4E098B1B9B2FE7DD2F34"> <enum>(1)</enum> <text>Statewide unemployment and underemployment rates that are 1 percentage point above the national average.</text> </paragraph> <paragraph id="H7F4C140908B8441C8265B21555CFEE09"><enum>(2)</enum><text>The number of local educational agencies in a State that elect to receive special assistance payments under section 11(a)(1)(F) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)</external-xref>).</text></paragraph> <paragraph id="H4D0C38EF016A42008F974F7C8D917F1F"><enum>(3)</enum><text>A statewide official poverty rate that is 1 percentage point above the national average.</text></paragraph> <paragraph id="HD8B8F83232724ECC83852404B500908C" commented="no"><enum>(4)</enum><text>As of the date on which the application is submitted under subsection (b), whether the State carries out a tuition-free community college program.</text></paragraph></subsection> <subsection id="HDE98A8D3AACA498BB79F799288121102"><enum>(d)</enum><header>Funds</header> <paragraph id="HED2D2C828D93435E944C9A66CC488581"><enum>(1)</enum><header>Timing</header><text>A grant under this title shall be awarded for a period of 5 years, of which—</text> <subparagraph id="H19E7F6989B974AA1A2FCA1CB4B1E66E8"><enum>(A)</enum><text>a maximum of 1 year may be used for planning; and</text></subparagraph> <subparagraph id="H0233E11F368A4E88BB46B97AE980CB00"><enum>(B)</enum><text>a minimum of 4 years shall be used for implementation.</text></subparagraph></paragraph> <paragraph id="H65AB6F9F14D64B5F84D00B814F3DA931" commented="no"><enum>(2)</enum><header>Federal cost share</header><text display-inline="yes-display-inline">The Federal cost share of facilitating tuition-free community college for eligible students pursuant to a grant awarded under subsection (a) shall be not less than 100 percent for costs incurred during the 5-year grant period described in paragraph (1).</text> </paragraph></subsection> <subsection id="H2AD0AD26325240768BA252CF6DF0162B"><enum>(e)</enum><header>Grant uses</header><text>An eligible State shall use grant funds awarded under this section—</text> <paragraph id="H2CDFB7079E894955AD3893D99AFA93E8"><enum>(1)</enum><text display-inline="yes-display-inline">to implement the State plan submitted as part of the application under subsection (b), including with respect to data collection and reporting in accordance with paragraph (10) of such subsection; and</text></paragraph> <paragraph id="H5F993211BEF94C4D8F19336B67BD6879"><enum>(2)</enum><text>to award subgrants to—</text> <subparagraph id="H051AE023B48D42278CCAB786FD7E63C7"><enum>(A)</enum><text>eligible institutions in accordance with section 102; and</text></subparagraph> <subparagraph id="H4130DF50489C421489310E061728CD62"><enum>(B)</enum><text>eligible students in accordance with section 103.</text></subparagraph></paragraph></subsection> <subsection id="H0BD102FCA1714B6C80C7B31FA8B8C90A"><enum>(f)</enum><header>Eligible student defined</header><text display-inline="yes-display-inline">In this section, the term <term>eligible student</term> means an individual who—</text> <paragraph id="HDB36CFF2B05F435FAFE5143D7D3DB7DF"><enum>(1)</enum><text>is at least 18 years of age;</text></paragraph> <paragraph id="H402DC1D9AE9B4D108A7C217A2C445B93"><enum>(2)</enum><text>does not have a postsecondary credential that is less than a bachelor’s degree; and</text></paragraph> <paragraph id="HF8B1894AD64C4B8385BAE4FB953F0161"><enum>(3)</enum><text>when used with respect to a State, is a resident of the State.</text></paragraph></subsection> </section> <section id="H525AFC2D27E746839312BF5D113A8EF0"><enum>102.</enum><header>Subgrants for institutional capacity and wraparound services</header> <subsection id="HBDB61C75C7E44ACDA96E428338DF25ED"><enum>(a)</enum><header>In general</header><text>A State that receives a grant under section 101 shall award subgrants to eligible institutions for institutional capacity and wraparound services.</text> </subsection> <subsection id="H8821B7B45D5448E08D9717FDD2BB2F9F"><enum>(b)</enum><header>Application</header><text>An eligible institution seeking a subgrant under this section shall submit to the State an application in such form, at such time, and containing such information as the State may require.</text> </subsection> <subsection id="HAB79EFB8195E493BB2B75EAE58441A5C"><enum>(c)</enum><header>Subgrant uses</header><text display-inline="yes-display-inline">An eligible institution that receives a subgrant under this section shall use such subgrant funds for implementing activities and services that improve retention and completion of recognized postsecondary credentials, including—</text> <paragraph id="H2C7C8C6E93AC48F38AB0F3DE1C7DDBF9"><enum>(1)</enum><text>identifying and addressing the needs of students, including affordable housing, childcare, transportation, and food;</text></paragraph> <paragraph id="HE75E599731C74C2B9A391F817E729903"><enum>(2)</enum><text>supporting the work of navigators, including—</text> <subparagraph id="H8DB6E23769724393A351664675CFA924"><enum>(A)</enum><text>providing information to students with respect to eligibility for assistance under other Federal, State, and institutional assistance programs; and</text></subparagraph> <subparagraph id="H9AD6D3BBAC9749229E2C0ABB1558F048"><enum>(B)</enum><text>connecting students with on-campus and off-campus supportive services;</text></subparagraph></paragraph> <paragraph id="H7EBC1DB7116042F4B9B3CE955C78BA37"><enum>(3)</enum><text>hiring additional staff;</text></paragraph> <paragraph id="HE673C136077C4E339860CF7A68006DB1"><enum>(4)</enum><text>increasing access to supportive services by centralizing such services on-campus;</text></paragraph> <paragraph id="HE8C21E47D5134AE1BD64A846D370E9EF"><enum>(5)</enum><text>offering additional scheduling options for classes with respect to the day, time, and location of such classes;</text></paragraph> <paragraph id="HFA8C019712B54C4CA74F3806DC5E9AEC"><enum>(6)</enum><text>improving the transfer of credits between institutions of higher education, including community colleges;</text></paragraph> <paragraph id="HE7E48F5A52574EFD8CBD66FF0324749B"><enum>(7)</enum><text>expanding pathways related to in-demand industry sectors or occupations;</text></paragraph> <paragraph id="H4831D944ACC449B3B018C5B38D80EC2C"><enum>(8)</enum><text>providing access to technology, including—</text> <subparagraph id="H63F715380F88450AA68BA4E24A309972"><enum>(A)</enum><text>digital literacy courses;</text></subparagraph> <subparagraph id="H83D30A23AA0E4A33B6AB67D325D97159"><enum>(B)</enum><text>computers;</text></subparagraph> <subparagraph id="HCFB4465AD47E47D19A863B84DE6932A9"><enum>(C)</enum><text>software; and</text></subparagraph> <subparagraph id="H778A12F08E2B40D88341807D03F2853A"><enum>(D)</enum><text>other equipment necessary to attain a recognized postsecondary credential; and</text></subparagraph></paragraph> <paragraph id="H42BE94AA4CC14765BFA88946059B62BC" commented="no"><enum>(9)</enum><text>partnering with an entity selected by the State to provide technical assistance, including with respect to—</text> <subparagraph id="HD71CC6E64A1D4D39AE7D623FF13F0F40" commented="no"><enum>(A)</enum><text>carrying out the State plan under section 101;</text></subparagraph> <subparagraph id="HEFFD8159BC664AF78F2A001C44651E86" commented="no"><enum>(B)</enum><text>awarding subgrants under section 103;</text></subparagraph> <subparagraph id="H1E96AEE495CC4BD8A2CCBC955E980382" commented="no"><enum>(C)</enum><text>developing reports under section 104;</text></subparagraph> <subparagraph id="HF8DDA44B48334FC991815FC2415FC973" commented="no"><enum>(D)</enum><text>connecting students to public benefits; and</text></subparagraph> <subparagraph id="H1B9D496B234545078CDC379FD00A3023" commented="no"><enum>(E)</enum><text>carrying out the activities described in paragraphs (1) through (8).</text></subparagraph></paragraph></subsection> <subsection id="H5E5B036B97B94B92A101B7281F314DA7"><enum>(d)</enum><header>Eligible institution defined</header><text>In this section, the term <term>eligible institution</term> means an institution—</text> <paragraph id="H9CF5BEA9A33A4268B4E726CF9DFCC267" commented="no"><enum>(1)</enum><text>located in the State; and</text></paragraph> <paragraph id="HA8076534E73644C6A0152FD733681082" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">that is—</text> <subparagraph id="H6F7CCE7DB25A4F3D84ED5F25E91B79BF" commented="no"><enum>(A)</enum><text>a community college that is located in a geographic area that serves local educational agencies that participate, through the community eligibility provision authorized by the Healthy, Hunger-free Kids Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref> note et seq.) in—</text> <clause id="HA7BA670971C0448B8CF49C15B7460AFD" commented="no"><enum>(i)</enum><text>the national school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); and</text></clause> <clause id="H78E0F2006C49414095D82B8707ED94E1" commented="no"><enum>(ii)</enum><text>the school breakfast program under the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>);</text></clause></subparagraph> <subparagraph id="H6BD7B03E0ED74B3DAA401723B8A336D7" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a community college that is located in geographic areas with 40 percent of the population at or below the Federal poverty line;</text></subparagraph> <subparagraph id="H2775AB705F494DC695FDEF92AA32CB2E" commented="no"><enum>(C)</enum><text>an institution of higher education with an admission rate of 50 percent or higher; or</text></subparagraph> <subparagraph id="HE7C3F9E2D3304E468AEB76D2B49FB758" commented="no"><enum>(D)</enum><text>an institution that is eligible to receive a grant under part A or B of title III or title V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), including—</text> <clause id="H41F72ECE0B5C4273AB0C21B25ADC0A54" commented="no"><enum>(i)</enum><text>a historically Black college or university;</text></clause> <clause id="H176D599117ED42C5A038199A6BD04CA4" commented="no"><enum>(ii)</enum><text>a Hispanic-serving institution;</text></clause> <clause id="HD195A44010B34E57B24FF3B025F98912" commented="no"><enum>(iii)</enum><text>a Tribal college or university;</text></clause> <clause id="HFB7478ADF3574F92B8B30D5381A25C36" commented="no"><enum>(iv)</enum><text>a minority-serving institution; and</text></clause> <clause id="HAE1A7177B71546BDA2DBB95F5FD7332B" commented="no"><enum>(v)</enum><text>a rural-serving institution of higher education.</text></clause></subparagraph></paragraph> </subsection> </section> <section id="H7B09E24285CE4F439E14475D5EA58AE9" commented="no"><enum>103.</enum><header>Subgrants for emergency aid to students</header> <subsection id="H451236DA17604DD683E4C2B979624861" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State that receives a grant under section 101 shall award subgrants to eligible students for emergency aid.</text> </subsection> <subsection id="H494D5D172884479DBBA9798A707858C3" commented="no"><enum>(b)</enum><header>Application</header> <paragraph id="HD987C7C32DB64FC5BC57BE067F95FDB0" commented="no"><enum>(1)</enum><header>In general</header><text>An eligible student seeking a subgrant under this section shall submit to the State an application in such form, at such time, and containing such information as the State may require.</text> </paragraph> <paragraph id="HF36FC04A31D24ACFB835B74AE2CB3E3A" commented="no"><enum>(2)</enum><header>Notification of receipt</header><text>Upon receipt of an application from an eligible student under paragraph (1), the State shall notify such student of such receipt in a manner to be determined by the State.</text></paragraph> <paragraph id="HDEA87A14F96245838724A4B435D01DEC" commented="no"><enum>(3)</enum><header>Appeal</header><text display-inline="yes-display-inline">If an application submitted by an eligible student under paragraph (1) is denied by the State, such student may appeal such denial in a manner to be determined by the State.</text></paragraph></subsection> <subsection id="HFC670C16F05A419D922BBE0509BF6D68" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Timing</header><text>A subgrant awarded under this section shall be for a period of 5 years.</text></subsection> <subsection id="H0F2CB446A79740C5ACC25D48D59D8309" commented="no"><enum>(d)</enum><header>Contracts</header><text>A State may award a contract to a scholarship-granting organization for purposes of—</text> <paragraph id="HEF34C803835B4CC4846B3F9A243366F9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">accepting applications from eligible students under subsection (b)(1); and</text></paragraph> <paragraph id="H4AD6B93DE79B4CC0947C81EAA3904A95" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>disbursing subgrant funds to eligible students in accordance with subsection (e)(4).</text></paragraph></subsection> <subsection id="H2A94AC4E8FC440AEADF083A2F0399E23" commented="no"><enum>(e)</enum><header>Funds</header> <paragraph id="H853A384D02584908B9E0A7DB59500043" commented="no"> <enum>(1)</enum> <header>Administration</header> <text>Not more than 20 percent of funds awarded under this section may be used for the administration of emergency aid to eligible students.</text> </paragraph> <paragraph id="HAB2654CB00624D53B95EA032B8C76985" commented="no"><enum>(2)</enum><header>Direct aid</header><text>Not less than 80 percent of funds awarded under this section shall be used to award emergency aid subgrants to eligible students.</text></paragraph> <paragraph id="HB051D32390A0429F96AA9D4065C7EE35" commented="no"><enum>(3)</enum><header>Subgrant amounts</header> <subparagraph id="HC8082C6B890C423AA53C1C0F81FFF7D5" commented="no"><enum>(A)</enum><header>Eligible students without dependents</header><text>With respect to an academic year, a subgrant awarded to an eligible student that does not have a dependent may not exceed $1,500.</text></subparagraph> <subparagraph id="H9D13F75998664184B36FED26D1252851" commented="no"><enum>(B)</enum><header>Eligible students with dependents</header><text>With respect to an academic year, a subgrant awarded to an eligible student with a dependent may not exceed $2,500.</text></subparagraph></paragraph> <paragraph id="H5FB21BFE107E42D08CC9A56366666422" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Disbursement of funds</header><text>An institution shall disburse funds to eligible students in a timely manner, as determined by the State.</text></paragraph> <paragraph id="HB96799D6B7114E13AFFECCBF0A493881" commented="no"><enum>(5)</enum><header>Federal taxes</header><text>A subgrant under this title may not be considered income for purposes of the Internal Revenue Code of 1986.</text></paragraph></subsection> <subsection id="H38487EEEF34948E7AA8D8A9569412777" commented="no"><enum>(f)</enum><header>Eligible student defined</header><text>In this section, the term <term>eligible student</term> means a student enrolled at a public junior or community college in the applicable State and participating in the tuition-free program pursuant to section 101, without regard to whether such student submits an application under section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>), who is experiencing financial challenges that may affect the ability of such student to remain enrolled at such college, including—</text> <paragraph id="H65D165D5492F452DB516B43223E33AE2" commented="no"><enum>(1)</enum><text>lack of access to or loss of—</text> <subparagraph id="HACA8E741C20C4E5CBF30A35042C8A98E" commented="no"><enum>(A)</enum><text>employment (including a temporary loss of employment);</text></subparagraph> <subparagraph id="HF505030EB60B4A4DB0F167E477D97B6F" commented="no"><enum>(B)</enum><text>transportation;</text></subparagraph> <subparagraph id="H52BA7A512C3B4D668F8D02DDD1D66FCA" commented="no"> <enum>(C)</enum> <text>child care;</text> </subparagraph> <subparagraph id="H6DBA4895E2104106AFB0ADE5E1313E2F" commented="no"><enum>(D)</enum><text>utilities (including water and electricity); or</text></subparagraph> <subparagraph id="H385517A7450241E2B4BC70693432DC5F" commented="no"><enum>(E)</enum><text>housing;</text></subparagraph></paragraph> <paragraph id="H7B3FA6D50DA94075B5FD48C91FE152EB" commented="no"><enum>(2)</enum><text>food insecurity;</text></paragraph> <paragraph id="H53C6FB8E8BD943F7AEB6B1137BACA443" commented="no"><enum>(3)</enum><text>with respect to a student or the dependent of such student, a medical condition or need, including—</text> <subparagraph id="H37B5FD27612843C5A5632DA6FFC3B94C" commented="no"><enum>(A)</enum><text>pregnancy; and</text></subparagraph> <subparagraph id="HF42A58DE4C3442D0988AE809A5BE4B82" commented="no"><enum>(B)</enum><text>mental health conditions; and</text></subparagraph></paragraph> <paragraph id="H4162D700F7784316AA552D596D26C5D9" commented="no"><enum>(4)</enum><text>with respect to a student who is a dependent—</text> <subparagraph id="H3AEDD66F878C4F659912FE7053254BC9" commented="no"><enum>(A)</enum><text>the death of a parent or guardian; or</text></subparagraph> <subparagraph id="H4D766D4432B3407E8271A46F6153C86A" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a parent or guardian with a medical condition that results in temporary or permanent loss of employment of such parent or guardian.</text></subparagraph></paragraph></subsection> </section> <section id="H1D3F637E16D344C1AA5DEC4064A4D93C"><enum>104.</enum><header>Reports</header> <subsection id="H082C6112276F4C79A847C7EC868A85D5"><enum>(a)</enum><header>Annual report</header> <paragraph id="H52CFCBE5FD9A4C41B8A2EDE4F34AFBF6"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after receiving the reports required under subsection (b) for a year, and on an annual basis thereafter, such State shall submit to the Secretary a report describing—</text> <subparagraph id="H95BB778B563147D78FE792A4B057B128"><enum>(A)</enum><text>the uses of funds under this title;</text></subparagraph> <subparagraph id="HB44F7AECC59B49F0BFA4840579A95513"><enum>(B)</enum><text>progress made in fulfilling the requirements of the grant;</text></subparagraph> <subparagraph id="HEE1A4A3D759A479EA6F001AAB7FA7130"><enum>(C)</enum><text>with respect to participating community colleges, rates of—</text> <clause id="H7F5AE260C3AE41EEA62507B2A8BD55B9"><enum>(i)</enum><text>graduation;</text></clause> <clause id="H11B8E00E240746BF844AF10112158357"><enum>(ii)</enum><text>persistence;</text></clause> <clause id="H4D45E7A4143548038B75755FB00B4CD8"><enum>(iii)</enum><text>transfer; and</text></clause> <clause id="H9C901886CBD84B878FA6B79EFB23FD5E"><enum>(iv)</enum><text>attainment of recognized postsecondary credentials;</text></clause></subparagraph> <subparagraph id="H8EE66FA9F9D745499584F1402EFC264B"><enum>(D)</enum><text>the institutional reports submitted under subsection (b);</text></subparagraph> <subparagraph id="HC0BD4B7010BD4303AFC8012EFA87FFA6"><enum>(E)</enum><text>the ways in which the State is communicating with institutions to—</text> <clause id="HDFAE18B3528447CC9BE828D91B14CB40"><enum>(i)</enum><text>understand the barriers of students, with respect to eligibility and access, to public supports; and</text></clause> <clause id="H8A4E437F38684F408ABE50680E51F8A4"><enum>(ii)</enum><text>use the information described in subparagraph (A) to inform any changes;</text></clause></subparagraph> <subparagraph id="H12BD31D591E54727B1CC6504D7F6CD1B"><enum>(F)</enum><text>the ways in which the State human services agency and State board are aligning the policy goals of such agencies with the policy goals of the State higher education agency;</text></subparagraph> <subparagraph id="H148647CA0609457981EAB9539D01A527"><enum>(G)</enum><text>changes in access to, and use of, public benefits;</text></subparagraph> <subparagraph id="H378EDB02EB90482D88733D1F48C4085D"><enum>(H)</enum><text>changes in employment with respect to in-demand industry sectors and high-quality jobs;</text></subparagraph> <subparagraph id="HC828DC2C88454FF2BE8139C774D4BF52"><enum>(I)</enum><text>changes in rates of unemployment and underemployment;</text></subparagraph> <subparagraph id="H7A9201B200FE4AD6802BC4AD24B4CA18"><enum>(J)</enum><text>other data as provided by the State; and</text></subparagraph> <subparagraph id="H2C0F77D43E0E40E9B9F4E6A6A93A68B5"><enum>(K)</enum><text>other data as required by the Secretary.</text></subparagraph></paragraph> <paragraph id="HD351CD7F04D649D38819662FB364FACC"><enum>(2)</enum><header>Disaggregation</header><text>The information described in subparagraphs (G) through (K) shall be disaggregated, to the extent practicable, by—</text> <subparagraph id="H898A5C7414534181982B2021F6C62444"><enum>(A)</enum><text>race;</text></subparagraph> <subparagraph id="HEDDBDF8D4EAD4A0C981329E3B27E79A6"><enum>(B)</enum><text>ethnicity; and</text></subparagraph> <subparagraph id="H70CC6D71B51B4DFFB0A24C934669613F"><enum>(C)</enum><text>income level.</text></subparagraph></paragraph></subsection> <subsection id="HBB2838E5DF2D4B50969E07D22AF5647C"><enum>(b)</enum><header>Institution report</header><text>Not later than 1 year after receiving a subgrant under section 102 or 103, and on an annual basis thereafter, an institution shall submit to the State a report describing—</text> <paragraph id="HDA9C37CCB5DC471B98FAC5724DDC0BC3"><enum>(1)</enum><text>the uses of funds;</text></paragraph> <paragraph id="H4142E233C3754BBE842757407574994D"><enum>(2)</enum><text>with respect to the period beginning on the date on which a subgrant was received and ending on the date on which the report is submitted, changes in rates of—</text> <subparagraph id="HE0718DAA3AD442D1B6FA6687C28B8DBF"><enum>(A)</enum><text>retention; and</text></subparagraph> <subparagraph id="H59F6D886B7E84D738F95BBD3A98EC81B"><enum>(B)</enum><text>graduation;</text></subparagraph></paragraph> <paragraph id="HF3F64E0564564278A9251B6E362A977D"><enum>(3)</enum><text>the ways in which such institution increased awareness of, and access to, public supports made available through State agencies; and</text></paragraph> <paragraph id="H7086C3DBE22B4F4DBA89A7408409C60E"><enum>(4)</enum><text>the ways in which such institution made improvements to tracking data with respect to—</text> <subparagraph id="HCC009372C1904D8F9BA899D871E97A39"><enum>(A)</enum><text>the basic needs of students;</text></subparagraph> <subparagraph id="H5C03DB837FAA43DABB1597C5CBAA822D"><enum>(B)</enum><text>the financial barriers of students; and</text></subparagraph> <subparagraph id="H01EF963777854768AC550F8CB9F8F8A9"><enum>(C)</enum><text>the connection of students to public supports.</text></subparagraph></paragraph></subsection> <subsection id="H30678FF7EFFE48A7A875DDCD34C9E61E" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Public access</header> <paragraph id="H3AA2048C0EF241AEAE65418478174CE9" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date described in subsection (a)(1) each year, the Secretary shall make the data from the report submitted by each State pursuant to such subsection publicly available and shall include—</text> <subparagraph id="HBF963C3A65D1482FBE87FF4F1446338D" commented="no"><enum>(A)</enum><text>a dashboard that provides key metrics; and</text></subparagraph> <subparagraph id="HAC7BFE7BB02043A7B0F4199CD5D2F76B" commented="no"><enum>(B)</enum><text>downloadable data sets for each participating State and participating institution.</text></subparagraph></paragraph> <paragraph id="H2431045096874157A84889E6524267FD" commented="no"><enum>(2)</enum><header>Development of metrics</header><text>In developing or adapting the reporting metrics described in paragraph (1)(A), the Secretary may consult with the Director of the Institute of Education Sciences.</text> </paragraph></subsection></section> <section id="H5389EE1B26654576AAC8692568D44476"><enum>105.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H850A69FF14574E9489418FE8D6950A36"><enum>(1)</enum><header>Business industry group</header><text>The term <term>business industry group</term> means an organization that represents businesses (including small businesses), individual employers, industry clusters, and individuals from—</text> <subparagraph id="H8945D21D85D94A34B80772777E80A48A"><enum>(A)</enum><text>business or trade organizations;</text></subparagraph> <subparagraph id="HE56CEBCA88074BC69320C24498E05957"><enum>(B)</enum><text>economic development organizations;</text></subparagraph> <subparagraph id="H979907A3B29B49C59158BEFB70951DF8"><enum>(C)</enum><text>nonprofit organizations, community-based organizations, or intermediaries;</text></subparagraph> <subparagraph id="H668556B9472C475A8573BABFE6CCA204"><enum>(D)</enum><text>philanthropic organizations;</text></subparagraph> <subparagraph id="HD0B967F120A54409A58258C2D7BAAE71"><enum>(E)</enum><text>industry associations; or</text></subparagraph> <subparagraph id="HF4AD6A151B434957AE9FCA3F7D28DB9D"><enum>(F)</enum><text>other organizations determined necessary by the State.</text></subparagraph></paragraph> <paragraph id="HAB63EA1AD43A47CE83FB44F5C57501E3"><enum>(2)</enum><header>Community college</header><text>The term <term>community college</term> has the meaning given the term <term>junior or community college</term> in Section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>).</text></paragraph> <paragraph id="H998AEEC18A1A46E7A44242443C337491"><enum>(3)</enum><header>Eligible State</header><text>The term <term>eligible State</term> means a State that is a recipient of a grant under section 101.</text></paragraph> <paragraph id="H331F2F82EABB4A0EA04BB949C48E66C4"><enum>(4)</enum><header>ESEA terms</header><text>The terms <term>secondary school</term> and <term>Secretary</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="H301EEDC8F34445128C429DF7055F6450"><enum>(5)</enum><header>HEA terms</header> <subparagraph id="H283ACC261D23402181628E0868788E79"><enum>(A)</enum><header>Hispanic-serving institution</header><text>The term <term>Hispanic-serving institution</term> has the meaning given such term in section 502 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a</external-xref>).</text></subparagraph> <subparagraph id="HF7997294A5E54C3EBDFB60F4E2A2A57D"> <enum>(B)</enum> <header>Historically black college or university</header> <text>The term <term>historically Black college or university</term> has the meaning
