<section id="HD09895E4A2A546189990D4CC15DD342F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America’s CHILDREN Act of 2025</short-title></quote> or the <quote><short-title>Protecting Children of Long-Term Visa Holders Act of 2025</short-title></quote>.</text></section> <section id="H12C10E1098FC42AE9EB9540FEF51AABE"><enum>2.</enum><header>Permanent resident status for certain college graduates who entered the United States as children</header> <subsection id="HDD5EE7026C004BD1958D5646273819A5"><enum>(a)</enum><header>Requirements</header><text>Section 201(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HAB3F39FDFF0A4F79A337CE434FE8A0B6"> 
<subparagraph id="H09C3BD1C928E490AAE4E2A0F0D1FD6BE" indent="up1"><enum>(F)</enum><text>Any alien who—</text> <clause id="H96F0B8CBA7A740BFBB426620772CCC1A"><enum>(i)</enum><text>is not inadmissible under section 212(a) or deportable under section 237(a);</text></clause> 
<clause id="H31BA7A72A9754F309AAAC969688C5C75"><enum>(ii)</enum><text>was lawfully present in the United States as a dependent child of a nonimmigrant admitted to engage in employment in the United States (other than a nonimmigrant described in subparagraph (A), (G), (N), or (S) of section 101(a)(15)) for an aggregate period of not less than 8 years;</text></clause> <clause id="H782FA3ADAE154871ACDB4A3B2CF6F2BE"><enum>(iii)</enum><text>on the date on which an application under section 204(a)(1)(M) is submitted, has been lawfully present in the United States for an aggregate period of not less than 10 years; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HCBBC95799FEA4108A61BD3E125FA2F23"><enum>(iv)</enum><text display-inline="yes-display-inline">has graduated from an institution of higher education (as defined in section 102(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)</external-xref>)) in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H113FD86037944FE5AE952D24400A0CFA"><enum>(b)</enum><header>Petition</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H8440C4CD684C48EAAD2EB3277A6B8866"> 
<subparagraph id="HCF8D4769F69C4489971CF86DEE4AE0B2"><enum>(M)</enum><text>Any alien entitled to classification under section 201(b)(1)(F) may file a petition with the Secretary of Homeland Security for such classification.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HBF2335C2B33343D38BE158359638DB17"><enum>3.</enum><header>Age-out protections and priority date retention</header> <subsection id="H95F73A154ACC4640813398C9FDCD9CBB"><enum>(a)</enum><header>Age-Out protections</header> <paragraph commented="no" display-inline="no-display-inline" id="H427D1BF1BD814211B6690A43EE425754"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDD3FBB1462144D5B9FD099BF1416711D"><enum>(A)</enum><text display-inline="yes-display-inline">in section 101(b) (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)</external-xref>), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HFECCC6949EA844AF862D585C76F03C20"> <paragraph id="H0FA6DD0D379947F4A6A1DF2191F90AD9"><enum>(6)</enum><header>Determination of child status</header><text display-inline="yes-display-inline">A determination as to whether an alien is a child shall be made as follows:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB41435184963431085F833789276CCCA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of a petition under section 204 and any subsequent application for an immigrant visa or adjustment of status, such determination shall be made using the age of the alien on the earlier of—</text> <clause commented="no" display-inline="no-display-inline" id="HD00F480115C340108A8BCE6448AAF772"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which the petition is filed with the Secretary of Homeland Security; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H27F8300760ED46278D4175099CFF8C63"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which an application for a labor certification under section 212(a)(5)(A)(i) is filed with the Secretary of Labor.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HBEF4381190E24749AFEE7868017DF5EB"><enum>(B)</enum><header>Certain dependents of nonimmigrants</header><text display-inline="yes-display-inline">With respect to an alien who, for an aggregate period of 8 years before attaining the age of 21, was in the status of a dependent child of a nonimmigrant pursuant to a lawful admission as an alien eligible to be employed in the United States (other than a nonimmigrant described in subparagraph (A), (G), (N), or (S) of section 101(a)(15)), notwithstanding clause (i), the determination of the alien’s age shall be based on the date on which such initial nonimmigrant employment-based petition or application was filed by the alien's nonimmigrant parent.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H94B9EAF4901C41138B58DD788C50B8A8"><enum>(C)</enum><header>Failure to acquire status as alien lawfully admitted for permanent residence</header><text display-inline="yes-display-inline">With respect to an alien who has not sought to acquire status as an alien lawfully admitted for permanent residence during the 2 years beginning on the date on which an immigrant visa becomes available to such alien, the alien’s age shall be determined based on the alien's biological age, unless the failure to seek to acquire such status was due to extraordinary circumstances.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HAF08BE86A44640FD94A5B7A0286509C1"><enum>(B)</enum><text display-inline="yes-display-inline">in section 201(f) (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>)—</text> 
<clause commented="no" display-inline="no-display-inline" id="H4635AAAD96644747954D7018A7D0284C"><enum>(i)</enum><text display-inline="yes-display-inline">by striking the subsection heading and all that follows through <quote><header-in-text style="OLC" level="subsection">termination date.—</header-in-text></quote> in paragraph (3) and inserting <quote><header-in-text style="OLC" level="subsection">Rule for determining whether certain aliens are immediate relatives.—</header-in-text></quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC3993D3065AD483EA946519D62067B09"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking paragraph (4).</text></clause></subparagraph></paragraph> 
<paragraph id="H0AD26AB063C54F899F39287053E1F96F"><enum>(2)</enum><header>Effective date</header> 
<subparagraph id="H5A6CE1A159D44A0C8FD70B18CA3CC1AF"><enum>(A)</enum><header>In general</header><text>The amendments made by this subsection shall be effective as if included in the Child Status Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/208">Public Law 107–208</external-xref>; 116 Stat. 927).</text></subparagraph> <subparagraph id="H4C001604331C4C189DEC97586D46BAF8"><enum>(B)</enum><header>Motion to reopen or reconsider</header> <clause commented="no" display-inline="no-display-inline" id="H1E0D93E41EC0467185D3B8AE03441082"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A motion to reopen or reconsider the denial of a petition or application described in the amendment made by paragraph (1)(A) may be granted if—</text> 
<subclause id="H48F5736AFB674FF78449994D58AB090B"><enum>(I)</enum><text>such petition or application would have been approved if the amendment described in such paragraph had been in effect at the time of adjudication of the petition or application;</text></subclause> <subclause id="H40A5797BD6264F0F8A03CED47B505D37"><enum>(II)</enum><text>the individual seeking relief pursuant to such motion was in the United States at the time the underlying petition or application was filed; and</text></subclause> 
<subclause id="H35DBB4338D0C4A369F39FC6DCFD8967D"><enum>(III)</enum><text>such motion is filed with the Secretary of Homeland Security or the Attorney General not later than the date that is 2 years after the date of the enactment of this Act.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H062366B63E9946E0A0FDB0C894605D29"><enum>(ii)</enum><header>Exemption from numerical limitations</header><text>Notwithstanding any other provision of law, an individual granted relief pursuant to a motion to reopen or reconsider under clause (i) shall be exempt from the numerical limitations in sections 201, 202, and 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>, 1152, and 1153).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H55B60525E3F043B1ABBEC4D393CFA587"><enum>(b)</enum><header>Nonimmigrant dependent children</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HAB963C52654B4EB78508FF79C840A2B1"> <subsection id="H3B3E35DAA11248CFB5835ADABF7B4E4F"><enum>(s)</enum><header>Derivative beneficiaries</header> <paragraph commented="no" display-inline="no-display-inline" id="H2C52E9D84A17438EB8F31C9DDDA5166D"><enum>(1)</enum><header>In general</header><text>Except as described in paragraph (2), the determination as to whether an alien who is the derivative beneficiary of a properly filed pending or approved immigrant petition under section 204 is eligible to be a dependent child shall be based on whether the alien is determined to be a child under section 101(b)(6).</text></paragraph> 
<paragraph id="H1977312B6D594B99955C484C1E70AD0D"><enum>(2)</enum><header>Long-term dependents</header><text>If otherwise eligible, an alien who is determined to be a child pursuant to section 101(b)(6)(B) may change status to, or extend status as, a dependent child of a nonimmigrant with an approved employment-based petition under this section or an approved application under section 101(a)(15)(E), notwithstanding such alien’s marital status.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA6B24A4001C94BF1A9DC14F8B3E93B35"><enum>(3)</enum><header>Employment authorization</header><text>An alien admitted to the United States as a dependent child of a nonimmigrant who is described in this section is authorized to engage in employment in the United States incident to status.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H58B8B02D0C9D4197BABE74D8345A708C"><enum>(c)</enum><header>Priority date retention</header><text display-inline="yes-display-inline">Section 203(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(h)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H502ACE64FD7A460EAA965CC22A0A4A5C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the subsection heading and inserting <quote><header-in-text style="OLC" level="subsection">Retention of priority dates</header-in-text></quote>;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6ED890B04655403C968E936752765004"><enum>(2)</enum><text>by striking paragraphs (1) through (4);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC3D9B4F99873416E98A5AD4A8AC58E41"><enum>(3)</enum><text>by redesignating paragraph (5) as paragraph (3); and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H17676598B3C84A70A01B1C49516A3637"><enum>(4)</enum><text>by inserting before paragraph (3) the following:</text> <quoted-block id="H91FFA59A02C5440B8A7715A68105C1FD" display-inline="no-display-inline" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H474C8647F2514F6E85E8CA81CF2ACC03"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The priority date for an individual shall be the date on which a petition under section 204 is filed with the Secretary of Homeland Security or the Secretary of State, as applicable, unless such petition was preceded by the filing of a labor certification with the Secretary of Labor, in which case the date on which the labor certification is filed shall be the priority date.</text></paragraph> 
<paragraph id="H8672614C9DD548D2BB13987BCD84E34C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The principal beneficiary and all derivative beneficiaries shall retain the priority date associated with the earliest of any approved petition or labor certification, and such priority date shall be applicable to any subsequently approved petition.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
