<section id="HEEC1869C8EEE458786F2B9C66CB0F66A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Access to Public Roads Act</short-title></quote> or <quote><short-title>MAP Roads Act</short-title></quote>.</text></section> <section id="HAD89FE6BB592422FAEA198746C0CA97B"><enum>2.</enum><header>Establishment of county road access and mapping pilot program</header> <subsection id="H3CEFD4528D5C4380BB2C08A72B39DB0C"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall establish a pilot grant program to provide grants to States to support rural commerce, increase public safety, and improve public access and navigation by funding the digitization of county roads and the creation of centralized, publicly accessible road datasets.</text></subsection> 
<subsection id="HAF594B42D6E44A54BBB3D3E9F8016C63"><enum>(b)</enum><header>Application</header> 
<paragraph id="H4E3AB8BEFE9F4553BEDAD66D650F78CD" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this Act, a State shall submit to the Secretary an application at such time, in such form, and containing such information as the Secretary may require.</text> </paragraph> <paragraph id="H4F9369B347F946A29C97D0E4ADF4DBBA"><enum>(2)</enum><header>Priority</header><text>In selecting an application for a grant under this Act, the Secretary shall give priority to an application in which the applicant State—</text> 
<subparagraph id="HDC2F8E6A94F641BC9105D5858BD287F3"><enum>(A)</enum><text display-inline="yes-display-inline">identifies a significant deficiency in digitized county roads within the State;</text></subparagraph> <subparagraph id="HF1233B1B4686495AB42A2FF84C235FCE"><enum>(B)</enum><text>demonstrates the capacity to administer—</text> 
<clause id="H353902B9BBF74E5B92773320360463C9"><enum>(i)</enum><text>a subgrant program to distribute funds to counties; and</text></clause> <clause id="HD1F4DD212E4A407899D797BE25860E2C"><enum>(ii)</enum><text>a statewide repository for county road data; and</text></clause></subparagraph> 
<subparagraph id="HCE3E4E62EE0B4C00BA6FF7C178CFBF9E"><enum>(C)</enum><text>expresses a commitment to coordinating with counties to create shared geospatial data standards.</text></subparagraph></paragraph></subsection> <subsection id="H4E955B920FCB41DD818A7210CEF5EEE5"><enum>(c)</enum><header>Use of funds</header> <paragraph id="H77CB8C21270740B1A5725BDFBE17BE76"><enum>(1)</enum><header>County activities</header><text>Funds distributed to counties under this Act may be used to—</text> 
<subparagraph id="H91A1AE54AB454DF093EA98AD372F5BA9"><enum>(A)</enum><text>digitize official county road records;</text></subparagraph> <subparagraph id="H5559325F0EC14EFB96AA19EAF5E24AF3"><enum>(B)</enum><text>convert paper maps or outdated formats to standardized geospatial datasets; and</text></subparagraph> 
<subparagraph id="H19282D24BF1F4074BA77CA9E1E3CB290"><enum>(C)</enum><text>train personnel or hire contractors to assist in data creation and conversion.</text></subparagraph></paragraph> <paragraph id="H0464EB64029D4485B61F76E6EE9B264E"><enum>(2)</enum><header>State repository</header><text>Each participating State department of transportation shall—</text> 
<subparagraph id="H86B685D098CD438B8023C679C6F9B765"><enum>(A)</enum><text>serve as the centralized data repository for all road data produced by counties under this program;</text></subparagraph> <subparagraph id="H303B2FAD23D045369E06DA630AC49229"><enum>(B)</enum><text>ensure that such data—</text> 
<clause id="H56ECE237B1FB4EE8985297B659AC98E0"><enum>(i)</enum><text>is published on a publicly accessible website;</text></clause> <clause id="H0E4D4D14617C4F3D99866316FA935122"><enum>(ii)</enum><text display-inline="yes-display-inline">is organized in a manner that distinguishes between public and private roads;</text></clause> 
<clause id="HE2715283E2E64A8898084FC3EADBEB71"><enum>(iii)</enum><text>is compatible with third-party mapping platforms; and</text></clause> <clause id="HBC14FFCF68514A43B4E31210710B593B"><enum>(iv)</enum><text>is updated at least annually; and</text></clause></subparagraph> 
<subparagraph id="H8335DF94B89F4AECB75433596928B085"><enum>(C)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, coordinate with Federal agencies and mapping authorities to align data formats and metadata.</text></subparagraph></paragraph></subsection> <subsection id="H4EDAA400CE4F411CA0EC0781AFD683AA"><enum>(d)</enum><header>Reporting requirements</header><text>Not later than 6 months after the establishment of the program under subsection (a), and annually thereafter for 3 years, each State awarded a grant under this section shall submit to the Secretary a report, which shall include, with respect to the period of time since the previous report—</text> 
<paragraph id="H4B5D242E9C634BAF9FB7BF55A0F5E896"><enum>(1)</enum><text>a list of counties that received a subgrant;</text></paragraph> <paragraph id="H379E01DEABC843978C5AA3D66455BAE3"><enum>(2)</enum><text>the amount of funding distributed to each county;</text></paragraph> 
<paragraph id="H2EC4D9109D13474C947B7BA90BEA9A5E"><enum>(3)</enum><text>the number of miles of county roads digitized under the program;</text></paragraph> <paragraph id="H2EBA43A8469D4976A232E7B7D3C06F31"><enum>(4)</enum><text>the status of State repository development and data integration efforts; and</text></paragraph> 
<paragraph id="H2E82BEFED44F40D3A9647440CA0003A1"><enum>(5)</enum><text>any recommendations for improvement or expansion of the program.</text></paragraph></subsection> <subsection id="HCC6C6F69EE1D4FB38FB0FD4A7426EFFD"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="H1D7AF7EC7F2B43548ECA52BD7E64D44A" commented="no"><enum>(1)</enum><header>County</header><text>The term <term>county</term> has meaning given the term in section 101 of title 23, United States Code.</text> </paragraph> <paragraph id="H702753C3E6704269A690F786AD7654BB"><enum>(2)</enum><header>County road</header><text>The term <term>county road</term> means a public road that is recognized and maintained by a county government.</text></paragraph> 
<paragraph id="H4F9327E867E243058F2131D987A50E50"><enum>(3)</enum><header>Digitization</header><text display-inline="yes-display-inline">The term <term>digitization</term> means the process of converting physical or analog map-based information into standardized electronic formats to produce geospatial data.</text></paragraph> <paragraph id="H50B48568DC214DE69541EA110D57EA57"><enum>(4)</enum><header>Geospatial data</header><text display-inline="yes-display-inline">The term <term>geospatial data</term> has the meaning given such term in section 752 of the Geospatial Data Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/43/2801">43 U.S.C. 2801</external-xref>).</text></paragraph> </subsection> 
<subsection id="H835270BCC8F240329C16C2382684A062"><enum>(f)</enum><header>Savings clause</header><text>Nothing in this Act shall be construed to—</text> <paragraph id="H0A5010571F2F43EA85F5E8B781D5D910"><enum>(1)</enum><text>confer any new authority upon a county or State to declare, designate, or assert jurisdiction over a road as a county road where such designation or jurisdiction does not otherwise exist under applicable State or local law;</text></paragraph> 
<paragraph id="HDEBD5ACAD3FA4148B7F1726A72E0BEE5"><enum>(2)</enum><text>alter, affect, or determine the legal status of any road for purposes of ownership, jurisdiction, or public access; or</text></paragraph> <paragraph id="HD587EC469479431DA2C1EC686E73D462"><enum>(3)</enum><text>limit or expand any existing rights, claims, or defenses related to road ownership, rights-of-way, or public access under Federal, State, or local law.</text></paragraph></subsection> 
<subsection id="H626FC522E0DA4E82A8FF95A18351E339" commented="no"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to permit the public disclosure of geographic information system data regarding the nature, location, character, or ownership of historic, paleontological, or archaeological resources, that is protected under any other provision of law.</text> </subsection> <subsection id="HCCEAEB366FAE4749B7E00662677F3C02"><enum>(h)</enum><header>Authorization of appropriations</header> <paragraph id="H21418410BB56401DBFDDB2177BC76843"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years 2026 through 2031, to remain available until expended.</text></paragraph> 
<paragraph id="HA458B59351C04F2790DD9559CA0AD3F1"><enum>(2)</enum><header>Administrative expenses</header><text>Of the funds authorized to be appropriated under paragraph (1), the Secretary may use not more than 2 percent of such funds to administer the program established under subsection (a).</text></paragraph></subsection> <subsection id="H60B23D69DEE54E58A4A3F248BE66DE76"><enum>(i)</enum><header>Sunset</header><text>The authority to make grants under this Act shall terminate on September 30, 2031, unless reauthorized by Congress.</text></subsection></section>
