<section id="HB21D15D755E2496793715DF85B00986D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Farmacy Act of 2025</short-title></quote>.</text></section> <section id="H529F885C54DE4199ADAEEF2A4B73FD9C"><enum>2.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the goal of healthy food pharmacies (also known as <quote>food farmacies</quote>) is to improve the health outcomes of their patrons by expanding access to nutritious foods and providing nutritional guidance.</text></section> 
<section id="H6F87DA205B4A447DAC09215420601AE4"><enum>3.</enum><header>Grants for healthy food pharmacies</header><text display-inline="no-display-inline">Part B of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H71D77C6AE63A4FDDB3444EAB029167A4"> <section id="HD9BF79DA2D2E46A29773E1D39B0785A9"><enum>320C.</enum><header>Grants for healthy food pharmacies</header> <subsection id="HE5CEC335376E478CBDBD30F81887196B"><enum>(a)</enum><header>Authority To make grants</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Agriculture, may make grants to eligible entities to assist in the establishment and operation of healthy food pharmacies.</text></subsection> 
<subsection id="H35617842DF5B4CAC99C5F475170DA4E7"><enum>(b)</enum><header>Use of grants</header><text display-inline="yes-display-inline">A grant received by an eligible entity under this section shall be used for costs related to—</text> <paragraph id="HAD623DAC28D942FE90CB9FC6EA2C22C9"><enum>(1)</enum><text>construction, conversion, or renovation of a healthy food pharmacy;</text></paragraph> 
<paragraph id="HC1FF695ACEFB4022BA4F4610924DB959"><enum>(2)</enum><text display-inline="yes-display-inline">the acquisition of equipment for a healthy food pharmacy, including for a mobile food pharmacy;</text> </paragraph> <paragraph id="HD22ABEDEF360462D98FE913C3F5E9A9C"><enum>(3)</enum><text>staffing to operate a healthy food pharmacy and help connect patients to other programs that support health outcomes and combat food insecurity; and</text></paragraph> 
<paragraph id="HE7E0B1D380A64810BA02A9CA616DF624"><enum>(4)</enum><text>the acquisition of food and materials necessary for food distribution by a healthy food pharmacy.</text></paragraph></subsection> <subsection id="H07DE5C7E21034E99B38FF5D7282E6FE6"><enum>(c)</enum><header>Eligibility</header> <paragraph id="H93509D80884E4257AC3BF3807FF8DFC3"><enum>(1)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">The following entities shall be eligible to receive a grant under this section:</text> 
<subparagraph id="H8C1F6F300A6A48D5A697B4DEF20BF796"><enum>(A)</enum><text display-inline="yes-display-inline">A non-profit qualified health care provider.</text> </subparagraph> <subparagraph id="HF1F92CB227394D88A5DC7E61EF1A8658"><enum>(B)</enum><text>A State or local government entity.</text></subparagraph> 
<subparagraph id="H4956F558C92B4B20BC51FAA720C3DAD5"><enum>(C)</enum><text>A Tribal organization.</text></subparagraph> </paragraph> <paragraph id="H1FBB1F120E8D48CF89A8291BE9495911"><enum>(2)</enum><header>Eligible healthy food pharmacies</header><text display-inline="yes-display-inline">The Secretary may make a grant under this section with respect to a healthy food pharmacy if the healthy food pharmacy—</text> 
<subparagraph id="HA003B5AB09C448BEAE9F92481D803C4B"><enum>(A)</enum><text display-inline="yes-display-inline">offers a range of services to its patrons, including access to healthy foods and nutritional guidance from a qualified health care professional;</text></subparagraph> <subparagraph id="H30A6975C5A924136A7D966CEA3F36F56"><enum>(B)</enum><text display-inline="yes-display-inline">is operated in a manner that prioritizes the provision of services to communities that are low income, rural, or facing food insecurity (as such terms may be defined by the Secretary);</text></subparagraph> 
<subparagraph id="HC66D7FA9775B427A995E8C80492B56A6"><enum>(C)</enum><text display-inline="yes-display-inline">provides food and nutritional guidance free of charge to individuals receiving benefits under Medicaid or the Supplemental Nutrition Assistance Program; and</text></subparagraph> <subparagraph id="H35736E29F3AB440CB7B573D272E6F502"><enum>(D)</enum><text display-inline="yes-display-inline">is operated in a manner that supports the <quote>Food is Medicine</quote> initiative of the Department of Health and Human Services.</text></subparagraph></paragraph></subsection> 
<subsection id="HDD81348C6EBE4F0E849F1DE0E84D5C0B"><enum>(d)</enum><header>Application</header> 
<paragraph id="HEAC7D613253E493998732C1FBD09257A"><enum>(1)</enum><header>In general</header><text>To receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> <paragraph id="H60E5DE7EA5194CF384E1D1E112A4EF65"><enum>(2)</enum><header>Plan for continuation of grant activities</header><text display-inline="yes-display-inline">As part of such an application, the Secretary shall require an eligible entity to submit a plan for continuing to carry out activities described in subsection (b) after the eligible entity is no longer receiving grant funds under this section, including a plan to retain staff hired using the grant funds.</text> </paragraph></subsection> 
<subsection id="H52CB6617EC5A4DC689B24A65579051D0"><enum>(e)</enum><header>Partnerships</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section may carry out activities using the amounts of the grant in partnership with other organizations seeking to reduce food insecurity and improve health outcomes.</text></subsection> <subsection id="H3A4C6CBCC11544D9B77E7633A77C26A4"><enum>(f)</enum><header>Limitation on grant amounts</header><text display-inline="yes-display-inline">The Secretary may not award to an eligible entity more than $500,000 in grants under this section for a fiscal year.</text></subsection>

            <enum>(g)</enum>
            <header>Authority To waive certain requirements</header>
 <text display-inline="yes-display-inline">The Secretary may waive requirements of title XI of the Social Security Act as may be necessary solely for the purposes of carrying out a program under this section.</text>
          </subsection> 
<subsection id="HF6194F1DF5124A9AA77616F0DFBAC561"><enum>(h)</enum><header>Reporting requirements</header> 
<paragraph id="H613A1D9B09F04D3CBA1F321E7765BC13"><enum>(1)</enum><header>Reports to Secretary</header><text display-inline="yes-display-inline">The Secretary may make a grant to an eligible entity under this section with respect to a healthy food pharmacy only if the eligible entity agrees to submit to the Secretary, on an annual basis for such period as the Secretary may prescribe, a report on the effectiveness of the activities funded with the amounts of the grant, including a description of—</text> <subparagraph id="H37F5A592CA794A5C91C4FF87B035FF5B"><enum>(A)</enum><text display-inline="yes-display-inline">the number of patrons served by the healthy food pharmacy;</text></subparagraph> 
<subparagraph id="HBA50A17DC64D4443B89E9235F1C99426"><enum>(B)</enum><text>the health needs of such patrons;</text></subparagraph> <subparagraph id="H0CD745A48737466CACFFA1F79596E279"><enum>(C)</enum><text>the repeated use of the healthy food pharmacy by such patrons;</text></subparagraph> 
<subparagraph id="HC9037E12BDD942EDAEB5E1DCB2D483EA"><enum>(D)</enum><text>the reported health outcomes of such patrons;</text></subparagraph> <subparagraph id="H7E73BD18F0B2403492A81EA041895990"><enum>(E)</enum><text display-inline="yes-display-inline">the types of food acquired by such patrons from the healthy food pharmacy; and</text></subparagraph> 
<subparagraph id="H0FFAF48EE2A64B42B818960C5AFDB937"><enum>(F)</enum><text>the assistance provided by the healthy food pharmacy to connect such patrons with other programs that address food insecurity and improve health outcomes.</text></subparagraph></paragraph> <paragraph id="HAAE8535698B24B62A843D79A2FE3942E"><enum>(2)</enum><header>Reports to Congress</header><text>Not later than 2 years after the date of enactment of this section, and biennially thereafter during the term of the grant program under this section, the Secretary shall submit to Congress a report that summarizes the reports received by the Secretary under paragraph (1).</text> </paragraph></subsection> 
<subsection id="H3B9711F5C0974548BA223CE74BC70967"><enum>(i)</enum><header>Definitions</header><text>In this Act:</text> <paragraph id="HB919AA2EB3C545C8BC14EB23874969D9"><enum>(1)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means an entity described in subsection (c)(1).</text> </paragraph> 
<paragraph id="HAAA2FAA7EA7D4ECCA94B95014B0BBD48"><enum>(2)</enum><header>Healthy food pharmacy</header><text display-inline="yes-display-inline">The term <quote>healthy food pharmacy</quote> means an organization that provides to its patrons services that include—</text> <subparagraph id="H18967C591F684CEABBEB73FA7C1BA1BD"><enum>(A)</enum><text>access to nutritious foods that are representative of foods for a healthy diet, based on the Dietary Guidelines of the Department of Agriculture and guidance from the Secretary; and</text></subparagraph> 
<subparagraph id="H5936E4980A0241C68AFA286D5F137F9D"><enum>(B)</enum><text>nutritional guidance from a qualified health care professional.</text></subparagraph></paragraph> <paragraph id="H4AB994FEA6ED443F98A2D8F762050B25"><enum>(3)</enum><header>Qualified health care professional</header><text>The term <quote>qualified health care professional</quote> means—</text> 
<subparagraph id="HE14B61DCAC6241F982EDBD30DAB6EA67"><enum>(A)</enum><text display-inline="yes-display-inline">a registered dietitian or nutrition professional, as defined by section 1861(vv)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(vv)(2)</external-xref>);</text></subparagraph> <subparagraph id="H8A1AF8350AF8418E9B7391DC71CF9D25"><enum>(B)</enum><text display-inline="yes-display-inline">a physician, as defined by section 1861(r) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)</external-xref>); and</text></subparagraph> 
<subparagraph id="HCB5FC1D4BC414D8D91239BBCCA170ECE"><enum>(C)</enum><text>a nurse practitioner, clinical nurse specialist, physician assistant, or other professional, as determined appropriate by the Secretary.</text></subparagraph></paragraph> <paragraph id="HB63A0BD73ABC4A509837C96B9240A51E"><enum>(4)</enum><header>Qualified health care provider</header><text>The term <quote>qualified health care provider</quote> means—</text> 
<subparagraph id="H9712E9CB1E284B2886AA9A1E69CFCA98"><enum>(A)</enum><text display-inline="yes-display-inline">a provider of services, as defined by section 1861(u) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(u)</external-xref>);</text></subparagraph> <subparagraph id="H532181C85CDD47C8BD713EBF04E33C9F"><enum>(B)</enum><text>a physician organization, as defined by section 411.351 of title 42, Code of Federal Regulations (or successor regulations);</text></subparagraph> 
<subparagraph id="H7F164873F370424D873D01C662828FDC"><enum>(C)</enum><text>a rural health clinic, as defined by section 1861(aa)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(2)</external-xref>);</text></subparagraph> <subparagraph id="HF2E0203D06704F74AD93FF665EFE30E5"><enum>(D)</enum><text>a Federally qualified health center, as defined by section 1887(aa)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(4)</external-xref>); or</text></subparagraph> 
<subparagraph id="HFBA796E9C669437F8484A24CD5183ED5"><enum>(E)</enum><text>another provider, as determined appropriate by the Secretary.</text> </subparagraph></paragraph> <paragraph id="H6C156C10312B45B68049BC666701B348"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Health and Human Services, acting through the Assistant Secretary for Health.</text> </paragraph></subsection> 
<subsection id="H5B74B30B3DE6490991EF3018F9FDB469"><enum>(j)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $10,000,000 for each of fiscal years 2026 through 2030.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
