<section id="H910AF91D6DBD47779D0D9EB5704CDB72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alan Reinstein Ban Asbestos Now Act of 2025</short-title></quote>.</text></section> <section id="H49C6045504CB47B8BF9615EF23350F06"><enum>2.</enum><header>Commercial asbestos ban and reporting</header><text display-inline="no-display-inline">Section 6 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605</external-xref>) is amended—</text> 
<paragraph id="H25CDE08E79B048E286AD0E5A13343B53"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph> <paragraph id="H34745DC69F2E401DBDA632A0B314C4CA"><enum>(2)</enum><text>by inserting after subsection (i) the following:</text>

<subsection id="H9994C87F502A419E8486B661C5555B9F"><enum>(j)</enum><header>Asbestos</header> 
<paragraph id="HF4370D6B20BF4291B162D373CDDCE504"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H17149EF6686D493AA208620D5F889FA3"><enum>(A)</enum><header>Commercial asbestos</header><text>The term <term>commercial asbestos</term> means the asbestiform varieties of the following, if extracted and processed for their commercial value:</text> 
<clause id="H98FD0355BF374454ADF7E56EBF39FA64"><enum>(i)</enum><text>Chrysotile (serpentine).</text></clause> <clause id="HF18A5B8223B140BBA888ED85066E3EFD"><enum>(ii)</enum><text>Crocidolite (riebeckite).</text></clause> 
<clause id="H0DDFFC5841C74EFEB7B8567B8ACF2CF1"><enum>(iii)</enum><text>Amosite (cummingtonite-grunerite).</text></clause> <clause id="H96E7F459D38B4DB192D539155ACBA9F3"><enum>(iv)</enum><text>Anthophyllite.</text></clause> 
<clause id="H388734F7626E49F2831A3F6157399DBC"><enum>(v)</enum><text>Tremolite.</text></clause> <clause id="H266910307FB5411E8623A071459293DA"><enum>(vi)</enum><text>Actinolite.</text></clause> 
<clause id="H225F0A7D96754F29A8B2A4F2BC3608A5"><enum>(vii)</enum><text>Richterite.</text></clause> <clause id="H60781D078E16426FA65051824791EDE4"><enum>(viii)</enum><text>Winchite.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA61F02EAC54F4332BC680A8F16EB338C"><enum>(B)</enum><header>Distribute in commerce; distribution in commerce</header> 
<clause id="H17578F5B4D514EEDA38402AE6714D119"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the terms <term>distribute in commerce</term> and <term>distribution in commerce</term> have the meanings given the terms in section 3.</text></clause> <clause id="H4360912D4BC444FA9EC84EAA10A7A2A0"><enum>(ii)</enum><header>Exclusions</header><text>The terms <term>distribute in commerce</term> and <term>distribution in commerce</term> do not include, with respect to commercial asbestos—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H2C7E9D91BCB44C81B1BCF34F49A1FE96"><enum>(I)</enum><text display-inline="yes-display-inline">end-use of a mixture or article containing commercial asbestos and installed in a building or other structure, product, or equipment before the date of enactment of the <short-title>Alan Reinstein Ban Asbestos Now Act of 2025</short-title>; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HC2C3AF4CA58149EF8A76C9D6C1400F89"><enum>(II)</enum><text display-inline="yes-display-inline">distribution of a mixture or article containing commercial asbestos solely for the purpose of disposal of the mixture or article in compliance with applicable Federal, State, and local requirements.</text></subclause></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEA0990962131462B8F2B509FE7B2EE5E"><enum>(C)</enum><header>Mixture or article containing commercial asbestos</header><text>The term <term>mixture or article containing commercial asbestos</term> does not include a mixture or article in which commercial asbestos is present solely as an impurity (as defined in section 720.3 of title 40, Code of Federal Regulations (or successor regulations)).</text></subparagraph></paragraph> <paragraph id="H0A8BE9AAFF3646508610273E286292C4"><enum>(2)</enum><header>Applicability</header> <subparagraph id="HF96561C321954E648A4633519076378E"><enum>(A)</enum><header>In general</header><text>The prohibitions, requirements, and definition of the term <term>commercial asbestos</term> in this subsection shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="HDBD46E779C8248D18E1BF42E2D59D9B9"><enum>(i)</enum><text display-inline="yes-display-inline">apply only—</text> <subclause id="HD23C7AE41BF34A9BBB7EB89A30ACF8A1"><enum>(I)</enum><text>to chemical substances; and</text></subclause> 
<subclause id="HC79B9576D78C411AB46FA0D4AA9386D7"><enum>(II)</enum><text>for purposes of regulating chemical substances under this Act; and</text></subclause></clause> <clause id="H1DE76ADEC2614F218454B73F3A7AD4F6"><enum>(ii)</enum><text>have no effect on—</text> 
<subclause id="H6659DFEE2F9145CF90CBFC24E7C4CE63"><enum>(I)</enum><text>any other prohibition or definition of the term <term>asbestos</term>; or</text></subclause> <subclause id="H480CBD5B1083492D9471AD717AEB212B"><enum>(II)</enum><text>any other requirement regulating asbestos, including for purposes of—</text> 
<item id="HE1A50718CA824A038219F443341091EC"><enum>(aa)</enum><text>regulating cosmetics under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>); and</text></item> <item id="HD9B80968DECE40F3B75B76856C387C8B"><enum>(bb)</enum><text>determining whether a cosmetic contains asbestos as an ingredient or as an impurity to an ingredient.</text></item></subclause></clause></subparagraph> 
<subparagraph id="HD9DD8D2DA50249A9AFDD7AB3788BEF22"><enum>(B)</enum><header>Impurities</header><text>Nothing in this subsection applies to any chemical substance, mixture, or article in which commercial asbestos is present solely as an impurity.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H74CF055251A44871A959EE7969F95A77"><enum>(3)</enum><header>Prohibition of manufacture, processing, use, and distribution in commerce</header><text>Effective on the date of enactment of the <short-title>Alan Reinstein Ban Asbestos Now Act of 2025</short-title>, no person may manufacture, process, use, or distribute in commerce commercial asbestos or any mixture or article containing commercial asbestos.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0699C40F2BFD4E4B929E1BCC097B0665"><enum>(4)</enum><header>Chlor-alkali industry</header><text display-inline="yes-display-inline">Notwithstanding paragraph (3), an owner, operator, or agent of an owner or operator of a chlor-alkali facility that is in operation on the date of enactment of the <short-title>Alan Reinstein Ban Asbestos Now Act of 2025</short-title> may, until January 1, 2030—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7677FFD494214AA0BFDD9A96CF1E5DD7"><enum>(A)</enum><text display-inline="yes-display-inline">use, hold, or process commercial asbestos fibers solely for the purpose of manufacturing diaphragms for use in the chlor-alkali process; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H74AC01A472A74418AE97A88712C583B8"><enum>(B)</enum><text display-inline="yes-display-inline">use asbestos diaphragms in chlor-alkali production.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H444A4CEAFC6F4BEA9081AB256302346D"><enum>(5)</enum><header>Exemption for national security reasons</header> <subparagraph id="HCE730EB53EBF4F86B211A7EF8C95F29D"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection, the President may, on application, grant any person an exemption from the prohibition under paragraph (3) once for the manufacture, processing, use, or distribution in commerce of commercial asbestos or any mixture or article containing commercial asbestos only if the President determines that—</text> 
<clause id="HA7BCC9BFC6E44EAD83EA847A2D244295"><enum>(i)</enum><text>the manufacture, processing, use, or distribution in commerce of commercial asbestos or any mixture or article containing commercial asbestos by the person is necessary to protect the national security interests of the United States; and</text></clause> <clause id="HDCEEDB284CC3480DA897981F039FBEBE"><enum>(ii)</enum><text>no feasible alternative to the manufacture, processing, use, or distribution in commerce of commercial asbestos or any mixture or article containing commercial asbestos exists for the intended use.</text></clause></subparagraph> 
<subparagraph id="H87688D8F644F4F48B606E93660FFC408"><enum>(B)</enum><header>Duration</header> 
<clause id="HB111E03ABAD44F1D841B564C7C319386"><enum>(i)</enum><header>In general</header><text>The period of an exemption granted under subparagraph (A) shall not exceed 3 years.</text></clause> <clause id="H8A311B2AEC6844D0AE2FF1E8E72B8444"><enum>(ii)</enum><header>Extension</header><text>The President may, in accordance with subparagraph (A), extend an exemption granted under that subparagraph once, for a period not to exceed 3 years.</text></clause></subparagraph> 
<subparagraph id="H4B8E783901C442019A188B93F2E174C3"><enum>(C)</enum><header>Terms and conditions</header><text>An exemption granted under this paragraph (including any extension granted under subparagraph (B)(ii)) shall include such terms and conditions as are necessary to achieve the maximum extent practicable reduction in exposure to commercial asbestos.</text></subparagraph> <subparagraph id="H84728778EAB34FA9AFD27876D691E76C"><enum>(D)</enum><header>Publication</header> <clause id="H5F404CD7970A4A94B9DE507811D4DD5D"><enum>(i)</enum><header>Applications</header><text>Not later than 30 days after receipt of an application for an exemption under this paragraph (including an extension under subparagraph (B)(ii)), the President shall publish the application in the Federal Register.</text></clause> 
<clause id="H7E55BC503B104B70999CB520950473BE"><enum>(ii)</enum><header>Exemptions</header><text>Not later than 30 days after granting an exemption under this paragraph (including an extension under subparagraph (B)(ii)), the President shall publish in the Federal Register—</text> <subclause id="H272B69DB9B354EA79D614F7AF2950042"><enum>(I)</enum><text>a notice of the exemption; and</text></subclause> 
<subclause id="HACC4745D530545978F9E52C7494B269B"><enum>(II)</enum><text>the terms and conditions included under subparagraph (C).</text></subclause></clause> <clause id="H3E831268552C470F830D1BCC4CAE65AC"><enum>(iii)</enum><header>Exception</header><text>The President, on a determination that publication under this subparagraph of information relating to an application or granting of a particular exemption would harm the national security interests of the United States—</text> 
<subclause id="HD0B4431B3E0F4DEFA7FA19B144589DBE"><enum>(I)</enum><text>shall not publish that information in the Federal Register; but</text></subclause> <subclause id="HEE8B21E2122F4026ABEA4EE3697FDD08"><enum>(II)</enum><text>shall provide that information to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></subclause></clause></subparagraph> 
<subparagraph id="H0A3CDF8CC4564102A790669CC46C29FB"><enum>(E)</enum><header>Application of waiver authority</header><text>Notwithstanding section 22, the Administrator may not issue a waiver under that section with respect to commercial asbestos.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
