provided otherwise, any reference to <quote>this Act</quote> contained in any division of this Act shall be treated as referring only to the provisions of that division.</text></section><division id="H9EA03982EB4B456C8F63AF44DD5638D9" style="appropriations"><enum>A</enum><header>CONTINUING APPROPRIATIONS ACT, 2026</header><section id="H30193AC47E9B4461BAEB2193DCC33934" section-type="undesignated-section"><text display-inline="yes-display-inline">The following sums are hereby appropriated, out of any money in the Treasury not otherwise appropriated, and out of applicable corporate or other revenues, receipts, and funds, for the several departments, agencies, corporations, and other organizational units of Government for fiscal year 2026, and for other purposes, namely:</text></section><section id="H832FACABAB1142C7B50A355B997B2A1E"><enum>101.</enum><text display-inline="yes-display-inline">Such amounts as may be necessary, at a rate for operations as provided in the applicable appropriations Acts for fiscal year 2025 and under the authority and conditions provided in such Acts, for continuing projects or activities (including the costs of direct loans and loan guarantees) that are not otherwise specifically provided for in this Act, that were conducted in fiscal year 2025, and for which appropriations, funds, or other authority were made available in the Full-Year Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>), except sections 1110, 1113, 1114, and 1207; the proviso in paragraph (4) of section 1602; and sections 1708 and 1808; and except section 11104 shall be applied by substituting <quote>2020, and 2021</quote> for <quote>and 2020</quote>; and except sections 774 and 778 of division B, section 540 of division C, and sections 110 and 112 of division D of <external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref> as continued in effect by section 1101 of division A of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>; and except section 7069(b) of division F of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>, as continued in effect by section 1101 of division A of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>.</text></section><section id="H0C29F05CEAEC4FF99072F3E92E5667F5"><enum>102.</enum><subsection commented="no" display-inline="yes-display-inline" id="H7ECED4960E934FE2BF5B6B98B61C35A5"><enum>(a)</enum><text>No appropriation or funds made available or authority granted pursuant to section 101 for the Department of Defense shall be used for:</text><paragraph id="HA8EA4A127DC848AF8617F4C64A9FB0F8"><enum>(1)</enum><text>the new production of items not funded for production in fiscal year 2025 or prior years;</text></paragraph><paragraph id="H7DA2D00395924DBB8F96B4967C13A019"><enum>(2)</enum><text>the increase in production rates above those sustained with fiscal year 2025 funds; or</text></paragraph><paragraph id="H720F47EA2D6A4EE493ADC37598B87F72"><enum>(3)</enum><text>the initiation, resumption, or continuation of any project, activity, operation, or organization (defined as any project, subproject, activity, budget activity, program element, and subprogram within a program element, and for any investment items defined as a P–1 line item in a budget activity within an appropriation account and an R–1 line item that includes a program element and subprogram element within an appropriation account) for which appropriations, funds, or other authority were not available during fiscal year 2025.</text></paragraph></subsection><subsection id="H470899FC23134077BF020EDEEA8219CA"><enum>(b)</enum><text>No appropriation or funds made available or authority granted pursuant to section 101 for the Department of Defense shall be used to initiate multi-year procurements utilizing advance procurement funding for economic order quantity procurement unless specifically appropriated later.</text></subsection></section><section id="H71EC8B8BB4EF4610B59A5A40D6F26E9E"><enum>103.</enum><text display-inline="yes-display-inline">Appropriations made by section 101 shall be available to the extent and in the manner that would be provided by the pertinent appropriations Act.</text></section><section id="H936EE8502D4D4984B8953AB86A3BA2AB"><enum>104.</enum><text display-inline="yes-display-inline">Except as otherwise provided in section 102, no appropriation or funds made available or authority granted pursuant to section 101 shall be used to initiate or resume any project or activity for which appropriations, funds, or other authority were not available during fiscal year 2025.</text></section><section id="HCB9DEF5EDAB74F3C9848C842C2C52A83"><enum>105.</enum><text display-inline="yes-display-inline">Appropriations made and authority granted pursuant to this Act shall cover all obligations or expenditures incurred for any project or activity during the period for which funds or authority for such project or activity are available under this Act.</text></section><section id="H08A640CF11E9446F80815614C78C41FC"><enum>106.</enum><text display-inline="yes-display-inline">Unless otherwise provided for in this Act or in the applicable appropriations Act for fiscal year 2026, appropriations and funds made available and authority granted pursuant to this Act shall be available until whichever of the following first occurs:</text><paragraph id="H3FF004C9756C4D31A6B18D7A666456EC"><enum>(1)</enum><text>The enactment into law of an appropriation for any project or activity provided for in this Act.</text></paragraph><paragraph id="HB4BF3C5661834307A775FD716AC131F7"><enum>(2)</enum><text>The enactment into law of the applicable appropriations Act for fiscal year 2026 without any provision for such project or activity.</text></paragraph><paragraph id="HE9F25AEE723A46A0AAC0DB5559E1788E"><enum>(3)</enum><text>November 21, 2025.</text></paragraph></section><section id="H9572A1775EC94C198C1CFE1706C4B51C"><enum>107.</enum><text display-inline="yes-display-inline">Expenditures made pursuant to this Act shall be charged to the applicable appropriation, fund, or authorization whenever a bill in which such applicable appropriation, fund, or authorization is contained is enacted into law.</text></section><section id="H2BACA13AFD524F63A386259D455F052C"><enum>108.</enum><text display-inline="yes-display-inline">Appropriations made and funds made available by or authority granted pursuant to this Act may be used without regard to the time limitations for submission and approval of apportionments set forth in section 1513 of title 31, United States Code, but nothing in this Act may be construed to waive any other provision of law governing the apportionment of funds.</text></section><section id="HA095192A85D04D53993A19DDAFFB74DA"><enum>109.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, except section 106, for those programs that would otherwise have high initial rates of operation or complete distribution of appropriations at the beginning of fiscal year 2026 because of distributions of funding to States, foreign countries, grantees, or others, such high initial rates of operation or complete distribution shall not be made, and no grants shall be awarded for such programs funded by this Act that would impinge on final funding prerogatives.</text></section><section id="HBFF48EBD56014F82AD98070CED34833E"><enum>110.</enum><text display-inline="yes-display-inline">This Act shall be implemented so that only the most limited funding action of that permitted in the Act shall be taken in order to provide for continuation of projects and activities.</text></section><section id="HF3816C237AF94D908D353C675B627DD4"><enum>111.</enum><subsection commented="no" display-inline="yes-display-inline" id="HF2B048698CD7462AAA40917E87F94EB3"><enum>(a)</enum><text>For entitlements and other mandatory payments whose budget authority was provided in an appropriations Act specified in section 101, for expenses authorized under section 324 of title 38, United States Code, and for activities under the Food and Nutrition Act of 2008, activities shall be continued at the rate to maintain program levels under current law, under the authority and conditions provided in the applicable appropriations Act, to be continued through the date specified in section 106(3) of this Act.</text></subsection><subsection id="H1116CDABF27F4F02B5ABFFFFD329CA6A"><enum>(b)</enum><text>Notwithstanding section 106, obligations for mandatory payments due on or about the first day of any month that begins after October 2025 but not later than 30 days after the date specified in section 106(3) may continue to be made, and funds shall be available for such payments.</text></subsection></section><section id="H7670C2A50B5248A0991767723CE187E1"><enum>112.</enum><text display-inline="yes-display-inline">Amounts made available under section 101 for civilian personnel compensation and benefits in each department and agency may be apportioned up to the rate for operations necessary to avoid furloughs within such department or agency, consistent with the applicable appropriations Act for fiscal year 2025, except that such authority provided under this section shall not be used until after the department or agency has taken all necessary actions to reduce or defer non-personnel-related administrative expenses.</text></section><section id="H99B3A45B880F4937B3B46626E3C90853"><enum>113.</enum><text display-inline="yes-display-inline">Funds appropriated by this Act may be obligated and expended notwithstanding section 10 of <external-xref legal-doc="public-law" parsable-cite="pl/91/672">Public Law 91–672</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/22/2412">22 U.S.C. 2412</external-xref>), section 15 of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2680">22 U.S.C. 2680</external-xref>), section 313 of the Foreign Relations Authorization Act, Fiscal Years 1994 and 1995 (<external-xref legal-doc="usc" parsable-cite="usc/22/6212">22 U.S.C. 6212</external-xref>), and section 504(a)(1) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3094">50 U.S.C. 3094(a)(1)</external-xref>).</text></section><section id="H440760F5504742E38AE18E8927298F7B"><enum>114.</enum><subsection commented="no" display-inline="yes-display-inline" id="HD956039C687649DA9136D75772BD927B"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H58B9D55E17C54A0EA3F1BD5DB8BBD8BB"><enum>(1)</enum><text>For each amount incorporated by reference in this Act that was previously designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985, each provision of law designating each such amount as an emergency requirement pursuant to such section shall not apply.</text></paragraph><paragraph id="H558CB6D5EBD54C348C58A8C6DBB0699E"><enum>(2)</enum><text>Each amount incorporated by reference in this Act that was designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 in the following provisions of law are designated by the Congress as an emergency requirement pursuant to section 4001(a)(1) of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022, and to legislation establishing fiscal year 2026 budget enforcement in the House of Representatives: section 11206(4) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref> and 7068(b) of division F of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>, as continued in effect by section 1101 of division A of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>.</text></paragraph></subsection><subsection id="H33889F832D794FE1A7F347D66297647D"><enum>(b)</enum><text>Each amount incorporated by reference in this Act that was previously designated by the Congress as being for disaster relief pursuant to section 251(b)(2)(D) of the Balanced Budget and Emergency Deficit Control Act of 1985 is designated by the Congress as being for disaster relief pursuant to a concurrent resolution on the budget.</text></subsection><subsection id="HE320103F5E63487CBA400C7A64163D23"><enum>(c)</enum><text>Each amount incorporated by reference in this Act that was previously designated in division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/159">Public Law 117–159</external-xref>, division J of <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>, or in section 443(b) of division G of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref> by the Congress as an emergency requirement pursuant to a concurrent resolution on the budget shall continue to be treated as an amount specified in section 103(b) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/5">Public Law 118–5</external-xref>.</text></subsection></section><section id="HE47C907994334C4E80A3E95EF61BDF6B"><enum>115.</enum><subsection commented="no" display-inline="yes-display-inline" id="H4AC17B9051EE4F408973D8774FF55F7A"><enum>(a)</enum><text>Rescissions or cancellations of discretionary budget authority that continue pursuant to section 101 in Treasury Appropriations Fund Symbols (TAFS)—</text><paragraph id="H4D517573DAC74DF08A7211796085C490"><enum>(1)</enum><text>to which other appropriations are not provided by this Act, but for which there is a current applicable TAFS that does receive an appropriation in this Act; or</text></paragraph><paragraph id="H8CA3F9E8D95A4422BED9D896D1E59348"><enum>(2)</enum><text>which are no-year TAFS and receive other appropriations in this Act,</text></paragraph><continuation-text continuation-text-level="appropriations-small">may be continued instead by reducing the rate for operations otherwise provided by section 101 for such current applicable TAFS, as long as doing so does not impinge on the final funding prerogatives of the Congress.</continuation-text></subsection><subsection id="H6E11721F5E004058B8C879D0CA8D681B"><enum>(b)</enum><text>Rescissions or cancellations described in subsection (a) shall continue in an amount equal to the lesser of—</text><paragraph id="H5C61F63A60824D89990653781BE81E9E"><enum>(1)</enum><text>the amount specified for rescission or cancellation in the applicable appropriations Act referenced in section 101 of this Act; or</text></paragraph><paragraph id="H2FF247190E9E47EA8C4F6D290B8AEFCE"><enum>(2)</enum><text>the amount of balances available, as of October 1, 2025, from the funds specified for rescission or cancellation in the applicable appropriations Act referenced in section 101 of this Act.</text></paragraph></subsection><subsection id="HEA02E887F3A241D89E23E3F94B495EF8"><enum>(c)</enum><text>No later than November 7, 2025, the Director of the Office of Management and Budget shall provide to the Committees on Appropriations of the House of Representatives and the Senate a comprehensive list of the rescissions or cancellations that will continue pursuant to section 101: <italic>Provided</italic>, That the information in such comprehensive list shall be periodically updated to reflect any subsequent changes in the amount of balances available, as of October 1, 2025, from the funds specified for rescission or cancellation in the applicable appropriations Act referenced in section 101, and such updates shall be transmitted to the Committees on Appropriations of the House of Representatives and the Senate upon request.</text></subsection></section><section id="HB09E1C390D9947449F99C1FBFB095F12" commented="no"><enum>116.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 for <quote>Domestic Food Programs—Food and Nutrition Service—Special Supplemental Nutrition Program for Women, Infants, and Children (WIC)</quote> may be apportioned at the rate for operations necessary to maintain participation.</text></section><section id="H1B4EE20B38324D5283529A095FB6F6AF" commented="no"><enum>117.</enum><text display-inline="yes-display-inline">Section 260 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636i">7 U.S.C. 1636i</external-xref>) and section 942 of the Livestock Mandatory Reporting Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635">7 U.S.C. 1635</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/78">Public Law 106–78</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="H68CAAD1AAE514267973E09E24B541822" commented="no"><enum>118.</enum><text display-inline="yes-display-inline">Section 8302(b) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/3851a">16 U.S.C. 3851a(b)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>October 1, 2023</quote>.</text></section><section id="H22FE3FE3F52F48FAB36FC229042E2407" commented="no"><enum>119.</enum><subsection commented="no" display-inline="yes-display-inline" id="H96CCD7B071BF4739BFE2DC759D871B86"><enum>(a)</enum><text>Amounts made available by section 101 for <quote>Department of Justice—United States Marshals Service—Salaries and Expenses</quote> may be apportioned up to the rate for operations necessary to maintain program operations.</text></subsection><subsection id="H11487777D85741F3B9885DE79ED49D6F"><enum>(b)</enum><text>In addition to amounts provided by section 101, for <quote>Department of Justice—United States Marshals Service—Salaries and Expenses</quote>, there is appropriated $30,000,000, for an additional amount for fiscal year 2026, to remain available until September 30, 2027, to carry out protective operations.</text></subsection></section><section id="H890FAA0D09364F60B0559E8185AA9A6A" commented="no"><enum>120.</enum><subsection commented="no" display-inline="yes-display-inline" id="H13A37DF03AB2452C8039981D37535AE3"><enum>(a)</enum><text display-inline="yes-display-inline">For the closeout of all Space Shuttle contracts and associated programs, amounts that have expired but have not been cancelled in the Exploration, Space Operations, Human Space Flight, Space Flight Capabilities, and Exploration Capabilities appropriations accounts shall remain available through fiscal year 2030 for the liquidation of valid obligations incurred during the period of fiscal year 2001 through fiscal year 2013.</text></subsection><subsection id="H47FA0B7CC38B44D6BC7CE62B51D0707D"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2DC0C6F9E8234E29BAE70978566F05D8"><enum>(1)</enum><text>Subject to paragraph (2), this section shall become effective immediately upon enactment of this Act.</text></paragraph><paragraph id="HCDBA3613A8F146E7988505A26CD7AC13" commented="no"><enum>(2)</enum><text>If this Act is enacted after September 30, 2025, this section shall be applied as if it were in effect on September 30, 2025.</text></paragraph></subsection></section><section id="H84CC7FCAA52841CDAC9FBF6D4BFCCB7A" commented="no"><enum>121.</enum><text display-inline="yes-display-inline">Section 3014(a) of title 18, United States Code, shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="H23EB31BDB97D405A95D158BE83AAFFCC" commented="no"><enum>122.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the first proviso in each of sections 8092 and 8096 of title VIII of division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> shall be applied by substituting <quote>advances</quote> for <quote>reimbursements</quote>.</text></section><section id="H22CDF9A83098457E87EE083B1ED801A3" commented="no"><enum>123.</enum><text display-inline="yes-display-inline">Notwithstanding sections 102 and 104, amounts made available by section 101 to the Department of Defense for <quote>Research, Development, Test and Evaluation, Air Force</quote> shall be apportioned up to the rate for operations necessary for the E–7 Wedgetail program, in an amount not to exceed $199,676,000, only for the purpose of continued rapid prototyping activities to maintain program schedule and transition to production for the E–7 Wedgetail program.</text></section><section id="HA7FF82BAC7D24D0A9728D21AB950563E" commented="no"><enum>124.</enum><text display-inline="yes-display-inline">Of the unobligated balance of funds available to the Department of Defense for the E–7 program under the heading <quote>Aircraft Procurement, Air Force</quote> in <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>, $200,000,000 is hereby transferred to and merged with amounts available for the E–7 program under the heading <quote>Research, Development, Test and Evaluation, Air Force</quote> only for the purpose of continued rapid prototyping activities to maintain program schedule and transition to production for the E–7 Wedgetail program.</text></section><section id="HCC397201AB8F4FB6A97B3F3B98538776" commented="no"><enum>125.</enum><text display-inline="yes-display-inline">Section 717(a) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4564">50 U.S.C. 4564(a)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="H9E08375D05AD4A049F59EB91FE1D085B" commented="no"><enum>126.</enum><text display-inline="yes-display-inline">Notwithstanding sections 102 and 104, amounts made available by section 101 of this Act to the Department of Defense for <quote>Shipbuilding and Conversion, Navy</quote> may be apportioned up to the rate for operations necessary to fund completion of prior year shipbuilding programs for the fiscal year 2016 and fiscal year 2018 Virginia Class Submarine Programs, in an amount not to exceed $154,000,000.</text></section><section id="HCCE59A1E2EA44DE692A44E74E32A706E" commented="no"><enum>127.</enum><text display-inline="yes-display-inline">During the period covered by this Act, section 103(f)(4)(A) of <external-xref legal-doc="public-law" parsable-cite="pl/108/361">Public Law 108–361</external-xref> (the Calfed Bay-Delta Authorization Act) shall be applied by substituting <quote>$32,600,000</quote> for <quote>$30,000,000</quote>.</text></section><section id="H2EA7F9E1C6714BFAB87747BA3D41F2D4" commented="no"><enum>128.</enum><subsection commented="no" display-inline="yes-display-inline" id="H925CA6C0108142AB927C054465DF099B"><enum>(a)</enum><text display-inline="yes-display-inline">Amounts made available by section 101 in the first proviso under the heading <quote>Department of Energy—Atomic Energy Defense Activities—National Nuclear Security Administration—Weapons Activities</quote> may be apportioned up to the rate for operations necessary to maintain current operations for the safe, secure transport of nuclear weapons.</text></subsection><subsection id="HE4C3B3463DCF4D5C9D3EB7194D6C6F7B" commented="no"><enum>(b)</enum><text>The Director of the Office of Management and Budget and the Secretary of Energy shall notify the Committees on Appropriations of the House of Representatives and the Senate not later than 3 days after each use of the authority provided in subsection (a).</text></subsection></section><section id="H686F2174DF8043E0A4CBB94BD04ACD90" commented="no"><enum>129.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the matter preceding the first proviso under the heading <quote>Office of Personnel Management—Salaries and Expenses</quote> in title V of division B of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> shall be applied by substituting <quote>$197,446,000</quote> for <quote>$219,076,000</quote>, and the second proviso under such heading in such title of such division of such Act shall be applied by substituting <quote>$214,605,000</quote> for <quote>$192,975,000</quote>.</text></section><section id="H47C60E692CC34A0DA09A079D38A00E8E" commented="no"><enum>130.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, except section 106, the District of Columbia may expend local funds made available under the heading <quote>District of Columbia—District of Columbia Funds</quote> for such programs and activities under the District of Columbia Appropriations Act, 2024 (title IV of division B of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>) at the rate set forth in the Fiscal Year 2026 Local Budget Act of 2025 (D.C. Bill No. 26–260) as modified as of the date of enactment of this Act.</text></section><section id="H27CF9459EAB9483A9D6CF08A5D64460B" commented="no"><enum>131.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, paragraph (1) under the heading <quote>Department of the Treasury—Departmental Offices—Salaries and Expenses</quote> in title I of division B of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> shall be applied by substituting <quote>$1,350,000</quote> for <quote>$350,000</quote>: <proviso><italic>Provided,</italic></proviso> That such amounts may be obligated in the account and budget structure set forth in the fiscal year 2026 President’s Budget, submitted pursuant to section 1105(a) of title 31, United States Code, and accompanying justification materials.</text></section><section id="H8FD95562D45C4E80ABB7694B285432DA" commented="no"><enum>132.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 for <quote>Small Business Administration—Business Loans Program Account</quote> may be apportioned up to the rate for operations necessary to accommodate increased demand for commitments for general business loans authorized under paragraphs (1) through (35) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), for commitments to guarantee trust certificates authorized by section 5(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/634">15 U.S.C. 634(g)</external-xref>), for commitments to guarantee loans under section 503 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/697">15 U.S.C. 697</external-xref>), and for commitments to guarantee debentures under section 303(b) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/683">15 U.S.C. 683(b)</external-xref>).</text></section><section id="H18EB6A66994F46A1AF23A4FAFF993371" commented="no"><enum>133.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, amounts are provided for <quote>Department of the Treasury—Office of Terrorism and Financial Intelligence—Salaries and Expenses</quote> at a rate for operations of $237,662,000.</text></section><section id="H457DB14F658E4D2C93DB8ACA9DA2054C"><enum>134.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, section 1605 of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref> shall be applied by substituting <quote>through the end of the last applicable pay period that commences on or before the date specified in section 106(3) of the Continuing Appropriations Act, 2026</quote> for <quote>through the date specified in section 1106 of this Act</quote>.</text></section><section id="HCEE3D80115634496B403BF0FE7B4C62B"><enum>135.</enum><text display-inline="yes-display-inline">Section 1(b) of <external-xref legal-doc="public-law" parsable-cite="pl/117/25">Public Law 117–25</external-xref> (135 Stat. 297; 136 Stat. 2133; 136 Stat. 5984; 138 Stat. 1771; 139 Stat. 46) shall be applied in each of paragraphs (3) and (4) by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="HF040E05379CD42FDA3F0135916BBD609"><enum>136.</enum><text display-inline="yes-display-inline">In addition to amounts otherwise provided by section 101 for <quote>The Judiciary—Supreme Court of the United States—Salaries and Expenses</quote>, there is appropriated $28,000,000, for an additional amount for fiscal year 2026, to remain available until expended, for the protection of the Supreme Court Justices, including the purchase and hire of passenger motor vehicles as authorized by 31 U.S.C. 1343 and 1344, to be expended as the Chief Justice may approve.</text></section><section id="H188F9332A2264B15A9DB608B44E5D981" commented="no"><enum>137.</enum><text display-inline="yes-display-inline">Section 210G(i) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(i)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="HF2179095640D4111970DE097901CE670" commented="no"><enum>138.</enum><text display-inline="yes-display-inline">Section 225(e) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/116/6">Public Law 116–6</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/49/44901">49 U.S.C. 44901</external-xref> note) shall be applied by substituting <quote>fiscal year 2019 through the date specified in section 106 of the Continuing Appropriations Act, 2026</quote> for <quote>fiscal years 2019 through 2025</quote>.</text></section><section id="H9418A2BC0A85442C99E8CE9D7C9C6A22" commented="no"><enum>139.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 to the Department of Homeland Security under the heading <quote>Federal Emergency Management Agency—Disaster Relief Fund</quote> may be apportioned up to the rate for operations necessary to carry out response and recovery activities under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></section><section id="HE6D4D4EDEA8F4515A65DDE16F5E031B6" commented="no"><enum>140.</enum><text display-inline="yes-display-inline">Section 227(a) of the Federal Cybersecurity Enhancement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1525">6 U.S.C. 1525(a)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="H8CB9C7F53BF4404F99FC15A8949546F9"><enum>141.</enum><text display-inline="yes-display-inline">Section 111(a) of the Cybersecurity Information Sharing Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1510">6 U.S.C. 1510(a)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="H2F08E372AC8743ABA2C3400CF9C0188B"><enum>142.</enum><text display-inline="yes-display-inline">Section 2220A(s)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665g">6 U.S.C. 665g(s)(1)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="HAF5E7BCFBA4B48379823DF4739E3BC7A" commented="no"><enum>143.</enum><text display-inline="yes-display-inline">During the period covered by this Act, section 3(b)(2)(C) of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669b">16 U.S.C. 669b(b)(2)(C)</external-xref>) shall be applied by substituting <quote>2027</quote> for <quote>2026</quote>.</text></section><section id="HA0571894EEE44AE1849801D80053849F" commented="no"><enum>144.</enum><text display-inline="yes-display-inline">During the period covered by this Act, section 1701 of title VII of division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/43">Public Law 117–43</external-xref>, as amended, shall be applied by substituting <quote>calendar years 2021 through 2026</quote> for <quote>2021 or 2022 or 2023 or 2024</quote> each place it appears.</text></section><section id="H9190AD7811144C90922AE2DF2B71F941" commented="no"><enum>145.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 for <quote>Department of the Interior—Department-Wide Programs—Wildland Fire Management</quote> and <quote>Department of Agriculture—Forest Service—Wildland Fire Management</quote> may be apportioned up to the rate for operations necessary for wildfire suppression activities.</text></section><section id="HDBAD4DAAD6694E14BC4AE17DC79EFF50" commented="no"><enum>146.</enum><subsection commented="no" display-inline="yes-display-inline" id="H8F2D4D3694BB4E45B800E3261E2DCED7"><enum>(a)</enum><text display-inline="yes-display-inline">In addition to amounts otherwise provided by section 101, amounts are provided for <quote>Department of Health and Human Services—Indian Health Service—Indian Health Services</quote> at a rate for operations of $72,265,000, for an additional amount for costs of staffing and operating facilities that were opened, renovated, or expanded in fiscal years 2025 and 2026, and such amounts may be apportioned up to the rate for operations necessary to staff and operate such facilities.</text></subsection><subsection id="HAFCF9867175B4732BB797FE4F29B5B2B" commented="no"><enum>(b)</enum><text display-inline="yes-display-inline">In addition to amounts otherwise provided by section 101, amounts are provided for <quote>Department of Health and Human Services—Indian Health Service—Indian Health Facilities</quote> at a rate for operations of $8,050,000, for an additional amount for costs of staffing and operating facilities that were opened, renovated, or expanded in fiscal years 2025 and 2026, and such amounts may be apportioned up to the rate for operations necessary to staff and operate such facilities.</text></subsection></section><section id="HF0ACFD0B9F84449794F53BC0796C248E" commented="no"><enum>147.</enum><text display-inline="yes-display-inline">Of the amounts made available in the third paragraph under the heading <quote>Environmental Protection Agency—State and Tribal Assistance Grants</quote> in the Disaster Relief Supplemental Appropriations Act, 2023 (division N of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>), up to $54,000,000 shall be available for technical assistance and grants under section 1442(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1(b)</external-xref>) in areas where the President declared an emergency in August of fiscal year 2022 pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>): <proviso><italic>Provided,</italic></proviso> That amounts repurposed pursuant to this section that were previously designated by the Congress as being for an emergency requirement pursuant to section 4001(a)(1) of S. Con. Res 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022, and section 1(e) of H. Res. 1151 (117th Congress), as engrossed in the House of Representatives on June 8, 2022, are designated as being for an emergency requirement pursuant to section 4001(a)(1) of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022, and to legislation establishing fiscal year 2026 budget enforcement in the House of Representatives.</text></section><section id="H8B31037C414F43468F1A1552FB289DCF" commented="no"><enum>148.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the matter under the heading <quote>Department of Health and Human Services—Administration for Children and Families—Children and Families Services Programs</quote> in title II of division D of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> shall be applied by adding the following after the second proviso: <quote><italic>Provided further</italic>, That for purposes of section 640(a)(2)(B)(v) of such Act, the base grant for each of the Federated States of Micronesia and the Republic of the Marshall Islands shall be $8,000,000, and shall be considered equal to the amount provided for base grants for such jurisdictions under such Act for the prior fiscal year:</quote>.</text></section><section id="HF549A713E24D40CA94D2B6F40F3BF660" commented="no"><enum>149.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, there is appropriated—</text><paragraph id="HB5232BB83D1C41B2894A6DC876568F63"><enum>(1)</enum><text>For payment to Ashley Paige Turner, heir of Sylvester Turner, late a Representative from the State of Texas, $174,000.</text></paragraph><paragraph id="HBD03A921811C4015858B8B0418DBE8D6"><enum>(2)</enum><text display-inline="yes-display-inline">For payment to Ramona Grijalva, widow of Raúl M. Grijalva, late a Representative from the State of Arizona, $174,000.</text></paragraph><paragraph id="H5121FF00BE9D428F830C9D00D85A10AE"><enum>(3)</enum><text>For payment to Catherine M. Act.</text></section><section id="H30EF59941656473C825683F24DC30B53"><enum>151.</enum><text display-inline="yes-display-inline">In addition to amounts otherwise provided by section 101, for <quote>Capitol Police—United States Capitol Police Mutual Aid Reimbursements</quote>, there is appropriated $30,000,000, for an additional amount for fiscal year 2026, to remain available until expended, for reimbursements for mutual aid and related training provided under the agreements described in section 7302 of <external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>: <proviso><italic>Provided,</italic></proviso>That obligation of the funds made available in this section in this Act shall be subject to notification to the Chairmen and Ranking Members of the Committees on Appropriations of both Houses of Congress, the Senate Committee on Rules and Administration, and the Committee on House Administration of the amount and purpose of the expense within 15 days of obligation.</text></section><section id="H1A6673A1467643A1A4ADF56F48FCBCB5" commented="no"><enum>152.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the matter under the heading <quote>Native American Veteran Housing Loan Program Account</quote> in title II of division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref> shall be applied by adding the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H10BED64FCC2448E2AED9E2D0A5BACB84"><text>In addition, for the cost of direct loans, $6,865,235, as authorized by subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code: <italic>Provided</italic>, That such costs, including the cost of modifying such loans, shall be as defined in section 502 of the Congressional Budget Act of 1974: <italic>Provided further</italic>, That funds made available under this heading are available to subsidize gross obligations for the principal amount of direct loans not to exceed $75,000,000.</text><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCF7DC7CD4CBD4603A47EDE67993F5932" commented="no"><enum>153.</enum><text display-inline="yes-display-inline">Section 1424(a) of the Better Utilization of Investments Leading to Development Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/22/9624">22 U.S.C. 9624(a)</external-xref>) shall be applied by substituting the date specified in section 106 of this Act for <quote>the date that is 7 years after the date of the enactment of this Act</quote>.</text></section><section id="H39E71CBBCE504D96861CC6A06104922E" commented="no"><enum>154.</enum><text display-inline="yes-display-inline">Notwithstanding sections 101 and 106, and sections 1101, 1106, and 11201 of <external-xref legal-doc="public-law" parsable-cite="pl/119/4">Public Law 119–4</external-xref>, the fifth and sixth provisos under the heading <quote>Millennium Challenge Corporation</quote> in title III of division F of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> shall be amended by substituting <quote>December 31, 2026</quote> for <quote>December 31, 2024</quote> each place it appears.</text></section><section id="HF26B1063649C45809B6E6064647A78E4" commented="no"><enum>155.</enum><text display-inline="yes-display-inline">Notwithstanding section 106, during fiscal year 2026, the Secretary of Housing and Urban Development may use the unobligated balances of amounts made available in prior fiscal years in paragraphs (2), (3), and (8) under the heading <quote>Public and Indian Housing—Tenant-Based Rental Assistance</quote> to support additional allocations under subparagraph (D) of paragraph (1) and subparagraph (B) of paragraph (4) of such heading to prevent the termination of rental assistance for families as the result of insufficient funding in the calendar year 2025 funding cycle: <proviso><italic>Provided,</italic></proviso>That amounts repurposed pursuant to this section that were previously designated by the Congress as an emergency requirement pursuant to a concurrent resolution on the budget or the Balanced Budget and Emergency Deficit Control Act of 1985 are designated by the Congress as being for an emergency requirement pursuant to section 4001(a)(1) of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022, and to legislation establishing fiscal year 2026 budget enforcement in the House of Representatives.</text></section><section id="HD5D9ECFB644B47B586CA135B2EFCD970"><enum>156.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 for <quote>Department of Transportation—Office of the Secretary—Payments to Air Carriers</quote> may be apportioned up to the rate for operations necessary to maintain Essential Air Service program operations.</text></section><section id="H8CCFC7C34D574A8AAB4695DF3CA04309" commented="no"><enum>157.</enum><text display-inline="yes-display-inline">Section 4144(d) of the Motor Carrier Safety Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/49/31100">49 U.S.C. 31100</external-xref> note) shall be applied by substituting the date specified in section 106 of this Act for <quote>September 30, 2025</quote>.</text></section><section id="HAFAEE5369C6B469892D982BF6DE7D83C" section-type="undesignated-section"><text>This division may be cited as the <quote>Continuing Appropriations Act, 2026</quote>.</text></section></division><division id="H81A5A7FE05B84E7B9448037F62E14CD1"><enum>B</enum><header>MISCELLANEOUS EXTENSIONS</header><section of the Committee on Energy and Commerce of the House of Representatives and the Chairman of the Committee on Health, Education, Labor, and Pensions of the Senate, as set forth in the Congressional Record.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" display-inline="yes-display-inline">Types of fees</header><text display-inline="yes-display-inline">Section 744M(a)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" id="HE694C9DA8BE64C10A6F4D2608E98FA2A"><enum>(iii)</enum><header>Subsequent fiscal years</header><text>For fiscal year 2028 and each subsequent fiscal year, the facility fees required under subparagraph (A) shall be due on the later of—</text><subclause id="HFFE16DB402CA4E1D927EE728A5227C65"><enum>(I)</enum><text>the first business day on or after October 1 of the fiscal year; or</text></subclause><subclause id="HFCF599D7FB164F6FAD4DF706D91A1529"><enum>(II)</enum><text>the first business day after the date of enactment of an appropriations Act providing for the collection Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379j-72">21 U.S.C. 379j–72(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5309CB6B0335419E835613B9C6ECC14D"><subsection commented="no" display-inline="no-display-inline" id="HC26BB293FE60470AB81E622677F976CA"><enum>(b)</enum><header through 2030, fees under subsection (a)(1) shall be established to generate a total facility fee revenue amount equal to the sum of—</text><subparagraph facilities described in subclause (II), the average number of such facilities (expressed as a percentage) that appeared on the arrears lists pursuant to subsection (e)(1)(A)(i) over the period of the preceding 3 fiscal years is less than 30 percent.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H764C2FEEBACB4EA9B5F9956D64D5FB94"><enum>(ii)</enum><header>Amount of adjustment</header><text display-inline="yes-display-inline">An adjustment under this paragraph for a fiscal year shall equal the product of—</text><subclause commented="no" display-inline="no-display-inline" id="H3C81142A877446D49F3614A447A4B17C"><enum>(I)</enum><text display-inline="yes-display-inline">the total facility revenue amount determined under subsection (b) for the fiscal year, exclusive of the adjustment under this paragraph for such fiscal year; and</text></subclause><subclause commented="no" display-inline="yes-display-inline">publish such fee revenue amounts, facility fees, and OTC monograph order request fees in the Federal display-inline="yes-display-inline">collecting, developing, and reviewing safety information on OTC monograph drugs, including adverse event reports;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H354D8BB809474E1CAF5D40F4A59C9F75"><enum>(II)</enum><text display-inline="yes-display-inline">developing and using improved analytical tools, adverse event data-collection systems, including information technology systems, to assess potential safety problems, including access to external databases; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8BD0C41FBAE74ACEA239C1127B83FB8C"><enum>(III)</enum><text>activities under section 760;</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBBB21AF2E1804D91B26A41ED74F5148E"><enum>(B)</enum><text>information regarding registration of OTC monograph drug facilities and contract manufacturing organization facilities and payment of registration fees by such facilities, including—</text><clause commented="no" display-inline="no-display-inline" id="H53ADBCEF04D949CDAE0D768A5D8B823D"><enum>(i)</enum><text display-inline="yes-display-inline">the OTC monograph drug facilities and contract manufacturing organization facilities that were first registered under section 510(c) or 510(i) in the fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H66042083B325496E8CA8C9D6F6880365"><enum>(ii)</enum><text display-inline="yes-display-inline">for each OTC monograph drug facility and contract manufacturing organization facility that was assessed a facility fee under section 744M(a) in the fiscal year, whether the facility paid such fee; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC737D34237C442CB8DA9A85D3C117F46"><enum>(C)</enum><text display-inline="yes-display-inline">the status of implementation of evidence and testing standards under section 505G(r) for nonprescription drugs intended for topical administration, including—</text><clause id="H4590C0D8F30F4CDBA2FAB0C41AB45ED7"><enum>(i)</enum><text display-inline="yes-display-inline">the application of evidence or testing standards; and</text></clause><clause id="H60EE5428D497478997AF8BEF47EB9431"><enum>(ii)</enum><text>the number of active ingredient requests for nonprescription drugs intended for topical administration reviewed using the standards under section 505G(b); and</text></clause></subparagraph><subparagraph id="HB2762AFB4BFB4B20A8489CF2D5080C39"><enum>(D)</enum><text>the progress of the Food and Drug Administration in allowing nonclinical testing alternatives to animal testing for the consideration of sunscreen active ingredients.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H606EAAC4A70F480BACBA5AE528376821"><enum>(3)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Nothing in paragraph (2) shall be construed to authorize the disclosure of information that is prohibited from disclosure under section 301(j) of this Act or section 1905 of title 18, United States Code, or that is subject to withholding under section 552(b)(4) of title 5, United States Code.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4D27640F6862459FAAA8F7D1B95D8D29"><enum>(2)</enum><text>in subsection (b), by striking <quote>fiscal year 2021 and each subsequent fiscal year</quote> and inserting <quote>each fiscal year</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H273E6F836CAF4D5D9197F639F35ECA6A"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD0F4B8583D474B909685409EBF65745A"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>2025</quote> each place it appears and inserting <quote>2030</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23E1049D51EC43B7829C845CD58CD912"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAD44492A45D348E89103E5A66A45EA98"><paragraph id="HEC8FCE72C5594A829F6ACB865FD88FF6" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Minutes of negotiation meetings</header><subparagraph id="H28D8B677335D47BB94C246FC70509FD9" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header>Public availability</header><text>The Secretary shall make publicly available, on the public website of the Food and Drug Administration, robust written minutes of all negotiation meetings conducted under this subsection between the Food and Drug Administration and the regulated industry, not later than 30 days after each such negotiation meeting.</text></subparagraph><subparagraph id="H4542B1C8DE9742878E122BDEFA199B6E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Content</header><text>The robust written minutes described under subparagraph (A) shall contain, in detail, any substantive proposal made by any party to the negotiations as well as significant controversies or differences of opinion during the negotiations and their resolution.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFAF90693533841BBBEC229E1390F24A2"><enum>(b)</enum><header>GAO report</header><paragraph id="HB76DDC7992F3428E9141EF29C4F4CB79"><enum>(1)</enum><header>In general</header><text>Not later than September 30, 2027, the Comptroller General of the United States shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report assessing the supply chain of over-the-counter monograph drugs.</text></paragraph><paragraph id="H3AE73AEF624D464295B90CCF6A9714AC"><enum>(2)</enum><header>Contents</header><text>The report required under paragraph (1) shall include an assessment of—</text><subparagraph id="HA523605A32314DC19476E301913BBFAD"><enum>(A)</enum><text>the overall stability of the supply chain of over-the-counter monograph drugs;</text></subparagraph><subparagraph id="HD037EF4C787D48D6BDAD11ED200EE995"><enum>(B)</enum><text>what information is collected by the Food and Drug Administration with respect to the supply chain of over-the-counter monograph drugs;</text></subparagraph><subparagraph id="H0033990E6E834D93B393067E7BAD4453"><enum>(C)</enum><text>how the Food and Drug Administration uses information collected on the supply chain of over-the-counter monograph drugs to inform regulatory decisions;</text></subparagraph><subparagraph id="H9F0B417ACF7D4E4CB7F4B6A596B04276"><enum>(D)</enum><text>how the Food and Drug Administration coordinates with other Federal agencies to monitor and mitigate disruptions to the supply chain of over-the-counter monograph drugs; and</text></subparagraph><subparagraph id="H964A663FB608439F93B750706C372074"><enum>(E)</enum><text>the unique characteristics of the over-the-counter monograph drug marketplace and what additional authorities or information the Food and Drug Administration may need to ensure the stability of the supply chain of over-the-counter monograph drugs.</text></subparagraph></paragraph></subsection></section><section id="H83A40576FE62495BA085FC35512D4154"><enum>506.</enum><header>Treatment of active ingredients for topical administration</header><subsection commented="no" display-inline="no-display-inline" id="HDD821C35D5D9477C873A7C2CC13E4CA9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 505G of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355h">21 U.S.C. 355h</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H45749D69810549219D7724ADF6BDC688"><subsection id="HBA7E8D28395D4FBC93446D8BF2D19B77"><enum>(r)</enum><header>Evidence and testing standards for active ingredients for topical administration</header><paragraph id="HDB0B4D2FD7A149C4B44CCF7DBC093E7E"><enum>(1)</enum><header>Evidence and testing standards for active ingredients for topical administration</header><text>The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF2069D11EA784562B31CEBB4E6B5F713"><enum>(A)</enum><text display-inline="yes-display-inline">in evaluating the generally recognized as safe and effective status of active ingredients used in nonprescription drugs intended for topical administration for purposes of subsection (a), utilize standards that allow for the use of real world evidence (as defined in section 505F(b)), as appropriate, as part of a comprehensive evaluation of scientific evidence to demonstrate the safety and effectiveness of such active ingredients, to supplement evidence from traditional clinical trials, provided that such standards allow the Secretary to evaluate whether the benefits of such active ingredients outweigh the risks; and</text></subparagraph><subparagraph id="H6981FD7AD1884F2C8960CECB503AD833"><enum>(B)</enum><text>apply subsection (b)(6)(C) to the regulation of active ingredients used in drugs intended for topical administration.</text></subparagraph></paragraph><paragraph id="H26B350B25B0C43A496A420ED666DF8B5"><enum>(2)</enum><header>Non-animal testing methods for topical active ingredients</header><subparagraph id="H8E78D86117524CEB9E77A675329168B4"><enum>(A)</enum><header>In general</header><text>The Secretary shall consider the types of nonclinical tests described in paragraphs (1) through (4) of the first subsection (z) of section 505 (as inserted by section 3209(a)(2) of the Health Extenders, Improving Access to Medicare, Medicaid, and CHIP, and Strengthening Public Health Act of 2022 (division FF of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>)), or any other alternative to animal testing that the Secretary determines appropriate, in the consideration of drugs intended for topical administration under this section.</text></subparagraph><subparagraph id="H4E9E18B516394824BCC5F2297D507C98"><enum>(B)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary shall issue new draft guidance on how sponsors can use nonclinical testing alternatives to animal testing, as appropriate, to meet safety and efficacy standards under this section for drugs intended for topical administration.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD91C5F108D64CCFA6D8B3CE151FDC09"><enum>(3)</enum><header>Clarification</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to alter, supersede, or limit the standards for making determinations of whether a drug is generally recognized as safe and effective under section 201(p) or the standards set forth under section 505 for determining the safety and effectiveness of drugs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H769067960E45470695D723C6A61C1FC2"><enum>(b)</enum><header>Sunscreen final administrative order</header><text display-inline="yes-display-inline">A final administrative order on nonprescription sunscreen active ingredients issued under section 3854 of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/21/360fff-3">21 U.S.C. 360fff–3</external-xref> note) shall—</text><paragraph id="H36EAFCDB96EC4BF9BD46960A284B98A2"><enum>(1)</enum><text>account for historical data regarding the safety of sunscreen active ingredients that have previously been accepted for marketing in the United States;</text></paragraph><paragraph id="H360B47A82AB749688322637BA03A4C18"><enum>(2)</enum><text>account for the role of broad spectrum sunscreens with a Sun Protection Factor of 15 or higher in effective skin cancer prevention; and</text></paragraph><paragraph id="H42D4F8FAB62A417CA15EF41781B443FB"><enum>(3)</enum><text display-inline="yes-display-inline">incorporate the evidence and testing standards for sunscreen active ingredients detailed in section 505G(r) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355h">21 U.S.C. 355h</external-xref>) (as added by subsection (a)).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H162F0FFE94DA42BC8AF78F8E0F516AC3"><enum>507.</enum><header>Increasing the clarity and predictability of the process for developing applications for Rx-to-nonprescription switches</header><subsection id="HAE8D751496834BBF817B4C2994EA816A"><enum>(a)</enum><header>In general</header><text>Section 505(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H07B9250CCC234AB687F71E8DA7622EEB"><paragraph id="H3FE48E452A4F49669C881CF11F653A2E"><enum>(7)</enum><header>Rx-to-nonprescription switches</header><subparagraph commented="no" display-inline="no-display-inline" id="H184FE1BAD22348278F3B20A8A9EAF9E4"><enum>(A)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">Any person planning to submit an application for an Rx-to-nonprescription switch may submit to the Secretary a written request for a meeting, for purposes of developing a plan for such application that addresses the potential risks to public health of such switch and the evidence necessary to support such application, including the design of any necessary studies, and the format and content of the planned application. The Secretary may grant such a meeting, as appropriate, consistent with established procedures for granting meetings with, and providing written responses to, applications under this section. Each such meeting shall be documented in meeting minutes.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE059A8A6FC864C838DE91BB8B4EBD1EB"><enum>(B)</enum><header>Guidance</header><clause commented="no" display-inline="no-display-inline" id="H0A26A45174114F4F9B45C584A83375B4"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this paragraph, the Secretary shall issue guidance to increase the clarity and predictability of the process and standards for approval of applications for nonprescription drugs under this section, including in the case of applications for an Rx-to-nonprescription switch, especially with respect to prescription drugs with well-established safety profiles for which an applicant may seek approval for nonprescription use.</text></clause><clause commented="no" display-inline="no-display-inline" id="H2EA37D5A9ACA4C20B4CD91D23BFC62D2"><enum>(ii)</enum><header>Contents</header><text display-inline="yes-display-inline">The guidance under clause (i) shall—</text><subclause commented="no" display-inline="no-display-inline" id="H375DA39D1815484C88534F41B1B8A00D"><enum>(I)</enum><text display-inline="yes-display-inline">describe how published reports in medical literature, any previous finding of safety or effectiveness for the drug under this section, the results of significant human experience with the drug, unpublished studies and other data, and other sources of information may be used to support an application for a nonprescription drug, including in the context of an application for an Rx-to-nonprescription switch;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H41C265B98B584E66B87DA0DC121F550A"><enum>(II)</enum><text display-inline="yes-display-inline">set forth procedures for sponsors to request meetings described in subparagraph (A) and document the recommendations made in such meetings;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2D06B5A84959484C89747CA8E2A2CCB7"><enum>(III)</enum><text display-inline="yes-display-inline">describe evidentiary expectations to support approval of an application for a nonprescription drug, including in the context of an application for an Rx-to-nonprescription switch, including how sponsors can demonstrate that consumers can appropriately self-select and use the drug and comprehend the nonprescription drug label; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB16B96AD048F477594D52082A9999AFA"><enum>(IV)</enum><text display-inline="yes-display-inline">provide recommendations for how mechanisms, in addition to the required Drug Facts Label, such as mobile applications and decisions aids, can be incorporated into the information submitted in support of an application for an Rx-to-nonprescription switch.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0F30504DA129453BB44E4D9A769B9A69"><enum>(C)</enum><header>Plan to engage with stakeholders</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall develop and make publicly available on the website of the Food and Drug Administration a plan to engage stakeholders on steps and factors for application holders and other stakeholders to consider in identifying approved prescription drugs that may be promising candidates for applications for an Rx-to-nonprescription switch.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEDD13B0359A464DB178A622F156EE22"><enum>(D)</enum><header>Definition</header><text>For purposes of this paragraph, the term <term>Rx-to-nonprescription switch</term> means the approval of an application, or supplemental application, as applicable, submitted under this section by the holder of an approved application for a prescription drug seeking approval to market such drug as a nonprescription drug, including for—</text><clause commented="no" display-inline="no-display-inline" id="H7BF3704786D64BFE84A0C8D90D5B3FFC"><enum>(i)</enum><text display-inline="yes-display-inline">a full Rx-to-nonprescription switch, under which a drug previously approved for prescription use only is—</text><subclause commented="no" display-inline="no-display-inline" id="HBEC0BF4CC7FE424B8519782DDB12A5DB"><enum>(I)</enum><text display-inline="yes-display-inline">approved for nonprescription use under the same conditions as applied to the drug when approved for prescription use; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H49A822B1FC014FC0A2557F573FCC70E3"><enum>(II)</enum><text>approved for nonprescription use subject to one or more additional conditions for nonprescription use; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H0E2A8F000A7449F9BAFF31CA9537D1CC"><enum>(ii)</enum><text display-inline="yes-display-inline">a partial Rx-to-nonprescription switch, under which the drug is approved for nonprescription use only under certain conditions described in the approved labeling, while the drug otherwise remains approved for prescription use only.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5259F32A0A354DD3A9D34BDC1C4FC61B"><enum>(E)</enum><header display-inline="yes-display-inline">Rule of construction</header><text>Nothing in this paragraph shall be construed to—</text><clause commented="no" display-inline="no-display-inline" id="H3D4A7F3F2649424BA62291D591B89703"><enum>(i)</enum><text>supersede or modify the authority of the Secretary under section 505G with respect to the regulation of OTC monograph drugs; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H17F49A33654942E2A5D453E5B68D574A"><enum>(ii)</enum><text display-inline="yes-display-inline">authorize the disclosure by the Secretary of confidential commercial information or trade secrets.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H01F40EF4AF6F458AB51EA6A7F2C6B65C"><enum>(b)</enum><header>GAO Report</header><paragraph commented="no" display-inline="no-display-inline" id="HECE54E3AD44745AEAB7964A6248D6393"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that evaluates—</text><subparagraph id="H42E244476A544CD69D8BDF55CE0858B3"><enum>(A)</enum><text>the number of applications for an Rx-to-nonprescription switch approved during the period beginning on October 1, 2022, and ending on the date of the report;</text></subparagraph><subparagraph id="HCAD3B79A3D7C4280BAEE2C08D94FB334"><enum>(B)</enum><text>the number of drugs for which an application for an Rx-to-nonprescription switch was approved during such period subject to an additional condition for nonprescription use;</text></subparagraph><subparagraph id="H6FEBEFE1282845E1BC32563AE4BFCDB2"><enum>(C)</enum><text>among the drugs for which an application for a full or partial Rx-to-nonprescription switch was approved during such period, the average length of time from receipt by the Food and Drug Administration of the application to the approval of such application;</text></subparagraph><subparagraph id="H7AFD3B041528433A8C1D5B22CF4297A6"><enum>(D)</enum><text>the number of partial Rx-to-nonprescription switch applications approved during such period, and the number of applications for such a partial switch not approved;</text></subparagraph><subparagraph id="HFC8F416A0A7E492984679F7632AD30BB"><enum>(E)</enum><text>any barriers to timely and predictable review of applications for an Rx-to-nonprescription switch;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF12CD819282443FB90605956E0231F94"><enum>(F)</enum><text display-inline="yes-display-inline">engagement by the Food and Drug Administration with public stakeholders, including public meetings or additional activities to support review of applications for an Rx-to-nonprescription switch; and</text></subparagraph><subparagraph id="H486EEA1FF54C4B7A9BDCA0BC0D18597D"><enum>(G)</enum><text>opportunities for collaboration between the Center for Drug Evaluation and Research and the Centers for Medicare &amp; guaranteed loan for such property</quote> and inserting <quote>amount of indebtedness under the guaranteed loan that the Secretary does not purchase</quote>; and</text></paragraph><paragraph title;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB00F7AF22C34487E97243B878A8A56C1"><enum>(B)</enum><text display-inline="yes-display-inline">shall be included, for the purpose of a liquidation sale, in the same manner as any other advance allowed by the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A233D2E19F04E29A99D04F71A1B8F8B"><enum>(C)</enum><text display-inline="yes-display-inline">shall not be claimed under the guaranty or increase the Secretary’s cost of acquisition of the property securing the defaulted loan.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB49FE998D0D34744B878AFC11C92351A"><enum>(c)</enum><header>Requirements of loan holder</header><text>Section (d)(1) of such section is amending by inserting <quote>and servicing the loan</quote> after <quote>documents</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H8FB9E7B52B5C470580288CFBA10CF588"><enum>(d)</enum><header>Default and foreclosure</header><text>Subsection (e) of such section is amended—</text><paragraph id="H7010A672FAE542C6B93EE85301AAD30B"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H64895D77C5664F0D9BC414E8231E75B6"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>an individual who</quote> and all that follows through the period at the end and inserting the following: <quote>a borrower who defaults on a partial claim shall be liable to the Secretary for any loss suffered by the Secretary with respect to such default, and such loss may be recovered in the same manner as any other debt due the United States. The Secretary shall not restore housing loan entitlement under section 3702(b) of this title until such loss is repaid in full.</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6F40333C3AF4C4C8740BFE9B9CE4AF4"><enum>(B)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H893DFFF14E6A49E9B05ACE210EE2CAB9"><subparagraph id="H565C370D7F004FF789A263E9AF855AFD" indent="up2"><enum>(B)</enum><text>The Secretary may charge administrative costs, fees, and interest, as appropriate, with respect to any default under a partial claim in a manner similar to the interest and administrative costs charged under section 5315 of this title.</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE0064ED63ADE4DB0993C7C4DEA27F7B9"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (2) to read as follows:</text><quoted-block style="USC" id="H3713D6EBE6314F77A9B151C15623DD8A" display-inline="no-display-inline"><paragraph id="HA62A4B76FADB41938B120D08702E33BD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding section 2410 of title 28, a nonjudicial sale of real property to satisfy a loan guaranteed under this chapter shall discharge the property from a partial claim interest held by the Secretary, provided that the holder of the guaranteed loan conducts the non-judicial sale and distributes the sale proceeds, if any, in accordance with the State or local law where such property is situated.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H06C0A9160858484ABBEA356EF835F9E5"><enum>(e)</enum><header>Guidance in advance of regulations</header><text>Subsection (h) of such section is amended to read as follows:</text><quoted-block id="H7841E72AA33C4F4E91AC0212FD3EFC47" style="USC" act-name=""><subsection id="H826514F5E8D84DCFA18DEE0F76BFADE3"><enum>(h)</enum><header>Guidance in advance of regulations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may, before prescribing regulations, issue administrative guidance with respect to the Partial Claim Program under this section and the loss mitigation options prescribed under section 3732(d) of this title, including any additional terms, conditions, and requirements the Secretary determines necessary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H1C61DF89C4AF41558AAE371ABACDAFC8"><enum>308.</enum><header>Government Accountability Office reports on Partial Claim Program of the Department of Veterans Affairs and other matters</header><subsection id="HD199C3D1FEBE43AB8732AAA01DE074E9" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Annual reports</header><paragraph commented="no" display-inline="no-display-inline" id="H362840CEF17241D8A2084719F0C17F2B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and every year thereafter until the Partial Claim Program terminates, the Comptroller General of the United States shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H172CF4CAC6614EBA94025F0E602F6CB0"><enum>(2)</enum><header>Elements</header><text>Each report required by paragraph (1) shall include, for the period covered by the report and disaggregated by quarter, the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="H99DA5B7E8A774AAC8733762EFED4117D"><enum>(A)</enum><text>Key data on the performance of the Partial Claim Program, including—</text><clause commented="no" display-inline="no-display-inline" id="H567A294A0A9D4B14AAF68B75815F2020"><enum>(i)</enum><text display-inline="yes-display-inline">the number of partial claims filed and approved; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD916D90280F46B9A541720815B6C6BA"><enum>(ii)</enum><text display-inline="yes-display-inline">the redefault and foreclosure rates of loans for which a partial claim was made.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4BFD9AB23824127BC2DC849BE0A084F"><enum>(B)</enum><text display-inline="yes-display-inline">A comparison of the data described in subparagraph (A) with data on the performance of other loss mitigation options provided by the Department of Veterans Affairs.</text></subparagraph><subparagraph id="HBF3BC1AFFB174CD5868909573F3C00AD"><enum>(C)</enum><text>The number of housing loans insured, guaranteed, or made by the Secretary of Veterans Affairs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code.</text></subparagraph><subparagraph id="HB0F518822F3F4F418E90F680E8ACAA66"><enum>(D)</enum><text>The number of applications for housing loan benefits under such chapter denied.</text></subparagraph><subparagraph id="HE812148E36E54BEDA5FA8727FDB15C72"><enum>(E)</enum><text display-inline="yes-display-inline">The number of housing loans insured, guaranteed, or made by the Secretary under such chapter refinanced under section 3710(a)(8) or 3712 of title 38, United States Code.</text></subparagraph><subparagraph id="H8F394ABFFD2944FB87E49E699C5C8933"><enum>(F)</enum><text display-inline="yes-display-inline">The number of veterans who owe a payment on a mortgage associated with a loan insured, guaranteed, or made by the Secretary under such chapter that is at least—</text><clause id="H41D2C67B78834809BC25FAF25DB9D4AA"><enum>(i)</enum><text>60 days late; and</text></clause><clause id="H1B6A815ADA2D47B383BEFAF7B0E02603"><enum>(ii)</enum><text>90 days late.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD8C04B0551794FC58D19BD43E9236212"><enum>(b)</enum><header>Assessment</header><paragraph commented="no" display-inline="no-display-inline" id="HEED76AAB7CA64DD4A93D40957C8CC18C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year before the Partial Claim Program terminates, the Comptroller General shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HAC871AABD44143A78C55A2BF8BB18F0D"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an assessment of the benefits and challenges of the Partial Claim Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H76E5DD97D1CE4EB4B130EC33C31B6A5A"><enum>(B)</enum><text>submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the findings of the Comptroller General with respect to that assessment.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAAB369DA6B5042BDBD1DEC401A413109"><enum>(2)</enum><header>Considerations</header><text>In conducting the assessment required by paragraph (1), the Comptroller General shall consider the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="HEBA1D549584B4102A9338E9EFFEFF7C9"><enum>(A)</enum><text>The characteristics of borrowers for whom a partial claim was made compared to the characteristics of borrowers provided other loss mitigation options by the Department of Veterans Affairs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BBA267214514CD9BC4D25F2DF8295D1"><enum>(B)</enum><text display-inline="yes-display-inline">The performance of loans guaranteed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code, following various loss mitigation actions.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFF925443580E4128868699871B852B35"><enum>(C)</enum><text display-inline="yes-display-inline">The information the Department considered in determining whether a borrower would benefit from a partial claim compared to other loss mitigation options.</text></subparagraph><subparagraph id="H6AA360453EA84389A31D92C050D7062C"><enum>(D)</enum><text>The costs to taxpayers of the Partial Claim Program compared to the costs of other loss mitigation options provided by the Department.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCEA617C93DEE4B4A9E7532AAE92C5F97"><enum>(E)</enum><text>Any similarities and differences in the Department's administration and use of the Partial Claim Program compared to the Department's administration and use of the COVID–19 Veterans Assistance Partial Claim Payment program established under subpart F of part 36 of title 38, Code of Regulations.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D2F9D9AF2B543B889F5AB3EA67BAA56"><enum>(F)</enum><text display-inline="yes-display-inline">The information the Department learned from the COVID–19 Veterans Assistance Partial Claim Payment program and the extent to which those lessons learned were applied to the Partial Claim Program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H82F3284449BD4E8688C66FB992E5A6E8"><enum>(G)</enum><text>The types of information the Department collected to monitor the performance and effectiveness of the Partial Claim Program and how the Department used that information to make any needed adjustments to the program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDCED6303F0B84F69989683C09AE824E3"><enum>(H)</enum><text>How the use by the Department of partial claims compares to the use of partial claims by other Federal housing agencies, including, for each partial claim program—</text><clause commented="no" display-inline="no-display-inline" id="H905D430CDD634A11A6013B8AEDCB50D3"><enum>(i)</enum><text display-inline="yes-display-inline">the volume of loans for which partial claims have been made;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD73DDAECCC4A4CE5B988DB1303877F00"><enum>(ii)</enum><text display-inline="yes-display-inline">the results for borrowers (including redefault and foreclosure rates);
