which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize certain States to take certain actions on certain Federal land to secure an international border of the United States, and for other purposes.</official-title></form><legis-body id="H13249700CD1741D9830D47BEDF5E6E4E" style="OLC"><section id="H95D4A1AE458648A1932AB44D0FD738EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Obstructions Necessary To Address Illegal and Nefarious Entry Rapidly Act</short-title></quote> or the <quote><short-title>CONTAINER Act</short-title></quote>. </text></section><section id="HFB7E301B871F4EF0ABF279304D695B50" section-type="subsequent-section"><enum>2.</enum><header>Placement of movable, temporary structures on certain Federal land to secure an international border of the United States</header><subsection commented="no" display-inline="no-display-inline" id="H4BF7D73BEB9B4460AD449A036AC9AED0"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HCAF156B865DE46238AB310CB2284A8D4"><enum>(1)</enum><header>Border state</header><text>The term <term>Border State</term> means a State that is adjacent to the northern border or southern border.</text></paragraph><paragraph id="H68220981D3154727A26BE5AA9EF29953"><enum>(2)</enum><header>Federal land</header><text>The term <quote>Federal land</quote> means land under the jurisdiction and management of a Federal land management agency that is adjacent to the northern border or southern border.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4FDBA193A08B4E7CA74A4403EB3B6C95"><enum>(3)</enum><header>Federal land management agency</header><text>The term <quote>Federal land management agency</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HBE7C727553234C3BBF602AA4439BC63C"><enum>(A)</enum><text>the Bureau of Indian Affairs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HABD0E790EC954886970CEC5FADEA8160"><enum>(B)</enum><text>the Bureau of Land Management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3AA1428C91B94FC78CA5275452527E0A"><enum>(C)</enum><text>the Bureau of Reclamation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18518B6639B44C2BB7A164E42F4D2F6B"><enum>(D)</enum><text>the Forest Service;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAFBCF0C65527402ABC69CA77143188A4"><enum>(E)</enum><text>the United States Fish and Wildlife Service; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB69998BD7CC24DFCA9709DC1885CEFED"><enum>(F)</enum><text>the National Park Service.</text></subparagraph></paragraph><paragraph id="HB534316394AB432886224722D6028CFD"><enum>(4)</enum><header>Northern border</header><text>The term <term>northern border</term> means the international border between the United States and Canada. </text></paragraph><paragraph id="H1BE9D5793E584B84A422D39AC6A310D2"><enum>(5)</enum><header>Operational control</header><text>The term <term>operational control</term> has the meaning given such term in section 2(b) of the Secure Fence Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/367">Public Law 109–367</external-xref>). </text></paragraph><paragraph id="H2215F641A8204BDCB8D8165A1DBCF0AF"><enum>(6)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H1868D6E1980C4D56B9476A351DCA2993"><enum>(A)</enum><text>the Secretary of the Interior, with respect to Federal land under the jurisdiction and management of the Secretary of the Interior, acting through, as applicable—</text><clause commented="no" display-inline="no-display-inline" id="HF1A07816A14644F2A461F735F0BA1A6C"><enum>(i)</enum><text>the Director of the Bureau of Indian Affairs;</text></clause><clause id="H73899994733146DF9AF0BB83EF00133E"><enum>(ii)</enum><text>the Director of the Bureau of Land Management; </text></clause><clause id="H9352FD92C334479D8337DE428841B5F0"><enum>(iii)</enum><text>the Commissioner of Reclamation;</text></clause><clause id="H7B31F568BF8F40EA8C1C785166D4A4AD"><enum>(iv)</enum><text>the Director of the United States Fish and Wildlife Service; and</text></clause><clause id="H68E5ABE1EA07479B8C0DAAC1C17A5EAB"><enum>(v)</enum><text>the Director of the National Park Service; and</text></clause></subparagraph><subparagraph id="HE6590240F071443A9E59D6568513487E"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to National Forest System land, acting through the Chief of the Forest Service. </text></subparagraph></paragraph><paragraph id="H009D063EED714E8DAF0A8343B374B848"><enum>(7)</enum><header>Southern border</header><text>The term <term>southern border</term> means the international border between the United States and Mexico. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HABBDA6F800204651B09A9E487602B812"><enum>(b)</enum><header>Special use authorization</header><text display-inline="yes-display-inline">Subject to subsection (c), the Secretary concerned shall not require a Border State to obtain a special use authorization for the temporary placement on Federal land within the Border State of a movable, temporary structure for the purpose of securing the northern border or southern border, if the Border State submits to the Secretary concerned notice of the proposed placement not later than 45 days before the date of the proposed placement.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HABAEC619345846C198AD91835F47740D"><enum>(c)</enum><header>Temporary placement</header><paragraph commented="no" display-inline="no-display-inline" id="HB6C6D16B94EF4374B7D93F9CE6392C7A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A movable, temporary structure described in subsection (b) may be placed by a Border State on Federal land in accordance with that subsection for a period of not more than 1 year, subject to paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57047CC0C3B94F70AD12EC33C4A9E4B6"><enum>(2)</enum><header>Extension</header><subparagraph commented="no" display-inline="no-display-inline" id="HF16C1E47000B4F658D66B4B855F8E7A4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The period described in paragraph (1) may be extended in 90-day increments, on approval by the Secretary concerned.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9F76CB34E4A043AEAFC61CEFD18A276C"><enum>(B)</enum><header>Consultation required</header><text>The Secretary concerned shall consult with the Commissioner of U.S. Customs and Border Protection for purposes of determining whether to approve an extension under subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3AE979ED6CF1490CB0A37FD467EEA1C9"><enum>(C)</enum><header>Approval</header><text>The Secretary concerned shall approve a request for an extension under this paragraph if the Commissioner of U.S. Customs and Border Protection determines that operational control has not been achieved as of the date of the consultation required under subparagraph (B). </text></subparagraph></paragraph></subsection></section></legis-body></bill>
