<section id="H626A530A8B3149F0A396B32043DD1E8D"><enum>2.</enum><header>Amendment of South Pacific Tuna Act of 1988</header><text display-inline="no-display-inline"> Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the South Pacific Tuna Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973 et seq.</external-xref>).</text></section> <section id="HE56E03812B75417BAA31E01FEAA91A9C"><enum>3.</enum><header>Definitions</header> <subsection id="H956DD8431691414E9CECC02CB088C878"><enum>(a)</enum><header>Applicable national law</header><text>Section 2(4) (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973(4)</external-xref>) is amended by striking <quote>described in paragraph 1(a) of Annex I of</quote> and inserting <quote>noticed and in effect in accordance with</quote>.</text></subsection> 
<subsection id="H30AB947E478C4540BF08235C5EFB1032" commented="no"><enum>(b)</enum><header>Closed Area</header><text>Section 2(5) (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973(5)</external-xref>) is amended by striking <quote>of the closed areas identified in Schedule 2 of Annex I of</quote> and inserting <quote>area within the jurisdiction of a Pacific Island Party that is closed to vessels pursuant to a national law of that Pacific Island Party and is noticed and in effect in accordance with</quote>.</text></subsection> <subsection id="HED79B2C248204D6FB44EEE2015F14639" commented="no"><enum>(c)</enum><header>Fishing</header><text>Section 2(6) (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973(6)</external-xref>) is amended—</text> 
<paragraph id="H03ACEDF96FB740AC9D5D6DA138834E55" commented="no"><enum>(1)</enum><text>in subparagraph (C), by inserting <quote>for any purpose</quote> after <quote>harvesting of fish</quote>; and</text></paragraph> <paragraph id="HB246AF0E56BC46BC925E453DC55EB295"><enum>(2)</enum><text>by amending subparagraph (F) to read as follows:</text> 
<quoted-block style="OLC" id="H5B44D5A34E7949AFA449CED5132E4EBF" display-inline="no-display-inline"> 
<subparagraph id="H654C498754424898A2B501F674C94A47"><enum>(F)</enum><text display-inline="yes-display-inline">use of any other vessel, vehicle, aircraft, or hovercraft, for any activity described in this paragraph except for emergencies involving the health or safety of the crew or the safety of a vessel.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2ECF45B3A9694D3AB62982BF4E4DA435"><enum>(d)</enum><header>Fishing vessel</header><text>Section 2(7) (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973(7)</external-xref>) is amended by striking <quote>commercial fishing</quote> and inserting <quote>commercial purse seine fishing for tuna</quote>.</text></subsection> 
<subsection id="H7E6EA0B42B4244D2A6A8E1189E3B2EFF" commented="no"><enum>(e)</enum><header>Licensing Area</header><text>Section 2(8) (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973(8)</external-xref>) is amended by striking <quote>in the Treaty Area</quote> and all that follows and inserting <quote>under the jurisdiction of a Pacific Island Party, except for internal waters, territorial seas, archipelagic waters, and any Closed Area.</quote>.</text></subsection> <subsection id="H54FF20ECB11948CE9AF8AE02D228CE52"><enum>(f)</enum><header>Limited Area; Party; Treaty Area</header><text>Section 2 (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973</external-xref>) is amended—</text> 
<paragraph id="H2D38F172203440F98036EF4ABE462C31"><enum>(1)</enum><text>by striking paragraphs (10), (13), and (18);</text></paragraph> <paragraph id="H666DAD58DE0846669A7CB93C588A549E"><enum>(2)</enum><text>by redesignating paragraphs (11) and (12) as paragraphs (10) and (11), respectively;</text></paragraph> 
<paragraph id="HD29AF35339DB463B9EB242A66CBABD29"><enum>(3)</enum><text>by redesignating paragraph (14) as paragraph (12); and</text></paragraph> <paragraph id="HE476B8952375480094FDD1AB2D742987"><enum>(4)</enum><text>by redesignating paragraphs (15) through (17) as paragraphs (14) through (16), respectively.</text></paragraph></subsection> 
<subsection id="H5A396004F7D043619EAFED53C01F2E8B"><enum>(g)</enum><header>Regional terms and conditions</header><text>Section 2 (<external-xref legal-doc="usc" parsable-cite="usc/16/973">16 U.S.C. 973</external-xref>) is amended by inserting after paragraph (12), as so redesignated, the following:</text> <quoted-block id="H66B658DAD3F54B3589736127375FCF5A" style="OLC"> <paragraph id="H3334740BDE8E43DCB87928F3B357EDAB"><enum>(13)</enum><text>The term <term>regional terms and conditions</term> means any of the terms or conditions attached by the Administrator to the license issued by the Administrator, as notified by the Secretary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="HEC5A7F944E00421DB03B6901F8A28600"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/973c">16 U.S.C. 973c(a)</external-xref>) is amended—</text> <paragraph id="HBAF0DFB2840C420380DE46142661CBB2"><enum>(1)</enum><text>by striking <quote>Except as provided in section 6 of this Act, it</quote> at the beginning and inserting <quote>It</quote>;</text></paragraph> 
<paragraph id="H0672DB480FBB46A7BA9E494A4A4462C3"><enum>(2)</enum><text>by striking paragraphs (3) and (4);</text></paragraph> <paragraph id="H6C68FCEBDD084B699360260A793609CD"><enum>(3)</enum><text>by redesignating paragraphs (5) through (13) as paragraphs (3) through (11), respectively;</text></paragraph> 
<paragraph id="H4BD3570A40EB458E8A0418D5E9B6896C"><enum>(4)</enum><text>in paragraph (3), as so redesignated, by inserting <quote>, except in accordance with an agreement pursuant to the Treaty</quote> after <quote>Closed Area</quote>;</text></paragraph> <paragraph id="H8AB049ED6F6647499E11B9BAD3C1B326" commented="no"><enum>(5)</enum><text>in paragraph (10), as so redesignated, by striking <quote>or</quote> at the end;</text></paragraph>

<subsection id="H744346AF9EA9497D89603AEB0A5E357C"><enum>(b)</enum><header>In the Licensing Area</header><text display-inline="yes-display-inline">Section 5(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/973c">16 U.S.C. 973c(b)</external-xref>) is amended—</text> <paragraph id="H88ECB06A77D1465CA51401503922F5B4"><enum>(1)</enum><text>by striking <quote>Except as provided in section 6 of this Act, it</quote> and inserting <quote>It</quote>;</text></paragraph> 
<paragraph id="H2C3B87E32C2046E4BBE5B34535F91667"><enum>(2)</enum><text>by striking paragraph (5); and</text></paragraph> <paragraph id="H0266C3C38B6A433BA0186BEFD3D7F112"><enum>(3)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (5) and (6), respectively.</text></paragraph></subsection></section> 
<section id="H4CDB0C4B510044FF9FF59E224D9D3235"><enum>5.</enum><header>Exceptions</header><text display-inline="no-display-inline">Section 6 (<external-xref legal-doc="usc" parsable-cite="usc/16/973d">16 U.S.C. 973d</external-xref>) is repealed.</text></section> <section id="HA3376D61905D4081A28198A433FA8C64"><enum>6.</enum><header>Criminal offenses</header><text display-inline="no-display-inline">Section 7(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/973e">16 U.S.C. 973e(a)</external-xref>) is amended by striking <quote>section 5(a) (8), (10), (11), or (12)</quote> and inserting <quote>paragraphs (6), (8), (9), or (10) of section 5(a)</quote>.</text></section> 
<section id="H907200FD1B624702A586DFAA440F7399"><enum>7.</enum><header>Civil penalties</header> 
<subsection id="HFDB24F8A216D48B1BAF94E09704004F8"><enum>(a)</enum><header>Determination of liability; amount; participation by secretary of state in assessment proceeding</header><text>Section 8(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/973f">16 U.S.C. 973f(a)</external-xref>) is amended—</text> <paragraph id="HDED52907F4124F62B626C0BC0AFD763B"><enum>(1)</enum><text>by striking <quote>Code</quote> after <quote>liable to the United States</quote>; and</text></paragraph> 
<paragraph id="HF60FBEB6C3044D04BC35AE2B84B2A561"><enum>(2)</enum><text>by striking <quote>Except for those acts prohibited by section 5(a) (4), (5), (7), (8), (10), (11), and (12), and section 5(b) (1), (2), (3), and (7) of this Act, the</quote> and inserting <quote>The</quote>.</text></paragraph></subsection> <subsection id="H70BA01673F7C4BA785E80B5E3A9C5300"><enum>(b)</enum><header>Waiver of referral to attorney general</header><text>Section 8(g) (<external-xref legal-doc="usc" parsable-cite="usc/16/973f">16 U.S.C. 973f(g)</external-xref>) is amended—</text> 
<paragraph id="H1EE1EEC2FB234FD9879485F72774CD58"><enum>(1)</enum><text>by striking <quote>section 5(a)(1), (2), (3), (4), (5), (6), (7), (8), (9), or (13)</quote> and inserting <quote>paragraphs (1), (2), (3), (4), (5), (6), (7), (11), (12), or (13) of section 5(a)</quote>; and</text></paragraph> <paragraph id="H1CE139F5C05944769BC1CF946150B3A6"><enum>(2)</enum><text>in paragraph (2), by striking <quote>, all Limited Areas closed to fishing,</quote> after <quote>outside of the Licensing Area</quote>.</text></paragraph></subsection></section> 
<section id="H01848C008D91404BB1436A12561974A0"><enum>8.</enum><header>Licenses</header> 
<subsection id="H5E68D51F890C42278FDDCA50923FADC6"><enum>(a)</enum><header>Forwarding and transmittal of vessel license application</header><text>Section 9(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/973g">16 U.S.C. 973g(b)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H1BF0C523552844179B3F01D07B80E7AC" display-inline="no-display-inline"> <subsection id="H50D8AEF367354ADBB53543073AEFF910"><enum>(b)</enum><text display-inline="yes-display-inline">In accordance with subsection (e), and except as provided in subsection (f), the Secretary shall forward a vessel license application to the Administrator whenever such application is in accordance with application procedures established by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5BDD801A00A8485ABDB280AF54EE9BDC"><enum>(b)</enum><header>Fees and schedules</header><text>Section 9(c) (<external-xref legal-doc="usc" parsable-cite="usc/16/973g">16 U.S.C. 973g(c)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H471338919C2647CCA92E42771747BAAC" display-inline="no-display-inline"> <subsection id="HA9169B70F4E946D58CC9D27C729E8A4A"><enum>(c)</enum><text display-inline="yes-display-inline">Fees required under the Treaty shall be paid in accordance with the Treaty and any procedures established by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD79050AC99EB411EBEDBDD33F711872A"><enum>(c)</enum><header>Minimum fees required To be received in initial year of implementation for forwarding and transmittal of license applications</header><text>Section 9 (<external-xref legal-doc="usc" parsable-cite="usc/16/973g">16 U.S.C. 973g</external-xref>) is amended—</text> <paragraph id="HD2601F114D594B1EBD73B52E85D8B4FE"><enum>(1)</enum><text>by striking subsection (f);</text></paragraph> 
<paragraph id="H5565810AD31E4EA6B55C0183478D8B91"><enum>(2)</enum><text>by redesignating subsections (g) and (h) as subsections (f) and (g), respectively;</text></paragraph> <paragraph id="HF03F72E156454E21A3BE4F1EEE46AE14"><enum>(3)</enum><text>by amending subsection (f), as so redesignated, to read as follows:</text> 
<quoted-block style="OLC" id="H1586CFF60CD24F9B9E278625B2DBF793" display-inline="no-display-inline"> 
<subsection id="H5C1FE5853A104A5BB62909DA8C344FB6"><enum>(f)</enum><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of State, may determine that a license application should not be forwarded to the Administrator if—</text> <paragraph id="HF1B3A908DA534CB59ABCAE97F91C8AF0"><enum>(1)</enum><text>the application is not in accordance with the Treaty or the procedures established by the Secretary; or</text></paragraph> 
<paragraph id="H83A4AB7CDBFC4DB082A2B17BEE467D53"><enum>(2)</enum><text>the owner or charterer—</text> <subparagraph id="H4468A5FA03674170B13644E3B2175A79"><enum>(A)</enum><text>is the subject of proceedings under the bankruptcy laws of the United States, unless reasonable financial assurances have been provided to the Secretary;</text></subparagraph> 
<subparagraph id="H84B7EF58F1F64630BA2BB9BB6141F801"><enum>(B)</enum><text>has not established to the satisfaction of the Secretary that the fishing vessel is fully insured against all risks and liabilities normally provided in maritime liability insurance; or</text></subparagraph> <subparagraph id="H74A66337D88A4288A24F7C6533999118"><enum>(C)</enum><text>has not paid any penalty which has become final, assessed by the Secretary in accordance with this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD9A04B1CA8274109A4D0C05D7798314F"><enum>(4)</enum><text>in subsection (g), as so redesignated—</text> <subparagraph id="HA81E4299603547279B93BDE4EFCCB7B0" commented="no"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>

<subparagraph id="H6DA53FDC885A417093CB91E36F9607DD"><enum>(C)</enum><text>in paragraph (3), by inserting <quote>of 1972</quote> after <quote>Marine Mammal Protection Act</quote>; and</text></subparagraph> <subparagraph id="H20972C67243743E4B53D02E8FE058384"><enum>(D)</enum><text>in the matter that follows paragraph (3), by striking <quote>any vessel documented</quote> and all that follows and inserting the following:</text> 
<quoted-block style="OLC" id="H65EF9B1C296C481EBBA96798EF641D0A" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">any vessel documented under the laws of the United States as of the date of enactment of the Fisheries Act of 1995 for which a license has been issued under subsection (a) may fish for tuna in the Licensing Area, and on the high seas and in waters subject to the jurisdiction of the United States west of 146° west longitude and east of 129.5° east longitude in accordance with international law, subject to the provisions of the Treaty, this Act, and other applicable law, provided that no such vessel intentionally deploys a purse seine net to encircle any dolphin or other marine mammal in the course of fishing.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> 
<section id="H882D82A8189B48A59EF8AFE39AE477D5"><enum>9.</enum><header>Enforcement</header> 
<subsection id="H247BB27BDA7D4ECDB7188F0CF2C33FD9"><enum>(a)</enum><header>Notice requirements to Pacific Island Party concerning institution and outcome of legal proceedings</header><text>Section 10(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/973h">16 U.S.C. 973h(c)(1)</external-xref>) is amended—</text> <paragraph id="H4B84E581FB5F492CB5369D8ED25AE80B"><enum>(1)</enum><text>by striking <quote>paragraph 8 of Article 4 of</quote>; and</text></paragraph> 
<paragraph id="H89A02027428F4280AB6AD94E1BF7B366"><enum>(2)</enum><text>by striking <quote>Article 10 of</quote>.</text></paragraph></subsection> <subsection id="HD8C71D90D2234FA4817289F5862D9EDA"><enum>(b)</enum><header>Searches and seizures by authorized officers; limitations on power</header><text>Section 10(d)(1)(A) (<external-xref legal-doc="usc" parsable-cite="usc/16/973h">16 U.S.C. 973h(d)(1)(A)</external-xref>) is amended—</text>

<section id="HF7538D199DD34B70A3ABEFE441B951D7"><enum>11.</enum><header>Reporting requirements; disclosure of information</header><text display-inline="no-display-inline">Section 12 (<external-xref legal-doc="usc" parsable-cite="usc/16/973j">16 U.S.C. 973j</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H09195334659647F8845521A5A339FE96" display-inline="no-display-inline"> <section id="H91EEF97F470B4B1FA26E35273B65328F"><enum>12.</enum><header>Reporting</header> <subsection id="H3645473D87E44025A335DC0180FE5AAB" commented="no"><enum>(a)</enum><header>Prohibited disclosure of certain information</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Secretary shall keep confidential and may not disclose the following information (and such information shall be exempt from disclosure under section 552(b)(3) of title 5, United States Code):</text> 
<paragraph id="H6543008CD9A24107AF025164553A0759" commented="no"><enum>(1)</enum><text>Information provided to the Secretary by the Administrator that the Administrator has designated confidential.</text></paragraph> <paragraph id="HE6B06BC6F9C04F728F828B7CE1FCFE33" commented="no"><enum>(2)</enum><text>Information collected by observers.</text></paragraph> 
<paragraph id="HEB85992DDAD940378ACDA2A63DD6A7EA" commented="no"><enum>(3)</enum><text>Information submitted to the Secretary by any person in compliance with the requirements of this Act.</text></paragraph></subsection> <subsection id="HC9122FA3E6634BF99FCE8D3C29AB7F85"><enum>(b)</enum><header>Permitted disclosure of certain information</header><text>The Secretary may disclose information described in subsection (a)—</text> 
<paragraph id="H45BBC358C142438BADF1DC85CEE67DF8"><enum>(1)</enum><text>if disclosure is ordered by a court;</text></paragraph> <paragraph id="HE88BD90E8500472CAB2F518BFED96CCF"><enum>(2)</enum><text>if the information is used by a Federal employee—</text> 
<subparagraph id="H73FD5E276D11414FA733BD8EEB06B0D6"><enum>(A)</enum><text>for enforcement; or</text></subparagraph> <subparagraph id="H9BB820F4C7404AEABC97EBCB6D360CEE"><enum>(B)</enum><text>in support of the homeland and national security missions of the Coast Guard as defined in section 888 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/468">6 U.S.C. 468</external-xref>);</text></subparagraph></paragraph> 
<paragraph id="H013530CCF9B84BB08D3573848A46D84A"><enum>(3)</enum><text>if the information is used by a Federal employee or an employee of the Fishery Management Council for Treaty administration or fishery management and monitoring;</text></paragraph> <paragraph id="H050E623F24504B9B9764DE12D763267B"><enum>(4)</enum><text>to the Administrator, in accordance with the requirements of the Treaty and this Act;</text></paragraph> 
<paragraph id="H2E16F0D527F7456E96A93CBEB956C20E" commented="no"><enum>(5)</enum><text>to the secretariat or equivalent of an international fisheries management organization of which the United States is a member, in accordance with the requirements or decisions of such organization, and insofar as possible, in accordance with an agreement that prevents public disclosure of the identity of any person that submits such information;</text></paragraph> <paragraph id="HA64D301B0F314017ADABF719867715C6"><enum>(6)</enum><text>if the Secretary has obtained written authorization from the person providing such information, and disclosure does not violate other requirements of this Act; or</text></paragraph> 
<paragraph id="HA0EEAF8E6F4F498E8628BBF4D750935D" commented="no"><enum>(7)</enum><text>in an aggregate or summary form that does not directly or indirectly disclose the identity of any person that submits such information.</text></paragraph></subsection> <subsection id="HA5B4530CF88841959C80D9AABC40F764" commented="no"><enum>(c)</enum><header>Savings clause</header> <paragraph id="H0C27A6002EBC44298B09D5CC2416C8DE" commented="no"><enum>(1)</enum><header>In general</header><text>Nothing in this section shall be construed to adversely affect the authority of Congress, including a Committee or Member thereof, to obtain any record or information.</text></paragraph> 
<paragraph id="HD4BDB60EFDB741FB9E7861339B764020" commented="no"><enum>(2)</enum><header>No negative implication</header><text>The absence of a provision similar to paragraph (1) in any other provision of law shall not be construed to limit the ability of Congress, including a Committee or Member thereof, to obtain any record or information.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H985408CAF9F84CEB998A66BF5CD4FDD9"><enum>12.</enum><header>Closed Area stowage requirements</header><text display-inline="no-display-inline">Section 13 (<external-xref legal-doc="usc" parsable-cite="usc/16/973k">16 U.S.C. 973k</external-xref>) is amended by striking <quote>. In particular, the boom shall be lowered</quote> and all that follows and inserting <quote>and in accordance with any requirements established by the Secretary.</quote>.</text></section> 
<section id="H3A89B6283F2C4998AD2E7A5BE1061A25" commented="no"><enum>13.</enum><header>Observers</header><text display-inline="no-display-inline">Section 14 (<external-xref legal-doc="usc" parsable-cite="usc/16/973l">16 U.S.C. 973l</external-xref>) is repealed.</text></section> <section id="HAC389B7FCF41433C9D8FDB1CB495C581"><enum>14.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 15 (<external-xref legal-doc="usc" parsable-cite="usc/16/973m">16 U.S.C. 973m</external-xref>) is amended to read as follows:</text>

<section id="HCCCA9CEBF5B746DCBB9C34C137817FD3"><enum>15.</enum><header>Technical assistance</header><text display-inline="no-display-inline">The Secretary and the Secretary of State may provide assistance to a Pacific Island Party to benefit such Pacific Island Party from the development of fisheries resources and the operation of fishing vessels that are licensed pursuant to the Treaty, including—</text> <paragraph id="H57A2FADDB4B24C059D588663C4F8DF44" commented="no"><enum>(1)</enum><text>technical assistance;</text></paragraph> 
<paragraph id="H8789CB18EACE4406B1450A11F194286A" commented="no"><enum>(2)</enum><text>training and capacity building opportunities;</text></paragraph> <paragraph id="H8C77826BAC6A4BF3A5E6534BFE24DC31" commented="no"><enum>(3)</enum><text>facilitation of the implementation of private sector activities or partnerships; and</text></paragraph> 
<paragraph id="HE7792FD3583049B19AE339F30FB1BE2A" commented="no"><enum>(4)</enum><text>other activities as determined appropriate by the Secretary and the Secretary of State.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HF5B02067A27E4CC4825492213E0275CC"><enum>15.</enum><header>Arbitration</header><text display-inline="no-display-inline">Section 16 (<external-xref legal-doc="usc" parsable-cite="usc/16/973n">16 U.S.C. 973n</external-xref>) is amended—</text> 
<paragraph id="H7FECF9DE10BE42248A47844ED3778D18"><enum>(1)</enum><text>by striking <quote>Article 6 of</quote> after <quote>arbitral tribunal under</quote>; and</text></paragraph> <paragraph id="HAD88F368C3E34D70AF4A407FB42AA887"><enum>(2)</enum><text>by striking <quote>paragraph 3 of that Article</quote>, and inserting <quote>the Treaty, shall determine the location of the arbitration</quote>.</text></paragraph></section> 
<section id="H77DAE2421C234B43A45DC66D3FC4BBBC"><enum>16.</enum><header>Disposition of fees, penalties, forfeitures, and other moneys</header><text display-inline="no-display-inline">Section 17 (<external-xref legal-doc="usc" parsable-cite="usc/16/973o">16 U.S.C. 973o</external-xref>) is amended by striking <quote>Article 4 of</quote>.</text></section> <section id="HDFD39ED5732246569847B5A8B67D2619" commented="no"><enum>17.</enum><header>Additional agreements</header><text display-inline="no-display-inline">Section 18 (<external-xref legal-doc="usc" parsable-cite="usc/16/973p">16 U.S.C. 973p</external-xref>) is amended by striking <quote>Within 30 days after</quote> and all that follows and inserting <quote>The Secretary may establish procedures for review of any agreements for additional fishing access entered into pursuant to the Treaty.</quote>.</text></section>
