which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><action display="yes"><action-date date="20251104">November 4, 2025</action-date><action-desc>Additional sponsor: <cosponsor name-id="S000250">Mr. Sessions</cosponsor></action-desc></action><action display="yes"><action-date date="20251104">November 4, 2025</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on September 10, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Board of Governors of the Federal Reserve System to issue rules to establish certain methodologies and scenarios used in stress testing, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HBA00" reported-display-style="italic" id="H09FAB832373D40E2BB90B849DACB6033"><section id="H71AD9AE357A245B9B805A6E852E1FAB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stress Testing Accountability and Transparency Act</short-title></quote>. </text></section><section id="H2432C2C7EC184969A98A42C1A8FA1809"><enum>2.</enum><header>Rulemaking related to stress capital buffer requirements</header><subsection id="H83286E07355C46F6AE295848E6E1C2C4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, the Board of Governors of the Federal Reserve System (in this Act referred to as the <quote>Board</quote>) shall issue a rule—</text><paragraph id="H267F5151C3784E0DA149E2B94ABA6DEF"><enum>(1)</enum><text display-inline="yes-display-inline">establishing the models, assumptions, formulas, and other decisional methodologies that are used to conduct any stress test pursuant to section 165(i) of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5365">12 U.S.C. 5365(i)</external-xref>), including any such test that is used to determine any component or subcomponent of the stress capital buffer requirement for a covered company; and</text></paragraph><paragraph id="H623542A315454276A3926F5C99C111C5"><enum>(2)</enum><text display-inline="yes-display-inline">to determine, where the Board has supervisory stress test results from two or more periodic analyses of a covered company, the covered company’s stress capital buffer requirement on the basis of supervisory stress test results from two or more periodic analyses of that covered company.</text></paragraph></subsection><subsection id="H4E305AE127C640D3A8698F29B3ED6068"><enum>(b)</enum><header>Changes</header><text display-inline="yes-display-inline">The Board may only make material changes to the methodologies established in the rule issued under subsection (a)(1) through notice and comment rulemaking.</text></subsection><subsection id="HA2DB40E91F2044278C728B00DF5A4DEE"><enum>(c)</enum><header>No double-count</header><text display-inline="yes-display-inline">The Board shall ensure no double-count of capital requirements for the same risks in the stress capital buffer requirement and the risk-based capital requirements.</text></subsection><subsection id="H4BF2249B551D4B6AAD970CC3BE976AF1"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H059626342CEA4A429EE72B7DB15780C0"><enum>(1)</enum><header>Covered company</header><text display-inline="yes-display-inline">The term <quote>covered company</quote> means a company to which section 225.8 of title 12, Code of Federal Regulations, or section 238.170 of title 12, Code of Federal Regulations, applies. </text></paragraph><paragraph id="HA8E7E41F84DC44708BD1B181C5F77930"><enum>(2)</enum><header>Stress capital buffer requirement</header><text>The term <quote>stress capital buffer requirement</quote> has the meaning given that term under—</text><subparagraph id="HF5F6EB31FA864C90962B7ADEE2B02625"><enum>(A)</enum><text display-inline="yes-display-inline">section 225.8(d) of title 12, Code of Federal Regulations; and</text></subparagraph><subparagraph id="H2924F5AA161C4A248E3997BD6EB3EFBB"><enum>(B)</enum><text display-inline="yes-display-inline">section 238.170(d) of title 12, Code of Federal Regulations.</text></subparagraph></paragraph></subsection><subsection id="H70ACC789FCC44634AE35F3795A2851B9"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to imply that the Board is required to establish a stress capital buffer requirement for any bank holding company or any other company regulated by the Board. </text></subsection></section><section id="H3C238F56E75B461C96D1C083EA4D5FD5"><enum>3.</enum><header>Rulemaking relating to stress testing</header><subsection id="H03C4BBBD26EB455F88CB8F48915BF6AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning in the first calendar year beginning after the date of the enactment of this section, the Board shall, not less than 60 days before conducting a stress test pursuant to section 165(i) of the Financial Stability Act of 2010, publicly disclose each scenario to be used in such stress test.</text></subsection><subsection id="H75B7EE5F0E684849BA8C268A72BA7FA6"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Board may not, by rule or otherwise, subject any nonbank financial company or bank holding company to a climate-related stress test using the authority provided in section 165(i) of the Financial Stability Act of 2010.</text></subsection></section><section id="H0A8D57FB0ABD414096176DAB37D942C7"><enum>4.</enum><header>GAO report</header><subsection id="HD06935AB6A7043529113F39231C49782"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall, every 3 years, conduct a study and submit a report to the Congress with respect to the stress tests conducted by the Board under section 165(i) of the Financial Stability Act of 2010 in the 3 most recent calendar years.</text></subsection><subsection id="H37DC2147501049A188C6F5F120078020"><enum>(b)</enum><header>Contents</header><text>The report submitted to the Congress under subsection (a) shall consider the effectiveness of the stress tests in evaluating—</text><paragraph id="H6C0D7AE996D74FD08C7E154193BB1492"><enum>(1)</enum><text display-inline="yes-display-inline">the safety and soundness of the nonbank financial companies and bank holding companies subjected to stress tests;
