<section section-type="section-one" id="H594434C38CFA4594987F6A90D777B7CC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ESP, Paraprofessional, and Education Support Staff Family Leave Act</short-title></quote>.</text></section> <section id="HAFBB268981684808971FBBC67CD99FB2"><enum>2.</enum><header>Eligibility for education support professionals and school support staff</header><text display-inline="no-display-inline">Section 101(2) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HDE303AF6B070438E974A1F37DBA67F78"><enum>(F)</enum><header>Paraprofessionals and education support staff</header>
<clause id="H00C237BC90934C06AA11614EFEFDE98A"><enum>(i)</enum><header>Determination</header><text display-inline="yes-display-inline">For purposes of determining whether a covered educational employee meets the hours of service requirement specified in subparagraph (A)(ii), the covered educational employee will be considered to meet the requirement if the employee has worked a number of hours equal to not less than 60 percent of the applicable total monthly hours expected for the employee’s job description and duties, as assigned for the previous school year.</text></clause> <clause id="H2484200AF60A44D5A16A4FC182B3DC32"><enum>(ii)</enum><header>File</header><text display-inline="yes-display-inline">Each employer of a covered educational employee shall maintain on file with the Secretary (in accordance with such regulations as the Secretary may prescribe) information specifying the total monthly hours expected for the employee’s job description and duties for each school year.</text></clause>
<clause id="H1A34ACFB393D4E839AD171E00669FCC4"><enum>(iii)</enum><header>Definitions</header><text>In this subparagraph:</text> <subclause id="HA6983DD3501748D58EAE73E06F914CA0"><enum>(I)</enum><header>Covered educational employee</header><text display-inline="yes-display-inline">The term <quote>covered educational employee</quote> means a <quote>paraprofessional</quote> or an <quote>education support staff member</quote> employed by an educational agency or institution.</text></subclause>
<subclause id="H495E6061AD44485181B0B8DEDD3B27FA"><enum>(II)</enum><header>Paraprofessional</header><text display-inline="yes-display-inline">The term <term>paraprofessional</term> has the meaning given the term in section 8101(37) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(37)</external-xref>).</text></subclause> <subclause id="H38E77B00BBAB47188215A502691277D6"><enum>(III)</enum><header>Education support staff</header><text display-inline="yes-display-inline">The term <term>education support staff member</term> (also known as a <quote>classified school employee</quote>, <quote>education support professional</quote>, or <quote>ESP</quote>) means an employee of an educational agency or institution who provides clerical and administrative services, transportation services, food and nutrition services, custodial and maintenance services, health and student services, technical services, or services related to skilled trades.</text></subclause>
<subclause commented="no" id="H63763D6C75ED48B88C551291EB6F8D48"><enum>(IV)</enum><header>Educational agency or institution</header><text display-inline="yes-display-inline">The term <quote>educational agency or institution</quote> has the meaning given the term in section 444(a)(3) of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g(a)(3)</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HEF33DBAE10AB4E03B00DFBE004B3DC89"><enum>3.</enum><header>Entitlement to leave</header><text display-inline="no-display-inline">Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HD014597D35BA485EB9F0C59AF458F8C2"><enum>(6)</enum><header>Calculation of leave for covered educational employees</header><text>The Secretary shall provide methods for calculating the leave described in paragraph (1) with respect to covered educational employees, in accordance with section 108, as applicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
