which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent the theft of catalytic converters and other precious metal car parts, and for other purposes.</official-title></form><legis-body id="HB8B0861C7AE945FCABC46957B0CA339C" style="OLC"><section id="HDCA31550EE864E44B3B088B7C895C9A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Auto Recycling Theft Act</short-title></quote> or the <quote><short-title>PART Act</short-title></quote>.</text></section><section id="HC085EAE8DAD649E79876741939352B75"><enum>2.</enum><header>Catalytic converter defined</header><text display-inline="no-display-inline">In this Act, the term <term>catalytic converter</term> means any of the following:</text><paragraph id="H9794DBE6F3564887A5AD8CC616791964"><enum>(1)</enum><text>Any device installed in the exhaust system of an internal combustion engine that utilizes catalytic action to oxidize hydrocarbon (HC) and carbon monoxide (CO) emissions to carbon dioxide (CO<subscript>2</subscript>) and water (H<subscript>2</subscript>O).</text></paragraph><paragraph id="H5537ADE866544BB2ADADA25023476C9C"><enum>(2)</enum><text>A diesel oxidation catalyst.</text></paragraph><paragraph id="HF00942C786464FD6A8E4BDA2F11BCC7C"><enum>(3)</enum><text>A diesel particulate filter.</text></paragraph></section><section id="HC4B181C1EDBA4BC58E2C1F626BD12317"><enum>3.</enum><header>Requirements for new motor vehicles relating to catalytic converters</header><subsection id="HB532C3F3545B43F8935636CF33EC8CBB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the National Highway Traffic Safety Administration shall—</text><paragraph id="H137E6633800C46579B726F847ED9B07F"><enum>(1)</enum><text>revise the motor vehicle theft prevention standard in section 541.5 of title 49, Code of Federal Regulations, to include catalytic converters among the parts specified in subsection (a) of such section; and</text></paragraph><paragraph id="HF18D091B5F3C48C2BF9AB80F6DB5EFEF"><enum>(2)</enum><text>update such regulations as are necessary to ensure that the requirements added by paragraph (1) apply to any vehicle covered by part 565 of such title.</text></paragraph></subsection><subsection id="H057CCF9D66F3457BA70129605E63C185" commented="no"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/331">chapter 331</external-xref> of title 49, United States Code, in the case of a vehicle described in paragraph (2) of subsection (a) that has not been sold to the first purchaser (as defined in section 33101 of such title), the requirements added by paragraph (1) of such subsection shall apply to the vehicle beginning on the date that is 6 months after the Secretary makes the revision and updates required by such subsection, regardless of the model year of the vehicle or the date on which the vehicle is manufactured.</text></subsection><subsection id="H6D113DB5E1714F978639FA823361E0FE"><enum>(c)</enum><header>Compliance</header><text display-inline="yes-display-inline">The identifying number affixed or inscribed required for catalytic converters under the revision described in subsection (a)(1) may include a unique part identification number that is included in a database that—</text><paragraph id="H7EEE97E1A89B45E48A99FA2AA01A9C50"><enum>(1)</enum><text>is accessible by law enforcement; and</text></paragraph><paragraph id="HEFA8B290AC7E4D5DBD42F44622997E20"><enum>(2)</enum><text>allows for the retrieval of the full vehicle identification number of the motor vehicle in which the catalytic converter was originally installed based on that part identification number.</text></paragraph></subsection><subsection id="H31B0E7588B054A8485B3930C1D71678F"><enum>(d)</enum><header>Amendments To add definition of catalytic converter</header><text>Section 33101 of title 49, United States Code, is amended—</text><paragraph id="H2955537608D540D1902F9570DDB5B499"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>In this chapter—</quote> and inserting <quote>In this chapter:</quote>;</text></paragraph><paragraph id="H404D9B7249314D188C0348466EA8CDD0"><enum>(2)</enum><text>in each of paragraphs (1) through (11)—</text><subparagraph id="H1445358EA2A1453F8AB7457489B3392A"><enum>(A)</enum><text>by inserting <quote>The Term</quote> after the enumerator; and</text></subparagraph><subparagraph id="H9659723B0B8349FFAF12976C7B936887"><enum>(B)</enum><text>by adding a paragraph heading the text of which comprises the term defined in the paragraph;</text></subparagraph></paragraph><paragraph id="HD02F6800A96A4185BB266495915A3C0B"><enum>(3)</enum><text>by redesignating paragraphs (1) through (11) as paragraphs (2) through (12), respectively; and</text></paragraph><paragraph id="H8C934374EC7E4269BFA2010F8FFE2281"><enum>(4)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="USC" id="H39131537798E4B37A5F374562059D8CD" display-inline="no-display-inline"><paragraph id="HB236375398894257ABBF62487675FABB"><enum>(1)</enum><header>Catalytic converter</header><text display-inline="yes-display-inline">The term <term>catalytic converter</term> means any of the following:</text><subparagraph id="H2D4D4A57424C4E85A6AD29B4F0CC946C"><enum>(A)</enum><text display-inline="yes-display-inline">Any device installed in the exhaust system of an internal combustion engine that utilizes catalytic action to oxidize hydrocarbon (HC) and carbon monoxide (CO) emissions to carbon dioxide (CO<subscript>2</subscript>) and water (H<subscript>2</subscript>O).</text></subparagraph><subparagraph id="H2C31F54C6D9042C180948D14A4D3D508"><enum>(B)</enum><text>A diesel oxidation catalyst.</text></subparagraph><subparagraph id="HFBD374425A444BE788D83B7F40A8FAA7"><enum>(C)</enum><text>A diesel particulate filter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBAF46E3755004FC786E248F7B677E534"><enum>(e)</enum><header>Marking of catalytic converters notwithstanding an exemption</header><text>Section 33106 of title 49, United States Code, is amended—</text><paragraph id="H80E45C55C61940C2910CB687AE3DEE79"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="HAC95D08A816E4A929E2B0D25BB7E814E"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HBAEF4BF8A84042A39D0862C4BC211D44"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="H2F4C92BF205E45EFA0D07EE0E66A36F0"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block id="H0D2F34E28AFD4D5C8CAFBC349199C71C" style="OLC"><paragraph id="H0DA64BF68B774B75BAA515AEDAA708A8"><enum>(3)</enum><text>a certification that the catalytic converter will be marked in accordance with sections 33101 through 33104, including any associated regulation; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H43F36457E09940B4B169553B2F1A6C54"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H4F0D106956C942A5A340A1CBFFA4F5D8" style="OLC"><subsection id="H7E1AEDFAEF96414CB25A17E540D73778"><enum>(f)</enum><header>Requirements for marking catalytic converters</header><paragraph id="HFCBEBA87A7324B12A5F743CDE0C086CA"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Highway Traffic Safety Administration shall promulgate regulations that require a catalytic converter on a vehicle line to be marked conspicuously in accordance with sections 33101 through 33104, including any associated regulation.</text></paragraph><paragraph id="H1CEC6CB962644EAC9B42F88280FE105A" commented="no"><enum>(2)</enum><header>Unique part identification numbers</header><text>In promulgating regulations under paragraph (1), the Administrator of the National Highway Traffic Safety Administration shall allow for a marking described in that paragraph to include a unique part identification number (as defined in section 33111(b)(3)) that is included in a database that is accessible by law enforcement and that allows for the retrieval of the full vehicle identification number.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H2BCAA0A8981648A0997DAC6EF23A7EC8" section-type="subsequent-section"><enum>4.</enum><header>Grant program for VIN stamping</header><subsection id="H3782C218371F45BC87FB82B701907A37"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Transportation shall establish a program to provide grants to eligible entities to carry out covered activities, excluding wages, related to catalytic converters.</text></subsection><subsection id="HB1D81F6E67FB4E199B29EAE708390D02"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, an eligible entity shall submit an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H5F192C2FB45D4D8DB301ED0D3627EB0F"><enum>(c)</enum><header>Eligible entities</header><text>In this section, eligible entities are the following:</text><paragraph id="H3B888FD788424AF8B6B902BC01702827" commented="no"><enum>(1)</enum><text>Law enforcement agencies.</text></paragraph><paragraph id="HA6B2DC14E88842EA887223B19C61526C"><enum>(2)</enum><text>Automobile dealers.</text></paragraph><paragraph id="H75C39BB8B3B849E89C08AD0B80488FAC" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Owners and lessees of centrally maintained vehicle fleets.</text></paragraph><paragraph id="H315CA7CC1BF54939A4ECECF3653A655E"><enum>(4)</enum><text>Automobile repair shops and service centers.</text></paragraph><paragraph id="H5FE58075374842128232572BED9D564B" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Nonprofit organizations.</text></paragraph></subsection><subsection id="HD525ABD333DC4EDEB95797BF6324D9D3"><enum>(d)</enum><header>Covered activities</header><text display-inline="yes-display-inline">Grant funds provided under this section may be used for equipment and materials necessary to carry out die or pin stamping of either the full vehicle identification number or a unique part identification number in a law enforcement accessible database that allows for the retrieval of the full vehicle identification number onto the outside of the catalytic converter in a conspicuous manner on motor vehicles. Such stamping shall be—</text><paragraph id="H3FF9C575BD9C4CA7B9A6E37E5B7DA598"><enum>(1)</enum><text>in a typed font and not handwritten; and</text></paragraph><paragraph id="H1B8753399EE64964A5404961032D160A"><enum>(2)</enum><text>covered by applying a coat of high-visibility, high-heat theft deterrence paint.</text></paragraph></subsection><subsection id="H54EFBA43C693475F88152AEAE5348A28"><enum>(e)</enum><header>Requirement</header><text>In carrying out the program under subsection (a), the Secretary shall ensure that each recipient of a grant is able to provide die or pin stamping services described in subsection (d) to the public.</text></subsection><subsection id="H573EA5A664AB4F428F7ACB10D501418D"><enum>(f)</enum><header>Prioritization</header><text display-inline="yes-display-inline">In making grants under this section, the Secretary shall prioritize—</text><paragraph id="H82533713B3384C45883B502E47BB7153"><enum>(1)</enum><text display-inline="yes-display-inline">eligible entities operating in the areas with the highest need for die or pin stamping described in subsection (d), including the areas with the highest rates of catalytic converter theft; and</text></paragraph><paragraph id="H0463BA4CED86455F9B8EB02B6DA16905" commented="no"><enum>(2)</enum><text>eligible entities that are in possession of motor vehicles that are subject to section 3(b).</text></paragraph></subsection><subsection id="H8A9F4CB249D04F32AA0DD5B649F437E9"><enum>(g)</enum><header>Procedures for marking</header><text display-inline="yes-display-inline">In carrying out the program established under subsection (a), the Secretary shall issue such regulations as are necessary to establish procedures to mark catalytic converters of vehicles most likely to be targeted for theft with unique identification numbers using a combination of die or pin stamping and high-visibility, high-heat theft deterrence paint without damaging the function of such converter.</text></subsection><subsection id="HC0EDA43AD1E641AE814CB503DA4854F9"><enum>(h)</enum><header>Annual report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter for 10 years, the Secretary shall submit to Congress a report on the program established under subsection (a) that includes a description of the progress, results, and any findings of the program, including the total number of catalytic converters marked under the program and, to the extent known, whether any catalytic converters marked under the program were stolen and the outcome of any criminal investigation into the threats.</text></subsection><subsection id="H67DE10639AE246B68FCFFE9E08D164A2"><enum>(i)</enum><header>Funding</header><paragraph id="HCD2C5896DBE0484B8ED4581000EDB62E"><enum>(1)</enum><header>Unobligated funding available</header><text>Of the unobligated balances appropriated by the American Rescue Plan Act of 2021, $7,000,000 shall be made available to carry out this section.</text></paragraph><paragraph id="HF97D4837D2FB462CAE24BD0D932FD042"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In the event that the total of $7,000,000 of the funds described under paragraph (1) may not be made available to carry out this section, there are authorized to be appropriated to carry out this section an amount equal to the remaining funding necessary to total $7,000,000.</text></paragraph></subsection><subsection id="H25C79DFF3033458DAD81EA46C2D169AE"><enum>(j)</enum><header>Centrally maintained vehicle fleet defined</header><text display-inline="yes-display-inline">In this section, the term <term>centrally maintained vehicle fleet</term> means a group of vehicles for which each aspect of management, including maintenance, repair, fuel management, and vehicle acquisition, is overseen and controlled by a single entity.</text></subsection></section><section id="H5BD1C7DE671943249C57D29930566B19"><enum>5.</enum><header>Requirements for purchase of catalytic converters and retention of seller information</header><subsection id="HAF7F44E287674647AB09364F746404FA"><enum>(a)</enum><header>Inclusion of catalytic converters</header><text display-inline="yes-display-inline">Paragraph (7) of section 33101 of title 49, United States Code (as redesignated by section 3(d)), is amended—</text><paragraph id="H977800AE2DE94FE6972341DBE21C2250"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (K), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H79B200CCF84E4199A825E23C3F9F807A"><enum>(2)</enum><text>by redesignating subparagraph (L) as subparagraph (M);</text></paragraph><paragraph id="HAB13DED8BE4C4387A1B046580199CE1D"><enum>(3)</enum><text>by inserting after subparagraph (K), the following:</text><quoted-block style="USC" id="H08BABE7C039B4EF7BEC8E44C72F20B50" display-inline="no-display-inline"><subparagraph id="HF84DA999610449268AE97AAD4EA7FDEC" commented="no"><enum>(L)</enum><text display-inline="yes-display-inline">the catalytic converter; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H51BF6C1B67A345AB9B6C02A2107E7D4D"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (M), as so redesignated, by striking <quote>subclauses (A)–(K) of this clause</quote> and inserting <quote>subparagraphs (A) through (L) of this paragraph</quote>.</text></paragraph></subsection><subsection id="H93D344F3CF8C445698A07F72C6E55899"><enum>(b)</enum><header>Retention of records</header><text display-inline="yes-display-inline">Section 33111 of title 49, United States Code, is amended—</text><paragraph id="H3118259AA54247AF90D40AAA0BECD9E8"><enum>(1)</enum><text>in subsection (a), in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">General requirements</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Prohibitions related to selling motor vehicle parts</header-in-text></quote>;</text></paragraph><paragraph id="HDE198E1BCAC8425A80C7199D6A4C0AD6"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text></paragraph><paragraph id="H2609910F87FF40C8AFFCB0B78DF33890"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="H03DE392325BA46119C095E4C4387C5AA" display-inline="no-display-inline"><subsection id="HBCFFCA081E064527A52A96FEC1C43F06"><enum>(b)</enum><header>Retention of records</header><paragraph id="H4C5205CB91C74E2894D6360D765C4A9F"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">A person engaged in the business of salvaging, dismantling, recycling, or repairing motor vehicles or motor vehicle parts that contain precious metals shall retain the records of any seller of motor vehicle parts that sells such a part to such person, including the following:</text><subparagraph id="H7E06742BA76A4B6AA793E6363C99BB02"><enum>(A)</enum><text>The name, address, telephone number, and a photocopy of a government-issued identification of the seller.</text></subparagraph><subparagraph id="H0BF95F51C29244759A07D79DC57E7D1C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">With regard to the motor vehicle or motor vehicle from which the parts came, the following:</text><clause id="HBA3D1469A5B34808A567D6DC309BA885" commented="no"><enum>(i)</enum><text>The make.</text></clause><clause id="H17F915157D1A4F17B18FAB7E05F6D282" commented="no"><enum>(ii)</enum><text>The model.</text></clause><clause id="H095D08934DB54158B32BC3C50958F7A5" commented="no"><enum>(iii)</enum><text>The vehicle identification number or a unique part identification number marked, etched, or engraved on the converter that can be tied directly to the vehicle identification number of the vehicle.</text></clause><clause id="H19E3E9A615C8458FBA092EA323277413" commented="no"><enum>(iv)</enum><text>The date of purchase.</text></clause></subparagraph></paragraph><paragraph id="HF6BFBA17655541DA8F9BFC87A5BC67DF"><enum>(2)</enum><header>Duration of retention</header><text>Such person shall retain such information for a period of at least two years.</text></paragraph><paragraph id="HEB399C25EAC944C5A2BD1F6AEBD6C4DD" commented="no"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HC83E023CFAE547FBB8DC426D8F200905"><enum>(A)</enum><header>Precious metals</header><text>The term <term>precious metals</term> has the meaning given such term in section 109–27.5101 of title 41, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph id="H42D516C05D434866A45023EAD868471E"><enum>(B)</enum><header>Unique part identification number</header><text>The term <term>unique part identification number</term>, with respect to a motor vehicle part, means a unique part identification number that—</text><clause id="HDEB3F5EA8A7A4EFA9C46A9566A7FEF34"><enum>(i)</enum><text>is marked, etched, or engraved on the motor vehicle part; and</text></clause><clause id="H7D3F27E315F443D991D1E730C9B4A6F9"><enum>(ii)</enum><text>is tied directly to the vehicle identification number of the vehicle on which the part was originally installed.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEDC2D6B3BCD04A31A6858196F79B2655" commented="no"><enum>(c)</enum><header>Prohibition on sale of certain catalytic converters</header><text display-inline="yes-display-inline">It shall be unlawful to sell or purchase any catalytic converter which has had identifying markings removed or otherwise tampered with.</text></subsection><subsection id="HCBC7EA8EEE2A4D20A0E9975792F57093" commented="no"><enum>(d)</enum><header>Traceable form of payment</header><paragraph id="H11C8BB8BA7EA447F9A3D236175E0FEA5" commented="no"><enum>(1)</enum><header>In general</header><text>Any purchase or sale of a catalytic converter shall be made with a traceable form of payment, including check and wire transfer.</text></paragraph><paragraph id="H9775037659C54A35921AA7DF8ACEC53A" commented="no"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">It shall be unlawful to sell or purchase any catalytic converter for cash or cryptocurrency.</text></paragraph></subsection><subsection id="H5E82E2CB9A0946F380A4BE3C3270C3A6" commented="no"><enum>(e)</enum><header>Regulations</header><text>The Attorney General shall prescribe regulations to carry out this section and the amendments made by this section, including the enforcement and penalties that apply to a violation of this section and the amendments made by this section.</text></subsection></section><section id="H5F44FD50589E4EC49457582D50DCD4E8"><enum>6.</enum><header>Criminal penalties</header><subsection id="H96910EC53ADC47FBA2FD42437D111280"><enum>(a)</enum><header>Theft of catalytic converters</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/31">Chapter 31</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H7E78CAFF9E764D8CAEC7014DD0A0BD28"><enum>(1)</enum><text>by adding at the end the following:</text><quoted-block id="HD68416585D9A45999CFFB18C9F542834" style="USC"><section id="H7B7E43E0BE7C4D00BD1247531D82B259"><enum>671.</enum><header>Theft of catalytic converters</header><subsection id="H913A1A56CD4B4382A44EC1CD3AD3205C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9714F569EB4D48EC93ECF7E8D2BBB21B"><enum>(1)</enum><header>Catalytic converter</header><text>The term <term>catalytic converter</term> means any of the following:</text><subparagraph id="H30B337BF2E5649BD9297E3F823E5A29D"><enum>(A)</enum><text display-inline="yes-display-inline">Any device installed in the exhaust system of an internal combustion engine that utilizes catalytic action to oxidize hydrocarbon (HC) and carbon monoxide (CO) emissions to carbon dioxide (CO<subscript>2</subscript>) and water (H<subscript>2</subscript>O).</text></subparagraph><subparagraph id="HFA87E1B704A04759939BB31B069A52D6"><enum>(B)</enum><text>A diesel oxidation catalyst.</text></subparagraph><subparagraph id="H054C7ED1231740839E14117EC6489064"><enum>(C)</enum><text>A diesel particulate filter.</text></subparagraph></paragraph><paragraph id="H8D3C1453F111409988E460B018248DB7"><enum>(2)</enum><header>Precious metals</header><text>The term <term>precious metals</term> has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="H101DF34A79464CD3BC8134D281C890CE"><enum>(b)</enum><header>Offense</header><text>It shall be unlawful to steal or knowingly and unlawfully take, carry away, or conceal a catalytic converter from the motor vehicle of another person, or knowingly purchase such catalytic converter with the intent to distribute, sell, or dispose of the catalytic converter or any precious metal removed therefrom in interstate or foreign commerce.</text></subsection><subsection id="H3EE8726768EB4FBA9EFAF59501D07E01"><enum>(c)</enum><header>Penalty</header><paragraph id="H2012111E61454D49B5757A10E2940747"><enum>(1)</enum><header>In general</header><text>Any person who violates subsection (b) shall be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph><paragraph id="H1935F7B906C54F25902B3567889A995F"><enum>(2)</enum><header>Concurrent sentences</header><text>Any term of imprisonment imposed on a person under paragraph (1) shall run concurrently with any other term of imprisonment imposed on a person at the same time for an offense arising out of the same conduct.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H27D6019985144C589226822916897C46"><enum>(2)</enum><text>in the table of sections for such chapter, by adding at the end of the following:</text><quoted-block id="HC9753CD8930545B78FDF00E08896340D" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">671. Theft of catalytic converters.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0A7192EE100B41178D46EB3CFA852209"><enum>(b)</enum><header>Definitions</header><text>Section 2311 of title 18, United States Code, is amended by inserting after <quote>for running on land but not on rails;</quote> the following:</text><quoted-block id="HD1119CBDF0E14AF5A0DA0D51CB43C8B0" style="OLC"><text display-inline="no-display-inline">‘Precious metals’ has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations, or any successor regulation;”.</text><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H91ED86F1819F48C49438D5E99E659A19"><enum>(c)</enum><header>Trafficking in car parts containing precious metals</header><text>Section 2321 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="HF70F9561237E4BB4B5D2603EFF9EDA01" style="OLC"><subsection id="H7C662BADBE51419DB7C91E03B15DCB9D"><enum>(d)</enum><header>Trafficking in motor vehicle parts containing precious metals</header><paragraph id="H9A2EFDA6D7954E419620EE4DB86365DE"><enum>(1)</enum><header>Definition of catalytic converter</header><text>In this subsection, the term <term>catalytic converter</term> means any of the following:</text><subparagraph id="H7413F043F8F74D3EA073C997D3D005B7"><enum>(A)</enum><text display-inline="yes-display-inline">Any device installed in the exhaust system of an internal combustion engine that utilizes catalytic action to oxidize hydrocarbon (HC) and carbon monoxide (CO) emissions to carbon dioxide (CO<subscript>2</subscript>) and water (H<subscript>2</subscript>O).</text></subparagraph><subparagraph id="HB303A2102B15470193DA1202DE90D4A5"><enum>(B)</enum><text>A diesel oxidation catalyst.</text></subparagraph><subparagraph id="H9CCDA361E5D347168C9E2464339ED47F"><enum>(C)</enum><text>A diesel particulate filter.</text></subparagraph></paragraph><paragraph id="H5BABAB0D5E2F4FD591F39D218F8E62F4"><enum>(2)</enum><header>Offense</header><text>It shall be unlawful to buy, receive, possess, or obtain control of, with intent to sell or otherwise dispose of, a catalytic converter, knowing that the catalytic converter has been stolen.</text></paragraph><paragraph id="H85EE191E64FC4A5990136DC2B1F0F09D"><enum>(3)</enum><header>Penalty</header><subparagraph id="H300BBBA7F1554B27ABBC9F5C62E8860A"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), any person who violates paragraph (2) shall be fined under this title, imprisoned not more than 5 years, or both.</text></subparagraph><subparagraph id="H2135FD509B9146A4919E8AFF5F9240F9"><enum>(B)</enum><header>Concurrent sentences</header><text>Any term of imprisonment imposed on a person under subparagraph (A) shall run concurrently with any other term of imprisonment imposed on the person at the same time for an offense arising out of the same conduct.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB88197A6EEE3428F81154A8DA751FDB0"><enum>(d)</enum><header>Chop shops</header><text>Section 2322(b) of title 18, United States Code, is amended to read as follows:</text><quoted-block id="H4E9AF3AF56954394B78EA41D0DE6B51A" style="OLC"><subsection id="H4AB0C80C857E40B7B35823BA936671A4"><enum>(b)</enum><header>Definition</header><text>For purposes of this section, the term <term>chop shop</term> means any building, lot, facility, or other structure or premise where one or more persons engage in receiving, concealing, destroying, disassembling, dismantling, reassembling, or storing any motor vehicle or motor vehicle part that has been unlawfully obtained in order to alter, counterfeit, deface, destroy, disguise, falsify, forge, obliterate, extract any precious metal therefrom, or remove the identify, including the vehicle identification number or derivative thereof, or other identification marking, of the vehicle or vehicle part and to distribute, sell, or dispose of the vehicle or vehicle part, or precious metal extracted from the vehicle or vehicle part, in interstate or foreign commerce.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
