<section id="H35392083688348CAA3A0757D37D5AADC"><enum>101.</enum><header>Prohibition on fast-track procedures under the Impoundment Control Act of 1974</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, during the period beginning on the date of the enactment of this Act and ending on January 20, 2029, the procedures under section 1017 of the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/688">2 U.S.C. 688</external-xref>) shall have no force or effect.</text></section> <section id="H4D78640ACB8B43629E9975B1B229AA87"><enum>102.</enum><header>Strengthening congressional control</header> <subsection id="H53618EB47C6B4CEFBB563D8EF353BD38"><enum>(a)</enum><header>In general</header><text>Part B of the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/682">2 U.S.C. 682 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="appropriations" display-inline="no-display-inline" id="H0C1B2007B4DA4F97BDE8EF3B5C8B4F0D"> 
<section commented="no" id="H8D4335519A984F4186F8AF0A1E3A6D04"><enum>1018.</enum><header>Prudent obligation of budget authority and specific requirements for expiring budget authority</header> 
<subsection commented="no" display-inline="yes-display-inline" id="H909227CA47484CAA9D5952FAC21C64D1"><enum>(a)</enum><header>Special message requirement</header><text display-inline="yes-display-inline">With respect to budget authority proposed to be rescinded or that is set to be reserved or proposed to be deferred in a special message transmitted under section 1012 or 1013, such budget authority—</text> <paragraph commented="no" id="H2CE85B78619146AC947E98DD59C43AEF"><enum>(1)</enum><text>shall be made available for obligation in sufficient time to be prudently obligated as required under section 1012(b) or 1013; and</text></paragraph> 
<paragraph commented="no" id="H27B7D26811884F5683610BB446277504"><enum>(2)</enum><text>may not be deferred or otherwise withheld from obligation during the 90-day period before the expiration of the period of availability of such budget authority, including, if applicable, the 90-day period before the expiration of an initial period of availability for which such budget authority was provided.</text></paragraph></subsection> <subsection commented="no" id="HE0AE486A24AB4BF7A200485D5D87464C"><enum>(b)</enum><header>Administrative requirement</header><text>With respect to an apportionment of an appropriation (as that term is defined in section 1511 of title 31, United States Code) made pursuant to section 1512 of such title, an appropriation shall be apportioned—</text> 
<paragraph commented="no" id="HC47A4366B38F4880BEAA9945A943B1DC"><enum>(1)</enum><text>to make available all amounts for obligation in sufficient time to be prudently obligated; and</text></paragraph> <paragraph commented="no" id="HA699B0D9CC134E16AF4A7E2CA8754CC2"><enum>(2)</enum><text>to make available all amounts for obligation, without precondition (including footnotes) that shall be met prior to obligation, not later than 90 days before the expiration of the period of availability of such appropriation, including, if applicable, 90 days before the expiration of an initial period of availability for which such appropriation was provided.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD72A5B807D354BCE98B8BD8C25BC1B51"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Congressional Budget and Impoundment Control Act of 1974 set forth in section 1(b) of such Act is amended by inserting after the item relating to section 1017 the following:</text> <quoted-block style="appropriations" display-inline="no-display-inline" id="H9EDFA279D67E46B3B3EDF8B98C2A7D08"> <toc regeneration="no-regeneration"> <toc-entry level="section">1018. Prudent obligation of budget authority and specific requirements for expiring budget authority.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HE3ED1364985D4571BD43B30F9C2418E1"><enum>103.</enum><header>Strengthening congressional review</header> <subsection id="H4670A1E7FC1041BE8BFDFD53782EC1B8"><enum>(a)</enum><header>In general</header><text>Part B of the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/682">2 U.S.C. 682 et seq.</external-xref>), as amended by section 102(a), is further amended by adding at the end the following:</text> 
<quoted-block style="appropriations" display-inline="no-display-inline" id="H373DCE591CBA47AB9E1A6BB906E9FD64"> 
<section commented="no" id="H964DC025FC39464FAD0D0E909301B222"><enum>1019.</enum><header>Reporting on apportionment of appropriations by departments and agencies</header><text display-inline="yes-display-inline">Each department or agency shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H84510009F82C4A119FDF84178D797DDE"><enum>(1)</enum><text display-inline="yes-display-inline">notify the Committee on the Budget and the Committee on Appropriations of the House of Representatives, the Committee on the Budget and the Committee on Appropriations of the Senate, and any other appropriate congressional committees if—</text> 
<subparagraph commented="no" id="HCD3C3A1A62EC448FB096C055A900CE33"><enum>(A)</enum><text>an apportionment is not made in the required time period provided in section 1513(b) of title 31, United States Code;</text></subparagraph> <subparagraph commented="no" id="H2417CD207F884C37B31E674180874A65"><enum>(B)</enum><text>an approved apportionment received by the department or agency conditions the availability of an appropriation on further action; or</text></subparagraph> 
<subparagraph commented="no" id="H0C0F8935D04F43239230B1C18E5C6DA5"><enum>(C)</enum><text>an approved apportionment received by the department or agency may hinder the prudent obligation of such appropriation or the execution of a program, project, or activity by such department or agency; and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H520BD73589E045C58A0664CAEB296A2D"><enum>(2)</enum><text display-inline="yes-display-inline">include in each notification under paragraph (1) information identifying the bureau, account name, appropriation name, and Treasury Appropriation Fund Symbol or fund account.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5E89DFFF2CC241978A001FEA0D15DAEF"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Congressional Budget and Impoundment Control Act of 1974 set forth in section 1(b) of such Act, as amended by section 102(b), is further amended by inserting after the item relating to section 1018 the following:</text> <quoted-block style="appropriations" display-inline="no-display-inline" id="HFC29229E44B649C794744C8DB0B49E81"> <toc regeneration="no-regeneration"> <toc-entry level="section">1019. Reporting on apportionment of appropriations by departments and agencies.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H97A74BF3934C4261BCBCB54A9FD03EDD"><enum>104.</enum><header>Updated authorities for and reporting by the Comptroller General</header> <subsection id="H2B9E169626154505BE578CAB898407D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1015 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/686">2 U.S.C. 686</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H5DB0AA14300243E698253EFAD27C352E"><enum>(c)</enum><header>Review</header> 
<paragraph id="HFCCF33715AEC4A3F97343D8662E90795"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General shall—</text> <subparagraph id="H4DF35CA5B25F423F9D72B16F02694F99"><enum>(A)</enum><text display-inline="yes-display-inline">review compliance with this part; and</text></subparagraph> 
<subparagraph id="HEF19C8FB51B34774A338C59705885B97"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the Committee on the Budget, the Committee on Appropriations, and the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on the Budget, the Committee on Appropriations, and the Committee on Oversight and Reform of the House of Representatives, and any other appropriate congressional committee of the Senate or the House of Representatives a report, and any relevant information related to the report, on any noncompliance with this part.</text></subparagraph></paragraph> <paragraph id="HF388C47636F44C66AB33AD6D4FEE5EEE"><enum>(2)</enum><header>Information, documentation, and views</header><text display-inline="yes-display-inline">The President or the head of the relevant department or agency of the United States shall provide information, documentation, and views to the Comptroller General, as is determined by the Comptroller General to be necessary to determine such compliance, not later than 20 days after the date on which the request from the Comptroller General is received, or if the Comptroller General determines that a shorter or longer period is appropriate based on the specific circumstances, within such shorter or longer period.</text></paragraph> 
<paragraph id="HB8AFD2E8589B49C3AAED7E24EBC09D5C"><enum>(3)</enum><header>Access</header><text display-inline="yes-display-inline">To carry out the responsibilities of this part, the Comptroller General shall have access to interview the officers, employees, contractors, and other agents and representatives of a department, agency, or office of the United States at any reasonable time as the Comptroller General may request.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H9DA6666DAF4942B584FEA1E1F11CE1BB"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Section 1001 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/681">2 U.S.C. 681</external-xref>) is amended—</text> 
<paragraph id="H8C39F4432A5D44D0A553545BBC3589EC"><enum>(1)</enum><text>in paragraph (3), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="H4B3069031E824FFB808250F164E0C84D"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H07105BE52CC4416CA6512B5373592F73"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H119667DDC0F24D2F8E4805D572BC87E3"> <paragraph id="HDF32E70611B04C9880EC3ED491F70444"><enum>(5)</enum><text>affecting or limiting in any way the authorities provided to the Comptroller General under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/7">chapter 7</external-xref> of title 31, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section commented="no" id="H71C248B8BDA34260851A134AD321AD40"><enum>105.</enum><header>Advance congressional notification and litigation</header><text display-inline="no-display-inline">Section 1016 of the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/687">2 U.S.C. 687</external-xref>) is amended to read as follows:</text> <quoted-block id="HE0E489563E8F4A53872110BAAC982E39" display-inline="no-display-inline" style="traditional"> <section commented="no" id="H100A4501520B470EBB6425860D2AD8B6"><enum>1016.</enum><header>Suits by Comptroller General</header> <subsection commented="no" display-inline="yes-display-inline" id="HBCC097F3D71243108F4D668C6D3713D2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If, under this title, budget authority is required to be made available for obligation and such budget authority is not made available for obligation or information, documentation, views, or access are required to be produced and such information, documentation, views, or access are not produced, the Comptroller General is expressly empowered, through attorneys selected by the Comptroller General, to bring a civil action in the United States District Court for the District of Columbia to require such budget authority to be made available for obligation or such information, documentation, views, or access to be produced.</text></subsection> 
<subsection commented="no" id="H1CF4D6A3CD51487C91C062ED3C07714D"><enum>(b)</enum><header>Court authority</header><text display-inline="yes-display-inline">In a civil action under subsection (a), the court is expressly empowered to enter, against any department, agency, officer, or employee of the United States, any decree, judgment, or order which may be necessary or appropriate to make such budget authority available for obligation or compel production of such information, documentation, views, or access.</text></subsection> <subsection id="H99812A6AE5D44838987A7C9275C712FC" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">No civil action shall be brought by the Comptroller General to require budget authority be made available under this section until the expiration of 15 calendar days following the date on which an explanatory statement by the Comptroller General of the circumstances giving rise to the action contemplated is filed with the Speaker of the House of Representatives and the President of the Senate, except that expiration of such period shall not be required if the Comptroller General finds (and incorporates the finding in the explanatory statement filed) that such delay would be contrary to the public interest.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection id="HCEA4429DBE1F4E2C8DE939A1AF6B0B5A"><enum>(a)</enum><header>In general</header><text>Part B of the Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/682">2 U.S.C. 682 et seq.</external-xref>), as amended by section 103(a), is further amended by adding at the end the following:</text> <quoted-block style="appropriations" display-inline="no-display-inline" id="H74059744D6314F3DA0AB49B2D4B2BEE7"> <section id="H201F4EB58BBD445FA56206900DD6827C"><enum>1020.</enum><header>Penalties for failure to comply</header> <subsection commented="no" display-inline="yes-display-inline" id="HF4AC77D17BE84BACB00637C32CFED2B9"><enum>(a)</enum><header>Administrative discipline</header><text display-inline="yes-display-inline">An officer or employee of the United States Government who withholds or causes to be withheld the obligation of budget authority that is required to be made available for obligation under this part shall be subject to appropriate administrative discipline, including, when circumstances warrant, suspension from duty without pay or removal from office.</text></subsection> 
<subsection id="H2363B2F3957B42B684FC68EFEB16F980"><enum>(b)</enum><header>Criminal penalty</header><text display-inline="yes-display-inline">An officer or employee of the United States Government who knowingly and willfully withholds or causes to be withheld the obligation of budget authority that is required to be made available for obligation under this part shall be fined not more than $5,000, imprisoned for not more than 2 years, or both.</text></subsection> <subsection id="H98E4F661C834430D9F5DA4F09591A612"><enum>(c)</enum><header>Reporting violations</header> <paragraph id="HB94E78873EC5439A8483B59542525FC8"><enum>(1)</enum><header>In general</header><text>In the event of a violation of section 1001, 1012, 1013, or 1018 of this part, or in the case that the Comptroller General issues a legal decision concluding that a department, agency, or office of the United States violated this part, the President or the head of the relevant department or agency as the case may be, shall report immediately to Congress all relevant facts and a statement of actions taken. A copy of each report shall also be transmitted to the Comptroller General and the relevant inspector general on the same date the report is transmitted to the Congress.</text></paragraph> 
<paragraph id="H48BEE9EA942A4F51BCB4E4B4B017EDAE"><enum>(2)</enum><header>Contents</header><text>Any such report shall include a summary of the facts pertaining to the violation, the title and Treasury Appropriation Fund Symbol of the appropriation or fund account, the amount involved for each violation, the date on which the violation occurred, the position of any individuals responsible for the violation, a statement of the administrative discipline imposed and any further action taken with respect to any officer or employee involved in the violation, a statement of any additional action taken to prevent recurrence of the same type of violation, and any written response by any officer or employee identified by position as involved in the violation. In the case that the Comptroller General issues a legal decision concluding that a department, agency, or office of the United States violated this part and the relevant department, agency, or office does not agree that a violation has occurred, the report provided to Congress, the Comptroller General, and relevant inspector general will explain the position of the department, agency, or office.</text></paragraph> <paragraph id="H96BE3F7254CB4D96A96D41D9A0F7C226" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Opportunity to respond</header><text display-inline="yes-display-inline">If any such report identifies the position of any officer or employee as involved in the violation, such officer or employee shall be provided a reasonable opportunity to respond in writing, and any such response shall be appended to the report.</text></paragraph></subsection> 
<subsection id="HB4DE6CE735104ED0BF8B207E08244DFA"><enum>(d)</enum><header>Attorney General review of reports</header><text display-inline="yes-display-inline">In the case that a report is transmitted under subsection (c), the Attorney General shall promptly review such report and investigate to the extent necessary to determine whether there are reasonable grounds to believe that the responsible officer or employee knowingly and willfully violated section 1001, 1012, 1013, or 1018 of this part, as applicable. If the Attorney General determines that there are such reasonable grounds, the Attorney General diligently shall investigate a criminal violation under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H68DCF07511C5480883233F1847624F05"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Congressional Budget and Impoundment Control Act of 1974 set forth in section 1(b) of such Act, as amended by section 103(b), is further amended by inserting after the item relating to section 1019 the following:</text>

                                </clause>

                                </clause>
                            </subparagraph>

 <text>Such report shall include, with respect to any transfer, reprogramming, or repurposing of funds to address the applicable national emergency—</text>

                            </subparagraph>
                        </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle> 
<subtitle id="H10801D1321FB44739751B79DC266F23C"><enum>B</enum><header>Empowering Congressional Review Through Nonpartisan Congressional Agencies and Transparency Initiatives</header> 
<section id="HE83CACC21B6B411485DC9D804E6C62D0"><enum>221.</enum><header>Requirement to respond to requests for information from the Comptroller General for budget and appropriations law decisions</header> 
<subsection id="H6343AE6E2D154238895DAB1A4E64469C"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/7">chapter 7</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="HE9D451DAB0C845F0830DAECFF2C9F67F"> <section id="HE0A8DAAE5ED541BBA907BF488BE134DC"><enum>722.</enum><header>Requirement to respond to requests for information from the Comptroller General for budget and appropriations law decisions</header> <subsection id="H9F58C541CA6541BD97106012059AF356"><enum>(a)</enum><text>If an agency receives a written request for information, documentation, or views from the Comptroller General relating to a decision or opinion on budget or appropriations law, the agency shall provide the requested information, documentation, or views not later than 20 days after receiving the written request, unless such written request specifically provides otherwise.</text></subsection> 
<subsection id="H843D6E373C6744BAAF2B8814F5FEACBE"><enum>(b)</enum><text>If an agency fails to provide the requested information, documentation, or views within the time required by subsection (a)—</text> <paragraph id="HC135B48957274979A7F4C882F320804A"><enum>(1)</enum><text>the Comptroller General shall notify, in writing, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Oversight and Accountability of the House of Representatives, and any other appropriate congressional committee of such failure;</text></paragraph> 
<paragraph id="H2EEBE90267BD4D758F2EC23C0F0C0E81"><enum>(2)</enum><text>the Comptroller General is hereby expressly empowered, through attorneys selected by the Comptroller General, to bring a civil action in the United States District Court for the District of Columbia to require such information, documentation, or views to be produced; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8AAA758BB1E44751BE6948937B2D2A16"><enum>(3)</enum><text display-inline="yes-display-inline">the court in a civil action brought under paragraph (2) is expressly empowered to enter against any department, agency, officer, or employee of the United States any decree, judgment, or order which may be necessary or appropriate to require such production.</text></paragraph></subsection> 
<subsection id="HD4A26A9DEA2946BE9A64AC56B2E0D6F9"><enum>(c)</enum><text>Nothing in this section shall be construed as affecting or otherwise limiting the authorities provided to the Comptroller General in section 716 of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF80EF7FAF419497B915FF357565EE331"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/7">chapter 7</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/721">section 721</external-xref> the following:</text>

<subsection id="H280280BE17714234BB1EC9C72F4B3288"><enum>(c)</enum><text display-inline="yes-display-inline">If the Comptroller General finds that an officer or employee of an executive agency or an officer or employee of the District of Columbia government violated section 1341(a) or 1342 of this title, and that the head of the agency or the Mayor of the District of Columbia has failed to make the report required under subsection (a), the Comptroller General shall make a report on the violation of section 1341(a) or 1342 and any available information concerning it to both Houses of Congress.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4B19EB63236141739730B048A9FDE3C5"><enum>(b)</enum><header>Violations of section 1517</header><text>Section 1517 of title 31, United States Code, is amended—</text> 
<paragraph id="HFBC6F2E0EAEF430DA156BCA1821A03D1"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H63B42BF6F7AF41C5977F1B427B50C76A"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or if the Comptroller General determines that an officer or employee of an executive agency or of the District of Columbia government violated subsection (a),</quote> before <quote>the head of the executive agency</quote>; and</text></subparagraph> 
<subparagraph id="H7D174A2385E543E5848AF18F8B4307A3"><enum>(B)</enum><text>by striking <quote>the Comptroller General</quote> and inserting <quote>the Comptroller General and the Attorney General</quote>; and</text></subparagraph></paragraph> <paragraph id="H4C6D9BA650B74221B7EEB63F1C64E32C"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3917B2524D5346C88D1414A2CDAB17D3"> 
<subsection id="H7655BD70FE554FA893AF09BF65803952"><enum>(c)</enum><text>Any such report shall include a statement of the provision violated, a summary of the facts pertaining to the violation, the title and Treasury Appropriation Fund Symbol of the appropriation or fund account, the amount involved for each violation, the date on which the violation occurred, the position of any officer or employee responsible for the violation, a statement of the administrative discipline imposed and any further action taken with respect to any officer or employee involved in the violation, a statement of any additional action taken to prevent recurrence of the same type of violation, a statement of any determination that the violation was not knowing and willful that has been made by the executive agency or the District of Columbia government, and any written response by any officer or employee identified by position as involved in the violation. In the case that the Comptroller General issues a legal decision concluding that subsection (a) was violated and the executive agency or the District of Columbia government does not agree that a violation has occurred, the report provided to the President, the Congress, and the Comptroller General will explain the position of the executive agency or the District of Columbia government.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H9A91AE05F6684509AA6DA1902FE247E3"><enum>223.</enum><header>Department of Justice reporting to Congress for Antideficiency Act violations</header> <subsection id="HB60A1678049A4A07968254F7D88D0645"><enum>(a)</enum><header>Violations of sections 1341 or 1342</header><text>Section 1350 of title 31, United States Code, is amended—</text> 
<paragraph id="HAFB00693C3F24674864A214FE55FB9CF"><enum>(1)</enum><text>by striking <quote>An officer</quote> and inserting <quote>(a) An officer</quote>; and</text></paragraph> <paragraph id="H05B03FA1CDFE493F86BD3A48082BFF77"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H68247C91DC6B4DEEA06297316595BBE6"> 
<subsection id="H8B3D7964BB03491B85E913B532843D2E"><enum>(b)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA704A7A28AB84CDC8E2FB5E7D462E600"><enum>(1)</enum><text>If an executive agency or the District of Columbia government reports, under section 1351, a violation of section 1341(a) or 1342, the Attorney General shall promptly review such report and investigate to the extent necessary to determine whether there are reasonable grounds to believe that the responsible officer or employee knowingly and willfully violated such section 1341(a) or 1342, as applicable. If the Attorney General determines that there are such reasonable grounds, the Attorney General diligently shall investigate a criminal violation under this section.</text></paragraph> <paragraph id="HA8FD12A058A543AD92A5BF0E4E7017F0" indent="up1"><enum>(2)</enum><text>The Attorney General shall submit to Congress and the Comptroller General on or before March 31 of each calendar year an annual report detailing separately for each executive agency and for the District of Columbia government—</text> 
<subparagraph id="H80F1AB052E0648F5818664F01DADB94E"><enum>(A)</enum><text>the number of reports under section 1351 transmitted to the President during the preceding calendar year;</text></subparagraph> <subparagraph id="HC9F4A375AA7A4FA887600CC2585B389F"><enum>(B)</enum><text>the number of reports reviewed in accordance with paragraph (1) during the preceding calendar year;</text></subparagraph> 
<subparagraph id="H0AC28C20CD334B3FAEBA9A802277E5EF"><enum>(C)</enum><text>without identification of any individual officer or employee, a description of each investigation undertaken in accordance with paragraph (1) during the preceding calendar year and an explanation of the status of any such investigation; and</text></subparagraph> <subparagraph id="H948933C962B64A7A89FF819967548199"><enum>(D)</enum><text>without identification of any individual officer or employee, an explanation of any update to the status of any review or investigation previously reported pursuant to this paragraph.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1396FDA3E3F6401386A64065B9E7767C"><enum>(b)</enum><header>Violations of section 1517</header><text>Section 1519 of title 31, United States Code, is amended—</text> <paragraph id="HDDC8A0E4489B46CBB26DAFFC052330DA"><enum>(1)</enum><text>by striking <quote>An officer</quote> and inserting <quote>(a) An officer</quote>; and</text></paragraph> 
<paragraph id="H02A37008A1814480BC220117F68368C8"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H05E0CD6E7AAF494CB466D1657D19FF21"> <subsection id="HE8B3ADC630214C77B735F3F8A5AF3DAD"><enum>(b)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H90CD32E1A86A43328CF79F3E4FF48B51"><enum>(1)</enum><text>If an executive agency or the District of Columbia government reports, under section 1517(b), a violation of section 1517(a), the Attorney General shall promptly review such report and investigate to the extent necessary to determine whether there are reasonable grounds to believe that the responsible officer or employee knowingly and willfully violated such section 1517(a). If the Attorney General determines that there are such reasonable grounds, the Attorney General diligently shall investigate a criminal violation under this section.</text></paragraph> 
<paragraph id="H8706BE5B61C2408FB1559D97E973A79D" indent="up1"><enum>(2)</enum><text>The Attorney General shall submit to Congress and the Comptroller General on or before March 31 of each calendar year an annual report detailing separately for each executive agency and for the District of Columbia government—</text> <subparagraph id="H63F4431BBE764C8D97489E9890EA518B"><enum>(A)</enum><text>the number of reports under section 1517(b) transmitted to the President during the preceding calendar year;</text></subparagraph> 
<subparagraph id="H8D155F3375F24650AE3A2120DE207E5A"><enum>(B)</enum><text>the number of reports reviewed in accordance with paragraph (1) during the preceding calendar year;</text></subparagraph> <subparagraph id="HD1248A8D63B949C6A304830ABD202686"><enum>(C)</enum><text>without identification of any individual officer or employee, a description of each investigation undertaken in accordance with paragraph (1) during the preceding calendar year and an explanation of the status of any such investigation; and</text></subparagraph> 
<subparagraph id="H1EA1BA2E690744D1A59DD13F87218F7A"><enum>(D)</enum><text>without identification of any individual officer or employee, an explanation of any update to the status of any review or investigation previously reported pursuant to this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H0872496E562147C7B0E64DDE40006DC5"><enum>224.</enum><header>Treatment of requests for information from Members of Congress</header><text display-inline="no-display-inline">Section 552(d) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>), is amended, in the second sentence, by inserting <quote>or any Member of Congress</quote> before the period at the end.</text></section> 
<section id="HF4403B76E0194A3080FFDB4BC3BA39A6" section-type="subsequent-section"><enum>225.</enum><header>Suits by Comptroller General for Antideficiency Act violations</header> 
<subsection id="H90DAEEAF0C984479877CF541147F74D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/7">chapter 7</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H303B1529316D4C5893C43A8B385659E2" display-inline="no-display-inline"> <section id="HDE75E31C2A4A466F8B292F9FEC0F656E"><enum>722.</enum><header>Suits by Comptroller General for ongoing Antideficiency Act violations</header><text display-inline="no-display-inline">If the Comptroller General determines that an individual is committing an ongoing violation of section 1341(a), 1342, or 1517(a), the Comptroller General may, through attorneys of his own selection, bring a civil action in the United States District Court for the District of Columbia, and such court is hereby expressly empowered to enter in such civil action, against any department, agency, officer, or employee of the United States, any decree, judgment, or order, which may be necessary or appropriate to stop the ongoing violation.</text></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H82976754C327465687D99EF30334C1E4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such subchapter is amended by adding after the item relating to section 721 the following:</text> <quoted-block style="USC" id="HE273D0DD732A4BA3B0E43EA5CE2A4D2E" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">722. <subsection id="H9EC29734537041EEB07D3ED2190B2008"><enum>(b)</enum><header>Special provisions concerning the Inspector General of the Office of Management and Budget</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">Chapter 4</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/424">section 424</external-xref> the following new section:</text> <quoted-block style="USC" id="HFE3A130DE25041F192C399C9DC6A4EA8" display-inline="no-display-inline"> <section id="H4A86E28AC8D34338A83AA876038E2C74"><enum>425.</enum><header>Special provisions concerning the Inspector General of the Office of Management and Budget</header><text display-inline="no-display-inline">The Inspector General of the Office of Management and Budget shall only have jurisdiction over those matters that—</text> 
<paragraph id="HD5EAFA5570C74992B9E311A949AB35C9"><enum>(1)</enum><text display-inline="yes-display-inline">have been specifically assigned to the Office under law;</text></paragraph> <paragraph id="HD29B18325F964AED91C0387D12065E6D"><enum>(2)</enum><text>are legal requirements delegated to the Office; or</text></paragraph> 
<paragraph id="H729FF69F475B4BDEB23D639D4DFC2849"><enum>(3)</enum><text>otherwise involve compliance with legal requirements.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HCDAC0495CB1248E08734437787EC1A57"><enum>(c)</enum><header>Appointment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the President shall appoint an individual to serve as the Inspector General of the Office of Management and Budget in accordance with section 403(a) of title 5, United States Code.</text></subsection></section> 
<section id="H6BBD83E99646440CBA31DCD5E73511CC"><enum>227.</enum><header>Publication of budget or appropriations law opinions of the Department of Justice Office of Legal Counsel</header> 
<subsection id="HC895D78FCA1842C984ADC65F723C72BF"><enum>(a)</enum><header>Schedule of publication for final OLC opinions</header><text>Each final OLC opinion shall be made available on its public website in a manner that is searchable, sortable, and downloadable in its entirety as soon as is practicable, but—</text> <paragraph id="H2934A6D11F474F19905B82E0F18D84A1"><enum>(1)</enum><text>not later than 30 days after the opinion is issued or updated if such action takes place on or after the date of enactment of this Act;</text></paragraph> 
<paragraph id="H2613B1A9E49141DDBCF08AED9D290DD5"><enum>(2)</enum><text>not later than 1 year after the date of enactment of this Act for an opinion issued on or after January 20, 1993;</text></paragraph> <paragraph id="HE6CB233ACD9C47D082D958071FBFE635"><enum>(3)</enum><text>not later than 2 years after the date of enactment of this Act for an opinion issued on or after January 20, 1981, and before or on January 19, 1993;</text></paragraph> 
<paragraph id="HC47C44E152ED4E67BBF5174A9369AF57"><enum>(4)</enum><text>not later than 3 years after the date of enactment of this Act for an opinion issued on or after January 20, 1969, and before or on January 19, 1981; and</text></paragraph> <paragraph id="HBBB2A9E3C49542F7A0DDB5F77C083F1A"><enum>(5)</enum><text>not later than 4 years after the date of enactment of this Act for all other opinions.</text></paragraph></subsection> 
<subsection id="H7BBAF14B7CEC452A8BEEBF3948C34A6C"><enum>(b)</enum><header>Exceptions and limitation on public availability of final OLC opinions</header> 
<paragraph id="H0E7B3D03881E4CB5BA17DA021F4DC8DE"><enum>(1)</enum><header>In general</header><text>A final OLC opinion or part thereof may be withheld only to the extent—</text> <subparagraph id="HE6ABA4A160EF40ED8434E4F068BB2CA2"><enum>(A)</enum><text>information contained in the opinion was—</text> 
<clause id="HD285C9131ECE48359C8374D919A76BDD"><enum>(i)</enum><text>specifically authorized to be kept secret, under criteria established by an Executive order, in the interest of national defense or foreign policy;</text></clause> <clause id="H19B2443D16254CF7909A48252D65B294"><enum>(ii)</enum><text>properly classified, including all procedural and marking requirements, pursuant to such Executive order;</text></clause> 
<clause id="H2F28D480F2ED44F882FA9CE610D96CD7"><enum>(iii)</enum><text>the Attorney General determines that the national defense or foreign policy interests protected outweigh the public’s interest in access to the information; and</text></clause> <clause id="H30AF36D45DFD44B8B9B7FBF92E73DF24"><enum>(iv)</enum><text>put through declassification review within the past two years;</text></clause></subparagraph> 
<subparagraph id="H54436366E0774B7496B80B7290DA29EA"><enum>(B)</enum><text>information contained in the opinion relates to the appointment of a specific individual not confirmed to Federal office;</text></subparagraph> <subparagraph id="HF39881796B0849AA807E0218B4308DE8"><enum>(C)</enum><text>information contained in the opinion is specifically exempted from disclosure by statute (other than sections 552 and 552b of title 5, United States Code), if such statute—</text> 
<clause id="H5ABFFF0D28084DA3A7D467FCBFB2CDBB"><enum>(i)</enum><text>requires that the material be withheld in such a manner as to leave no discretion on the issue; or</text></clause> <clause id="HF8F9B1E411054CA296E76550F5BD0987"><enum>(ii)</enum><text>establishes particular criteria for withholding or refers to particular types of material to be withheld;</text></clause></subparagraph> 
<subparagraph id="HF869082F9A3C47B9B4346D03F48BC4CA"><enum>(D)</enum><text>information in the opinion includes trade secrets and commercial or financial information obtained from a person and privileged or confidential whose disclosure would likely cause substantial harm to the competitive position of the person from whom the information was obtained;</text></subparagraph> <subparagraph id="HD9CFF548C8E3406B8F89CBF28D6246CF"><enum>(E)</enum><text>the President, in his or her sole and nondelegable determination, formally and personally claims in writing that executive privilege prevents the release of the information and disclosure would cause specific identifiable harm to an interest protected by an exception or the disclosure is prohibited by law; or</text></subparagraph> 
<subparagraph id="H7A3DF9560F654D51AC2C7BD264DB99CF"><enum>(F)</enum><text>information in the opinion includes personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.</text></subparagraph></paragraph> <paragraph id="HDF95002381F647F491FBBABDB683ABEF"><enum>(2)</enum><header>Determination to withhold</header><text>Any determination under this subsection to withhold information contained in a final OLC opinion shall be made by the Attorney General or a designee of the Attorney General. The determination shall be—</text> 
<subparagraph id="HF1A35744C2114783A289D665FEDC0CF4"><enum>(A)</enum><text>in writing;</text></subparagraph> <subparagraph id="H2F7636C229D94A18A660D07238D57007"><enum>(B)</enum><text>made available to the public within the same timeframe as is required of a formal OLC opinion;</text></subparagraph> 
<subparagraph id="HB1599EFC6C3647CC8A70182D609C72C0"><enum>(C)</enum><text>sufficiently detailed as to inform the public of what kind of information is being withheld and the reason therefore; and</text></subparagraph> <subparagraph id="H3C9C425B1D57426387F1A461A12E42EF"><enum>(D)</enum><text>effective only for a period of 3 years, subject to review and reissuance, with each reissuance made available to the public.</text></subparagraph></paragraph> 
<paragraph id="HE06B8756429D4BD08297269296EEE77C"><enum>(3)</enum><header>Final opinions</header><text>For final OLC opinions for which the text is withheld in full or in substantial part, a detailed unclassified summary of the opinion shall be made available to the public, in the same timeframe as required of the final OLC opinion, that conveys the essence of the opinion, including any interpretations of a statute, the Constitution, or other legal authority. A notation shall be included in any published list of final OLC opinions regarding the extent of the withholdings.</text></paragraph> <paragraph id="H79FF6C09F082401FB57FD21DB93F58DC"><enum>(4)</enum><header>No limitation on freedom of information</header><text>Nothing in this subsection shall be construed as limiting the availability of information under section 552 of title 5, United States Code or construed as an exemption under paragraph (3) of subsection (b) of such section.</text></paragraph> 
<paragraph id="H942C4CC5A12D47E8A231F7E09188747A"><enum>(5)</enum><header>No limitation on relief</header><text>A decision by the Attorney General to release or withhold information pursuant to this title shall not preclude any action or relief conferred by statutory or regulatory regime that empowers any person to request or demand the release of information.</text></paragraph> <paragraph id="HB146D82B27314A7FBA8A80E2C416B3C5"><enum>(6)</enum><header>Reasonably segregable portions of opinions to be published</header><text>Any reasonably segregable portion of an opinion shall be provided after withholding of the portions which are exempt under this section. The amount of information withheld, and the exemption under which the withholding is made, shall be indicated on the released portion of the opinion, unless including that indication would harm an interest protected by the exemption in this paragraph under which the withholding is made. If technically feasible, the amount of the information withheld, and the exemption under which the withholding is made, shall be indicated at the place in the opinion where such withholding is made.</text></paragraph></subsection> 
<subsection id="H869A38E69E494AAA83892E5A22D005E5"><enum>(c)</enum><header>Method of publication</header><text>The Attorney General shall publish each final OLC opinion to the extent the law permits, including by publishing the opinions on a publicly accessible website that—</text> <paragraph id="HC57ED517D5C24D23BF8D7B708EB266F6"><enum>(1)</enum><text>with respect to each opinion—</text> 
<subparagraph id="HE9260C5501E245BA94D671E69BE16DBF"><enum>(A)</enum><text>contains an electronic copy of the opinion, including any transmittal letter associated with the opinion, in an open format that is platform independent and that is available to the public without restrictions;</text></subparagraph> <subparagraph id="HC804D7E352E0453FBB8437F7198779F7"><enum>(B)</enum><text>provides the public the ability to retrieve an opinion, to the extent practicable, through searches based on—</text> 
<clause id="H47CBEF4C841241D786CB3DAEC49072A2"><enum>(i)</enum><text>the title of the opinion;</text></clause> <clause id="H43E96F9E833D453B968E3E0A87836C91"><enum>(ii)</enum><text>the date of publication or revision; or</text></clause> 
<clause id="HD1910E827C2648E1A163FCEF7A1A53B1"><enum>(iii)</enum><text>the full text of the opinion;</text></clause></subparagraph> <subparagraph id="H92FCBA3825EB40448822AC25583D1153"><enum>(C)</enum><text>identifies the time and date when the opinion was required to be published, and when the opinion was transmitted for publication; and</text></subparagraph> 
<subparagraph id="H7D1164FF6238462AAD3A6AAA78EA055D"><enum>(D)</enum><text>provides a permanent means of accessing the opinion electronically;</text></subparagraph></paragraph> <paragraph id="H392E136283814FE49D626EEDC0D4D8DB"><enum>(2)</enum><text>includes a means for bulk download of all final OLC opinions or a selection of opinions retrieved using a text-based search;</text></paragraph> 
<paragraph id="H1F0D3432B5364350A10DA9876E15C443"><enum>(3)</enum><text>provides free access to the opinions, and does not charge a fee, require registration, or impose any other limitation in exchange for access to the website; and</text></paragraph> <paragraph id="HE9EA1B55623E43CA954A79FC79F78088"><enum>(4)</enum><text>is capable of being upgraded as necessary to carry out the purposes of this section.</text></paragraph></subsection> 
<subsection id="HA9412AE9BDAA41869BBD2DE4B49286B0"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H59067D085F174A2695A6DEA7744C0232"><enum>(1)</enum><header>OLC opinion</header><text>The term <term>OLC opinion</term> means views on a matter of legal interpretation communicated by the Office of Legal Counsel of the Department of Justice to any other office or agency, or person in an office or agency, in the Executive Branch, including any office in the Department of Justice, the White House, or the Executive Office of the President, and rendered in accordance with sections 511–513 of title 28, United States Code, and relating to—</text> 
<subparagraph id="H9C55C40F35074DAEA31D42925E76522D"><enum>(A)</enum><text>subtitle II, III, V, or VI of title 31, United States Code;</text></subparagraph> <subparagraph id="HC4FEF5570A344602B8E1C473219FEE08"><enum>(B)</enum><text>the Balanced Budget and Emergency Deficit Control Act of 1985;</text></subparagraph> 
<subparagraph id="H96899F30120648D0A374A4D761548FCB"><enum>(C)</enum><text>the Congressional Budget and Impoundment Control Act of 1974; or</text></subparagraph> <subparagraph id="H8B145980A30F4FDD81AC5F41AAB0CF3F"><enum>(D)</enum><text>any appropriations Act, continuing resolution, or other provision of law providing or governing appropriations or budget authority.</text></subparagraph></paragraph> 
<paragraph id="H4D455F6FDB264663BDF62C140EAE8F00"><enum>(2)</enum><header>Final OLC opinion</header><text>The term <term>final OLC opinion</term> means an OLC opinion that—</text> <subparagraph id="HF997D881BFF5498A86FC8C7523A8CA6E"><enum>(A)</enum><text>the Attorney General, Assistant Attorney General for the Office of Legal Counsel, or a Deputy Assistant Attorney General for the Office of Legal Counsel, has determined is final; or</text></subparagraph>

<section id="H5D5B7B86DDB248F0BA7E700B2B875118" changed="not-changed"> <enum>311.</enum> <header>Congressional review of national emergencies</header> <text display-inline="no-display-inline">The National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621 et seq.</external-xref>) is amended by inserting after title I the following:</text> <quoted-block style="OLC" id="H28C55E779EC84869BCA9F81210147EF0" display-inline="no-display-inline" changed="not-changed"> <title id="H6D26CE7BE59345928E3C69AAD0E795A0" changed="not-changed"> <enum>II</enum> <header>Declarations of future national emergencies</header> <section id="H95E1C5F66F0F4102AD86E52D3A7D6AA8" changed="not-changed"> <enum>201.</enum> <header>Declarations of national emergencies</header> <subsection id="HAF9BF314EFAD42CDBE1D3AEB79470265" changed="not-changed"> <enum>(a)</enum> <header>Authority To declare national emergencies</header> <text>With respect to Acts of Congress authorizing the exercise, during the period of a national emergency, of any special or extraordinary power, the President is authorized to declare such a national emergency by proclamation. Such proclamation shall immediately be transmitted to Congress and published in the Federal Register.</text> </subsection>

<paragraph id="H09286B6EC4C1436BA6FFE84BF9297A3E" changed="not-changed"> <enum>(2)</enum> <text>one or more Executive orders relating to the emergency published in the Federal Register and transmitted to Congress.</text> </paragraph> </subsection> <subsection commented="no" id="H84415AD533FC4CF58E14B9D06F24F31E" changed="not-changed"> <enum>(c)</enum> <header>Prohibition on subsequent actions if emergencies not approved</header> <paragraph commented="no" id="HF10C06A453E24929B97A072676BEA0E5" changed="not-changed"> <enum>(1)</enum> <header>Subsequent declarations</header> <text>If a joint resolution of approval is not enacted under section 203 with respect to a national emergency before the expiration of the 45-day period described in section 202(a), or with respect to a national emergency proposed to be renewed under section 202(b), the President may not, during the remainder of the term of office of that President, declare a subsequent national emergency under subsection (a) with respect to the same circumstances.</text> </paragraph>

<section id="H23D8E8BFF955429C9ED9659D48536295" changed="not-changed"> <enum>202.</enum> <header>Effective periods of national emergencies</header> 
<subsection id="H2331591821B746B1A8837CB5AEF4A6B6" changed="not-changed"> <enum>(a)</enum> <header>Temporary effective periods</header> 
<paragraph id="H6C17DE62EFBA4E29B94175BDF8B9C3CE" changed="not-changed"> <enum>(1)</enum> <header>In general</header> <text>A declaration of a national emergency shall remain in effect for a period of 45 calendar days from the issuance of the proclamation under section 201(a) (not counting the day on which the proclamation was issued) and shall terminate when such period expires unless there is enacted into law a joint resolution of approval under section 203 with respect to the proclamation.</text> </paragraph> <paragraph id="H4940AA98F9C146FABFF36F22E15FFD15" changed="not-changed"> <enum>(2)</enum> <header>Exercise of powers and authorities</header> <text>Any emergency power or authority made available under a provision of law specified pursuant to section 201(b) may be exercised pursuant to a declaration of a national emergency for a period of 45 calendar days from the issuance of the proclamation or Executive order (not counting the day on which such proclamation or Executive order was issued). That power or authority may not be exercised after such period expires unless there is enacted into law a joint resolution of approval under section 203 approving—</text> 
<subparagraph id="HEB609787B19949A88EBF2D742A0178CF" changed="not-changed"> <enum>(A)</enum> <text>the proclamation of the national emergency or the Executive order; and</text> </subparagraph> <subparagraph id="HA26D14A452EC42AC93F70E4D632AFEAD" changed="not-changed"> <enum>(B)</enum> <text>the exercise of the power or authority specified by the President in such proclamation or Executive order.</text> </subparagraph> </paragraph> </subsection> 
<subsection id="HFA3FF3D1EE32464BB071D9881DC88855" changed="not-changed"> <enum>(b)</enum> <header>Renewal of national emergencies</header> <text>A national emergency declared by the President under section 201(a) or previously renewed under this subsection through the enactment of a joint resolution of approval, and not already terminated pursuant to subsection (a) or (c), shall terminate on the date that is one year after the President transmitted to Congress the proclamation declaring the emergency or the joint resolution of approval was enacted into law, unless—</text> <paragraph id="H39FAAB9931CA4355AC546AA910C1043E" changed="not-changed"> <enum>(1)</enum> <text>the President publishes in the Federal Register and transmits to Congress an Executive order renewing the emergency; and</text> </paragraph> 
<paragraph id="HA4E7C4D7CA254B60B682B48099D9864F" changed="not-changed"> <enum>(2)</enum> <text>there is enacted into law a joint resolution of approval renewing the emergency pursuant to section 203 before the termination of the emergency or previous renewal of the emergency.</text> </paragraph> </subsection> <subsection id="HC899EE8A1BE74202BA8134B2F1634BAE" changed="not-changed"> <enum>(c)</enum> <header>Termination of national emergencies</header> <paragraph id="HA6CF45EBCBA9448B94DF919960B2B81F" changed="not-changed"> <enum>(1)</enum> <header>In general</header> <text>Any national emergency declared by the President under section 201(a) shall terminate on the earliest of—</text> 
<subparagraph id="HED1244464E3C418096FAA0E5ABD499F7" changed="not-changed"> <enum>(A)</enum> <text>the date provided for in subsection (a);</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA6910B2A85A04BE199822F7E0E051F15" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">the date provided for in subsection (b);</text> </subparagraph> 
<subparagraph id="HC06BB58342FF4B8BBF70C6A2CD5672DB" changed="not-changed"> <enum>(C)</enum> <text>the date specified in an Act of Congress terminating the emergency; or</text> </subparagraph> <subparagraph id="HED37EDA00F2145CC9EA1CDDFD852FFE3" changed="not-changed"> <enum>(D)</enum> <text>the date specified in a proclamation of the President terminating the emergency.</text> </subparagraph> </paragraph> 
<paragraph id="H04F1672938394FEEADD813CF81E1D902" changed="not-changed"> <enum>(2)</enum> <header>Effect of termination</header> 
<subparagraph id="H41BF7FFBB04B48519C3ED2EECB889A8B" changed="not-changed"> <enum>(A)</enum> <header>In general</header> <text>Effective on the date of the termination of a national emergency under paragraph (1)—</text> <clause id="H9880951A3E424FC58559F7DDB6E1430D" changed="not-changed"> <enum>(i)</enum> <text>except as provided by subparagraph (B), any powers or authorities exercised by reason of the emergency shall cease to be exercised;</text> </clause> 
<clause id="HCF638EFB0EAA4083B9A37665227116EE" changed="not-changed"> <enum>(ii)</enum> <text>any amounts reprogrammed or transferred under any provision of law with respect to the emergency that remain unobligated on that date shall be returned and made available for the purpose for which such amounts were appropriated; and</text> </clause> <clause id="H1081CCC3AC064CAC8E6DF9296CB27EE9" changed="not-changed"> <enum>(iii)</enum> <text display-inline="yes-display-inline">any contracts entered into pursuant to authorities provided as a result of the emergency shall be terminated.</text> </clause> </subparagraph> 
<subparagraph id="H114E4293F4604D91AA0070EEE7290D1D" changed="not-changed"> <enum>(B)</enum> <header>Savings provision</header> <text>The termination of a national emergency shall not affect—</text> <clause id="H7AF0663321E04A91B446290EB3FF9ED4" changed="not-changed"> <enum>(i)</enum> <text>any legal action taken or pending legal proceeding not finally concluded or determined on the date of the termination under paragraph (1);</text> </clause> 
<clause id="H81C52F0A96C34B67AAB2E3BB843785B7" changed="not-changed"> <enum>(ii)</enum> <text>any legal action or legal proceeding based on any act committed prior to that date; or</text> </clause> <clause id="H9A4D7A19D8FE4CEEB813EFA94BCE9232" changed="not-changed"> <enum>(iii)</enum> <text>any rights or duties that matured or penalties that were incurred prior to that date.</text> </clause> </subparagraph> </paragraph> </subsection> </section> 
<section id="H1E57A6AC419A4FE3BE13BFEFDC64A3AE" changed="not-changed"> <enum>203.</enum> <header>Review by Congress of national emergencies</header> 
<subsection id="HC46F596EF2D14000BAF83BA12F6648ED" changed="not-changed"> <enum>(a)</enum> <header>Joint resolution of approval defined</header> <text>In this section, the term <term>joint resolution of approval</term> means a joint resolution that contains, after its resolving clause, only—</text> <paragraph id="HD4074986625C49629C7DA539349D7C79" changed="not-changed"> <enum>(1)</enum> <text>a provision approving—</text> 
<subparagraph id="H0A0EE97C69304FCCA6BE1DAC128A20BF" changed="not-changed"> <enum>(A)</enum> <text>a proclamation of a national emergency made under section 201(a);</text> </subparagraph> <subparagraph id="HE528EDAA53544435B210DFB0B77D64B7" changed="not-changed"> <enum>(B)</enum> <text>an Executive order issued under section 201(b)(2); or</text> </subparagraph> 
<subparagraph id="HDEBF8E3280AF4A778EFABD2A90E027D5" changed="not-changed"> <enum>(C)</enum> <text>an Executive order issued under section 202(b); and</text> </subparagraph> </paragraph> <paragraph id="HE70DBCC7A000450390E442469284D441" changed="not-changed"> <enum>(2)</enum> <text>a provision approving a list of all or a portion of the provisions of law specified by the President under section 201(b) in the proclamation or Executive order that is the subject of the joint resolution.</text> </paragraph> </subsection> 
<subsection id="HB24967F9E3924B79939BE2C3E2F5041D" changed="not-changed"> <enum>(b)</enum> <header>Procedures for consideration of joint resolutions of approval</header> 
<paragraph id="H16AB322EC50A48DDB8AC04D90B105BFA" changed="not-changed"> <enum>(1)</enum> <header>Introduction</header> <text>After the President transmits to Congress a proclamation declaring a national emergency under section 201(a), or transmits to Congress an Executive order specifying emergency powers or authorities under section 201(b)(2) or renewing a national emergency under section 202(b), a joint resolution of approval may be introduced in either House of Congress by any member of that House.</text> </paragraph> <paragraph id="H71F5B8374E39476C9385B685A2D2C532" changed="not-changed"> <enum>(2)</enum> <header>Consideration in Senate</header> <text>In the Senate, the following shall apply:</text> 
<subparagraph id="HEFB547932DCA4DC1978CA071C77CD9E6" changed="not-changed"> <enum>(A)</enum> <header>Reporting and discharge</header> <text>If each committee to which a joint resolution of approval has been referred has not reported it at the end of 10 calendar days after its introduction, that committee shall be automatically discharged from further consideration of the resolution and it shall be placed on the calendar.</text> </subparagraph> <subparagraph id="H7FDCC32D5C6F48A88858E45C5A4B0073" changed="not-changed"> <enum>(B)</enum> <header>Proceeding to consideration</header> <text>Notwithstanding Rule XXII of the Standing Rules of the Senate, when each committee to which a joint resolution of approval is referred has reported the resolution, or is discharged under subparagraph (A) from further consideration of the resolution, it is at any time thereafter in order (even though a previous motion to the same effect has been disagreed to) for a motion to proceed to the consideration of the joint resolution, and all points of order against the joint resolution (and against consideration of the joint resolution) are waived. The motion to proceed is subject to 4 hours of debate divided equally between those favoring and those opposing the joint resolution of approval. The motion is not subject to amendment, or to a motion to postpone, or to a motion to proceed to the consideration of other business.</text> </subparagraph> 
<subparagraph id="H3FCE3E1388604FBABC5078580383B139" changed="not-changed"> <enum>(C)</enum> <header>Floor consideration</header> <text>A joint resolution of approval shall be subject to 10 hours of consideration, to be divided evenly between the proponents and opponents of the resolution.</text> </subparagraph> <subparagraph id="H41ADEB2832CA41E9BC747B5397ECF85B" changed="not-changed"> <enum>(D)</enum> <header>Amendments</header> <text>No amendments shall be in order with respect to a joint resolution of approval.</text> </subparagraph> 
<subparagraph id="H608089476551484C94EE360A8A1589C8" changed="not-changed"> <enum>(E)</enum> <header>Motion to reconsider final vote</header> <text>A motion to reconsider a vote on passage of a joint resolution of approval shall not be in order.</text> </subparagraph> <subparagraph id="H6E9DA1A5AD754F5482F72A54298EB812" changed="not-changed"> <enum>(F)</enum> <header>Appeals</header> <text>Points of order, including questions of relevancy, and appeals from the decision of the Presiding Officer, shall be decided without debate.</text> </subparagraph> </paragraph> 
<paragraph id="H1562DF32D0BB4D19B5F2D3B033713DC9" changed="not-changed"> <enum>(3)</enum> <header>Consideration in House of Representatives</header> <text>In the House of Representatives, the following shall apply:</text> <subparagraph id="HFA701EF2E6864D11827E0D7C435F762B" changed="not-changed"> <enum>(A)</enum> <header>Reporting and discharge</header> <text>If each committee to which a joint resolution of approval has been referred has not reported it to the House within 10 calendar days after the date of referral, such committee shall be discharged from further consideration of the joint resolution.</text> </subparagraph> 
<subparagraph id="H65440DFD383A4C7CA4FC6E3709918A2D" changed="not-changed"> <enum>(B)</enum> <header>Proceeding to consideration</header> 
<clause id="H7694ECDD0D6E40359144146904FCAE63" changed="not-changed"> <enum>(i)</enum> <header>In general</header> <text>Beginning on the third legislative day after each committee to which a joint resolution of approval has been referred reports it to the House or has been discharged from further consideration, and except as provided in clause (ii), it shall be in order to move to proceed to consider the joint resolution in the House. All points of order against the motion are waived. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. The motion shall not be debatable. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text> </clause> <clause id="H7C245CC898CD4EFFB56364875E117A2B" changed="not-changed"> <enum>(ii)</enum> <header>Subsequent motions to proceed to joint resolution of approval</header> <text>A motion to proceed to consider a joint resolution of approval shall not be in order after the House has disposed of another motion to proceed on that joint resolution.</text> </clause> </subparagraph> 
<subparagraph id="H700D6AFEA51E46448E798086E2637928" changed="not-changed"> <enum>(C)</enum> <header>Floor consideration</header> <text>Upon adoption of the motion to proceed in accordance with subparagraph (B)(i), the joint resolution of approval shall be considered as read. All points of order against the joint resolution of approval and against its consideration are waived. The previous question shall be considered as ordered on the joint resolution to final passage without intervening motion except two hours of debate, equally divided and controlled by the sponsor of the joint resolution (or a designee) and an opponent. A motion to reconsider the vote on passage of the joint resolution shall not be in order.</text> </subparagraph> <subparagraph id="H302A6477314D456CA285D2F9B9DB1342" changed="not-changed"> <enum>(D)</enum> <header>Amendments</header> <text>No amendments shall be in order with respect to a joint resolution of approval.</text> </subparagraph> </paragraph> 
<paragraph id="H0AA621223B0F4323A21630A8E0D9E35C" changed="not-changed"> <enum>(4)</enum> <header>Receipt of resolution from other House</header> 
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HC87C8B3C8AAA468785949238FA62AFBD"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">If, before passing a joint resolution of approval, one House receives a joint resolution of approval from the other House, then—</text> <clause id="H39C1FA0041064DB2BEA356E5A6CD9F55" changed="not-changed"> <enum>(i)</enum> <text>the joint resolution of the other House shall not be referred to a committee and shall be deemed to have been discharged from committee on the day it is received; and</text> </clause> 
<clause id="H078254BA236344DAAAE239720A109787" changed="not-changed"> <enum>(ii)</enum> <text>the procedures set forth in paragraphs (2) and (3), as applicable, shall apply in the receiving House to the joint resolution received from the other House to the same extent as such procedures apply to a joint resolution of the receiving House.</text> </clause> </subparagraph> <subparagraph id="H106D25C2299743BC8B9FBD443AB598CA"> <enum>(B)</enum> <header>Application to revenue measures</header> <text>The provisions of this paragraph shall not apply in the House of Representatives to a joint resolution of approval that is a revenue measure.</text> </subparagraph> </paragraph> </subsection> 
<subsection id="HF5BCC1BFB56B40A38479B462215F1CD7" changed="not-changed"> <enum>(c)</enum> <header>Rule of construction</header> <text>The enactment of a joint resolution of approval under this section shall not be interpreted to serve as a grant or modification by Congress of statutory authority for the emergency powers of the President.</text> </subsection> <subsection id="HF841909CC43541849378D16427947FCD" changed="not-changed"> <enum>(d)</enum> <header>Rules of the House and Senate</header> <text display-inline="yes-display-inline">This section is enacted by Congress—</text> 
<paragraph id="H8F3340A567C54336B97892819BB443A8" changed="not-changed"> <enum>(1)</enum> <text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in the House in the case of joint resolutions described in this section, and supersedes other rules only to the extent that it is inconsistent with such other rules; and</text> </paragraph> <paragraph id="H3F53FA887598446DA2933B0384DCE308" changed="not-changed"> <enum>(2)</enum> <text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text> </paragraph> </subsection> </section> 
<section id="HE512C50F3D214F00A38C0CA453A3719B" changed="not-changed"> <enum>204.</enum> <header>Applicability</header> <text display-inline="no-display-inline">This title shall apply to a national emergency pursuant to which the President proposes to exercise emergency powers or authorities made available under any provision of law that is not a provision of law described in section 604(a).</text> </section> </title> <after-quoted-block>.</after-quoted-block> </quoted-block> </section> <section id="H6198B9FB6EF64CDFB317BB2E3455FAFE" changed="not-changed"> <enum>312.</enum> <header>Reporting requirements</header> <text display-inline="no-display-inline">Section 401 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1641">50 U.S.C. 1641</external-xref>) is amended—</text> 
<paragraph id="HC5C9A479618D4F57B659E9C6408806F6" changed="not-changed"> <enum>(1)</enum> <text>in subsection (c)—</text> <subparagraph id="HD82B8DC53B3B423ABEA2742313E7CB11" changed="not-changed"> <enum>(A)</enum> <text>in the first sentence by inserting <quote>, and make publicly available</quote> after <quote>transmit to Congress</quote>; and</text> </subparagraph> 
<subparagraph id="HBA1DB0994C874D98A1312849DD7C68F1" changed="not-changed"> <enum>(B)</enum> <text>in the second sentence by inserting <quote>, and make publicly available,</quote> before <quote>a final report</quote>; and</text> </subparagraph> </paragraph> <paragraph id="H97D9104DF47C4253BB01E115A0A69B1C" changed="not-changed"> <enum>(2)</enum> <text>by adding at the end the following:</text>

<subsection id="H1E745B9109704B78B0DF30638295FDD7" changed="not-changed"> <enum>(d)</enum> <header>Report on emergencies</header> <text>The President shall transmit to the entities described in subsection (g), with any proclamation declaring a national emergency under section 201(a) or any Executive order specifying emergency powers or authorities under section 201(b)(2) or renewing a national emergency under section 202(b), a report, in writing, that includes the following:</text> <paragraph id="HC32C972DCA0D4029B8B546732567F1F7" changed="not-changed"> <enum>(1)</enum> <text>A description of the circumstances necessitating the declaration of a national emergency, the renewal of such an emergency, or the use of a new emergency authority specified in the Executive order, as the case may be.</text> </paragraph> 
<paragraph id="H3D0083F01E924586AB3A19B67535A35E" changed="not-changed"> <enum>(2)</enum> <text>The estimated duration of the national emergency, or a statement that the duration of the national emergency cannot reasonably be estimated at the time of transmission of the report.</text> </paragraph> <paragraph id="H4E2404158C2B47FD8865B86C631CA4F1" changed="not-changed"> <enum>(3)</enum> <text>A summary of the actions the President or other officers intend to take, including any reprogramming or transfer of funds, and the statutory authorities the President and such officers expect to rely on in addressing the national emergency.</text> </paragraph> 
<paragraph id="H7E619893432848E3974568555532974F" changed="not-changed"> <enum>(4)</enum> <text display-inline="yes-display-inline">The total expenditures estimated to be incurred by the United States Government during such six-month period which are directly attributable to the exercise of powers and authorities conferred by such declaration.</text> </paragraph> <paragraph id="H5E7E517C1A734565BEC6E353DC58EB6A" changed="not-changed"> <enum>(5)</enum> <text>In the case of a renewal of a national emergency, a summary of the actions the President or other officers have taken in the preceding one-year period, including any reprogramming or transfer of funds, to address the emergency.</text> </paragraph> </subsection> 
<subsection id="HB953B236B76E49A2AE7C06355705642E" changed="not-changed"> <enum>(e)</enum> <header>Provision of information to congress</header> <text display-inline="yes-display-inline">The President shall provide to the entities described in subsection (g) such other information as such entities may request in connection with any national emergency in effect under title II.</text> </subsection> <subsection id="HAD1E88EFDE1444E1A575163CAA1B036B" changed="not-changed"> <enum>(f)</enum> <header>Periodic reports on status of emergencies</header> <text display-inline="yes-display-inline">If the President declares a national emergency under section 201(a), the President shall, not less frequently than every 6 months for the duration of the emergency, report to the entities described in subsection (g) on the status of the emergency, the total expenditures incurred by the United States Government, and the actions the President or other officers have taken and authorities the President and such officers have relied on in addressing the emergency.</text> </subsection> 
<subsection id="H3E56326B09BC4037A017139C50E1B418" changed="not-changed"> <enum>(g)</enum> <header>Entities described</header> <text>The entities described in this subsection are—</text> <paragraph id="H92D0C5D097954ECB970858E01288220B" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">the Speaker of the House of Representatives;</text> </paragraph> 
<paragraph id="H3608D0DC2B47416D9D5E5259AF128E4B" changed="not-changed"> <enum>(2)</enum> <text display-inline="yes-display-inline">minority leader of the House of Representatives;</text> </paragraph> <paragraph id="HBC34F1C2ECE541458E05145821F1CF9E" changed="not-changed"> <enum>(3)</enum> <text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text> </paragraph> 
<paragraph id="H0BCA1F1E6C4849F3AA2DF5F12244AD7F" changed="not-changed"> <enum>(4)</enum> <text>the Committee on Homeland Security and Governmental Affairs of the Senate.</text> </paragraph> </subsection> <after-quoted-block>.</after-quoted-block> </quoted-block> </paragraph> </section> <section id="HB0F0B9F16B804044B0BCA05AB7760406" changed="not-changed"> <enum>313.</enum> <header>Exclusion of certain national emergencies invoking International Emergency Economic Powers Act</header> <subsection id="H1A15540DD5DB4E8CBE95F927501A3484" changed="not-changed"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">The National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), as amended by this subtitle, is further amended by adding at the end the following:</text>

<section id="HCE4C36E985D3477A83598A8420409BC6" changed="not-changed"> <enum>604.</enum> <header>Applicability</header> 
<subsection id="H1A1C0EB6BCF44A0FB102AAB8AEA49D35" changed="not-changed"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">This title shall apply to a national emergency pursuant to which the President proposes to exercise emergency powers or authorities made available under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>).</text> </subsection> <subsection id="HFBF4AF1775424D53B4B295DD753B7DD4" changed="not-changed"> <enum>(b)</enum> <header>Effect of additional powers and authorities</header> <text>This title shall not apply to a national emergency or the exercise of emergency powers and authorities pursuant to the national emergency if, in addition to the exercise of emergency powers and authorities described in subsection (a), the President proposes to exercise, pursuant to the national emergency, any emergency powers and authorities under any other provision of law.</text> </subsection> </section> </title> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="H00E9DD4D5A5F4B70A57253A9FFDE896C" changed="not-changed"> <enum>(b)</enum> <header>Transfer</header> <text display-inline="yes-display-inline">Sections 201, 202, and 301 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), as such sections appeared on the day before the date of the enactment of this Act, are—</text> <paragraph id="HD65D7380C3FA4B9DBE3365A81CF7F797" changed="not-changed"> <enum>(1)</enum> <text>transferred to title VI of such Act (as added by subsection (a));</text> </paragraph> 
<paragraph id="HBC426B76952141D0BAA0CAB8ED836731" changed="not-changed"> <enum>(2)</enum> <text>inserted before section 604 of such title (as added by subsection (a)); and</text> </paragraph> <paragraph id="H138B042C933946F28DE12589FB13CEF0" changed="not-changed"> <enum>(3)</enum> <text>redesignated as sections 601, 602, and 603, respectively.</text> </paragraph> </subsection> 
<subsection id="HE9E7EEEE765E4AF88C03BD33C754EACA" changed="not-changed"> <enum>(c)</enum> <header>Conforming amendment</header> <text display-inline="yes-display-inline">Title II of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), as such title appeared the day before the date of the enactment of this Act, is amended by striking the heading for such title.</text> </subsection> </section> <section id="HC842944D9ECA4F169DF207877C0E300B" changed="not-changed"> <enum>314.</enum> <header>Conforming amendments</header> <subsection id="HBBE6FAFD69E14E99A4907C2B194C0285" changed="not-changed"> <enum>(a)</enum> <header>National Emergencies Act</header> <text display-inline="yes-display-inline">Title III of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1631">50 U.S.C. 1631</external-xref>) is repealed.</text> </subsection> 
<subsection id="H543E6A2772FD4C49A021CE5F1F0D3718" changed="not-changed"> <enum>(b)</enum> <header>International emergency economic powers act</header> <text>Section 207(b) of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1706">50 U.S.C. 1706</external-xref>) is amended by striking <quote>concurrent resolution</quote> each place it appears and inserting <quote>joint resolution</quote>.</text> </subsection> </section> <section id="H09A322BECEB94617AFF1DEDE624D5C96" changed="not-changed"> <enum>315.</enum> <header>Effective date; applicability</header> <subsection id="H55218CBFEFB24EE0869DBCB3790FCDBE" changed="not-changed"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">This title and the amendments made by this title shall—</text> 
<paragraph id="H8F0CDAED2C194E32929600E30C4D6BB4" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">take effect on the date of the enactment of this Act; and</text> </paragraph> <paragraph id="H2276112DD8E040BC8B3E076C0D7CEEC1" changed="not-changed"> <enum>(2)</enum> <text>except as provided in subsection (b), apply with respect to national emergencies declared under section 201 of the National Emergencies Act on or after such date.</text> </paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC191E01180834A93B5D011DAE6F99130" changed="not-changed"> <enum>(b)</enum> <header>Applicability to renewals of existing emergencies</header> <text>With respect to a national emergency declared under section 201 of the National Emergencies Act before the date of the enactment of this Act that would expire or be renewed under section 202(d) of that Act (as in effect on the day before such date of enactment), that national emergency shall be subject to the requirements for renewal under section 202(b) of that Act, as amended by section 311.</text> </subsection> <subsection id="HF0D2127B36E448FF85DA4E8803E8490F" changed="not-changed"> <enum>(c)</enum> <header>Supersession</header> <text display-inline="yes-display-inline">This title and the amendments made by this title shall supersede title II of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621 et seq.</external-xref>) as such title was in effect on the day before the date of enactment of this Act.</text> </subsection> </section> </subtitle> 
<subtitle id="H2DD907C8DE88490A89DB06C9A610195D" style="OLC" changed="not-changed"> <enum>B</enum> <header>Limitations on Emergency Authorities</header> 
<section section-type="subsequent-section" id="HDD9777A47011464D94274701EF012900" changed="not-changed"> <enum>321.</enum> <header>Presidential war powers under Communications Act of 1934</header> <text display-inline="no-display-inline">Section 706 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/606">47 U.S.C. 606</external-xref>) is amended—</text> <paragraph id="HDC3118C9F33C4E90889522C4A5B4CB90"> <enum>(1)</enum> <text>in subsection (c), by inserting <quote>and declares a national emergency</quote> after <quote>in the interest of national security or defense,</quote>; and</text> </paragraph> 
<paragraph id="HC573FF27FFF443FB991F61164338748E"> <enum>(2)</enum> <text>in subsection (d), by striking <quote>there exists</quote> and inserting <quote>a national emergency exists by virtue of there being</quote>.</text> </paragraph> </section> <section id="HD7B9BAEF8556411E9FC1B036F336AB80" changed="not-changed"> <enum>322.</enum> <header>Disclosure to Congress of presidential emergency action documents</header> <subsection id="H1C043EC09D5B47319AF0EE0D3AF4CD85" changed="not-changed"> <enum>(a)</enum> <header>In general</header> <text>Not later than 3 days after the conclusion of the process for approval, adoption, or revision of any presidential emergency action document, the President shall submit that document to the appropriate congressional committees.</text> </subsection> 
<subsection id="HC9C9E0124A9E42E0BDEB4C232E5A7B10" changed="not-changed"> <enum>(b)</enum> <header>Documents in existence before date of enactment</header> <text>Not later than 15 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees all presidential emergency action documents in existence before such date of enactment.</text> </subsection> <subsection id="H699AE11E784B44A687CA612062981FF0" changed="not-changed"> <enum>(c)</enum> <header>Oversight</header> <paragraph id="HE9B7D476CA324A10ACB7CEDF380B50B4" changed="not-changed"> <enum>(1)</enum> <header>Senate</header> <text>The Committee on Homeland Security and Governmental Affairs of the Senate shall have—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD275947D13424CD6A7B406D79CC9352D" changed="not-changed"> <enum>(A)</enum> <text>continuing legislative oversight jurisdiction in the Senate with respect to the proposal, creation, implementation, and execution of presidential emergency action documents; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H37C09584693B46A38865DF5A3AD8B6C8" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">access to any and all presidential emergency action documents.</text> </subparagraph> </paragraph> 
<paragraph id="HF1C5EBF9A25741BBAFE9ED72726474D6" changed="not-changed"> <enum>(2)</enum> <header>House of Representatives</header> <text>The Committee on Oversight and Accountability of the House of Representatives shall have—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4A5A5F908A5643B6B96DD5263C19AE36" changed="not-changed"> <enum>(A)</enum> <text>continuing legislative oversight jurisdiction in the House of Representatives with respect to the proposal, creation, implementation, and execution of presidential emergency action documents; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEEBA9848BBE64217B8E70401E1F434C1" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">access to any and all presidential emergency action documents.</text> </subparagraph> </paragraph> <paragraph id="HA95FC170E6B14A2091FF70EBEB04C51E" changed="not-changed"> <enum>(3)</enum> <header>Duty to cooperate</header> <text>All officers and employees of any Federal agency shall have the duty to cooperate with the exercise of oversight jurisdiction described in this subsection.</text> </paragraph> 
<paragraph id="HFABC1C7B36174E5382FFB2886E032AD8" changed="not-changed"> <enum>(4)</enum> <header>Security clearances</header> <text>The chairpersons and ranking members of the appropriate congressional committees, and designated staff of those committees, shall be granted all security clearances required to access, and granted access to, presidential emergency action documents, including under relevant Presidential or agency special access and compartmented access programs.</text> </paragraph> </subsection> <subsection id="H16D29E663444499EB532449B5CA4FD02" changed="not-changed"> <enum>(d)</enum> <header>Definitions</header> <text>In this section:</text> 
<paragraph id="H5DB563F1854442CAA249BF812D810680" changed="not-changed"> <enum>(1)</enum> <header>Appropriate congressional committees</header> <text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HC029668FAC0D4EFB9471C2E83CA75F0E" changed="not-changed"> <enum>(A)</enum> <text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text> </subparagraph> 
<subparagraph id="H019FB6A45F1A4DD2AA1DD9DC495FE362" changed="not-changed"> <enum>(B)</enum> <text>the Committee on Oversight and Accountability of the House of Representatives.</text> </subparagraph> </paragraph> <paragraph id="HA3266F7AC0D94C5A9D4FC99F8EEB6ED0" changed="not-changed"> <enum>(2)</enum> <header>Federal agency</header> <text>The term <term>Federal agency</term>—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H85685B3C46E045F28334CCD42392A95D" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">has the meaning given the term <term>agency</term> in section 552(f) of title 5, United States Code; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H130CC0515A054321BF429126E8CF4B25" changed="not-changed"> <enum>(B)</enum> <text>includes the Executive Office of the President, the Executive Office of the Vice President, the Office of Management and Budget, and the National Security Council.</text> </subparagraph> </paragraph> 
<paragraph id="H4AC4EAA1CE1B4C5894EE2683FC974BFD" changed="not-changed"> <enum>(3)</enum> <header>Presidential emergency action document</header> <text>The term <term>presidential emergency action document</term> refers to any document created by any Federal agency before, on, or after the date of the enactment of this Act, that is—</text> <subparagraph id="H30E01E1FAF354DCB976D50E6740FDF29" changed="not-changed"> <enum>(A)</enum> <text>designated as a presidential emergency action document or presidential emergency action directive;</text> </subparagraph> 
<subparagraph id="HC71E272330AA4C81B78F7668E8E0760E" changed="not-changed">
                                <enum>(B)</enum>
 <text>designed to implement a presidential decision or transmit a presidential request when an emergency disrupts normal executive, legislative, judicial, or other Federal Governmental processes;</text>
                            </subparagraph> 
<subparagraph id="H89A7620AEB6F4F9AACEBE015896F3F9D" changed="not-changed"> <enum>(C)</enum> <text>a Presidential Policy Directive, regardless of whether the directive is available to the public, that triggers any change in policies, procedures, or operations of the Federal Government upon the declaration by the President of an emergency; or</text> </subparagraph> <subparagraph id="H584D7E48546844CC929A0560F6A9FB73" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(D)</enum> <text>any other document, briefing, or plan, regardless of whether the document, briefing, or plan exists in any tangible or written form, that triggers any change in operations of the Federal Government upon the declaration by the President of an emergency.</text> </subparagraph> </paragraph> </subsection> </section> </subtitle> </title>
