<section id="HF240C2D5FD6546A19B6D1CED42E46C58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bus Utilization for Fleet Flexibility and Emergency Resilience Act</short-title></quote> or the <quote><short-title>BUFFER Act</short-title></quote>.</text></section> <section id="H3F143116DB38464D8A2241FB4BD05643"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HB583B85D87E54EE7A4E7EEBA2F736CBF"><enum>(1)</enum><text>Extreme weather events such as extreme heat and extreme cold threaten the lives and livelihoods of communities across the United States.</text></paragraph> <paragraph id="H9FAAF2AA356041648CB7EEDB6DD2909D"><enum>(2)</enum><text>Instances of extreme weather can increase vehicle repair and maintenance needs for transit buses.</text></paragraph> 
<paragraph id="H56D90265C09C468B9713C73CE02D3D63"><enum>(3)</enum><text>Operational disruptions to fixed bus routes during extreme weather events are dangerous to people who rely on bus services to get around.</text></paragraph> <paragraph id="H43969042501240CFA250DE141610C870"><enum>(4)</enum><text display-inline="yes-display-inline">Transit agencies with high-frequency and high-intensity service, including regions that are tourism and live entertainment hubs, face additional operational challenges.</text></paragraph></section> 
<section id="H13BB76AF2E2E4D1698A0150B122B231E"><enum>3.</enum><header>Increase of spare bus ratio</header> 
<subsection id="H311665B0913C49A286AFCE45A09E4BEA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation, acting through the Administrator of the Federal Transit Administration, shall issue such regulations and guidance as are necessary to allow, upon request, a regional transportation planning organization to increase the spare bus ratio of such organization to 30 percent.</text></subsection> <subsection id="H559A18A7D8024CD2AA6682E33AF1ACAC"><enum>(b)</enum><header>Eligibility for spare bus ratio increase</header><text display-inline="yes-display-inline">To be eligible for an increase described under subsection (a), a regional transportation planning organization shall submit to the Administrator—</text> 
<paragraph id="HAF3F54C83C984AF5BD88F02E411BDD20"><enum>(1)</enum><text display-inline="yes-display-inline">a certification that the region regularly experiences extreme weather events;</text></paragraph> <paragraph id="H241AEB43A62648A79A7531D5EE4E6490"><enum>(2)</enum><text>a description of how extreme weather events have disrupted bus operations in the region; and</text></paragraph> 
<paragraph id="H5260B2CA1BD440FFBB655CA74E40EDAD"><enum>(3)</enum><text>a description of how increasing the spare ratio will help ensure reliable services for users of fixed bus routes during incidents of extreme weather.</text></paragraph></subsection></section> </legis-body></bill>
