<section id="HC1B42191E8BD4BBDBC452EEE9A9802A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>BOP Release Card ID Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HE7CD6E4649D34482A4BF4F01ED931B4C"><enum>2.</enum><header display-inline="yes-display-inline">Identification documents for prisoners being released</header> <subsection commented="no" display-inline="no-display-inline" id="H3ECA67E960694A3CB1465A6F76A55719"><enum>(a)</enum><header display-inline="yes-display-inline">Prisoners being released from Federal custody</header><text display-inline="yes-display-inline">Section 4042 of title 18, United States Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H31B26CF75E8B4C5EBFC59F6177C6ECBA"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4E5F5B2F69C6435398F3FCC20505BF00"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H520B00FEB7DE42788AFE71C315CB6116"><enum>(d)</enum><header>Identification documents</header>
<paragraph commented="no" display-inline="no-display-inline" id="H3D850FA343024776989AFECD5968B209"><enum>(1)</enum><header display-inline="yes-display-inline">Identification documents</header><text>Not later than 180 days after the date of the enactment of the BOP Release Card ID Act of 2025, the Director shall issue a photo identification release card that meets the minimum standards under section 202(b) of the REAL ID Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301(b)</external-xref> note) to each prisoner who is a citizen of the United States and is being released from custody from a facility of the Bureau of Prisons.</text></paragraph> <paragraph id="H7FCEC4A90DD04ACC9A358E79490CCDC6"><enum>(2)</enum><header>Period of validity</header><text display-inline="yes-display-inline">A photo identification release card shall be valid for not less than 18 months after the date on which the prisoner to whom the card is issued is released from custody.</text></paragraph>
<paragraph id="H60F1EDE0D0A849E792504A85B77AF737"><enum>(3)</enum><header>Acceptance of photo identification release card for State IDs</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H12BF592E8B5047AAB11B167E07B77EB3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall negotiate with each State to establish a system under which a prisoner may use a photo identification release card to obtain identification from the State.</text></subparagraph> <subparagraph id="HA1F2CD0B3BC046D098697F295CB6D2C4"><enum>(B)</enum><header>Reporting</header><text>Not later than 1 year after the date of enactment of the BOP Release Card ID Act of 2025, and every year thereafter, the Director shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the progress of the Director in negotiating agreements under subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="HE8AB5AC622F34B4E8A11D2654DA507E9"><enum>(4)</enum><header>Acceptance of photo identification release card for Federal programs and by Federal agencies</header><text display-inline="yes-display-inline">A photo identification release card shall be accepted as proof of the identity of the former prisoner to whom the card relates for purposes of—</text> <subparagraph id="H1426FE832CFC4E67A1A08448B0B0A5D0"><enum>(A)</enum><text>the old-age, survivors, and disability insurance benefits program established under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H33E979A116DE44459C0385FDD32277C3"><enum>(B)</enum><text display-inline="yes-display-inline">the Medicaid program established under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC0E66D366AD6499F902531182C939BED"><enum>(C)</enum><text display-inline="yes-display-inline">the Medicare program established under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC720872F7F014E1893FB604E8009D9E0"><enum>(D)</enum><text display-inline="yes-display-inline">any other program, project, or activity of the Department of Health and Human Services;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H83725B76089F47AE9E6952EF29C0BA60"><enum>(E)</enum><text display-inline="yes-display-inline">the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA853E5CEF88E4154857192FB544D7E77"><enum>(F)</enum><text display-inline="yes-display-inline">any program, project, or activity funded by the temporary assistance for needy families program under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC3895A2281B2464B95849F22B2FC589A"><enum>(G)</enum><text display-inline="yes-display-inline">any program, project, or activity of the Office of Probation and Pretrial Services of the Administrative Office of the United States Courts;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2ED39280A8214FAFAA1C3CC734E1E067"><enum>(H)</enum><text display-inline="yes-display-inline">any program, project, or activity of the Court Services and Offender Supervision Agency for the District of Columbia;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA30DE14441544390A8DE5B1F44B393BA"><enum>(I)</enum><text display-inline="yes-display-inline">any program, project, or activity of the Department of Education;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAF2DBC01D56246429C2122C8987F611F"><enum>(J)</enum><text display-inline="yes-display-inline">any program, project, or activity of the Department of Housing and Urban Development;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H396F72DEF532454080D79D49D0353F2F"><enum>(K)</enum><text display-inline="yes-display-inline">any program, project, or activity of the Department of Veterans Affairs; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3E2BB8009C10400082CF52B1E702FF71"><enum>(L)</enum><text>any requirement for an individual to present an identification document to obtain entry into a Federal building.</text></subparagraph></paragraph> <paragraph id="H9F57BF9AF10345C28C80CA708F77631E"><enum>(5)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to satisfy the requirement for the Bureau of Prisons to establish prerelease planning procedures under subsection (a)(6).</text></paragraph>
<paragraph id="H44AF2FE7C790462BBCCC266387F96565"><enum>(6)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H3E7EC6FABC174C0C8E94C93733459D2B"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Bureau of Prisons; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6F756667A3C54519BBD6CFE581A0F3A6"><enum>(B)</enum><text>the term <term>State</term> means each of the several States of the United States, the District of Columbia, and any commonwealth or territory of the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8DD52B45DB93495A8B423178C9156D0E"><enum>(b)</enum><header>Guidance for States</header> <paragraph commented="no" display-inline="no-display-inline" id="H12C1355FB14647FE8D82C7986F5B4AA5"><enum>(1)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Attorney General shall issue guidance for States regarding the issuance of photo identification release cards for prisoners being released from custody of a correctional facility of the State.</text></paragraph>
<paragraph id="H17C3C5BA6B4D4F7DA281433A19D927D3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>State defined</header><text>In this subsection, the term <term>State</term> means each of the several States of the United States, the District of Columbia, and any commonwealth or territory of the United States.</text></paragraph></subsection></section> </legis-body></bill>
