<section id="HA93C802E1A02408BAABAEC302B07D9E9" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Agricultural Borrower Information Act</short-title></quote>.</text></section> 
<section id="H57FEF62D37E44855B988A5F5B3F47B83"><enum>2.</enum><header>Strengthening of privacy protections for recipients of loans and payments processed by the Farm Service Agency</header><text display-inline="no-display-inline">Section 339 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1989">7 U.S.C. 1989</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H356E03860BE54A5BBB1B18A17F5590BE" display-inline="no-display-inline"> <subsection id="HA46EFE42651D4E828BEA9BE26A735103"><enum>(f)</enum><header>Privacy protections</header> <paragraph id="H7743DE5CC51E456D808388A31BB37D17"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for the Secretary or any officer or employee of the Farm Service Agency to disclose information provided pursuant to this Act by an applicant for, or a recipient of, a benefit under this Act, to—</text> 
<subparagraph id="HA5FA794385A0487FAA90BEA44BB6914B"><enum>(A)</enum><text>a special government employee, as defined in section 202 of title 18, United States Code; or</text></subparagraph> <subparagraph id="H81CB0678156F4C49A29B9A2F0AAD6219"><enum>(B)</enum><text>a government employee detailed to the Farm Service Agency under section 3341 of title 5 of such Code.</text></subparagraph></paragraph> 
<paragraph id="HE9E8A97E7C6D4C2984FD1C195297994E"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any of the following:</text> <subparagraph id="H29056D73F7E34B7096C8F56D777B22D2"><enum>(A)</enum><header>Disclosure in statistical or aggregate form</header><text display-inline="yes-display-inline">Information that has been transformed into a statistical or aggregate form which does not allow identification of the provider.</text></subparagraph> 
<subparagraph id="H8ACD02032F274DD4A1CB36ED000935BB"><enum>(B)</enum><header>Consent of provider</header><text display-inline="yes-display-inline">Disclosure with the consent of the provider, if the consent is not provided a condition of participation in, or receipt of a benefit under, a program administered by the Secretary.</text></subparagraph></paragraph> <paragraph id="H35A9C293AC484EDEBC3CA82810A5209E"><enum>(3)</enum><header>Violations; penalties</header><text display-inline="yes-display-inline">Whoever knowingly violates this subsection shall be fined not more than $10,000, imprisoned not more than 1 year, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
